A Rogers County man was sentenced Jan. 31 in
federal court for killing a man with a machete in Claremore in 2017.
Michael Eugene Spears, 59, of Claremore, was
sentenced to 300 months in prison for the second
degree murder of victim Mark McKinney. Following
his prison sentence, he will spend five years on supervised release.
“The defendant’s murderous act and attempted
cover-up earned him a 25-year federal prison sentence,” said U.S. Attorney Clint Johnson. “The dedicated work of the Claremore Police Department, FBI
and Assistant U.S. Attorneys Tom Duncombe and
Justin Bish have ensured justice for the victim and
his family. I am proud of their resolve to hold accountable those who commit brutal acts of violence in our
communities.”
“[Jan. 31’s] sentencing brings to an end a tragic story of cold-blooded murder
and an attempted cover-up by a merciless and violent criminal,” said FBI Oklahoma
City Special Agent in Charge Edward J. Gray. “Thanks to a determined investigation by the FBI, Claremore Police Department, and the U.S. Attorney’s Office in
the Northern District of Oklahoma, Spears will be held accountable for his heinous
crime.”
The murder occurred following a disagreement between the two men on Nov. 18,
2017, in a trailer owned by Spears’ sister. Sometime after the brutal attack, Spears
told a relative about his crime and asked to borrow a truck so he could transport
the victim’s body to a lake, where he planned to dispose of it. A relative reported the
crime to law enforcement the next morning and the victim’s body was recovered
from the trailer.
Prosecutors argued for a sentence of 30 years in prison, given the brutal nature
of the murder. In particular, prosecutors noted how the defendant had stabbed
the victim repeatedly with the sixteen-inch-blade weapon, beat him until he was
unrecognizable, took his phone and the few dollars in his pocket, and left him to die
on the floor while Spears spent hours drinking.
The defense argued for a sentence of 15 years, contending that Spears’ years of
alcoholism, his troubled childhood, his issues with judgment and impulse control,
and evidence of cognitive decline showed a lower sentence was appropriate. The
defense also pointed to Spears’ lack of criminal history and contended that Spears
may have acted in self-defense.
Prosecutors noted that the defendant’s issues with impulse control and judgment
were the very reasons he continued to pose a danger to the public and that the
evidence at the crime scene in no way corroborated Spears’ claims of self-defense.
The FBI and Claremore Police Department conducted the investigation. Assistant
U.S. Attorneys Thomas E. Duncombe and Justin G. Bish prosecuted the case.
Spears was previously charged and convicted of first degree murder in Rogers
County District Court. Because the defendant is a tribal citizen and the crime occurred within the Cherokee Nation reservation, his state conviction was vacated
following the Supreme Court’s McGirt v. Oklahoma decision and subsequent other
court decisions. The U.S. Attorney’s Office then prosecuted the case. First degree
murder under Oklahoma law has similar elements to the federal crime of second
degree murder.

A man who shot himself in the face and
ran down Interstate 24 armed with the
handgun was taken to two hospitals last
month, a Rutherford County Sheriff’s supervisor said.
Deviset Patton, 41, of Nashville was
treated by paramedics while transporting
him to Ascension St. Thomas Hospital in
Murfreesboro. He was later taken to Vanderbilt University Medical Center in Nashville.
Detective Sgt. Ty Downing said Patton’s girlfriend was driving on I-24 when they
began arguing about 5:30 pm.
“He shot himself once in the face,” Downing said.
She pulled over and called 911. Sheriff’s deputies, Tennessee Highway Patrol
troopers, Murfreesboro Police and Murfreesboro Fire & Rescue responded.
“As they approached, he took off on foot running down the interstate with a
pistol in his hand,” Downing said. “Deputies led by Sgt. David Alford closed traffic
in both directions because of an armed man running on the freeway.”
Patton refused Alford’s commands to drop the weapon.
The SWAT Team responded. A K9 stopped Patton and SWAT Team deputies
took him into custody.

A Mayes County man is facing child pornography charges after state investigators
received a tip from NCMEC.
According to Oklahoma State Bureau of
Investigation (OSBI), Special Agents from the
OSBI Internet Crimes Against Children Unit
(ICAC), with assistance from Special Agents
with the United State Department of Homeland Security Investigations - Tulsa (HSI), arrested Paul Harley Cook on charges related
to child pornography. The arrest was made on
January 13 after OSBI ICAC and HSI Agents
executed a search warrant at Cook’s residence located on Sunset Drive near Langley.
The investigation into Cook began on December 23, 2022, when ICAC Agents received a tip from the National Center
for Missing and Exploited Children (NCMEC) that child pornography had been
uploaded to a social media platform. The investigation revealed that the IP
address from the uploaded content was associated with Cook. An arrest
warrant was issued for the following charges:
• Count 1: Distribution of Child Pornography
• Count 2: Possession of Child Pornography
• Count 3: Violation of the Oklahoma Computer Crimes Act.
Cook was arrested without incident transported to the Mayes County Jail.
Bond for set at $250,000 and he is remanded to jail until he posts bond. His
next court appearance is scheduled for March 9 at 9:30 a.m.

On March 7, Oklahoma voters will have a say on whether or not to legalize
recreational marijuana use with SQ 820 on the ballot. If this question passes,
how do you think this will affect crime in our state? Should driving under the
influence of drugs become a felony? Should those convicted of misdemeanor
marijuana charges in the past be cleared?

Misttina B: Colorado crime rate skyrocketed after legalizing marijuana. It should
be treated like any other mind altering substance for DUI.
Rockey L: Yes, it should be felony for driving under the influence of drugs and
for those whom had misdemeanors for marijuana charges should not be cleared
as they knew they were breaking the law at the time they were caught.
April F: Rockey Lee the part that makes it a felony or misdemeanor is the fact
of how many charges you prior or if your caught with a large amount..it is really no
difference than DUI with alcohol
Monkeys P: I don’t think it will affect crime but we need it to pass. We need the
jail space for violent criminals. It should have already become federally legal . It is
not deadly like tobacco and alcohol
Rockey L: Monkeys P Just like cigarettes marijuana can cause emphasima and
copd which can be deadly and alcohol is deadly when consumed and you get
behind the wheel of a car. So where do you draw the line ?
Robbie W: Driving under the influence of anything that visibly impaired you driving should be a felony in the first place. I really don’t think it will effect crime. It might
drop from fewer marijuana arrests. And all you can hope for is that these people
strung out on worse drugs choose pot because it’s legal.
Jerry K: I’m trying to figure this out. Last vote, it was said that this is a needed
medicine for some people. Now some are wanting to use it recreationally. What
other medicine do we do that with??? I don’t remember the last time I took a anti-biotin for a fun Saturday night. Look at what it did to Colorado.
Robbie W: Jerry K alcohol
Jerry K: Alcohol is not used as medicine unless you are talking rubbing alcohol.
Maria M: Man marijuana is not a drug in the first place it is and always has been
a plant. So no it shouldn’t be a felony for that worry about the drunk drivers alcohol is legal and more people get killed by drunk drivers than anything else. Really
have you heard of any wrecks where they smoked??? And yes so many people
have been punished harshly for smoking a plant that is natural. It is time for our
society to open their eyes and see this plant is helping people with their mental
and physical issues.

Prevention Month
The National Association of Students
Against Violence Everywhere is a nonprofit
aiming to provide safer environments for
our youth. Its mission is to decrease the
potential for violence in our schools and
communities by promoting meaningful student involvement, education and service
opportunities.
SAVE’s Vision: Schools and communities will be safer and more secure, free of
fear and conducive to learning as a result of
students being actively involved in meaningful violence prevention efforts.
How It Got Started: SAVE was started by students in Charlotte, North Carolina in 1989 after the tragic death of a classmate who was trying to break up a
fight at an off-campus party. A group of students who did not want this death
to be “just another statistic” took action and created a violence prevention
program.
Chapters: SAVE has evolved into a national association with chapters in
elementary, middle and high schools as well as at colleges and community organizations across the country. Today, there are more than 200,000 students
involved nationwide.
Activities: Student members take the lead in planning chapter activities by
using the three SAVE Essential Elements: conducting crime prevention activities, conducting conflict management activities and providing meaningful service through projects in schools and communities. SAVE chapters also plan
safety rallies and safety awareness campaigns, engage in peer mentoring to
younger students, and conduct fun and educational meetings.

DANGEROUS DECISIONS
Two Craig County residents are facing federal
charges for crimes that could have had very dangerous outcomes.
Melanie Ann Mcelyea was charged with Willfully
Making a Threat to Kill, Injure, Intimidate, and Damage by Means of an Explosive.
On Nov. 22, 2022, Mcelyea, 42, of Vinita, allegedly
threatened to kill an individual at a law office located within the Muscogee Nation reservation. She left
a voicemail suggesting that she would blow up a
courthouse and the law office as well. She then stated, “…you will all be dead…” The courthouse Mcelyea was referencing was the Cherokee Nation Courthouse in Tahlequah, which is within the Cherokee
Nation reservation. The Bureau of Alcohol, Tobacco,
Firearms and Explosives, the Oklahoma Highway
Patrol, and Muscogee Nation Lighthorse Tribal Police Department are the investigative agencies.
Marvin Thomas Wilkins was charged Felon in Possession of a Firearm and Ammunition.
Wilkins, 63, of Big Cabin, is charged with being
a felon in possession of a Remington 270 caliber
bolt-action rifle; a JC Higgins 12-gauge caliber shotgun; Marlin Firearms (Glenfield) .22 caliber semi-automatic rifle; a Savage.
22 caliber bolt-action rifle; a Rifle Factory Ishapore (R.F.I.) 7.62mm caliber
bolt-action rifle; a Marlin Firearms (Glenfield) .22 caliber semi-automatic rifle;
and four rounds of ammunition. The Bureau of Alcohol, Tobacco, Firearms
and Explosives and Mayes County Sheriff’s Office are the investigative agencies.

Brian Walshe is a ‘dumb as dirt’ alleged criminal:

Alleged wife-murderer Brian Walshe is up a creek
without a paddle after his arraignment, legal experts say
— and his situation will only get worse if authorities find
the body of his missing spouse, Ana.
Walshe, 47, is accused of murdering his wife, who
went missing on New Year’s Day, and prosecutors presented a slew of damning evidence at his arraignment.
“If these allegations are true, it’s stunning how
dumb as dirt this guy appears to be,” Mark Bederow,
a high-profile criminal defense attorney, told The Post.
“It’s unbelievable.”
Bederow, a former prosecutor for the Manhattan District Attorney’s Office, said Walshe’s internet searches
will not only be used as evidence of his alleged crime but
might work against his ability to blame mental health issues.
“His internet searches — as sick as they may be — are rational in a cogent thought
type of way,” the lawyer said. “There appears to be a lot of planning and it appears to
be well thought out.”
Prosecutors revealed the dad of three used his son’s iPad to google “how to stop a
body from decomposing,” “how long before a body starts to smell,” “hacksaw best tool
to dismember” and “can you identify a body with broken teeth?”
Police have yet to locate the body of Ana, 39, a real estate manager who lived with
Brian and their kids in Cohasset, Mass., but worked in Washington, DC.
“Without the body, [the case] is not a slam-dunk case for the prosecution,” former
New York prosecutor and current criminal defense attorney Duncan Levin said. “If they
find her body, the case will obviously become much more difficult for the defense to have
a fighting chance.”
Levin explained that even though the prosecution’s argument looks strong, the case is
still young, and all the evidence gathered by authorities is “subject to attack.”
“It’s too early to tell what holes there may be in any of the evidence,” he said. “Obviously from what we know, there is an extremely strong circumstantial case against Brian
Walshe.
“You could not have planned a worse murder if you tried,” Levin added, saying Walshe
appeared to have “bungled every aspect of this from beginning to end.”
He also suggested the defense might try to move the trial outside Cohasset, which is
home to less than 10,000 people, because of how much attention the case has received.
“On the flip side, the pre-trial publicity in this case has been so significant that a judge
may well find that there would not be any less publicity in a different area of the state,”
he said.
Prosecutors said Wednesday that during Walshe’s previously reported trip to Home
Depot to buy $450 of cleaning supplies with cash, his purchases included a Tyvek body
suit, mops and baking soda.
Worse, a man in a Volvo matching Brian’s description was caught on surveillance
footage lugging heavy trash bags into dumpsters.
When searching through trash bags originally dumped at Walshe’s mother’s home,
police found a hatchet, blood, hacksaw, trash bags, used cleaning supplies and a rug.
They also found a Prada purse and Hunter boots matching what Ana was believed to be
wearing when last seen, along with a COVID-19 vaccination card in her name, the Tyvek
suit her husband had purchased, towels and tape, prosecutors revealed.

An Afton man pleaded guilty Jan. 26 in federal court for filming himself sexually abusing
a young child that he had handcuffed and
gagged, announced US Attorney Clint Johnson.
Glenn David Nickols, 40, pleaded guilty to
aggravated sexual abuse of a minor under 12
years of age in Indian Country and sexual exploitation of a child.
In March of 2021, the National Center for
Missing and Exploited Children (NCMEC) and
the Oklahoma State Bureau of Investigation
(OSBI) received a CyberTipline report regarding an email account used by Nickols to
transmit more than 100 videos and images of
child sexual abuse. However, agents noticed
that several files were not of previously identified victims of child sexual abuse
material. Those images and videos showed multiple instances of a man wearing a hat with the name “Buckster” sexually abusing a child with tape over
her mouth and whose arms and legs had been restrained with handcuffs and
shackles.
After identifying Nickols and his address, OSBI conducted a search warrant
on his home where they seized evidence of the abuse. Agents were also able
to identify the young Native American victim and ensure she was safe from
any future harm.
Nickols was arrested and interviewed by OSBI agents. During the interview,
he identified himself as the adult male seen in the videos, that his nickname
was “Buck,” and that he was the owner of the account. He told agents the
abuse took place at his home in Afton, within the bounds of the Cherokee
Nation.

A Ottawa County man pleaded guilty last month
in federal court to committing sex crimes against
children, announced U.S. Attorney Clint Johnson.
Caleb Lee Giles, 23, of Afton, pleaded guilty to
sexual abuse of a minor in Indian Country and coercion and enticement of a minor. Giles perpetrated sex crimes against two minor victims starting
in 2020. The crimes continued for several years.
Giles began communicating with the first victim
when the minor was 13 years old, which became
a sexual relationship when she was 14. Giles began communicating with the second victim for the
purpose of coercing her into sexual activity when she was 12 years old.
The FBI conducted the investigation.
