A shady point was arrested — well
actually, he arrested himself, after an
officer found him staggering down the
road.
On Nov. 19, a Shady Point officer was
on patrol when he received a call about
a man staggering down the road, the
affidavit states.
He drove to the area where the man
had been seen walking and saw the
subject walking around in circles in the
roadway. He asked the man, identified
as Tony Colwell, 33, how he was doing.
As anyone found walking in circles in the middle of the road
should, Colwell wisely answered, “Not too good.”
The man then reached for the door handle on the officer’s patrol car and told him, “Let’s go to jail.”
Colwell sat in the passenger side front seat and the officer
asked him what he was doing.
“I’m drunk — let’s go to jail,” the admittedly intoxicated man
replied.
To back up his admission, the officer could smell a strong
odor of alcohol coming from Colwell’s breath and person.
The officer checked him for warrants and found that he was
wanted in Leflore County.
He transported Colwell to jail and during booking, Colwell
was asked to remove all items from his pockets. He pulled out
a black film container with a green leafy substance and a pipe
commonly used for smoking marijuana.
Colwell is being charged with possession of marijuana, unlawful possession of drug paraphernalia and public intoxication. He was released on a $2,500 bond and is scheduled to
appear in court on Jan. 3, 2014.

A Vian woman is in jail after she lied to
police about the location of stolen items.
According to the affidavit, a LeFlore
County deputy was dispatched to a residence in reference to a man that had been
caught trying to steal things.
When he arrived, he saw the male suspect flee the scene. He made contact with a
female that had been with the male subject.
The deputy asked the woman, later identified as Stephanie Ray Silva, 32, what she
was doing on the side of the road and why
she was being accused of stealing property.
She told him that she and the male subject had been driving around.
He asked her to park at a convenience store, and then he broke into a
house across the street from the store.
Silva said the couple left the store and drove down the road until
they ran out of gas.
The deputy asked her if she knew where the stolen property was
and she told him no.
The victim of the theft told the deputy that when he had found
them stealing, they threw the stolen property over the fence to hide it.
The deputy asked Silva if that was true; she told him yes, that they
had thrown the stolen property over the fence because they “got
scared.”
The deputy looked behind the fence and found many items, including an air compressor, gas jugs and a battery charger.
The deputy went back to Silva and found her shaking out a black
pouch and kicking the contents underneath a vehicle.
Silva was placed under arrest. The deputy picked up the pouch
and found a smoking device with a crystal-like residue and two small
plastic baggies that contained a crystal-like substance.
Silva is being charged with knowingly concealing stolen property
and unlawful possession of drug paraphernalia. She is being held on
a $4,500 bond and is scheduled to appear in court on Jan. 7, 2014.

The Bible does
not prohibit the
consumption of alcohol
but leaves that choice up
to the individual.
Opponents argue
against drinking by
citing the destructive
effects of alcohol
addiction, such as
divorce, job loss, traffic
accidents, breakup of
families, and destruction
of the addict’s health.
One of the most dangerous elements of drinking alcohol is setting
a bad example for other believers or leading them astray. The
Apostle Paul, especially, cautions Christians to act responsibly so as
not to be a bad influence on less mature believers:
Since an overseer is entrusted with God’s work, he must be
blameless-not overbearing, not quick-tempered, not given to
drunkenness, not violent, not pursuing dishonest gain. (Titus 1:7,
NIV)
As with other issues not specifically spelled out in Scripture, the
decision whether to drink alcohol is something each person must
wrestle with on their own, consulting the Bible and taking the matter
to God in prayer.
In 1 Corinithians 10:23-24, Paul sets down the principle we should
use in such cases:
“Everything is permissible”-but not everything is beneficial.
“Everything is permissible”-but not everything is constructive.
Nobody should seek his own good, but the good of others. (NIV).

On the fly
John Posey, a 65-year-old Arkansas man, was jailed after he
allegedly entered a Radio Shack drunk and then proceeded to
urinate on the floor and various electronics.
According to Paragould Police, officers were dispatched to a
local Radio Shack after receiving a report of an intoxicated man
that the retailer wished to have removed from the premises.
Arriving officers spoke with the store clerk who pointed out
a puddle on the floor where Posey had just urinated and then
pointed officers in his direction.
Investigators then spoke with Posey who had blood shot eyes,
slurred speech and appeared to be unsteady on his feet. Posey
denied urinating on the floor and told the officer that he was
“just shopping” despite having an unzipped fly.
The officer placed Posey into a patrol car and then went back into the store to evaluate
the damage. Among the damaged items were several television sets, various recording
equipment and other audio equipment valued at about $800.
During a second interview, Posey admitted to urinating on the floor, explaining that he
“had to pee bad.” When the officer asked Posey why he didn’t ask to use a restroom, Posey
stated that “stores usually won’t let you, so I didn’t ask.”
Posey was booked into the Greene County Jail and charged with criminal mischief.

They say that breakfast is the most
important meal of the day, but apparently it’s also a meal that can make
people angry.
At least it seems to have pissed off
a Wilburton man, who assaulted his
wife after disrupting her morning
meal on a December morning.
According to the affidavit, a Wilburton police officer was dispatched to a
residence in reference to a domestic
dispute on Dec. 10.
When he arrived at the residence, he spoke to a woman who
told him that the incident had occurred while she was trying to
eat.
She explained that she was eating breakfast when her husband, Jason Walter Wylie, 33, took a biscuit off her plate and
dropped it on the floor.
She said when she asked her husband to pick it up, he simply
replied, “F--- you,” and walked outside.
The victim said she followed Wylie outside and asked what
was wrong with him. He allegedly walked up to her and elbowed
her in the left side of her face.
The officer saw some redness on the left side of her face and
took pictures of her injuries.
Her husband was placed under arrest and transported to the
Latimer County Jail. The inmates there should probably keep a
close eye on their biscuits.
Wylie is being charged with domestic abuse — assault and
battery in the presence of a minor child. His bond was set at
$5,000 and he is scheduled to appear in court on Dec. 17, 2013.

A McAlester man was arrested
and taken to jail despite his many
assertions of “No, I’m good.”
According to the affidavit, two
McAlester police officers were in a
convenience store when they saw a
man, later identified as 18-year-old
John Edmond Dutton, staggering
through the aisles and almost falling into a shelf. They noticed he
had glassy eyes.
Police watched as Dutton staggered up to the register and placed
a drink and candy bar on the counter. An officer told Dutton to wait before the paid for the items.
Dutton ignored the officer and stared straight ahead with a
blank stare. The officer repeated the command, but Dutton
continued to ignore him.
The officer then said, “Hey!” Dutton looked at him and the
officer told him again to wait before purchasing the items.
In slurred speech, Dutton asked why.
The officer explained that he could be going to jail for public intoxication, and he asked Dutton if he had been drinking.
Dutton said, “No, I’m good.”
The officer could not smell the odor of alcohol on Dutton, so
he asked him what kind of drug he had been taking, Dutton
once again replied, “No, I’m good.”
The officer placed Dutton under arrest and found the man’s
truck outside, still running with the headlights on.
The officer placed Dutton in the patrol car and walked over
to the truck. Inside the truck, police found part of a smoking
pipe in a cup holder that had burnt residue in it, which police
believed to be synthetic marijuana, according to the affidavit.
Police opened up the center console of the truck and found a
smoking pipe with a burnt reside and a black package with a
green leafy substance believed to be synthetic marijuana.
They also found two tablets and nine capsules. After consulting a pharmacist, the tablets were identified as Xanax and
hydrocodone.
A man was also sitting in the passenger’s seat of the truck.
After police confirmed that he was sober, they asked Dutton if
he wanted the man to drive his truck. Dutton said yes.
Dutton is being charged with possession of a controlled dangerous substance, unlawful possession of drug paraphernalia
and public intoxication. He is being held on a $15,000 bond
and is scheduled to appear in court on Dec. 20, 2013.

Michael Wilson
The Oklahoma Pardon and Parole
Board rejected clemency on Dec. 16 for
death row inmate Michael Wilson, 38,
who is scheduled to be executed next
month for the beating death of a Tulsa
convenience store manager in 1995.
The board voted 4-1 against commuting
the death sentence of Michael Lee
Wilson.
Wilson was convicted of fi rst-degree
murder in the death of Richard Yost,
who was killed during a robbery at the
convenience store where he worked
as the night clerk on Feb. 26, 1995.
Prosecutors alleged that Wilson, who
also worked at the convenience store,
planned the robbery. He was among four
people convicted in the case.
Wilson’s execution is set for Jan. 9, 2014.
The board declined to reduce Wilson’s sentence to life in prison without
parole after Wilson apologized to members of the victim’s family and
acknowledged the harm he had caused them.

HIDDEN CAMERAS IN WOMEN’S RESTROO M
A McAlester man was arrested and faces federal and state
charges after investigators say he put a hidden camera inside the
women’s restroom at the McAlester Army Ammunition Plant.
Kenneth Elkins, 55, was an employee at the plant.
Elkins is charged with three counts of federal video voyeurism, two counts of recording/transmitting obscenity. The state
is also charging him with two counts of using electronic equipment in clandestine manner.
Investigators say women were videotaped using the restroom
at the plant between July and August. They say Elkins captured very revealing
pictures of least three of the women.
When investigators searched Elkins home they found child pornography on his
computer and evidence he was recording inside a 16-year-old relative’s room.
Elkins is out on bond.

Three people were arrested at a Checotah
residence after a call about a fire proved to be
false, but the presence of illegal items proved
to be true.
According to the affidavit, a McIntosh
Sheriff’s deputy was dispatched in reference
to a fire at the residence on Dec. 9. When he
arrived, he made contact with Paul Smith, 46,
of Checotah, who told him that he had just
been inside the residence and there was no
fire.
The deputy observed that there was indeed
no fire inside the house, but he did notice a
glass pipe commonly used to consume illegal
narcotics inside the front door.
While speaking with Smith, a vehicle arrived at the residence with two occupants:
John Tucker Scroggins, 60, of Checotah, and
Jessica Leigh McBride, 36, of Henryetta.
Scroggins identified himself as the owner
of the residence and gave the deputy written
consent to search the home.
Inside the home, the deputy found many
items commonly used in the consumption
and distribution of drugs, including pipes
with residue, digital scales, small baggies and
plates containing a green leafy substance.
All three subjects were placed under arrest
and taken to jail. McBride told the deputy
that she had been at the residence earlier that
day to obtain methamphetamine. She said
she didn’t pay for the drugs, but earned them by cleaning out a vehicle for Scroggins.
Smith said that he had gone to the residence to party and had
brought a glass pipe, marijuana and meth, which he had consumed
inside the residence.
McBride is being charged with possession of a controlled dangerous substance. She is being held on a $10,000 bond.
Smith is being charged with possession of a controlled dangerous
substance and unlawful possession of drug paraphernalia. He is being held on a $10,000 bond.
Scroggins is being charged with maintaining a dwelling for keeping/ selling a controlled dangerous substance and possession of a
controlled dangerous substance. He was released on a $10,000 bond.
All three are scheduled to appear in court on Feb. 20, 2014.

Well, winter is here! With this
most recent ice and snow storm
that gripped Oklahoma, there obviously were some significant
obstacles to safe driving. One that I have noticed, that doesn’t really
get a lot of attention, is the visibility that is obstructed by iced over
windshields and windows on vehicles. I’m going to touch on some
of that, to try to raise some awareness about it, and give some tips
to help us stay safe.
We’ve all seen it...a vehicle coming down the road with just a
small hole scraped in the windshield so the driver could see the
road. Every time I see it, I cringe! The law that governs this is
Oklahoma State Statute 47:12-404.C, which states: “No person
shall drive any motor vehicle with any sign, poster, other nontransparent material, or debris, including but not limited to snow,
ice, or frost upon the front windshield or the side wings, or side
or rear windows......which obstructs, obscures, or impairs the
driver’s clear view of the highway ahead or to either side or of any
intersecting highway.” What this means to the everyday driver is
that the little hole you scraped to drive by, just won’t cut it! While
compliance is the goal, the reason is safety! Obviously the chances
of an accident drastically increase as visibility decreases...so why
limit our vision to just a small hole out the front windshield?
There are several ways to clear those windshields, both
mechanically and chemically. A simple ice scraper has been the
preferred method for as long as most people can remember. They
are inexpensive, and easy to find. Another method is simply to go
out 10 minutes before you leave and simply start your car up, and
get the defroster going! When the windows are clear, you are good
to go! Still another way is to obtain any number of chemical deicing sprays that are available at most stores. Don’t pour hot water
on your windows, as the change in temperatures can cause your
window to crack or break!
While we are talking about it, lets not forget about those side and
rear widows. A significant percentage of accidents happen while
backing, so it stands to reason that we need to be able to see out our
back glass as well as the front. Side windows are no different, no one
wants to be struck by a vehicle they couldn’t see when they pull into
an intersection. After you finish with those side windows, go ahead
and hit those side mirrors as well!
All of these suggestions simply take a little extra time, and
sometimes money, but the time and money pale in comparison to
the impact on time and money that an accident will have on you, or
others. As a safe, courteous driver, you owe it to yourself and your
fellow drivers! Thanks for reading, buckle up and be safe!

An angry, drunken Stigler man
was taken to jail on Dec. 8 after he
became hostile when an officer attempted to help him after his truck
had run off the highway.
According to the affidavit, dispatch
advised a Haskell County deputy that
someone had called in on a black
truck that had run off of the highway.
Dispatch added that a passerby had
stopped to help the man, but apparently the man was intoxicated and
became angry at the would-be good Samaritan.
When the deputy arrived, he found a black truck in the ditch
and saw a man slumped over in the driver’s seat of the truck.
Dispatch told the officer that the truck belonged to James Allen
Rainwater, 30.
The deputy began yelling at the man, but he didn’t wake up.
The deputy sprinkled snow on the man’s face, but he still didn’t
wake up.
The deputy called for an ambulance, and the EMS crew eventually was able to get Rainwater to respond. They told the deputy that nothing was wrong with him other than being heavily
intoxicated.
The deputy opened the truck’s door and Rainwater almost
fell out. He told the man that he needed to get out of the truck
and try to walk to the ambulance. Rainwater responded that he
wasn’t going to get out of the truck.
The deputy was able to get Rainwater out of the truck, but
the intoxicated man fell to the ground. The deputy tried to help
him stand up, but Rainwater fought back.
The deputy called for backup. Rainwater was able to get back
on his feet and went back to his truck. He reached inside the
vehicle and told the deputy, “This is how you want to play it.”
The deputy took out his pistol and pointed it at Rainwater.
The deputy told him to show his hands, or he would shoot.
Rainwater eventually complied with the deputy’s commands.
The deputy told dispatch that he no longer needed backup.
Rainwater was placed under arrest and taken to jail.
He is being charged with assault and battery upon a police
officer, resisting an officer and public intoxication. He was released on a $5,000 bond.

Brian Hounslow, a 37-year-old Tulsa man, was jailed after he
was allegedly caught masturbating inside a women’s restroom.
According to police, a woman shopping at a Tulsa Walmart
was unpleasantly surprised when she walked into the women’s
restroom to find Hounslow masturbating in front of a mirror.
Investigators say Hounslow’s pants were down around his
ankles and he was masturbating his “fully exposed turgid
penis” when the woman walked in.
Hounslow reportedly got dressed and began walking toward
the store’s exit while the woman attempted to get help. When
the woman was unable to find someone who could address the
situation, she pulled out her cell phone and began recording
the man as he continued to walk toward the exit.
The video shows a man walking away from the woman as she proceeds to make
a public spectacle of him. At one point in the video, the man runs from the woman
when she begins shouting “stop that man, stop that man.”
Although the man succeeded in fleeing the scene, another shopper managed to get
Hounslow’s license plate number. He was arrested later the same day.
During a subsequent interview with police, Hounslow reportedly confessed to the
masturbation explaining that he thought that he was inside the men’s restroom.
Hounslow was booked into jail and charged with indecent exposure.
