convicted of murder and
sentenced to die in 2003 for
the 1997 beating death of
Albert Hale, 73. Authorities
said Coddington beat Hale
on the head with a hammer
because Hale wouldn’t give
him money to buy drugs.
The appeals court
overturned Coddington’s original death sentence, but a
diff erent jury imposed another death sentence in 2008.
The court’s opinion said jurors at Coddington’s second
sentencing trial found that Hales’ death was atrocious
and cruel and that Coddington posed a continuing threat
to society.
The Oklahoma Court of Criminal Appeals upheld the
death sentence.

After reviewing the OSBI investigation into the October 30,
2015 officer involved shooting by Cherokee County Deputy
Bryan Qualls, District Attorney Brian Kuester has determined
that the use of force was justified and that criminal charges
will not be filed against Qualls.
Kuester said the OSBI investigation showed that on October
30, 2015 at 7:30 p.m. Deputy Qualls and other law enforcement personnel responded to a 9-1-1 call at 22279 N. Four Mile
Road in Cherokee County. The caller indicated that someone
had stabbed several people and set several fires around the area. Deputies quickly
confirmed this information as they arrived on scene, finding two people with stab
wounds and also freshly burned hay. The victims described the suspect and said
his name was Daniel Nole. Deputies then began their search for Nole.
Nole was located in an out-building with a knife in his hand. Deputy Qualls and
Hulbert Police Officer Anthony Torix, who had responded to assist, identified
themselves as police officers and commanded Nole to drop the knife. When Nole
failed to do so, Deputy Qualls used his Taser, deploying it and pulling its trigger
three times. The Taser, however, had no apparent effect and Nole continued toward Deputy Qualls with the knife in his hand. Deputy Qualls “back-pedaled” in
an effort to put more distance between he and Nole. As he back-pedaled he fell
backward to the floor and Nole continued forward and was within a step of Qualls
with the knife being held up in an aggressive fashion.
Despite commands by Quall and Torix throughout this interaction, Nole continued toward Qualls. He discharged his firearm several times, striking Nole’s
chest. Nole fell to the ground and did not make any further aggressive movement.
Cherokee County Deputy Dreadfulwater then entered the building and removed
the knife from Nole’s hand. Nole was pronounced dead by medical personnel on
the scene. The scene investigator indicated that Nole had what appeared to be
penetrating injuries consistent with bullet wounds – one in the upper left chest
and one in the lower right chest.
Kuester stated, “The evidence presented by the OSBI investigation shows that
Nole had already injured others with a knife. At the time that Deputy Qualls discharged his weapon, Nole was making an apparent attempt to seriously harm
or kill Deputy Qualls and had the ability, with the knife in his hand and in close
proximity to his intended victim, to do so. Oklahoma law justifies the use of deadly force in circumstances such as these. Charges will therefore not be filed against
Deputy Qualls.”
Kuester said that he expects to receive the Medical Examiner’s report in the
near future. Although he expects that the ME’s findings will be consistent with
the scene investigation, he will review the report when it is completed and revisit
his decision.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money or
favor to not publish a photo.
We hear many times from people that the arresting
offi cer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

A Muskogee man was taken into custody Dec. 5 after
he ran from the cops for being in possession of drugs and
a stolen vehicle.
Robert Branscum, 39, was charged possession of a stolen vehicle, two counts of possession of CDS, possession
of drug paraphernalia, and resisting an officer, in Muskogee County District Court.
According to the police affidavit, a woman called police
on a suspicious vehicle behind her residence. When officers arrived at the location at S. Cherokee and Independence, they found a GMC pickup, and a Nissan SUV stuck
in the mud that was stolen out of Broken Arrow.
The suspect, later identified as Branscum, took off running toward a wooded area when he saw the officers. Police ordered him to stop, but he ignored the commands.
Officers eventually caught him and placed him in cuffs.
On Branscum’s person, officers found three bags of white powder-like substances,
eight round yellow pills, two glass pipes with residue on them, and three lighters.
Branscum’s bond was set at $25,000 and he was ordered to back to court on Dec. 23
at 9 a.m.

On December 9, a Sportsman Acres officer
was called to a residence at 101 Quail Drive
due to a man barricading himself inside a
bedroom at his home and making suicidal
statements.
Initial information gathered at the scene
indicates when the officer arrived on scene,
Sammy Monroe Echols, Jr., 51, came out of
the residence with a rifle in his hand. The officer told him to put down the rifle. Echols did
as instructed, but moments later he picked up
the rifle again and pointed it at the officer. The
officer shot Echols.
Echols was taken to the Mayes County hospital where doctors pronounced him
dead. The Mayes County Sheriff's Office requested OSBI investigate the case.
Once a written report is completed, an agent will deliver it to the district attorney
who will determine if the shooting was justified.

Grove man Jesus Allen Funches,
23, weirded out some people at a local
convenience store on December 12. He
kept going in the bathroom, turning a
flashlight on and off, and telling people
that there was an 8 ball in his pants.
According to the affidavit, a Grove
officer was dispatched to the store in
the 2100 block of S. Main shortly after
2 a.m. for a suspicious man. A store
clerk said Funches kept going in and
out of the bathroom. He told her that
he was hiding from his mom and sister. She said she also heard him say he
had an “8 ball” in his pants.
The officer saw the man and asked how he was doing. Funches replied, “I’m good. My mom
left me at Walmart to go wash the car and has not come back to get me yet.” He then said she
would be there any minute to pick him up.
Funches didn’t have any identification, but he gave the officer his information. The officer
checked the man for warrants -- dispatch advised he had full extradition warrants out of
Wyoming.
The officer informed the man that he was being arrested for his warrants. He put the man
in the patrol car and asked him if he had any drugs. Funches said no.
The officer told him if any illegal items were found when he got to jail, it would be another
charge. Funches replied, “I have a spoon, a syringe and a baggie with crushed up allergy pills
in my spandex underwear.”
Sure enough, the items were stuffed in the man’s drawers, except the substance in the baggie tested positive for meth.
When they arrived at the jail, Funches asked if he could smoke a cigarette. The officer took
a cigarette from the man’s pocket and put it in his mouth.
When he was done smoking, he asked the officer if he could go to his knees and say a prayer.
Funches then lunged forward and tried to run. The officer grabbed him and asked what he
was doing. The suspect replied, “Man, I don’t know. I was trying to get away.”
Funches is being charged with possession of controlled dangerous substance and unlawful
possession of drug paraphernalia. His bond was set at $2,500.

29-year-old mom Estellamarie Ruiz enjoys
taking her children on weekend jaunts of petty
theft and fraud. A Chicago woman was at a gas
station when she noticed her wallet had been
lifted from her car. The woman told responding
officers that she had seen a green van leaving
the scene. And just to make sure this was the
easiest crime ever investigated, she found that
her credit card had already been used at a McDonald’s just 50 yards from the gas station. It
seems Ruiz thinks elongated getaways are very
much overrated. So after stealing the woman’s
wallet, she merely drove across the street to
McDonald’s, where she bought some delicious
chemical burgers for her two children. When
police arrived at McDonald’s parking lot, they
found the suspect green van, along with the the
Family Ruiz eating inside of it. Her receipt was
matched to the stolen credit. And police soon
discovered she’d also stopped to buy gas at a
nearby station, then dumped the stolen wallet
in the garbage. She was charged with felony
identity theft, misuse of a credit card, and illegally conducting criminal activities.

Tifani P: I think 263 years is a little crazy.. Yes he
did very wrong. But you rape 36 women and got that many years. A military man
from where I’m from abused a baby until he later died and he got 15 years for child
abuse. Like what??? Are you serious. He is a very sick man and deserves time. But
that’s almost 3 life sentences... Priorities need to be set. A child can’t protect themselves, and neither can a woman.
Leslie B: Unfortunately, he will be segregated from the general prison population because he was a cop. If they had to worry about “prison justice” & being
afraid to close their eyes to sleep, perhaps a law enforcement officer might think
long & hard about abusing his or her authority…
Jim S: Law enforcement are suppose to keep a higher standard of living. If a
person is charged with a crime against a law enforcement official that crime penalty use generally more severe. The same standards should be equal for the trust
in the person enforcing the law is lost. So their penalty should also be be greater.
Lacie W: I think it’s odd that he was only charged on 18 out of 36 charges,
I also think it’s wierd that he forced that many women to do oral on him.... I’m
pretty sure if I was forced to do that id be biting as hard as possible. I’m not saying
he didn’t do the things he is being accused of but I do have a feeling a lot of women
jumped on the bandwagon on this.

a little jailhouse justice.
Michael S: This cop is a shining example of why the public does NOT trust
the police. As a whole...The police would tell you that the actions of a few should
not cast a shadow on all the rest.. This IS a SYSTEMIC problem and will NEVER
go away as long as the police are allowed to police themselves. Personally I feel
that 263 yrs is over the top for a punishment for the corrupt activiety that this cop
ingaged in. It’s almost like a cartoon sentence. As a tax payer It just dosen’t seem
fair to pay for his incarceration for the rest of my life. I would feel better about all
this if he were only sentenced to say 5 yrs in prison... REAL hard time in general
population like a REAL criminal. The catch to the short sentence would be that he
gets to be raped against his will 263 times before his 5 yrs are up to get out. Then
be able to get out and work and live with a moniter on his ankle for the rest of his
life…

looked at every bit of the evidence. Good verdict.

should be held to higher standards when they break the law.

their actions regardless of their badge.
Vaden M: He did the crime, he did the time and needs to rot in jail. Regardless of what his job was or how decorated his uniform was. He was found
guilty and was proven guilty. There’s many great cops, and there’s bad ones, too.

officers out there that are doing or have done the same thing. Believe me hes not
the only one. It makes you scared to trust the law inforcement. He needs put away
for good.

A Union, Missouri, woman found wandering around Miami with a brick was arrested
when an officer suspected she might be under the influence of something.
On December 9, a concerned citizen called
the police at approximately 10:40 p.m.
and said an intoxicated female was walking through people’s yards. A Miami officer
went to the location and found 25-year-old
Amber Nicole Fieser near the intersection of
Seventh Ave. NW and M St. NM.
According to the affidavit, she seemed unsteady on her feet. She
was also carrying a brick.
The officer made contact with the woman and immediately smelled
the odor of alcohol. He asked her if she had been drinking. She replied in slurred speech that she had a few sips of a margarita.
While the officer was speaking with the woman, he noticed that
she seemed to be having a hard time completing her thoughts. When
he asked her about the brick, she told him that she found it on the
ground and she was “looking for a place for it to fit.”
The officer asked her where she lived. She started pointing all over
the place saying, “Over there.”
The officer placed her under arrest for public intox. He asked if she
had anything in her possession he should know about. She told him
she had a bag in her pocket. The officer asked her what kind of bag.
She replied, “The clear plastic kind.”
The clear plastic bag contained a white powder that later tested
positive for meth. Fieser admitted to using drugs the day before.
Fieser is being charged with public intoxication and possession of
controlled dangerous substance. Her bond was set at $3,300, and she
is scheduled to appear in court on January 14, 2016.
