Presumed Innocent Until Proven Guilty 3 | MAY 2021 CANADIAN COUNTY
An 18-year-old man was arrested in Canadian
County after he allegedly shot and killed a woman
on April 19.
According to reports, Oklahoma City officers
were dispatched to SW 15th Street and Czech Hall
Road to investigate a 911 call regarding shots fired
at approximately 1 a.m. When officers arrived on
the scene, they discovered that a 36-year-old woman had been shot and killed.
During the investigation, officers learned that the
woman had been killed in her own driveway. The
woman was shot when the suspect, Javier Lewis,
had allegedly fired shots at another family member.
Officers were given a description of the suspect.
About 10-15 minutes later, they found the suspect vehicle at SW 89th
and Western. They pursued the suspect, who eventually crashed into a
police vehicle. He was placed under arrest and transported to jail.
Lewis was booked into jail on complaint of numerous charges, including
first-degree murder and assault and battery with a dangerous weapon.
Bond information and court date were unavailable at time of publication.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

A South Carolina man was caught rubbing buttered toast all over his
neighbor’s SUV window. Seems like a foolproof plan, how did he get
caught? According to MSN, He just dropped the toast a few feet away
from the car and made his departure, causing a nearby woman to notice and call the police. The police charged the now hungry man with
“malicious damage to property” and estimated the cost of damage to
be about $1.
What’s the hottest you’ve ever been? Temperature-wise of course, because if it was in physical terms, we all know we were the hottest at our
5th grade, bowl-cut, chubs stage. But really, to what extent would you
go to cool off ?
Hopefully not so far you’d get arrested, but this is exactly what a group
of four young men in Germany did. On a hot day, they decided to make
their own pool in a car. In a BMW no less. A policeman noticed a very
strange convertible driving down the road. Upon closer viewing, it appeared that the bathing-suit clad men were splashing around in the water-fi lled car, clearly intoxicated. Though there was no law against driving
around with a pool in someone’s car, they were probably charged for
driving without a permit. Talk about hot water.
What do you guys think about sausage? I suppose it’s better than a
hot dog, which in turn is better than bologna (which is basically giant hot
dog slices?). And no matter what, it has to be better than Lunchables
*shudder*.
No matter your opinion, sausage was a huge disappointment for this
Phoenix man. He attempted to rob two large businesses, fi rst an Ace
Hardware and then a Safeway. He put his hand under his shirt to look
like a gun, but the cashier was not fooled and calmly said “no” to his request for money. Equally unsuccessful was his attempt to rob a Safeway,
which resulted in him being escorted out of the building. He waited a few
minutes before returning into the store to snag a small breakfast sausage
and was therefore charged with shoplifting. I guess all that failing worked
up an appetite.
Sometimes people don’t want their babies. Throughout history, these
people have found convenient ways to get rid of them. In the middle
ages, a popular solution was to leave a swaddled infant on the doorstep
of a misfortunate new parent. Worse for the child, another option was an
orphanage. In later times, parents could even put their kid in the circus
for life. The last one, I’m actually jealous of.
It might not have been this Florida woman’s goal to give away her child,
but that’s sure what it looked like. She had gone shopping at Dillard’s,
and tried to shoplift $260 worth of clothing using her baby stroller. When
a police offi cer followed her out to her car, she fl ipped out and eventually threw her baby in its little carseat at him. The baby was not injured.
The shoplifter received three charges, including “resisting a police offi cer
without violence”. Um. What would be violent, throwing her entire family?

Cpl. Kyle Davis, a deputy with the Washington County Sheriff ’s
Department, became involved in an altercation on March
25 with a violent inmate that was arrested on a warrant.
He was killed by the suspect in the line of duty.
An investigation into the incident is being conducted by
the Oklahoma State Bureau of Investigation, the District
Attorney’s Offi ce, the Washington County Sheriff ’s Offi ce,
and the Bartlesville Police Department.
The suspect was arrested as a result of an ongoing
investigation by the Bartlesville Police Department
and Oklahoma Bureau of Narcotics and Dangerous
Drugs. Seventeen individuals were arrested on
March 25 between 6 a.m. and 9 a.m.
The suspect was uncooperative and aggressive toward detention staff at the
Washington County Detention Center.
During a physical altercation between the suspect and staff members, a deputy
sheriff was injured and transported to the hospital, where he succumbed to his
injuries.
The OSBI, BPD and the 11th Judicial District Attorney’s Offi ce are working
together to investigate the deputy’s death.
As of press time, the name of the suspect involved in the death of the deputy
has not been released and no charges have been fi led.

Clinton man Omar Venegas Rios, 26, allegedly
sped through a school zone during a police pursuit just as kids were leaving for the day on April 6.
According to reports, a Clinton officer tried to
stop the man near the intersection at 11th Street
and Modelle. Rios accelerated and sped north on
11th Street toward Nance Elementary.
Due to the time of day, kids were leaving school
and boarding buses and vehicles. The pursuit
continued to Rios’ home in the 100 block of South
12th Street. He refused to comply with officer
commands to get down on the ground.
Officers took the man to the ground, but he was
combative and resisted.
According to court documents, Rios has been previously convicted of
many things, including resisting arrest.
Rios is being charged with endangering others while eluding or attempting to elude a police officer, resisting an officer, and driving with a suspended license. His bond was set at $2,000, and he is scheduled to appear in court on May 14, 2021.

40 Violent Crime Cases Include 22 Murder, Four Manslaughter, and Six Sexual Abuse Involving Minors Cases
The United States Attorney’s Office for the Eastern
District of Oklahoma announced at the end of March
it has filed forty violent crime in Indian Country cases
since the March 11, 2021, Oklahoma Court of Criminal
Appeals opinions in Bosse v. Oklahoma and Hogner
v. Oklahoma. The cases include twenty-two murders,
four manslaughters, and six sexual abuse offenses involving minor victims.
“Our goal has been and will continue to be protecting the people of the Eastern District of Oklahoma by
focusing all of our available resources on ensuring that
violent offenders are transitioned from state custody to federal custody to be tried
for the violent crimes they have been charged with committing,” said Acting United
States Attorney Christopher J. Wilson. “Our staff has been working many long
and stress-filled hours reviewing law enforcement reports and preparing charging
documents. The logistics of handling this volume of cases has been challenging
and has required the cooperation of District Attorney Offices, Sheriff Offices, the
Federal Bureau of Investigation, the United States Marshals Service, and the Oklahoma Department of Corrections.”
Many of the recent federal charges filed by the Eastern District of Oklahoma involve defendants previously convicted in state court. The Supreme Court decision
in McGirt v. Oklahoma and the recent Oklahoma Court of Criminal Appeals rulings
in Bosse and Hogner held that Congress never disestablished the reservations of
the Muscogee (Creek) Nation, Chickasaw Nation and the Cherokee Nation, and
the State of Oklahoma lacked jurisdiction to prosecute major crimes involving Native Americans occurring on these reservation lands. Based on these rulings, many
state convictions have and will be vacated. It will be the responsibility of the federal
government and/or tribal governments to prosecute the offenders. It is anticipated
additional decisions impacting the Choctaw and Seminole Nations will be issued
by the Oklahoma Court of Criminal Appeals in the coming days.
“As I stated when the recent Hogner and Bosse opinions came down, the Eastern District U.S. Attorney’s Office has been identifying cases of violent offenders
currently in custody within the areas of the Cherokee and Chickasaw reservations
which could be impacted by a change in Indian Country jurisdiction. The collective
efforts of our state, local, tribal, and federal partners have enabled our office to
have federal charges in place to avoid these violent offenders from being released
from custody. The forty cases filed to date are only the beginning. We are reviewing and making charging decisions on additional cases daily. In addition, we have
already discovered approximately 150 violent offender cases in the Choctaw and
Seminole areas over which we anticipate assuming federal criminal jurisdiction if
the OCCA renders similar rulings,” said Wilson.
“I am keenly aware of the hardship the jurisdictional change has placed on so
many victims,” said Wilson. “As the previous state convictions are being vacated
for lack of jurisdiction, victims and victim families are being forced to relive the entire process. We are committed to assisting the victims of these violent crimes as
their cases navigate through the federal criminal justice system.”
A criminal complaint does not constitute evidence of guilt. A criminal complaint
is only a method of bringing formal charges against a defendant. A defendant is
presumed innocent of the charges and may not be found guilty unless evidence
establishes guilt beyond a reasonable doubt.

A Cache man’s dark secret was revealed after a child
he allegedly sexually assaulted tested positive for a sexually transmitted disease.
Justin Brock, 32, was charged March 23 with lewd or
indecent acts to a child and possess juvenile pornography in Comanche County District Court.
According to OSBI, on March 19, 32-year-old Justin
Brock was arrested by agents from the Oklahoma State
Bureau of Investigation (OSBI) on charges related to sexually abusing a young child.
In January 2021, the Comanche County District Attorney’s Office requested a full OSBI investigation after learning that the young child had tested positive for
a sexually transmitted disease. Over the course of the
OSBI investigation, evidence was collected and interviews were done that pointed
to Brock being the suspect that sexually abused the child.
Brock was arrested at 1:45 p.m. on March 19 by OSBI agents and transported
to the Comanche County Detention Center by the Lawton Police Department. The
Cache Police Department also assisted with the investigation.

BACK-PACK PACKIN’
A 47-year-old Elk City man was arrested
after he allegedly stole some stuff from a retail
store on April 2. He also had drugs, paraphernalia, and a loaded gun in his possession.
According to reports, Elk City police officers
were dispatched to a store on West Third to
investigate reports of a shoplifter. When they
arrived at the location, they were advised that
the shoplifting suspect was in a nearby store
in the same shopping complex.
Officers went to the grocery store and
placed the suspect, Charlie Harold Waggoner, under arrest. They searched a backpack
he was wearing and found three watches that
Waggoner had allegedly stolen from the retail
store.
Officers also found the following in the backpack: a loaded 9 mm handgun,
a 45-automatic pistol with a fully loaded magazine, two folding knives, two
containers filled with a substance that later tested positive for marijuana, and
a glass pipe and a clear plastic bag containing a substance that would later
test positive for methamphetamine.
During booking at the Elk City Jail, officers noticed that the man seemed to
be under the influence of a controlled substance.
Waggoner is being charged with possession of firearms after conviction or
during probation, two counts of possession of a controlled dangerous substance, carrying a firearm while under the influence, unlawful possession of

A 21-year-old Enid woman was arrested April
11 on two felony complaints of making a bomb
threat.
Amber Royal was arrested by Sgt. Aaron Barber in connection to bomb threats made March 18
and 20 to the Tyson Food plant at 4929 E. Willow.
Through his investigation, Barber was able to
identify Royal as a suspect. She was interviewed
and confessed to making to making the threats.
At the time of the incidents, the plant in question
was searched and a device was never located.
Royal was charged with two counts of threat
of incendiary device. set at $20,000 and she is
scheduled to appear in court on May 17.

FORMER FAIRVIEW RESIDENT SENTENCED AFTER PLEADING
GUILTY TO VIOLATING THE CLEAN WATER ACT
On April 7, Dakota B. Gray, of Carmen, pleaded
guilty to a single-count Information charging him
with negligently discharging oil into a water of the
United States, in violation of the Clean Water Act,
announced Acting U.S. Attorney Robert J. Troester.
On December 2, 2020, Gray was charged by Information with violating the Clean Water Act. The
Clean Water Act was enacted by Congress to restore and maintain the chemical, physical, and
biological quality of the Nation’s waters. In addition, the Clean Water Act was enacted to prevent,
reduce and eliminate water pollution in the United
States and to conserve the waters of the United States for the protection and
propagation of fish and aquatic life and wildlife, for recreational purposes, and
for the use of such waters for public drinking water, agricultural, and industrial
purposes. Among other offenses, the Clean Water Act prohibits the negligent
discharge of oil or a hazardous substance in harmful quantities into a water of
the United States.
Gray pleaded guilty to discharging crude oil into the Cottonwood Creek in
Major County. At the hearing, Gray admitted that he opened the valves on
a tank battery that contained approximately 129 barrels of crude oil. Gray
discharged the crude oil onto the ground and most of the oil eventually spilled
into Cottonwood Creek, which is a tributary stream that flows approximately
22 miles from its headwaters in Major County northeast to is confluence with
the Cimarron River near Orienta, Oklahoma. The Cimarron River flows to the
Arkansas River, the Mississippi River, and ultimately the Gulf of Mexico.
A response team from the Environmental Protection Agency (EPA), along
with the tank battery’s owners, participated in the cleanup and recovery operation. Response actions included the placement of rigid booms, sorbent pads,
and an underflow dam to recover and remove the crude oil from Cottonwood
Creek and the accompanying shoreline. Due to the prompt response and
cleanup efforts, inspectors did not observe any permanent contamination of
the affected area during follow-up inspections.
At yesterday’s combined plea and sentencing hearing, U.S. Magistrate
Judge Suzanne Mitchell accepted Gray’s guilty plea and sentenced him to
serve three years of probation.
“Enforcement of the Clean Water Act protects public health and the environment,” said Acting U.S. Attorney Troester. “I commend the dedicated efforts
of the U.S. Environmental Protection Agency for their investigative efforts and
rapid response to mitigate the impact of the pollution.”
“Our nation’s environmental laws are designed to protect our communities
and our natural resources,” said Special Agent in Charge Christopher Brooks
of EPA’s Southwest Area Office. “EPA will continue to hold individuals responsible for their environmental crimes and the resulting harm.”
