Dwayne L. Roush, a
physician from Yukon,
who is practicing in
Purcell, was sentenced
September 18 to serve
36 months of probation and ordered to pay
$340,652.53 in restitution to the IRS for to failing to file a federal tax
return for 2011. In addition, Roush was ordered
to pay a $1,000 fine and
perform 200 hours of community service.
Roush was charged by information on May 22, 2014, with failing to
file a federal tax return for 2011. He pled guilty on June 10, 2014. As
part of his guilty plea, Roush agreed to pay restitution to the Internal
Revenue Service for six tax years, including 2007, 2008, 2009, 2010,
2011, and 2012.

A Maysville man thought he could get
away with using his former roommate’s
name after getting busted for DWI, but his
mug in OK Jailbirds gave his ploy away.
According to probable cause affidavit,
Dylan Ashley, 22, was arrested by an OHP
trooper on August 9 for driving impaired.
Ashley did not have a photo ID on him.
But instead of giving the trooper his real
name, he gave his name as Blake Bergen
and Bergen’s birthdate.
How did Ashley know Bergen’s
information? Ashley was at one time
Bergen’s roommate in Norman.
Ashley was processed into the Garvin County Jail as Bergen.
Lo and behold, a couple of weeks later, September’s edition of OK
Jailbirds is produced and was in stores. Bergen’s mother informed him that
his name was in OK Jailbirds, but with his soon-to-be ex-buddy’s photo.
He got a copy, and sure enough, Ashley’s goofy mug shot was in the Garvin
County data, but the name under the mug said Blake Bergen, DWI.
The real Bergen went to the Garvin County Sheriff’s Office immediately to
clear his name. Bergen proved his identity and DPS was notified.
On Sept. 16, Ashley was booked into the Garvin County Jail, again, on
an outstanding Okmulgee County warrant, this time using his own name.
When questioned about the Bergen incident, Ashley admitted he gave the
trooper Bergen’s name and birthdate instead of his own. He said he knew
Bergen well, and that he lived with him and his parents in the past. He
added he had intended to pay for the costs, but didn’t realize the identifiers
and latent prints were used by law enforcement to identify offenders.
Ashley was charged with felony false personation the next day. The
charges of DWI that were under Bergen’s name have been corrected in court
records and are now under Ashley’s name. Ashley is scheduled to appear in
court on October 24 at 10 am for his preliminary hearing.

A self-admitted poor Weatherford college student was taken to jail when police found weed inside of his apartment on
September 18.
According to the police report, Weatherford police officers
were dispatched to the 900 block of Delarice Lane around 3:11
p.m. in reference to a property damage accident. When they
arrived, they met two women that were in one of the vehicles
involved in the collision. Officers asked the women where the
owner of the other vehicle had gone. They said he gave them
his number and left the scene. One of the girls called the man
and asked him to come back outside.
Justice Francisco De La Paz, 20, approached the scene and
appeared to be nervous. When an officer started to complete
an accident investigation, De La Paz told the officer all of his
information was inside his apartment.
He walked past the officer to get his info, but the officer smelled the odor of raw marijuana.
The officer followed the man to his apartment. De La Paz quickly walked into his apartment
and immediately shut the door. When the officer walked to the entryway of the apartment
complex, he again smelled a strong odor of raw marijuana.
When De La Paz came out of the apartment, the officer told him to step away from the open
door. He told the man he smelled marijuana, and he was going to secure the apartment.
De La Paz tried to shut the door, and he tried to push the officer away from his apartment.
Other officers arrived on scene, and they placed De La Paz in handcuffs.
Two other men were inside the apartment. One of them said he knew there was marijuana
inside the home, but he didn’t know how much.
De La Paz told officers he didn’t commit a violent crime and didn’t understand why he was
being detained since he was just a “poor college kid selling a little weed.” He allowed police
to search his apartment and said, “All of it is mine. My friends don’t know anything about the
weed.”
Inside the apartment, officers found a bag of marijuana, electronic scales, rolling paper,
lots of small bags containing marijuana and clear baggies.
De La Paz is being charged with possession of a controlled dangerous substance within
1,000 feet of a park and unlawful possession of drug paraphernalia. He was released on a
$5,000 bond and is scheduled to appear in court on October 31, 2014.

Well, the temperatures are
dropping, and fall is almost here,
and these things signal the start
of football season in Oklahoma! Not only have our major colleges
had their first home games, but all across the state, people are
traveling to and from football games from 4th graders on up to
high school. With that in mind, I wanted to re-visit a few tips to
make this football season safe.
Lets start with college. Whether you are a Sooner, Cowboy,
or Golden Hurricane fan, one thing is for sure...you aren’t
alone! There are thousands of fans for each home game
traveling to the stadiums. This volume of traffic demands your
consideration. First, if you can, leave early! The closer to game
time, the worse the traffic gets, so if you can, get to the stadium
early. There are plenty of things on a game day that are going on
prior to kickoff that you can spend your time enjoying. There are
usually lots of free stuff for the kids to do that make the whole game
day experience wonderful for them as well.
Second, be patient! You WILL run into traffic, so plan ahead,
and don’t get frustrated with it. Turn on the radio, listen to the pregame hype, and remember to be a safe, courteous driver. Getting
frustrated, and getting into a hurry, can result in a traffic accident
that will delay your arrival, and could end up being very expensive,
not to mention the potential for injury.
Last, be aware that there are usually some temporary traffic
control changes on game days. Both before and after the games,
law enforcement will be at intersections controlling the traffic
lights, and making adjustments to keep the traffic flowing in the
best possible manner. Be alert and aware, and recognize when and
where these temporary traffic controls are taking place.
Now, on to the local games! The biggest thing I remember from
growing up is that parents are usually running late to get to games,
because of what time they got off work. This has not changed...we
Troopers are stopping folks who are speeding trying to get to a kid’s
ball game all the time. While we understand, (we have kids too!)
we also see all too often what happens when accidents happen as
a result of unsafe speed. If you get stopped by us, you’re going to
be even later, and possibly on the hook for a hefty fine. If you get
involved in an accident, you may not make the game at all.
Finally, when you do get there, be a good fan! Cheer your team,
don’t denigrate the other team. Use appropriate language in the
stands; remember, there are kids of all ages in the stands with
you. We Oklahomans love our football, just remember to show
your support in a positive way! Thanks for reading, buckle up, and

Pom Pom: it’s what’s for dinner
Police call the relationship “toxic.” If the details of the
police report are accurate, folks won’t need much convincing.
Bear the Pomeranian disappeared in early August after the
dog’s owner and her then-boyfriend Ryan Eddy Watenpaugh
had an argument.
The woman fled her apartment after she was physically
assaulted by Watenpaugh, she told police in Redding,
California. When she returned, Bear was gone.
The couple, which police say had a tumultuous dating
relationship that included the woman being held against
her will, briefly reconciled the first week in September.
Watenpaugh, 35, cooked her a meal that included meat.
Then the text messages began.
“How’s your dog taste? I thought it was better with BBQ and those Hawaiian buns.”
“I guess u could bury what u didn’t eat.”
“The smile on my face when you read this … priceless,” KRCR reported.
Then early on Sept. 9, Watenpaugh showed up at the woman’s house and left a small bag
by her front door, police say. Inside was a note and two dog paws.
“Burn in hell,” the note says. “I hate you so much it hurts. Stay away from me. I want
nothing to do with you. F— you.” At the bottom of the note: a smiley face.
Redding police arrested him two days later. They say he’s admitted to sending the
messages and placing the dog paws at the woman’s residence, but has denied killing or
cooking Bear.
“You know this is extremely strange,” Redding Sgt. Todd Cogle told KRCR. “Unusual,
something we had never seen before.”
Watenpaugh has been charged with domestic violence, false imprisonment, stalking and
animal cruelty. He’s being held on $250,000 bail in the Shasta County jail.

An Elk City man begged an officer to get rid of his meth
pipe after his arrest at a probation and parole office on
September 26.
An Elk City officer was dispatched to the office in the
400 block of E. Third around 11:56 a.m. to help with a
resistant subject, according to the police report. When he
arrived, he saw Darryl Lynn Garcia, 34, struggling with
officers and wearing hand restraints while trying to leave
the office.
Officers told Garcia to get on the ground, but he resisted.
Eventually, he stopped struggling and agreed to sit back
in a chair. When the officer asked him what was going on,
Garcia replied, “Just take me to jail — I’m ready to go.”
The probation and parole officers told the assisting officer that Garcia had come to the office to speak with a parole officer. She told him he was under arrest for a Beckham County warrant, and all hell broke loose.
The officer said Garcia told them he was not going to jail, and a fight ensued. The Elk City
officer verified the warrant was valid, and he placed Garcia under arrest and put him in his
patrol vehicle.
The officer asked the other officers if Garcia had any property. They said they found a meth
pipe and some pills when they emptied his pockets. When officers put Garcia’s property into
evidence bags, they observed a fake driver’s license in his wallet.
One of the officers said Garcia asked him several times to just “crush the pipe.” Obviously it
didn’t work, but Garcia wasn’t done trying. On the way to jail, Garcia asked the arresting officer to break his pipe. Even though the officer told him he wasn’t going to get rid of the pipe,
Garcia continued to ask him to get rid of it.
What was so important about this pipe? It later field-tested positive for methamphetamine.
The pills found in Garcia’s pockets were identified as Lunesta, Aprazolam and Clonazepam.
The ID was printed on a Domino’s pizza card.
Garcia is being charged with three counts of possession of a controlled dangerous substance, make/sell/possess/display false identification card, unlawful possession of drug
paraphernalia and resisting an officer. His bond was set at $100,000, and he is scheduled to
appear in court on November 25, 2014.

Six years ago, the remains of an unidentifi ed woman were
found in a shallow grave near Lake Thunderbird outside
Norman. The medical examiner’s offi ce believes the remains
are those of a white female, possibly with Native American
heritage, who was approximately 5 feet, 5 inches tall and
between 30 and 45 years old. She also had given birth to at
least one child.
Due to the rate of decomposition, investigators believe she
had been in the grave between 3 and 12 months.
A distinct tattoo of a sunburst was on a large portion of her
back. Attempts to identify the woman through DNA have produced no results.
OSBI Forensic Artist Harvey Pratt reconstructed her skull to provide a likeness of the woman.

The key to your freedom
A state trooper knew something was up when a Canton man told him he just pulled over
to let the officer pass.
Well, that and the smell of marijuana.
According to the affidavit, the trooper was traveling eastbound on Carlton Blacktop on
September 18 around 8:22 p.m., when he saw a vehicle weaving in its lane. The car suddenly turned and stopped on the side of the road.
Thinking that the driver might be having car trouble, the trooper pulled behind the
vehicle to check on its occupants. When he asked the driver, John David Whiteeagle Jr.,
49, if they were having car trouble, Whiteeagle said they just pulled over to let the trooper
pass them. The trooper saw a female passenger, Gracemont woman Marion Ruth Redbird, 37, and a baby in the backseat.
He also noticed a strong odor of marijuana.
The trooper asked Whiteeagle to have a seat in the patrol car so they could talk. Once
they were in the vehicle, the trooper could still smell marijuana and asked the man if he
had been smoking weed. Whiteeagle said he had given a ride to someone who was smoking it.
The trooper noticed several physical signs that alluded to Whiteeagle actually smoking
the weed himself.
The trooper went back to the vehicle and told Redbird he could smell marijuana in
the vehicle; he also said Whiteeagle told him someone in the vehicle had been smoking
it. Redbird said they had both been smoking marijuana in the car, and there was a halfsmoked joint on the passenger side of the car. The trooper found the joint and went back
to his patrol vehicle.
He administered standard field sobriety tests to Whiteeagle. The man didn’t do well. He
also had visible eyelid tremors and a higher-than-normal pulse during the tests.
Troopers placed Whiteeagle and Redbird under arrest and transported them to jail. A family member came to the
scene to pick up the baby.
Whiteeagle is being charged with child endangerment by driving under the influence and possession of a controlled
dangerous substance. He was released on a $2,000 bond.
Redbird is being charged with child endangerment by permitting presence in vehicle when driver is impaired or
under the influence and possession of a controlled dangerous substance. She was released on a $1,000 bond.
They are both scheduled to appear in court on November 4, 2014.

Children have a
wonderful capacity
for trust. The faith
they put in adults is unqualified, and that should humble us; we often don’t
deserve it.
Sometimes kids suffer from intentional betrayal by a trusted adult, like
former Penn State football coach Jerry Sandusky, recently convicted of
sexually abusing underprivileged young boys. Other times, they are neglected
by society at large, as are the 1.7 million children with a parent behind bars.
Many of these kids face enormous obstacles, but get little notice.
The Bible affirms that children are a central focus of God.
Our national problem is not that we somehow undervalue children; it’s
that we don’t always know where to look to find the children most in need
of our help. Inmates’ children in particular get placed on the back burner.
They grow up in single-parent homes, or they get shuffled into foster care.
They are five times more likely than their peers to live in poverty. They often
endure confusion, loneliness, depression, abandonment, social ostracism,
and profound anger. Should we be surprised if they often follow their
parents to prison?
It doesn’t take much to ease the burden of an inmate’s family. Churches—
and other people of good will—can incorporate prisoners’ children into their
existing programs, like VBS, youth mentoring programs, or summer camps.
They can make sure kids have the supplies they need to succeed in school, or
gifts to celebrate the holidays; the opportunities are boundless.
If we take seriously the notion that every child has inherent worth and
deserves our society’s nurture and protection, we cannot afford to ignore
children with an incarcerated parent. Like Jesus, we must reach out to them,
and their trust will for once not be betrayed. In turn we will discover that the
blessing goes both ways: They will teach us what it means to have faith that
pleases God, faith that presses in close, believing everything will be okay.

An Elk City man was arrested at a gentleman’s club for less-than-gentlemanly behavior on September 25. Apparently, he just
couldn’t keep his hands to himself — but not
where the dancers were concerned.
Washita County deputies were dispatched
to the joint in the 800 block of S. Ninth in Canute around 12:17 a.m., according to the affidavit. The reason? A stabbing had occurred
between a man and one of the bouncers.
When the deputies arrived, they found the
victim lying on the floor being treated by EMS personnel. Two men
that knew the suspect identified the alleged guilty man as Edgar J.
Lamouth, 23.
One of the security guards told deputies that Lamouth had his cell
phone out in the bullpen area (an area next to the stage where the
girls dance). The club has a strict policy about no cellphones in the
bullpen. When the bouncer tried to enforce the rule, Lamouth told
him “f--- you” and continued to talk on his phone.
The bouncer once again told him to put his phone away. Lamouth
threw another f-bomb, and the bouncer motioned for the security
guard to help him. An altercation ensued, and sometime during the
struggle, Lamouth apparently stabbed the bouncer.
A deputy reviewed the security tapes and said, “You can see [an]
altercation occur and see where (the bouncer) finds out that he had
been stabbed.”
The deputy went to the hospital and spoke with the victim. The
victim said when he tried to get Lamouth to leave after he refused
to put his cellphone away, the suspect told him, “F--- with me, I cut
you.”
The victim said he felt the warm blood coming from his stomach,
but he still wanted to protect the other customers and employees.
