SENTENCES HANDED DOWN FOR TAHLEQUAH
COUPLE ON CHILD SEX ABUSE CHARGES
CHEROKEE COUNTY, Okla. – A Tahlequah
couple has plead guilty to multiple charges of
child sex abuse in Cherokee County District
Court. On Thursday, June 17, 2021, 37-year
old Jennifer Mason plead guilty to 1 count of
Child Sexual Abuse to a Child Under the Age
of Eighteen (18) and 1 count of Procuring, Producing, Distributing, or Possessing Child Pornography. She was sentenced to a term of 20
years in the Oklahoma Department of Corrections.
On March 25, 2021, Mason’s husband,
44-year-old John Haynes, entered a plea of
Nolo Contendere to 1 count of Aggravated
Possession of Child Pornography and 1 count
of Sexual Abuse of a Child Under 12. The Cherokee County District Judge sentenced him to a
term of 25 years in the Oklahoma Department
of Corrections. Additionally, Haynes will be a
lifetime registered sex offender.
The investigation was initiated when an Electronic Service Provider (ESP) reported that chat
logs suggested Haynes sexually abused an
infant child and that Jennifer had also participated. On May 1, 2020, OSBI Internet Crimes
Against Children (ICAC) Agents and the Department of Homeland Security (HSI) Tulsa
Agents executed a federal search warrant at 12911 W. Southern Oaks
in Tahlequah, Okla., where Haynes and Jennifer lived. Based upon the
evidence collected, Haynes was arrested and booked into the Cherokee
County Detention Center.
The child’s mother, Jennifer Mason, was later found to be involved with
abuse of the infant and was arrested June 16, 2020. Jennifer was also
booked into the Cherokee County Detention Center.
Based on the investigation and a review of evidence collected during the
search warrant, OSBI ICAC Agents were able to locate an additional child
victim in Virginia who was safely rescued.
This was a joint OSBI ICAC and HSI Tulsa investigation with assistance
from HSI Springfield, Cherokee Nation Marshals Service, Tulsa Police Department, Cherokee County Sheriff’s Office, HSI Dallas Victim Assistance
Program, Oklahoma Department of Human Services, the US Attorney’s
Office for the Eastern District of Oklahoma, and the Cherokee County District Attorney’s Office.

As summer draws to a close and
children start heading back to school,
family life can get pretty hectic. It’s
important to remember – and share
with your children – some key tips that
will help keep them safe and healthy
throughout the school year.
Getting to School
Whether children walk, ride their bicycle or take the bus to school, it is vitally
important that they – and the motorists around them – take proper safety precautions.
Walkers:
• Walk on the sidewalk; if there is no sidewalk and you must walk in the street,
walk facing traffic
• Before crossing the street, stop and look left, right and left again to see if cars
are coming
• Never dart out in front of a parked car
• Parents: Practice walking to school with your child, crossing streets at cros
walks when available
• Never walk while texting or talking on the phone
• Do not walk while using headphones
Bike Riders:
• Always wear a helmet that is fitted and secured properly
• Children need to know the rules of the road: Ride single file on the right side
of the road, come to a complete stop before crossing the street and walk the
bike across
• Watch for opening car doors and other hazards
• Use hand signals when turning
• Wear bright-colored clothing
Bus Riders:
• Teach children the proper way to get on and off the bus
• Line up 6 feet away from the curb as the bus approaches
• If seat belts are available, buckle up
• Wait for the bus to stop completely before standing
• Do not cross in front of the bus if possible, or walk at least 10 feet ahead until
you can see the other drivers
Drivers, Share the Road:
• Don’t block crosswalks
• Yield to pedestrians in crosswalks, and take extra care in school zones
• Never pass a vehicle stopped for pedestrians
• Never pass a bus loading or unloading children
• The area 10 feet around a school bus is the most dangerous for children; stop
far enough back to allow them to safely enter and exit the bus

GUILTY OF MURDER
Miranda Lynne Ree, 24, of Broken Arrow, was
found guilty by a federal jury of Murder Second
Degree in Indian County last month.
The jury trial began with testimony on Tuesday, June 1, 2021, and concluded on Thursday, June 3, 2021 with the guilty verdict. The
defendant was indicted in September 2020 on
the charge of Murder I. After considering the
evidence presented at trial, the jury found Ree
guilty of the lesser included offense of Murder II.
Murder in the Second Degree is punishable by
any term of years or life in imprisonment.
The evidence presented at trial proved that
on or about September 27, 2018, Ree, an Indian, unlawfully killed Bryan James Chaney with
a knife. The crime occurred in Wagoner County,
within the boundaries of the Muscogee (Creek) Nation, and within the Eastern
District of Oklahoma.
The guilty verdict was the result of an investigation by the Wagoner County
Sheriff’s Office and the Federal Bureau of Investigation.
“The defendant was originally charged in the District Court of Wagoner with
Murder in the First Degree, but the case was dismissed after the Supreme
Court decision in McGirt v. Oklahoma,” said Acting United States Attorney
Christopher J. Wilson. “Once the state charge was dismissed, the Federal
Bureau of Investigation picked up the investigation and prosecution of the
case was initiated by our office. The verdict in federal court represents the
next step in ensuring the defendant is held responsible for unlawfully killing
Bryan James Chaney.”
The Honorable Ronald A. White, U.S. District Judge in the United States
District Court for the Eastern District of Oklahoma, in Muskogee, presided
over the trial and ordered the completion of a presentence report. Sentencing
will be scheduled following completion of the report. Ree was remanded to
the custody of the United States Marshal pending the imposition of sentencing.

A Stilwell man faces charges after allegedly sexually assaulting a minor in 2017 near
Vinita, announced Acting U.S. Attorney Clint
Johnson.
David Anthony Romannose, 44, was
charged by criminal complaint with sexual
abuse of a child in Indian Country and aggravated sexual abuse in Indian Country. At
a hearing on July 6, U.S. Magistrate Judge
Susan E. Huntsman ordered the defendant
detained while awaiting trial. Romannose is
a citizen of the Cheyenne and Arapaho Tribes
of Oklahoma.
On July 4, 2017, Romannose accompanied a group who were traveling through
northeastern Oklahoma after attending a festival in Seiling. While traveling, according to
the affidavit, Romannose allegedly sexually assaulted the victim in the backseat of the vehicle. The violation occurred in Indian Country on the Will Rogers Turnpike/Interstate Highway I-44 near Vinita, in Craig County. The victim
told investigators she remembered the group stopping at a rest stop in Vinita
shortly after the abuse occurred. Romannose reportedly also abused the minor, an Oneida Indian Nation citizen, after the group arrived home in New
York. The victim later disclosed the abuse to a counselor and family member.
A criminal complaint is a temporary charge alleging violation of the law.
Defendants are presumed innocent until proven guilty beyond a reasonable
doubt in a court of law. For the case to proceed to trial, the United States must
present the charge to a federal Grand Jury within 30 days. Once a Grand Jury
returns an Indictment, a defendant has a right to a jury trial at which time the
United States would have the burden of proving the defendant’s guilt.
The FBI, Oneida Indian Nation Police Department, and Craig County Sheriff’s Office are the investigative agencies. Assistant U.S. Attorney Gina S.
Gilmore is prosecuting the case.

Home Invasion/Burglary Suspect Arrested
On July 5, around 9:15, officers responded to a
burglary in progress call near 71st and Trenton in
south Tulsa.
When officers got there, they spotted the suspect, Joseph Bart, trying to leave the apartment
and holding a knife. Bart dropped the knife after
multiple commands, and he was taken into custody.
The victim says Bart is the father of her child
and she has a protective order against him. The
victim says Bart kicked in the door, assaulted her,
threatened her with a knife, and damaged the
apartment.
The victim was not seriously hurt in the incident.
Bart was arrested for Assault and Battery with a Dangerous Weapon, 1st
Degree Burglary, Threatening a Violent Act, Violation of a Protective Order,
Public Intoxication.

GOING TO THE BIG HOUSE
James Michael Stewart, 42, of Muskogee,
was found guilty by a federal jury of one count
of Attempted Aggravated Sexual Abuse.
This crime is punishable by imprisonment
for any term of years or up to life imprisonment, a fine of up to $250,000, or both.
Stewart was acquitted on two counts of
Aggravated Sexual Abuse in Indian Country.
The jury trial began with testimony on Monday, June 7, 2021 and concluded on Thursday, June 10, 2021 with the guilty verdict.
The evidence presented at trial proved
that on May 25, 2018, Stewart attempted to
sexually assault a female victim in a room at
the Studio 6 hotel on North 32nd Street in
Muskogee. Stewart undressed and pushed
the victim onto a bed. The victim was able to
free herself, ran to the bathroom, locked the door, and called 911. When the
police arrived, they found the defendant still nude. According to the police officer, the victim was very emotional and appeared afraid of Stewart.
The United States Attorney’s Office for the Eastern District prosecuted the
case because Stewart is a member of a federally-recognized Indian tribe and
the crime occurred in Muskogee County, within the boundaries of the Muscogee (Creek) Nation, and within the Eastern District of Oklahoma.
The guilty verdict was the result of an investigation by the Muskogee Police
Department and the Federal Bureau of Investigation.
The Honorable Ronald A. White, U.S. District Judge in the United States
District Court for the Eastern District of Oklahoma in Muskogee, presided over
the trial and ordered the completion of a presentence report. Sentencing will
be scheduled following completion of the report. Stewart was remanded to
the custody of the United States Marshal pending the imposition of sentencing.

OBN SHUTS DOWN ILLEGAL MARIJUANA FARM IN MUSKOGEE
COUNTY, FINDS EVIDENCE OF POSSIBLE HUMAN TRAFFICKING
On Monday, June 14, OBN shut down a large illegal marijuana growing operation in Muskogee County. OBN Spokesman Mark Woodward said the 40-
acre, 24,000 plant farm had no licensing and those in charge of the operation
had made no effort to get licensing. In addition, the 20 to 30 Hispanic males
working on the farm were potentially victims of Human (Labor) Trafficking.
“While none of them willingly claimed to be a victim, these men were forced
to live in deplorable conditions. They stayed in make-shift shanties without
electricity or running water to the property. They appeared to be bathing and
washing their clothes in a less than sanitary and stagnate creek/pond nearby.
Interviews revealed that they had not been paid and were told that would
receive a percentage of the profits after the harvest.” said Mark Woodward,

AROUND THE NATION
Man Charged with dumping poop water near
stream in Sierra County, CA
On July 5th, an off-duty Sierra County Sheriff’s Office detective driving on Highway 49 noticed a GMC
pickup with a gray and yellow Attitude trailer parked
on Highway 49 near the Forest Service Road 9 at
mile-post-marker 40.19. The off-duty detective saw
a white male, later identified through a California
State driver’s license as Peter Cate, standing next
to the trailer dumping the black tank into the ditch
along Highway 49. The license plate on the vehicle
was noted and reported to Sierra County Sheriff’s
Office dispatch, and an illegal dumping case was
opened.
The Sierra County Sheriff’s Office detective could see brown water discharging from the trailer. The detective turned around and parked across from the
truck and trailer. He observed Cate discharging sewage from the black tank.
The sewage ran down the road and into an adjacent ditch that drained into a
nearby creek. Cate then closed the black tank, got back into his truck, and
drove away.
Photographs were taken of the raw sewage which ran approximately 30 yards
from dump site. The detective reported a strong smell of sewage and could see
toilet paper and human waste. The sewage was about 12 inches from a stream
in which the detective could see trout.
Local Fish and Wildlife Warden, Steve Ulrich responded to the scene and
assisted the Sierra County Sheriff’s Office in charging the suspect with felony
discharge of pollutants into a waterbody. Warden Ulrich notified Fish and Wildlife officers in Cate’s jurisdiction and asked them to contact and interview Cate.
Sierra County Sheriff’s Office wrote an arrest warrant that was served that
evening by the Livermore Police Department. Cate was booked into Alameda
County Sheriff’s Office on a felony charge of the California Water and a misdemeanor charge of Fish and Game Code, Disposal of Trash into or within 150
feet of a waterbody.
