DANGEROUS DRIVE
Fugitive Christopher Wayne Smith, 32, was
taken into custody after he allegedly shot at
deputies during a pursuit.
According to a Cherokee County Sheriff
Department press release, on the evening of
Tuesday January 3, Deputy Nick Chute was
on patrol in the Woodall area of southwestern Cherokee County when he attempted to
make a traffic stop on a red SUV for excessive speed. The driver refused to stop and
Deputy Chute, with the assistance of other
CCSO deputies, troopers of the Oklahoma
Highway Patrol and deputy marshals of the
Cherokee Nation Marshal Service, pursued
the vehicle eastbound into the Stone Chapel
area. During the pursuit, the suspect driver fired several shots from a handgun
at Deputy Chute, striking the windshield area of Deputy Chute’s patrol vehicle
twice. The pursuit traveled back westbound to the Woodall area and across
Highway 62 where the suspect driver drove the red SUV off road, stopped,
abandoned the vehicle and fled on foot.
The suspect driver was not located in the area, but evidence located in the
abandoned red SUV gave CCSO deputies sufficient probable cause to obtain
an arrest warrant for Smith, a resident of the Woodall area.
Smith was later tracked down several days later at an apartment in Tahlequah. Formal charges have yet to be filed as of press time.

TRIPLE PLAY
Three suspects were arrested on December
29 after a deputy found fentanyl in their possession during a traffic stop.
According to reports, a Wagoner County
deputy was patrolling in the area of Highway
69 and SW 15th Street when he saw a white
car commit a traffic offense. He stopped the
vehicle and made contact with the driver, identified as Caleb Gipson. Gipson did not have a
valid driver’s license.
The passengers were identified as 35-yearold Amanda Ruth Gipson of Pryor and Wagoner man Noah Nicholas Wilson, 29.
While the deputy was speaking to a passenger, he saw a clear baggy that contained
a white powdery substance. He searched the
vehicle and found two baggies. The substance
in the baggies field-tested positive as fentanyl.
Officers placed the suspects under arrest
and transported them to jail.
Amanda Gipson is being charged with aggravated trafficking in illegal drugs, possession
of a controlled dangerous substance, and public intoxication. Her bond was set at $200,000,
and she is scheduled to appear in court on
January 18, 2023.
Wilson is being charged with possession of
a controlled dangerous substance, unlawful
possession of drug paraphernalia, and public
intoxication. His bond was set at $2,500, and
he is scheduled to appear in court on February
1, 2023.
Caleb Gipson was arrested on suspicion of
driving under the influence of drugs, aggravated trafficking in controlled dangerous substances, driving under suspension, and failure
to comply with compulsory insurance law. Formal charges, bond information, and court date
were unavailable at the time of publication.

REPO MAN
A Gore man is facing charges after he allegedly pointed a gun at some men who were
trying to repossess his vehicle on December
29.
According to reports, a Sequoyah County deputy was dispatched to a residence on
4445 Road to investigate a shooting. When
he arrived, two employees told the deputy
that they went to the residence of Thomas
Glenn Spears to repossess his vehicle. When
they tried to take the vehicle, Spears allegedly
pointed a gun at both of the men. He then
fired a round into the air. He also fired a round
into the men’s tire while they were trying to
take his vehicle.
The men said they tried to talk to Spears, but he told them to get off of his
property. He then shut the gate behind them.
When the deputy spoke to Spears, Spears said he walked outside and
saw two men trying to take his truck. He said he didn’t know who they were.
Spears did admit, however, to being behind on payments for the vehicle.
The deputy asked the man if he pointed a gun at the men’s heads.
Spears said no. He told the deputy that he only fired a round into the air and
at the truck’s tire.
Spears is being charged with feloniously pointing a firearm, reckless conduct with a firearm, and malicious injury to property under $1,000. Bond information and court date were unavailable at the time of publication.

“‘Girls Gone Wild’ hot tub party”
Patrol officer Maegan Hall, who is married, was
fired last month for engaging ‘in a sexual relationship’ with multiple men on the La Vergne police force
Four police officers from the Nashville suburb of
La Vergne were fired for allegedly having sex on duty
with a female cop, who was also fired and accused
of taking off her top at what the local mayor called a
‘Girls Gone Wild’ hot tub party.
Patrol officer Maegan Hall of La Vergne Police Department is at the forefront of the investigation after
it was revealed in December that she ‘engaged in a
sexual relationship’ with at least four male officers.
Fellow patrol officers Juan Lugo-Perez, Lewis Powell, detective Seneca
Shields and Sgt. Henry Ty McGowan admitted to the accusations, according
to the report, with Shields claiming he had oral sex with Hall in the department’s gym while on duty.
It’s unclear if any of the officers will appeal.

STILWELL RESIDENT SENTENCED TO LIFE
IMPRISONMENT FOR MURDER IN INDIAN COUNTRY
Earl McAlister, 55, of Stilwell, was sentenced to life
imprisonment and five years of supervised release for
Murder in Indian Country – Second Degree. The charges
arose from an investigation by the Federal Bureau of Investigation and the Adair County Sheriff’s Office.
McAlister previously entered a guilty plea to an Information filed in August 2022 alleging that on or about
November 17, 2019, within the Eastern District of Oklahoma, in Indian Country, the defendant, Earl McAlister,
a non-Indian, with malice aforethought, did unlawfully kill Randolph England, an Indian. The investigation
revealed that McAlister shot England two times. After
which, McAlister, along with others, drove to his “compound,” placed the victim’s body on a burn pile with tires and set him on fire
until nothing was left but bone fragments and teeth. McAlister then dumped the
victim’s remains down a ravine in a plastic container. Investigators were able to
identify the victim by comparing dental records.
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted the case because the victim in this case was a member of a federally recognized Indian tribe and the crime occurred in Adair County, within the boundaries
of the Cherokee Nation Reservation and within the Eastern District of Oklahoma.
“The life sentence imposed by the Court is fitting punishment for the defendant’s
vicious acts,” said United States Attorney Christopher Wilson. “I am thankful for
the cooperative efforts of local, state, and federal law enforcement in working this
case. Investigating and prosecuting violent crimes like this one will continue to be
a priority for the United States Attorney’s Office.”
“The murder of Randolph England was senseless and horrific, but the sentencing ensures the defendant will remain safely away from the public for the rest of
his life,” said FBI Oklahoma City Special Agent in Charge Edward J. Gray. “The
FBI will continue to work closely with our law enforcement partners to investigate
the most serious crimes in Indian Country.”
McAlister will remain in custody pending transportation to a designated United
States Bureau of Prisons facility to serve his non-paroleable sentence of incarceration.

AROUND THE STATE
ROBBERY ARREST -- Suspect bites clerk,
steals cigarettes, then tries to outrun Officers
on a bicycle.
On Jan. 9, around 1:55 a.m., Officers responded to a larceny in progress at a convenience store near 71st and Riverside.
The caller said a man, later identified as
Jeremiah Wooten, was behind the counter
stealing cigarettes and assaulting a clerk.
Video of the incident showed Jeremiah
Wooten walk behind the counter and grab
multiple packs of cigarettes attempting to
steal them.
The clerk tried to stop Wooten, and the two
got into a fight where Wooten struck the clerk
multiple times and bit him in the chest. Eventually, Wooten got away and left
with a tote bag filled with stolen cigarettes.
Officers swarmed the area and found Wooten riding a bicycle near 6800 S.
Rockford. When Officers tried to stop Wooten, he began to pedal faster and
started weaving between the patrol cars.
Eventually, Wooten turned down a dead end street and ran on foot. He
climbed a fence and ran into a backyard where he was taken into custody.
The tote bag with 15 packs of cigarettes was recovered and returned to
the store.
The clerk had multiple injuries, including a possible broken nose.

FEDERAL JURY CONVICTS MUSKOGEE RESIDENT OF
COMMITTING KIDNAPPING, CARJACKING, AND ROBBERY
OFFENSES WITH USE OF A FIREARM
Patrick Wayne McHenry, 29, of Muskogee,
was found guilty by a federal jury of Conspiracy to Commit Kidnapping, Kidnapping,
Carjacking, Robbery in Indian Country, and
the Carry/Use of a Firearm During and in Relation to a Crime of Violence.
The jury trial began with testimony on Monday, December 19, 2022 and concluded on
Wednesday, December 21, 2022 with the
guilty verdicts.
During the trial, the United States presented evidence that beginning on or around
September 11, 2021, and continuing until
September 13, 2021, McHenry kidnapped
and assaulted the victim, B.N., in Muskogee,
then transported B.N. to Braggs where
he locked B.N. in a shed. The victim was
bound with rope and tape but managed to escape and run to a neighboring
house for help. When law enforcement arrived, they observed the victim had
multiple injuries, was still partially bound with rope, and very emotional. The
United States also presented evidence that on September 12, 2021, McHenry robbed and carjacked C.J. at a motel in Muskogee, while possessing a
sawed-off shotgun.
The guilty verdicts were the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, Muskogee County Sheriff’s Office,
and Muskogee Police Department.
The United States Attorney’s Office for the Eastern District of Oklahoma
prosecuted the case because one of the victims is a member of a federally
recognized Indian tribe, McHenry used a cell phone and the internet to facilitate the kidnapping, and the crimes occurred in Muskogee County, within
the boundaries of the Muscogee (Creek) Nation Reservation, and within the
Eastern District of Oklahoma.
Sentencing will be scheduled following completion of the report. McHenry
was remanded to the custody of the United States Marshal pending the imposition of sentencing.
