SELF INFLICTION
A Tahlequah man will not spend any additional time in jail for possessing a firearm that he
accidentally shot himself with.
Michael Shane Lowrey, 51, was sentenced to
time served and two years of supervised release
for possessing a firearm after a felony conviction.
The charges arose from investigations by the Cherokee County Sheriff’s
Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
On March 9, 2022, Lowrey pleaded guilty to the offense.
On January 1, 2021, the Cherokee County Sheriff’s Office dispatched deputies to investigate a shooting at a local residence. Deputies answering the
call discovered Lowrey with a self-inflicted accidental gunshot wound. Upon
questioning, Lowrey admitted to knowingly possessing the firearm despite
his felony conviction.

Pilot gets high, tries to bring others down
While fl ying is generally safer than driving, that’s not the case when a man
high on mushrooms tries to shut-off a plane’s engine in mid-fl ight. That’s what
off -duty pilot Joseph Emerson allegedly did during a West Coast fl ight in October where he was a guest travelling in a cockpit jump seat. The 44-year-old
airman told investigators he’d experienced an emotional breakdown and had
not slept.
Colosseum vandal gets an F in history
Some people shouldn’t go anywhere. A 27-year-old tourist confessed to
carving his and his girlfriend’s names into the ancient Colosseum in Rome while
visiting the nearly 2,000-year-old structure. The man identifi ed by his lawyer as
Ivan Danailov Dimitrov apologized, claiming he was unaware of “the antiquity of
the monument.”
Teen “terrorist” shuts down Ford plant
Other people — like Zachariah A. Peterson — are fi ne staying local. The
19-year-old Missouri man is accused swatting Ford’s Kansas City Assembly
Plant in Claycomo, Mo., so his friend wouldn’t have to go to work. Peterson,
who allegedly said he was barricaded in a bathroom on the second fl oor with
an AK-47 and C4 explosives strapped to his chest, is charged with making a
terroristic threat.
Jack in the Bang
Some people shouldn’t go to work. Video released September as part of a
lawsuit against Jack and the Box shows a fast food worker opening fi re through
a drive-thru window following an argument that reportedly involved curly fries.
No one was injured.
Punishment fi ts the crime
An angry Ohio woman was sentenced to work in a fast food joint after throwing a burrito bowl at a Chipotle manager. A judge gave defendant Rosemary
Hayne that bizarre off er to shorten her criminal sentence and she took it, according to Cleveland.com.

someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

Two people were taken into custody after Wagoner County deputies discovered drugs and paraphernalia in their car that was parked inside a Porter cemetery.
According to the Wagoner County Sheriff’s Office, just after dawn on January 30, Wagoner County Deputy J. Busch was dispatched to a cemetery
located at 5300 W 50th St N for a suspicious vehicle that had been sitting in cemetery since approximately 4:30 a.m. Upon arrival, Deputy Busch observed the vehicle matching the description parked
facing southbound on the north side of the cemetery. Upon making contact with the vehicle, he observed a male and female asleep in the back seat.
Upon approach, the Deputy was also able to
smell a strong odor commonly associated with
marijuana coming from the vehicle with the doors
shut and all windows up. After knocking on the
back driver side window of the vehicle and speaking with the pair, the male subject identified as Joseph Fanelli. The female subject was identified as
Jessee Tao. Undersheriff M. Secrist arrived a short
time later to assist.
While talking with Jessee and Joseph, the odor of marijuana became stronger
after the back driver side door was opened, and Jessee stated that the reason they
were at the cemetery was due to her and Joseph being homeless. At that time,
Deputy Busch stated that he could smell the odor of marijuana coming from the
vehicle and asked Jesse and Joseph if they had a valid medical marijuana license,
which neither possessed. Upon searching the vehicle deputies discovered a white
crystal-like substance and two large bags of a green leafy substance.
Both individuals were taken into custody without incident and transported to
the Wagoner County Detention Center. Jessee Tao was charged with Possession
of Marijuana and Possession of Paraphernalia. Joseph Fanelli was charged for
Possession of Marijuana, Possession of Methamphetamine, and Possession of

HOW DOES IT FEEL?
A Gore woman will be spending the next three-plus
years in a federal prison after she allowed a man to
keep his kidnap victim on her property.
Tristen Riley Cawhorn, 26, was sentenced to 38
months in prison for Accessory After the Fact to Kidnapping.
The charges arose from an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives,
the Muskogee County Sheriff’s Office, and the Muskogee Police Department.
On March 21, 2023, Cawhorn pleaded guilty to one count of Accessory After the
Fact to Kidnapping.
According to investigators, in September 2021, Cawhorn assisted Patrick Wayne
McHenry in a kidnapping, allowing McHenry to lock the victim in a shed on her property and alerting McHenry when the victim attempted to escape.
On December 21, 2022, McHenry was convicted by a federal jury in the Eastern
District of Oklahoma for Conspiracy to Commit Kidnapping, Kidnapping, Carjacking,
Robbery in Indian Country, and the Carry/Use of a Firearm During and in Relation to
a Crime of Violence.
The crime occurred within the boundaries of the Muscogee (Creek) Nation Reservation, in the Eastern District of Oklahoma.
Cawhorn will remain in the custody of the U.S. Marshal pending transportation to
a designated United States Bureau of Prisons facility to serve a non-paroleable sentence of incarceration.
We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that

We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

News Flash! Trucks don’t surf!
A New York man was arrested and charged in
Florida after authorities caught him driving his pickup truck into the ocean at New Smyrna Beach, just
south of Daytona Beach, early on Tuesday.
A video shared by the Volusia Sheriff’s Office
shows a person driving a white pickup truck into the
water — sometimes driving alongside the waves and other times against it — and
even attempting to perform a donut.
The driver — later identified as 49-year-old Jason Brzuszkiewicz, of Bridgeport,
N.Y. — is then seen off the water chatting with deputies, who informed him the
beach was closed due to high tides.
Bodycam video also shows Brzuszkiewicz attempting to hide from a camera by
covering part of his face with a black baseball cap. He then tells an officer that he’s
not really the one to blame. “It’s not my fault truck don’t surf!” he says.
“Yeah, but you shouldn’t be driving on the beach when the gates are all closed,”
one deputy responds.
“I thought I was in England,” Brzuszkiewicz says.
When the deputy confirms they are not in England, Brzuszkiewicz’s response gets
even more colorful.
“We are not in Kansas, anymore?” he asks, using the famous Judy Garland line
from 1939’s MGM classic “The Wizard of Oz” — before laughing at his own joke.
According to the sheriff’s office, Brzuszkiewicz “drove around a closed gate
marked DO NOT ENTER and
accessed the beach in New
Smyrna Beach.”
He was ultimately charged
with a violation of the Volusia
County Ordinance — failure to
pay vehicular access fee — and
then taken to the Volusia County Branch Jail on a $200 bond.

DOUBLE DOWN
A Westville man was sentenced last month for
two separate crimes committed within one year.
Mitchell Dale Thompson, 26, of Westville, was
sentenced to 41 months in prison for one count
of Robbery in Indian Country and 51 months in
prison for one count of Assault Resulting in Serious Bodily Injury in Indian Country. The sentences will run concurrently.
The charges arose from investigations by the Bureau of Alcohol, Tobacco,
Firearms and Explosives and the Adair County Sheriff’s Office.
On April 17, 2023, Thompson pleaded guilty to the charges.
According to investigators, on July 19, 2021, Thompson demanded car
keys from the victim at gunpoint, then drove off in the victim’s car. On April 8,
2022, while incarcerated at the Adair County Detention Center on separate
charges, Thompson beat a fellow inmate, causing multiple skull fractures.
The crimes occurred in Adair County, within the boundaries of the Cherokee Nation Reservation, in the Eastern District of Oklahoma.
Thompson will remain in the custody of the U.S. Marshal pending transportation to a designated United States Bureau of Prisons facility to serve a

A Muskogee man will spend the rest of his life
in an Oklahoma pen after he murdered his wife.
According to OSBI, on January 29, 47-year-old
Dayan Banks was convicted of Murder in the First
Degree and Desecration of a Human Corpse in
Muskogee County District Court.
On November 16, 2021, the Muskogee County Sheriff’s Office responded to
a missing person report in Haskell. 43-year-old Tamera Lynn Ellison Banks had
not been heard from or seen since the previous day. Tamera had a protective
order against her husband, Dayan Banks, stemming from a domestic violence
incident on October 23, 2021.
On November 17, 2021, the Muskogee County Sheriff’s Office requested investigative assistance from the Oklahoma State Bureau of Investigation. The
OSBI launched what would turn into a two-year investigation into Tamera’s disappearance. The investigation ultimately revealed that Tamera had been murdered in Haskell.
Based on the information and evidence from the case, the jury recommended
Dayan Banks receive a life sentence without the possibility of parole for the murder, plus seven years for the desecration charge.
During the course of the investigation, 35-year-old Lauren Ann Jackson of
Broken Arrow was also arrested and previously pled guilty to Desecration of a
Human Corpse in Indian Country in United States District Court.
The OSBI would like to thank the Muskogee County Sheriff’s Office, the Eastern District of Oklahoma United States Attorney’s Office, the Muskogee County
District Attorney’s Office, the Office of the Chief Medical Examiner, and Red Dirt/

PLEADS GUILTY TO
FEDERAL FIREARM CRIME
Raheem Travon Walker, 21, of Muskogee,
entered a guilty plea to Felon in Possession of
Firearm and Ammunition.
The Indictment alleged that on October 28,
2023, Walker possessed a pistol and ammunition after having been convicted of a crime punishable by imprisonment
exceeding one year.
The charges arose from an investigation by the Muskogee Police Department and the United States Marshal Service.
The Honorable Judge Jason A. Robertson, U.S. Magistrate Judge in the
United States District Court for the Eastern District of Oklahoma, accepted the plea and ordered the completion of a presentence investigation report. Walker remains in the custody of the United States Marshal Service
pending a sentencing hearing.

Man arrested for making multiple threats
On February 3, a church member from a
church near 5th and S. Memorial called police
about threats of mass murder made on his congregation.
The church member said he came into contact with Ruben Marquez at a
gas station near 11th and 169th. The church member said Marquez told him
that he was going to use his guns to kill everyone at the church, including
women and children.
The investigation revealed that in January, the church member made a police report after Marquez made similar threats and blamed the church for
breaking up his marriage.
Ruben Marquez was taken into custody at his home, not far from the
church. He was arrested for Threatening an Violent Act.
