A Tahlequah man was sentenced to 120 months
imprisonment for Manslaughter in Indian Country after he shot and killed a man while at a party on the
Illinois River four years ago.
On May 19, 2022, James Mounce, 50, pleaded
guilty to Manslaughter in Indian Country.
According to court documents, on September
8, 2019, Mounce got into a fight with the victim.
Mounce went to the home of a nearby acquaintance,
obtained a shotgun, returned to the victim’s location,
and shot and killed the victim.
Reports state several people were having a party about two miles south of Todd
Access on the Illinois River, and a man and woman there, who were dating, got into a
fight. The man beat the woman in the head with a stick, and Mounce intervened. The
two men fought, and that’s when Mounce got the shotgun and shot the boyfriend.
The crime occurred in Cherokee County, within the boundaries of the Cherokee
Nation Reservation, in the Eastern District of Oklahoma. The charge arose from an investigation by the Federal Bureau of Investigation, the Cherokee County Sheriff’s Office, the Oklahoma State Bureau of Investigation, and the Grand River Dam Authority.
The Honorable John F. Heil, III, U.S. District Judge in the United States District
Court for the Eastern District of Oklahoma, presided over the sentencing hearing in
Muskogee. Mounce will remain in custody of the U.S. Marshal pending transportation
to a designated United States Bureau of Prisons facility to serve a non-paroleable

Holy guacamole!
A Richmond, Indiana, woman attempted to prevent police officers from searching her for drugs by faking a heart
attack, court documents reveal. The effort ended up being
in vain as jail staff later found an “avocado-size” sandwich
bag concealed in her privates that contained meth, fentanyl and crack cocaine.
Amanda Smith, 41, was arrested and charged with
dealing methamphetamine, a Level 2 felony; dealing in a
narcotic drug, a Level 2 felony; dealing in cocaine, a Level 3 felony, and dealing in a controlled
substance, a Level 6 felony.
This is the second time this summer Smith has been charged with multiple felony counts.
In early July, police accused Smith of luring a woman to a Richmond home under the guise
of selling her a ring. Instead, Smith allegedly assaulted the woman, punching her in the face
multiple times before stealing her wallet and phone.
Smith was arrested for the alleged assault and charged with robbery resulting in bodily
injury, a Level 3 felony, and criminal confinement, a Level 3 felony. She did not stay in jail long,
however, posting two separate cash bonds in July in order to be released from Wayne County
Jail — a move that would be repeated with her most recent charges.
Smith’s latest encounter with law enforcement occurred in September after a Wayne County
Sheriff’s deputy noted Smith interacting with known drug users at a Philipp 66 gas station in
Richmond. Being familiar with Smith, the deputy followed the woman’s vehicle and initiated a
traffic stop after Smith failed to use a turn signal and drove down the center of the road.
According to the deputy’s report, Smith would end up faking a heart attack after a K9 alerted
police to the presence of drugs. Smith reportedly began yelling and screaming that she was
having a heart attack but refused to let Richmond EMS hook her to monitors or give her a
medical evaluation.
After being taken to the hospital, Smith refused to change out of her clothes and insisted
on using the bathroom. Police believed Smith was concealing drugs and were aware that she
was likely trying to prevent herself from being searched while trying to find ways to dispose of
the hidden drugs.
Smith eventually agreed to change in the presence of nurses and admitted to having fentanyl hidden in her underwear. While changing, however, nurses spotted what appeared to be a
plastic sandwich bag concealed within her privates, documents detail.
According to the court documents, Smith continued to deny there was anything hidden
inside her even after the jail performed a body scan that showed an “abnormality in her pelvic
area.”
Eventually, Smith admitted to concealing drugs inside her privates and removed an “avocado-size plastic sandwich bag” from inside her, according to the documents.
Police ended up testing the contents of the bag and said 38.9 grams of meth, 10.4 grams
of crack cocaine and 9.2 grams of fentanyl — along with an untested fine white powder — had
been separately wrapped and shoved inside the plastic bag.
A search of Smith’s vehicle unveiled even more pills and substances including Gabapentin,
Naloxone and buprenorphine, court documents said. A ledger was also found in the vehicle
that contained names, weights, dollar amounts and drug types.
Police also found $5,845 in cash in Smith’s wallet and said four cell phones were seized
from the vehicle as evidence. According to the deputy’s report, three of the cell phones kept
ringing throughout the course of the investigation with calls coming in from known drug users.
Despite being charged with six felony counts over the last three months, Smith once again
posted bail after a brief stay at Wayne County Jail. Court records show Smith paid a $4,500
bond the day after her arrest (a $45,000 surety bond). In July, Smith paid two separate cash
bonds totaling $3,500 to avoid jail.

A Wagoner man is facing a multitude of charges after
he crashed his car into a liquor store and a then a large
amount of drugs were found in his home.
Samuel Robert Arnold, 49, was charged September
27 with indecent exposure, malicious injury to property,
public intox, improper stopping, improperly leaving motor vehicle unattended, two counts of unlawful poss of drug paraphernalia, possession of
CDS with intent, poss of CDS, in Wagoner County District Court.
On September 20, according to the Wagoner County Sheriff’s Office, deputies were
dispatched to 22300 Block of East 730 Road in the Wagoner area to check on the
well-being of anyone that may be in the residence. Wagoner County 911 Dispatch advised deputies that the Wagoner Police Department had arrested Samuel Arnold after he
had wrecked his vehicle into a business inside the City Limits of Wagoner and had left the
scene of the accident.
Upon arrival at the residence, deputies attempted to make contact with someone inside the residence. As they checked the back side of the house, deputies observed
that the back door of the residence was open. The Deputies cleared the residence and
discovered the residence to be empty of occupants.
As the deputies were clearing the residence, a large number of narcotics were discovered throughout the residence. Deputies secured the residence and obtained a search
warrant for the narcotics in the residence. Upon executing the search warrant, deputies and investigators
discovered and seized a large amount of narcotics.
Deputies seized a clear baggy with white crystal-like substance, clear baggy with white powdered
substance, clear baggy containing Mushrooms, glass
pipes, large plastic totes full of a green leafy substance,
scales used for measuring exact weights, a large
amount of case, and other types of paraphernalia (needles).
Court records stated deputies confiscated 15
pounds of marijuana.

STALKER
A Broken Arrow man was taken into custody after he
allegedly stalked a very young victim on social media
and then discovered where the victim lived.
Daren Chase, 36, of Broken Arrow, was charged
October 13 with stalking and sexual exploitation- child
under 12, in Wagoner County District Court.
According to a Wagoner County Sheriff’s Office press
release, on October 1, at 5:30 p.m., Wagoner County
Deputy W. Sieg was dispatched to 26100 Block of East 86th Street South in Broken Arrow in reference to a suspicious subject. It was reported by the homeowner that they had
left their residence and a short time later the Ring doorbell notified them that someone
was at their front door. The homeowner looked at the camera and observed an unidentified white male snooping around the front porch.
The homeowner commented about the “weird looking man” to their juvenile child and
showed them the picture. The juvenile then stated that the man looked like a guy who had
been following the juvenile on social media accounts. It was discovered that the juvenile
would block the male subject on social media and the male subject would create new
profiles to contact the juvenile again. Due to the circumstances, the homeowner called
the Sheriff’s Office to report the information.
On October 6, Wagoner County 911 Dispatch received a phone call from the homeowner advising that the male subject was at their residence in the yard. Wagoner County
Deputies W. Farmer and Investigator B. Noble proceeded to the residence in attempt to
make contact with the male subject. A short time later Deputy Farmer arrived on scene,
located the male subject, and took him in custody. The male subject was identified as
Daren Chase of Broken Arrow, OK.
Chase was charged after having repeated, non-consensual interactions with a juvenile,
including making lewd proposals to the juvenile over social media and seeking the juvenile
out at their personal residence. These interactions caused the juvenile, as well as other
family members, to feel frightened, threatened, and intimidated.
Wagoner County Sheriff Chris Elliott stated “It is important that parents regularly go
through their children’s phones looking for sexually explicit material and signs that younger teens and pre-teens may be being targeted or groomed by older individuals looking
to take advantage of them. Also make sure to discuss the danger associated with using
social media improperly with your children.”
Bond for Chase was set at $50,000 an he was ordered back to court on November 29

At approximately 10:00 pm on June 6, 1998,
16-year-old Dena Dean left the Marvin’s Food
Store located in the Town West shopping center
in Tulsa. Dean was never heard from again.
Dean’s vehicle was discovered in the parking
lot of the Marvin’s Food Store. Almost a week later, her body was found in a
wooded area a few miles away near Berryhill.
No has been arrested in the case.

THE REAL DEAL
A Vian drug dealer will be spending the next
seven-plus years in prison after he was convicted
of distributing meth.
Gene Douglas Fleet, 53, of Vian, was sentenced
to 87 months in prison for possession with intent
to distribute methamphetamine.
On April 26, 2022, Fleet pleaded guilty to one
count of Possession with Intent to Distribute
Methamphetamine.
On June 23, 2021, law enforcement conducted
a traffic stop on the I-40 corridor near Checotah after observing Fleet’s truck exceeding 75 miles per hour and drifting off the road. A search of the cab revealed
a single package of more than 200 grams of pure methamphetamine. At the plea
hearing April 26, 2022, Fleet admitted to possessing the methamphetamine in
order to distribute it.
The charges arose from an investigation by the Drug Enforcement Administration, the Oklahoma Bureau of Narcotics, the District 25 Drug and Violent Crime
Task Force, and the McIntosh County Sheriff’s Department.
The Honorable John F. Heil, III, U.S. District Judge in the United States District
Court for the Eastern District of Oklahoma, presided over the hearing in Muskogee. Fleet will remain in the custody of the U.S. Marshal pending transportation
to a designated United States Bureau of Prisons facility to serve a non-paroleable
sentence of incarceration.

DEADLY DECISION
A Stilwell man has pleaded guilty to federal
charges after he killed a person while driving under
the influence of drugs.
Bradley Jordan Eagle-Tate, 30, entered a guilty
plea in September to one count of Involuntary
Manslaughter in Indian Country.
The Indictment alleged that on June 27, 2022,
Eagle-Tate unlawfully killed the victim by failing to
devote his full time and attention to driving. According to investigators, Eagle-Tate drifted into the oncoming lane of Oklahoma
Highway 100 in a no-passing zone, clipping one vehicle before colliding head-on
with a second vehicle. The driver of the second vehicle died at the scene. Eagle-Tate admitted during the plea hearing that he had multiple drugs in his system
at the time of the collision.
The crime occurred in Adair County, within the boundaries of the Cherokee
Nation Reservation, in the Eastern District of Oklahoma.
The charges arose from an investigation by the Oklahoma Highway Patrol and
the Federal Bureau of Investigation.
The Honorable Jason A. Robertson, U.S. Magistrate Judge in the United States
District Court for the Eastern District of Oklahoma, accepted the plea in Muskogee and ordered the completion of a presentence investigation report. The
Court permitted Eagle-Tate to remain out of custody pending sentencing. WYATT

IN THE SEA
A Stilwell man will spend the next 10 years in a federal prison after he beat and robbed a fisherman at an
area lake last year.
Kaleb Thomas Linville, age 24, of Stilwell, was sentenced to 120 months in prison for one count of Using,
Carrying, Brandishing, and Discharging a Firearm During and in Relation to a Crime of
Violence.
The charge arose from an investigation by the Adair County Sheriff’s Office, the Cherokee Nation Marshal’s Service, and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
On May 10, 2022, Linville pleaded guilty to brandishing and discharging a firearm
during a robbery. According to investigators, Linville robbed an area fisherman in the
early hours of March 4, 2022. During the robbery, Linville brandished a semi-automatic
rifle at the fisherman, ordered him into the water, fired a round, struck him with the rifle
butt, stole his phone, wallet, and car keys, then drove off in the victim’s car.
The crime occurred in Adair County, within the boundaries of the Cherokee Nation
Reservation, in the Eastern District of Oklahoma.
“You wake up bright and early to go fishing and meet the likes of Mr. Linville; it’s not the
big fish story anyone should have to tell. Mr. Linville’s behavior was violent and aggressive; two adjectives that don’t go well with firearm possession. Because of his thoughtless actions, he gets to spend 10 years in federal prison,” stated ATF Dallas Field Division
Special Agent in Charge Jeffrey C. Boshek II. “I would like to thank our partners at Adair
County Sheriff’s Office, Cherokee Nation Marshal’s Service, and the United States Attorney’s Office for helping to put a stop to Mr. Linville’s violence.”
“This office is committed to vigorously prosecuting those who disrupt the safety and
security of our communities, especially when defendants use firearms to perpetrate their
crimes,” said United States Attorney Christopher J. Wilson.
The Honorable John F. Heil, III, U.S. District Judge in the United States District Court for
the Eastern District of Oklahoma, presided over the hearing in Muskogee. Linville will remain in custody of the U.S. Marshal pending transportation to a designated United States
Bureau of Prisons facility to serve a non-paroleable sentence of incarceration.

MUSKOGEE MAN PLEADS

SEX OFFENDER, THEFT
Nathan Kelly Graham, 26, of Muskogee, entered a guilty
plea to one count of Failure to Register as a Sex Offender,
and one count of Theft in Indian country, charged in two
single-count indictments.
One Indictment alleged that Graham resided in Indian
country from approximately July 2022 to March 2023, and
knowingly failed to register and update his registration as required by the Sex Offender Registration and Notification Act. Graham is required to register as a sex offender after having received
a felony conviction from the State of Oklahoma in 2015 for Rape in the Second Degree. The
charge arose from an investigation by the United States Marshals Service and the Muskogee
County Sheriff’s Office.
A separate Indictment alleged that on January 26, 2023, Graham stole a motor vehicle parked
at a Valero gas station in Muskogee. The charge arose from an investigation by the Muskogee
Police Department and Muskogee County Sheriff’s Office, who located the stolen 2019 Ford
F150 with Graham behind the wheel. Graham fled the scene and was later apprehended by
police. The crime occurred in Muskogee County, within the boundaries of the Muscogee (Creek)
Nation Reservation, in the Eastern District of Oklahoma.
The Honorable Gerald L. Jackson, U.S. Magistrate Judge in the United States District Court
for the Eastern District of Oklahoma, accepted the pleas, and ordered the completion of a presentence investigation report. Graham will remain in the custody of the United States Marshal

A Muskogee man was sentenced earlier this
month for threatening communications and cyberstalking police officers in 2020.
Parker Ryan Little, 26, of Muskogee, was sentenced to 51 months imprisonment for posting
threats online against Wagoner Police Officers and a Fort Gibson Police Officer, and
for stalking and harassing two additional victims.
The charges arose from investigations by the Federal Bureau of Investigation, the
California-based Regional Enforcement Allied Computer Team (REACT) Task Force,
the Wagoner Police Department, and the Fort Gibson Police Department.
On June 22, 2022, Little pleaded guilty to two counts of Threatening Interstate
Communications and two counts of Stalking.
On May 4, 2020, Little used one acquaintance’s identity to send an anonymous
tip to the Fort Gibson Police Department threatening a mass shooting. On May 8,
2020, Little, assuming the same victim’s identity, posted a public message on a
gaming forum threatening to shoot several Fort Gibson police officers, and posted
personal identifiable information (PII) doxing the officers. The threatening messages
were observed and reported to law enforcement by individuals located outside of
Oklahoma.
On June 11, 2020, Little discussed the harassment of a second acquaintance
in a group internet conversation. In the group conversation, Little admitted to harassing that second victim, including swatting the victim’s house. On the same day,
Little posed as the second victim and posted a public message on a gaming forum
threatening to shoot six Wagoner Police Department Officers, including the Chief of
Police, the Deputy Chief, and four others. At the same time, Little posted personally
identifiable information in the same public message, doxing the threatened Wagoner
police officers. The threatening messages involving the second victim were also observed and reported to law enforcement by individuals located outside of Oklahoma.
“The defendant’s relentless campaign of online threats, harassment, and stalking
intended to instill fear and divert critical law enforcement resources from where they
are truly needed,” said FBI Oklahoma City Special Agent in Charge Edward J. Gray.
“Our hope is that today’s sentence brings some relief to the private citizens and
members of the law enforcement community that were affected by this reprehensible
behavior.”
“We live in an increasingly interconnected society, which can be either a blessing or a curse,” said United States Attorney Christopher J. Wilson. “In this case,
the defendant chose the latter, utilizing various electronic platforms to spew threats
and stalk innocent victims, including members of law enforcement. The sentence
imposed sends a clear message this type conduct is criminal and will be punished
accordingly.”
The Honorable John F. Heil, U.S. District Judge in the United States District Court
for the Eastern District of Oklahoma, presided over the hearings in Muskogee, Oklahoma. Little will remain in the custody of the U.S. Marshal pending transportation
to a designated United States Bureau of Prisons facility to serve a non-paroleable
sentence of incarceration.

Overly passionate pastor
On October 2, Tulsa Police Officers arrested
a former pastor from a local church after an investigation revealed three years of inappropriate
behavior with a young girl starting when she was
15 years old.
The victim reported in May 2023 that the suspect, identified as Matthew Martinez, sexually
abused her, including kissing and groping her while threatening her not to tell
anyone.
Detectives learned Martinez, an associate pastor at the church, started texting the victim as a tutor in Fall 2020 before the messaging became more personal and the in-person contact became more physical – touching her hands
and feet at first before putting his hand up her skirt multiple times and touching her chest. The victim said Martinez would make her touch him as well.
In September, Detectives recovered thousands of text messages between
Martinez and the victim which included Martinez texting her “sexual hypotheticals” and talking about kissing her.
A warrant was issued for Martinez on September 28 and he was arrested
shortly after. He’s been charged with two counts of Sexual Battery.
This is an arrest, not a conviction.
We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

More than 100,000 children and
youth in the U.S. foster care system
are awaiting permanent families.
National Adoption Month is a time
to raise awareness about the adoption of children and youth from foster care.
The Children’s Bureau in partnership with AdoptUSKids and Child
Welfare Information Gateway sponsors the initiative each November as a way to focus public attention on the
urgent need for adoptive families for children and youth waiting in foster
care for a permanent family. This year’s focus, “Partnering for Permanency,” builds on the social media theme from last year. A special web page
on Information Gateway’s website helps child welfare professionals, prospective adoptive parents, and youth partner for permanency. The website
contains resources, stories, and videos on topics such as getting started
with social media, how to build a recruitment campaign, and how social
