The Oklahoma District Attorneys Association
encourages defeat of State Question 762, which
would remove the Governor from the pardon and
parole process on non-violent offenders. Recent
recommendations of the Parole Board relating to
early release of inmates have prompted the Association to call for a comprehensive review of
the early release process.
In the past several months, District Attorneys
have discovered serious issues with the way the
Parole Board is handling paroles. Recent consideration of an 85% inmate after serving only 4
years of a 10 year sentence raised serious questions about the recommendations. Crime victims have been told that offenders serving time
for 85% crimes (crimes involving violence) will have to serve at least 85% of the sentence
before any chance of release. That isn’t happening on all cases. Offenders sentenced to life
without parole sentence have been considered for release. Offenders facing consecutive
sentences are being paroled through the second sentence to the street. Even though this SQ
won’t impact all those situations, they cause concern for removing the Governor from any
part of the process.
“Removing the Governor from the parole process would be a terrible mistake. There
would be absolutely no accountability for those who are tasked with releasing criminals
from our prisons. And we know based on recent cases that the Parole Board is not acting
responsibly,” said District Attorney Greg Mashburn, Norman, and President of the Association. If SQ 762 is passed, non-violent offenders, if recommended by the Board for parole,
will hit the streets within days of the decision. Drug dealers, drunk drivers, child pornographers, abusers of vulnerable adults in nursing facilities and white collar criminals will all be
eligible for release without review of the Governor. No crime is victimless. It is imperative
to keep the Governor in this process as the ultimate gatekeeper.
Let’s remember why voters required the governor and the parole board to be jointly involved in this important process. They are a check and balance on each other. State Question 762 is not right for Oklahoma. “It is imperative to keep the Governor in this process as
someone who takes this task very seriously. This way the public can be assured that no one
is released from prison to our streets that shouldn’t be,” added Mashburn.

A Tahlequah man was taken into custody on a misdemeanor charge, but a
felony was later added when meth was
found in his wallet at the jail.
Jimmy Dale Brown, 21, was charged
Sept. 27 with possession of a CDS and
public intoxication in Cherokee County
District Court.
According to the police affidavit, Patrolman Chance Davis was on routine
patrol Sept. 15 around 1:30 a.m. when
he spotted a vehicle traveling south on
Muskogee Ave. with its headlights off.
He initiated a traffic stop at Fourth and
Muskogee and took the driver, Matthew Hooper, into custody for
driving under the influence. His passenger, Brown, was sitting in
the front seat and admitted to drinking six beers earlier. Davis could
smell the booze coming from Brown, so he placed him under arrest
for public intox.
Both men were transported to the Tahlequah City Jail. While logging them in, a jailer found a small baggie of meth inside Brown’s
wallet. He was then taken to the Cherokee County Detention Center
and booked in for possession of CDS and public intoxication.

Children have a wonderful
capacity for trust. The faith
they put in adults is unqualified, and that should humble us; we
often don’t deserve it.
Sometimes kids suffer from intentional betrayal by a trusted
adult, like former Penn State football coach Jerry Sandusky, recently
convicted of sexually abusing underprivileged young boys. Other
times, they are neglected by society at large, as are the 1.7 million
children with a parent behind bars. Many of these kids face enormous
obstacles, but get little notice.
The Bible affirms that children are a central focus of God.
Our national problem is not that we somehow undervalue children;
it’s that we don’t always know where to look to find the children most
in need of our help. Inmates’ children in particular get placed on
the back burner. They grow up in single-parent homes, or they get
shuffled into foster care. They are five times more likely than their
peers to live in poverty. They often endure confusion, loneliness,
depression, abandonment, social ostracism, and profound anger.
Should we be surprised if they often follow their parents to prison?
It doesn’t take much to ease the burden of an inmate’s family.
Churches—and other people of good will—can incorporate prisoners’
children into their existing programs, like VBS, youth mentoring
programs, or summer camps. They can make sure kids have the
supplies they need to succeed in school, or gifts to celebrate the
holidays; the opportunities are boundless.
If we take seriously the notion that every child has inherent worth
and deserves our society’s nurture and protection, we cannot afford
to ignore children with an incarcerated parent. Like Jesus, we must
reach out to them, and their trust will for once not be betrayed. In
turn we will discover that the blessing goes both ways: They will
teach us what it means to have faith that pleases God, faith that
presses in close, believing everything will be okay.

A Muskogee couple who allegedly murdered two Tahlequah
residents were arraigned Oct. 3 and pled not guilty to charges
before Associate District Judge Mark Dobbins.
Jessie Renee Leppke-Redford, 46, and her husband Tracy
Lee Redford, 43, were both charged with two felony counts of
murder in the first degree- malice aforethought, murder in the
first degree, and robbery with a dangerous weapon.
Last August, Tahlequah Police were called to conduct a welfare check at 106 Louellen. When no one would come to the
door, officers made entry and found the bodies of Angela Findlay and Jesse Catron with significant trauma.
Leppke-Redford allegedly admitted that she killed her sister,
but her husband killed Catron.
The couple is also accused of attempting to rob another man
and stabbing him 11 times in a separate incident earlier that
day.
The couple has been jailed without bond since their arrest
Aug. 16. Their preliminary hearing is set for Nov. 28 at 9 a.m.

Fall is finally here, and with the
arrival of cooler temperatures and
the turning of the leaves, a lot of
people in Oklahoma head to the
woods to enjoy the fall hunting seasons. Every year, thousands of
people enjoy a safe and enjoyable hunting season, and proper safe
firearms handling is a big reason why. I’m going to touch on some of
these safe firearms handling tips, and hopefully, this will help insure
that we all have a safe hunting
season.
First, lets cover the four basic safety rules for firearms handling.
1: Always treat a firearm as if it were loaded! Never make the
assumption that a gun is unloaded, even if you just saw someone
unload it. Many unintentional discharges of firearms are usually
followed by someone saying, “I didn’t think it was loaded”. 2: Never
point a firearm at anyone or anything that you are not willing to kill
or destroy. Good muzzle discipline is a cornerstone of safe firearms
handling. 3: Always keep your finger (primary safety) off the trigger
and outside the trigger guard until you have made a conscious
decision to shoot. It only takes a fraction of a second to get that finger
on the trigger from outside the trigger guard when you have decided
to make a shot, so there is no reason to have your finger on the trigger
until then. 4: Always make positive target identification, be sure of
your backstop and the area around and beyond your target. This
one is pretty is pretty common sense...you shouldn’t be shooting at
anything that you don’t know what it is! Knowing what is around and
behind what you are shooting at is critical, because bullets can travel
a long, long ways, even after hitting your target in some situations. In
addition to these, I would add to keep all mechanical safeties engaged
until ready to shoot, and re-engage them when done.
A common occurrence in the field while hunting is crossing fences.
This can be done safely by handing your weapon to a partner,
crossing the fence, and having him hand both your’s and their’s over
to you before they cross. If alone, simply unload the gun, set it on the
ground, cross the fence, then retrieve the gun...and make sure you
keep the barrel pointed in a safe direction! Speaking of unloading a
gun, it is very important to do so correctly. Once you think you have
all the cartridges out of the weapon, physically and visually check
both the chamber and the magazine to make sure! When loading,
again, make sure your barrel is pointed in a safe direction! Also, if
you are hunting in an elevated stand, don’t climb up or down with a
loaded weapon!
Following these simple steps can be the difference between a
safe, enjoyable hunting experience, or a trip to the hospital or

A former high school coach accused of having sex with a
female student fights to have his case dismissed.
The suspect’s attorney said the state’s age of consent law
is unconstitutional.
The controversial legal fight centers on a state law
banning sexual relationships between students and
school employees.
The former educator accused of breaking that law,
Tyrone Nash, allegedly carried on a sexual relationship
with a female student at Western Heights high school.
Nash asked the court to overturn state law.
Under the current law, it would legal for the judge in the case to have consensual
sex with a 16-year-old girl, but Nash, as a former school employee, may not
have the same right.
That’s why the defense said the law should be unconstitutional.

A Gore man was thrown into jail after he threw a punch at a police
officer behind a local retail shop.
Thomas Larchey, 21, was charged Sept. 25 with aggravated assault and battery upon a police officer in Sequoyah County District
Court.
According to the police affidavit, Gore Police Chief Billy White was
called to the True Value store as back-up by Officer Mark Shamblin
around 9:30 p.m. on Sept. 22. Just as he arrived, he saw Larchey
ball up his fist and cold-cock Shamblin right in the face so hard it
knocked the officer to the ground.
White immediately got out of his patrol car and took Larchey to
the ground. As he was attempting to get the cuffs on him, Larchey
began to struggle and resist, so White had to place him in a wrist lock to get him to comply.
White got the cuffs on and Larchey was transported to the Sequoyah County Jail.
Shortly after Larchey was dropped off at the jail, an officer at the jail called White because
she needed an ambulance for Larchey. She said he was very intoxicated and needed to be
checked out.
Larchey was later admitted into the hospital due to the high levels of alcohol in his system.
Shamblin was also treated at the hospital for a broken nose and a severe cut above his
right eye.
Larchey pled not guilty at his initial appearance. His deposition was set for Oct.
24 at 9 a.m.

A Mulrow man turned himself into authorities after he discovered they discovered
his secret garden behind their mobile home.
David George, 33, was charged Oct. 2 with
cultivation of a controlled substance, possession of a CDS, and possession of drug
paraphernalia.
Sequoyah County Narcotic Investigator
Eric Helms received a search warrant Sept.
25 for an address outside Muldrow on S.
4751 Rd. He was assisted by Deputies Robert Gude, Roger Johnson, Paul Moreland,
and Investigator Greg Peters.
The officers arrived at the George’s around 3 p.m., but no one was
home. They secured the the area and walked behind the trailer along
a beaten path to see if the path led to the suspected marijuana plants.
“As I walked behind the trailer,” Helms wrote in his report, “I could
smell the strong odor of green marijuana lingering in the humid air
of the wooded area.”
Approximately 50 feet behind the trailer, he located the first marijuana plant. It was in a mound of cultivated dirt and appeared to
have been watered regularly. Close by was another area that contained three marijuana plants. About 25-30 feet west of there, he
discovered a second group of marijuana plants, and a little further
on, he found another single marijuana plant, and then further, another marijuana plant.
On the property, the team found a metal storage shed with a loaded .22 caliber rifle inside. Near the storage building were other old
trailers and they found paraphernalia.
The next day, George came into the Sheriff’s Department asking
about the search warrant at his trailer. He said the pipe and set of
scales found were his. He went on to say the .22 rifle was his and he
had it in the storage building because some stray dogs were coming around. He added his wife knew nothing about the marijuana or
paraphernalia.
He was then booked into the Sequoyah County Jail. He pled not
guilty at his initial hearing and his next court date was set for Oct. 24.

A Florida man, believed to be the Bucket
List Bandit, was arrested by the Roland Police Department in Roland September 13 after being pulled over on a routine traffic stop.
Michael Eugene Brewster, 54 was driving a
vehicle reported stolen out of Florida, with an
alleged fictitious Utah license plate. The Roland Police Department is to be commended
for their quick and thorough efforts in this
arrest. Due to their alertness and sound judgment, the arrest was made without incident.
Brewster was dubbed the Bucket List
Bandit because of statements made to bank tellers that he only has
months to live.
Brewster is wanted on an outstanding federal warrant for the robbery of the Huntington National Bank in Erie, Pennsylvania, on
September 10, 2012. Brewster is suspected of robbing as many as 10
banks over the last three months in Arizona, Colorado, Idaho, Utah,
North Carolina, Tennessee, Illinois, Missouri, and Pennsylvania. The
Bucket List Bandit was the focus of a nationwide publicity campaign
by the FBI, which assisted in the identification of Brewster.

Duncan
District Attorney Brian Kuester announced that
Michael Duncan, 52, of Stilwell, was sentenced
August 30 to twenty years imprisonment under
the custody and control of the Oklahoma Department of Corrections with seven years in custody
and the remaining 13 years under supervised probation.
Duncan was charged with Lewd Molestation
wherein the charges alleged that in March of 2012
Duncan, age 52, did touch and feel the body of a 14
year old juvenile female in a lewd and inappropriate manner.
On August 30, Duncan entered a plea of no contest to the allegations and was sentenced pursuant
to a plea agreement with the State to serve seven years in prison followed by
a thirteen year term of probation under the supervision of the State of Oklahoma’s Probation and Parole Office. Pursuant to the plea, Duncan will also be
required to register in accordance with the Oklahoma Sex Offenders Registration Act.
The case was investigated by Josh Smith of the Stilwell Police Department
and Assistant District Attorney Joshua C. King prosecuted the case.

A Muskogee sex offender will be spending the
next 10 years in a federal prison for possessing
child pornography.
Wade Allen Rogers, age 47, of Muskogee, was
sentenced Oct. 10 to 123 months imprisonment,
followed by five years of supervised release, for
possession of certain material involving the sexual exploitation of minors.
The charge arose from an investigation by the
FBI. The defendant was indicted in June 2012
and pled guilty in July 2012.
The indictment alleged that between on or
about April 19, 2011 and June 17, 2011, Rogers, after having been previously convicted of lewd or indecent proposals or acts to a child, an offense
involving sexual abuse of a minor and abusive sexual conduct involving
a minor, did knowingly possess and attempt to possess matters that contained visual depictions and the production of said visual depictions involved the use of a minors engaging in sexually explicit conduct and said
visual depictions were transported in interstate commerce by computer.
Rogers remains in the custody of the United States Marshals Service,
pending transportation to the designated federal prison at which he will
serve his non-parolable sentence.

Deadly Hiccups
Patrick Myers, a 27-year-old South Carolina man was
jailed after he allegedly shot a friend in the face while
trying to cure him of the hiccups.
According to police, Myers and two friends were
watching a football game and drinking at his residence
when one of the men developed a case of the hiccups.
That’s when Myers allegedly grabbed a gun and
pointed it at his friend in an attempt to scare the
“hiccups” out of him.
Investigators say hiccups were the least of his friend’s
worries when the gun that was pointed at his face
suddenly went off. The 22-year-old victim died at the
scene.
Myers told detectives that the shooting was an
accident and that he thought the gun had been loaded
with “dummy rounds.”
Myers was booked into the Bell County Jail and charged with manslaughter.
