Presumed Innocent Until Proven Guilty 5 | NOVEMBER 2018 CHEROKEE COUNTY
Baudel Lopez-Rodriguez, 41, of Woodall, entered a guilty plea to Illegal Alien In Possession
of Firearm and Ammunition,, punishable by not
more than 10 years imprisonment, a fine up to
$250,000, or both.
The Indictment alleged that on or about December 2, 2016, Lopez-Rodriguez, then being an alien
illegally and unlawfully in the United States, did
knowingly possess in and affecting commerce,
firearms and ammunition which had been shipped
and transported in interstate commerce.
The charges arose from an investigation by the
Cherokee County Sheriff’s Office, Immigration
and Customs Enforcement of the Department of
Homeland Security, and the Bureau of Alcohol, Tobacco, Firearms and
Explosives.
The Honorable Steven P. Shreder, U.S. Magistrate Judge in the United
States District Court for the Eastern District of Oklahoma, in Muskogee,
accepted the plea and ordered the completion of a presentence investigation report.

A Wagoner teen was taken into custody
after an observant neighbor reported several
flashlights on the grounds of a rural property
that weren’t supposed to be there.
According to Wagoner County Sheriff’s Office, on October 15, at approximately 8:40
p.m., deputies were dispatched to the area
of 720 Road and South 260 Road in the
Wagoner area in reference to a burglary in
progress. The caller reported that a white
SUV was parked at a residence on South
260 Road that did not belong there. The caller also advised that there were people with
flashlights on the property.
Wagoner County Deputy J. Phorn was the
first deputy to arrive and he observed a white
Toyota SUV in front of a residence. Deputy Phorn could also see suspects
walking around in the residence with flashlights, so he activated his emergency lights and gave commands for the suspects to exit the residence. The
suspects complied, and two male subjects exited the residence with their
hands in the air. The suspects were taken into custody by the deputy without
incident.
The adult male subject arrested was identified as Anthony Whitney, 18, and
confessed to taking property from the residence. The second male subject
was a juvenile.
The Wagoner County Office of Juvenile Affairs was contacted, and the juvenile was released to a guardian.
Anthony Whitney was transported to the Wagoner County Detention Center
and charged with Second Degree Burglary. The victim was contacted and
responded to the scene to take possession of the stolen property recovered
by Wagoner County Deputies.

A South Carolina man was caught rubbing buttered toast all over his
neighbor’s SUV window. Seems like a foolproof plan, how did he get
caught? According to MSN, He just dropped the toast a few feet away
from the car and made his departure, causing a nearby woman to notice and call the police. The police charged the now hungry man with
“malicious damage to property” and estimated the cost of damage to
be about $1.
What’s the hottest you’ve ever been? Temperature-wise of course, because if it was in physical terms, we all know we were the hottest at our
5th grade, bowl-cut, chubs stage. But really, to what extent would you
go to cool off?
Hopefully not so far you’d get arrested, but this is exactly what a group
of four young men in Germany did. On a hot day, they decided to make
their own pool in a car. In a BMW no less. A policeman noticed a very
strange convertible driving down the road. Upon closer viewing, it appeared that the bathing-suit clad men were splashing around in the water-filled car, clearly intoxicated. Though there was no law against driving
around with a pool in someone’s car, they were probably charged for
driving without a permit. Talk about hot water.
What do you guys think about sausage? I suppose it’s better than a
hot dog, which in turn is better than bologna (which is basically giant hot
dog slices?). And no matter what, it has to be better than Lunchables
*shudder*.
No matter your opinion, sausage was a huge disappointment for this
Phoenix man. He attempted to rob two large businesses, first an Ace
Hardware and then a Safeway. He put his hand under his shirt to look
like a gun, but the cashier was not fooled and calmly said “no” to his request for money. Equally unsuccessful was his attempt to rob a Safeway,
which resulted in him being escorted out of the building. He waited a few
minutes before returning into the store to snag a small breakfast sausage
and was therefore charged with shoplifting. I guess all that failing worked
up an appetite.
Sometimes people don’t want their babies. Throughout history, these
people have found convenient ways to get rid of them. In the middle
ages, a popular solution was to leave a swaddled infant on the doorstep
of a misfortunate new parent. Worse for the child, another option was an
orphanage. In later times, parents could even put their kid in the circus
for life. The last one, I’m actually jealous of.
It might not have been this Florida woman’s goal to give away her child,
but that’s sure what it looked like. She had gone shopping at Dillard’s,
and tried to shoplift $260 worth of clothing using her baby stroller. When
a police officer followed her out to her car, she flipped out and eventually threw her baby in its little carseat at him. The baby was not injured.
The shoplifter received three charges, including “resisting a police officer
without violence”. Um. What would be violent, throwing her entire family?

Muldrow Man Sentenced To 70 Months
For Methamphetamine Distribution
Gregory Martin Williams, 57, of Muldrow,
was sentenced to 70 months imprisonment and three years supervised release for
Possession With Intent To Distribute Methamphetamine. The charge arose from an investigation by the District 27 District Attorney’s
Drug Task Force and the Drug Enforcement
Administration.
The Indictment alleged that on or about August 30, 2016, Williams knowingly and intentionally possessed with intent to distribute a
mixture or substance containing a detectable
amount of methamphetamine, a Schedule II
controlled substance.
United States Attorney Brian J. Kuester
said, “Rural Oklahoma is no stranger to the
devastating impact that Methamphetamine
has on people, families and communities. The dealers of this deadly poison
must be held accountable. Thanks to the District 27 Drug and Violent Crime
Task Force and the DEA, prosecutors in this office successfully prosecuted
Williams.”
District Attorney Jack Thorp added, “Cooperation between federal, state,
and local agencies continue to provide excellent results in the administration
of justice. I am thankful for the strong working relationships that we have with
our federal partners as we work together to make Eastern Oklahoma safer.
This investigation and prosecution is a great example of what we can accomplish when we work together.”
The Honorable Ronald A. White, U.S. District Judge in the United States
District Court for the Eastern District of Oklahoma, in Muskogee, presided
over the hearing. Assistant United States Attorney Christopher Wilson represented the United States. The defendant will remain in custody pending
transportation to the designated federal facility at which the non-paroleable
sentence will be served.

A former deputy with the Hamilton County (Kansas) Sheriff’s Department was sentenced October
10 to a year and a day in federal prison for lying
to investigators about a missing machine gun, according to U.S. Attorney Stephan McAllister.
Robert W. Doty, 60, Guymon, pleaded guilty to
one count of lying to a federal investigator. In his
plea, Doty admitted that in March 2018, he was
interviewed by an agent of the Bureau of Alcohol, Tobacco, Firearms and Explosives. The agent
was investigating a report by the Hamilton County
Sheriff’s Office that an Uzi machine gun was missing from its inventory.
Doty told the agent that he had cleaned the machine gun, taken it to the range to shoot it and then returned it to the Sheriff’s office. In fact, Doty did not return the machine gun. He took it to a third
party’s house and left it there.
According to the Kansas Commission on Peace Officers’ Standards
and Training, Doty’s certification as a law enforcement officer has been
revoked.

Jessica Jean Clark, 38, of Stilwell, entered
a guilty plea to Child Neglect In Indian Country,
punishable by up to life imprisonment, up to a
$250,000 fine, or both.
The Indictment alleged that from in or about
June 2017, to September 13, 2017, Jessica Jean
Clark, a/k/a Jessica Jean Kidd, did willfully and
maliciously commit the crime of Child Neglect In
Indian County by failing to provide adequate nurturance, hygiene, sanitation, shelter and medical
care to J.H. and P.H., and provide special care
made necessary by the physical condition of P.H.,
all while the defendant was responsible for the health, safety and welfare
of J.H. and P.H., children under the age of eighteen.
The Honorable Kimberly E. West, U.S. Magistrate Judge in the United
States District Court for the Eastern District of Oklahoma, in Muskogee,
accepted the plea and ordered the completion of a presentence investigation report.

A Muskogee man who allegedly committed
a string of robberies in three different cities
was placed under arrest on October 11.
According to an affidavit, 24-year-old Andrew William Sluder walked into an adult
store in the 2200 block of N. 32nd Street in
Muskogee shortly after 2 p.m. on August 29.
He wasn’t there to buy any toys or any other,
um, forms of entertainment, though. He was
there to get some money. Sluder allegedly
pulled out a gun and told an employee to
hand over the cash. After getting the money,
Sluder left the store.
On September 13, the man went to Check
Into Cash in the 1200 block of N. York at approximately 5:46 p.m. with his gun and once again demanded an employee
give him some money.
Sluder hit up two more places – another Check Into Cash store in Broken
Arrow on October 1 and a gas station in Owasso on October 3 – before he
was arrested.
Officers from Muskogee, Broken Arrow, and Owasso worked together to
stop the robber, according to reports. On October 8, Owasso Police released
surveillance photos of the man to the public. On October 11, Sluder was
placed under arrest and booked into jail.
For the robberies in Muskogee, Sluder is being charged with two counts of
robbery with a weapon. His bond was set T $200,000, and he is scheduled
to appear in court on November 30, 2018. He is expected to be charged with
the robberies in Owasso and Broken Arrow, also.

AG Hunter Calls on the FCC to Adopt New Rules to
Crack Down on Robocalls and Sca m Phone Calls
Attorney General Mike Hunter and a bipartisan coalition of 34 state attorneys general have sent a letter
to the Federal Communications Commission (FCC),
calling on the commission to adopt new rules to allow telephone service providers to block robocalls and
scam phone calls before they reach consumers.
The added authority sought by the attorneys general
will allow service providers to use new technology to
detect and block illegal robocalls – even those coming
from what appear to be legitimate, local phone numbers. Service providers will be ready to launch this new authentication method in
2019.
Attorney General Hunter said the Consumer Protection Unit in his office received
over 4,000 phone calls in the last year regarding phone scams, more than half of
all the calls the unit received.
“Illegal robocalls are irritating and disconcerting, and phone scammers are successfully able to steal personal information, leaving Oklahomans susceptible to
identity theft,” Attorney General Hunter said. “It is time to take more action and give
service providers more tools in order for them to protect consumers from these
scams. I appreciate my colleagues for continuing this fight to protect our families,
neighbors and loved ones across the Unites States. Working together with state
partners, the federal government and law enforcement personnel, we will find a
way to end these calls and give Oklahomans protection and peace of mind.”
In the formal comment sent to the FCC, attorneys general write about the difficulty of enforcement efforts and why more authority needs to be given to service
providers.
“Our respective Consumer Protection Offices receive and respond to tens of
thousands of consumer complaints each year concerning the disruptive and abusive nature of these calls,” the letter reads. “We then attempt to identify and target
potential wrongdoers. However, it is common for our efforts to be frustrated, as
these types of calls travel through a maze of smaller providers. If the calling party is
found at all, he or she is most often located overseas, making enforcement difficult.
Due to the nature of this problem, investigations and enforcement actions cannot
serve as the sole solution.”
Attorneys general also explain how scammers have found ways around the Call
Blocking Order the FCC implemented last year. Despite new authority given to
service providers, which increased their ability to block robocalls, the problem is
still getting worse.
Last year, reports reflect that American landline and wireless subscribers received an estimated 30.5 billion illegal robocalls, up from the 2016 estimate of
29.3 billion calls, attorneys general write. By the end of this year, industry experts
estimate more than 40 billion robocalls to be made to consumers.
First Orion, a tech company that provides phone carriers and their customers
caller ID and call blocking technology, predicts nearly half of all cellphone calls next
year will come from a scammer.
Attorney General Hunter was joined on the comment by the attorneys general
of Arizona, Arkansas, Connecticut, Delaware, District of Columbia, Florida, Illinois,
Indiana, Iowa, Kansas, Louisiana, Maryland, Massachusetts, Minnesota, Mississippi, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico,
New York, North Carolina, North Dakota, Oregon, Pennsylvania, Rhode Island,
Tennessee, Utah, Vermont, Virginia, Washington, Wisconsin and the Hawaii Office

Tips for Parents:
• Be sure to screen babysitters and caregivers. Many states now
have public registries that allow parents to screen individuals for
prior criminal records and sex offenses. Check references with
other families who have used the caregiver or babysitter. Once
you have chosen the caregiver, drop in unexpectedly to see how
your children are doing. Ask your children how the experience
with the caregiver was, and listen carefully to their responses.
• Never leave children unattended in an automobile, whether it
is running or not. Children should never be left unsupervised
or allowed to spend time alone, or with others, in automobiles,
as the potential dangers to their safety outweigh any perceived
convenience or “fun.” Remind children NEVER to hitchhike,
approach a car or engage in a conversation with anyone in a
car who they do not know or trust, or go anywhere with anyone
without getting your permission first.
