Tahlequah Man Sentenced To
60 Months For Arson
John Cole Haeberle, 23, of Tahlequah, was
sentenced to sixty months imprisonment,
and three years of supervised release for Arson. The charges arose from an investigation
by the Cherokee County Sheriff’s Office, the
Tahlequah Fire Department, and the Bureau
of Alcohol, Tobacco, Firearms and Explosives.
The Indictment alleged that from on or
about February 24, 2020, Haeberle maliciously damaged and destroyed, and attempted to damage and destroy, by means of
fire and explosive materials the Garden Walk
Apartments located at 18106 W. 794 Road,
APT 40B, Tahlequah, a building which was
used in any activity affecting interstate commerce.
United States Attorney Brian J. Kuester said, “The defendant’s conduct
had the potential for injuring many people. Although no one was physically
harmed, setting fire to an occupied apartment building is a serious offense.
The diligent efforts of the investigation and prosecution teams that worked
on this case led to the defendant’s quick apprehension, prosecution, and
sentencing. His community is safer with him in a Bureau of Prisons facility.”
“The use of fire to commit arson is one of the most dangerous criminal acts
today. The fact that Mr. Haeberle committed this violent act at an apartment
complex is even more concerning. Thanks to the hard work of the Cherokee
County Sheriff’s Office and the Tahlequah Fire Department, this criminal actor
was caught and brought to justice,” said ATF Special Agent in Charge Jeffrey
C. Boshek II.

OSBI ARRESTS DUNCAN MAN ON MULTIPLE CHILD PORNOGRAPHY CHARGES
DUNCAN, Okla. – On September 22,
Agents from the Oklahoma State Bureau of
Investigation (OSBI), assisted by officers from
the Duncan Police Department, served a
search warrant in the 200 block of North B
Street in Duncan. As a result of the search
warrant, 69-year-old Jeffrey Lee Birst was arrested and faces multiple child pornography
charges.
The case originated in July when the National Center for Missing and Exploited Children (NCMEC) forwarded a cyber tip they received from an electronic service provider to
the OSBI. The OSBI Internet Crimes Against Children (ICAC) Unit opened an
investigation upon receiving the tip. Based on their investigation, Birst was
arrested today without incident and booked into the Stephens County Jail.
Birst is charged with Possession of Child Pornography, Distribution of Child
Pornography and Violation of the Oklahoma Computer Crimes Act.

Two people were taken into custody after deputies stopped a car and the passenger allegedly attempted to go for a gun under his seat.
According to the Wagoner county Sheriff’s Office,
on September 20, at 2:30 a.m., Wagoner County
Deputies M. Smith and T. Fisher initiated a vehicle
stop near the intersection of 193rd East Avenue and
2nd Street in the Catoosa area. Deputies made contact with the female driver, identified as Tanya Gazaway. Additionally, a male passenger in the vehicle
was identified as Ronnie Hutchins. The male passenger was reaching under his seat upon the deputies approach of the vehicle. He did not know Deputy
Fisher was on the passenger side as Deputy Smith
was speaking with Tanya at the driver side window.
The male passenger stopped reaching once he observed Deputy Fisher on his side of the vehicle.
Wagoner County E-911 Dispatch confirmed a
felony NCIC bench warrant for female driver for possession of controlled dangerous substance with intent to distribute. Additionally, she had 2 grams of
meth hidden inside her bra. A search of the vehicle
revealed a loaded 9mm pistol under the passenger
seat where the male was sitting. The gun also came
back confirmed stolen out of Cushing Police Department. Tanya Gazaway
and Ronnie Hutchings were both taken into custody without incident. Both
individuals were transported to the Wagoner County Detention Center and
booked into jail.
Tanya Gazaway was booked for her felony warrant and possession of CDS.
Ronnie Hutchins was jailed for Felon in possession of a firearm and possession of a stolen firearm (AFCF).

A warrant for the arrest of 29-year-old Chancey Tanielle Yandell, of Waldron, Arkansas, led to
the arrest of Yandell and Sallisaw man James
Paul Cripps, 22, after a high-speed pursuit on
September 28.
According to reports, a Sallisaw officer was
advised that Yandell had a federal arrest warrant. He was also told that Yandell had been
hanging out with Cripps, so officers conducted
surveillance on Cripps’ apartment.
Around 10:24 a.m., officers were traveling
south on Walnut when they saw a woman they
believed to be Yandell sitting in the front passenger seat of a silver truck. They followed
the truck as it turned north onto Walnut from
Choctaw.
The driver, later identified as Cripps, took off
at a high rate of speed and took an abrupt turn
through the parking lot of a convenience store
at Maple and Cherokee. The man was traveling
50 mph in a 25 mph zone.
Officers followed the suspect vehicle down
Maple and onto Denton Street, then down
Redwood. They tried to stop the couple, and
Cripps threw the truck in reverse, nearly hitting
a patrol car. He then drove east on Redwood in
excess of 70 mph.
Cripps continued to Rigsby Drive, where he rammed through two wooden fences. Officers eventually found the vehicle wrecked in a ditch parallel
to Redwood Street. The suspects fled the scene on foot.
Officers found Cripps and Yandell near some houses on Sam Ed Bush
Drive and Byrd Street.
Officers also learned that the truck the couple had been traveling in was
registered as stolen out of Fort Smith, Arkansas.
In the truck, officers found a sawed-off shotgun.,
Cripps is being charged with possession of firearms after conviction or
during probation, possession of sawed-off shotgun/rifle, endangering others while eluding/attempting to elude police officers, possession of stolen vehicle and knowingly receiving or concealing stolen property. He is
scheduled to appear in court on November 4.
Yandell is being charged with possession of firearm after former felony
conviction, possession of sawed-off shotgun/rifle and resisting arrest. She
is scheduled to appear in court on November 18, 2020.

Billy Ray Flynn (Abbott), 66, of Stilwell, entered
a guilty plea on September 21 in federal court to
Aggravated Sexual Abuse In Indian Country. The
crime is punishable by not more than life imprisonment, a fine up to $250,000, or both.
The Indictment alleged that on or about January 31, 2020, in Indian Country, the defendant, an
Indian, did knowingly use force against the victim
to engage in a sexual act against her will.
The charges arose from an investigation by the
Cherokee Nation Marshal Service and the Federal
Bureau of Investigation.
The Honorable Kimberly E. West, U.S. Magistrate Judge in the United States District Court for
the Eastern District of Oklahoma, in Muskogee, accepted the plea and
ordered the completion of a presentence investigation report.

Fort Gibson man Levi Austin Nance, 19, allegedly robbed a Game X Change employee at knifepoint on October 7.
Reports state that the victim told police Nance
went into his place of employment in the 600
block of W. Shawnee Bypass, took out a knife and
demanded money from the registers.
The victim handed over the cash, and Nance
left the location. The victim watched Nance leave
in a silver truck.
A witness told police he saw Nance leave the
store with a big wad of cash in his hands.
Officers located Nance just a few minutes after
the robbery in the parking lot of Arrowhead Mall
and placed him under arrest.
Nance is being charged with robbery with a weapon. His bond was set
at $250,000, and he is scheduled to appear in court on October 23, 2020.
