The Oklahoma State Bureau of Investigation has
completed a preliminary report on the 2012 Index Crime
Trends. This report looks at
seven crimes the FBI considers serious. The FBI defines
“serious” as ones that would
occur regardless of geographical location, likely reported to
law enforcement, would affront the moral sensitivities of
our society’s rational being, and would occur with sufficient frequency so that counting it would be worthwhile statistically.
The preliminary report tracks murder, rape, robbery, and aggravated assault as violent crimes. It also studies burglary, larceny, and
auto theft as non-violent crimes. In 2012, as compared to statistics
from the previous year, reported rapes have shown a significant increase. Reported rapes increased nearly 15% from 2011. Aggravated
assault increased by nearly 4%, whereas the number of murders remained steady at 219, and robberies decreased. In the non-violent
crime category, auto theft increased by 4.8%, larceny increased by
2.9%, and the number of burglaries in the state decreased by more
than 2%.
More than 300 sheriff’s offices and police departments across the
state participated in this state-mandated program. This crime report
is helpful to law enforcement to track trends and, therefore, assign
more manpower to areas showing increases. It also aids departments
applying for grants and other funding sources to combat increases in
specific areas of crime.
The full 2012 Oklahoma Uniform Crime Report is not complete. It
should be ready for publication in the next few months. OSBI UCR

Schneider Charged with
Murder in Maher Homicide
First degree murder, first degree
arson, and larceny from the home
charges have been filed in Cherokee
County against Joshua Schneider,
33, in relation to the homicide of
Tiffany Maher.
Maher’s body was found inside
her Tahlequah home May 31st. Several fires were intentionally set inside the house.
Schneider pawned and sold items
stolen from Maher’s home. Agents
believe Schneider and Maher met
through a dating website.
Schneider and his girlfriend,
Heather Black, ran from police in
Tulsa when agents attempted to serve felony warrants for his arrest
more than a week ago. They left Schneider’s two-year-old daughter
inside the car as they fled the area on foot. The warrants included
false declaration of ownership in pawn and failure to register as a
sex offender. Schneider and Black were found July 27 in south Tulsa.

David Magnan
David Magnan, 50, who admitted to
intentionally killing 2 women, a man, and
injuring another, was granted a release in
June on a court’s order due to a technicality.
Magnan pled guilty in Seminole County
District Court to three counts of 1st-degree
murder and one count of shooting with
intent to kill on March 3, 2004. He was
sentenced to death by lethal injection.
But Magnan’s conviction was overturned
by the 10th US Circuit Court of Appeals
after it was determined the triple homicide
had taken place on an Indian reservation
- offi cial Native American land where the
state technically has no authority or jurisdiction.
Only federal and tribal laws have prosecutorial authority on reservation
territory - providing a legal loophole in this case.
Therefore, Magnan, a member the Fort Peck Assiniboine and Sioux
tribes, was removed from death row at the Oklahoma State Penitentiary
in McAlester, where he’d been for nearly 10 years.
The judgment came with the presumption that federal authorities will
intercede and re-arrest and prosecute Magnan, given the homicidal
nature of the crimes and admitted guilt in the triple murder and
wounding of other members of the Seminole Nation.
If he is ever tried federally though, it’s likely Magnan will not face the
death penalty as it is rarely imposed in federal courts.
The killings occurred in 2004 inside an inherited Seminole residence,
where family and friends had gathered to celebrate a birthday. Magnan
drove to the home with two other men, where he shot and injured Eric
Coley who’d come outside to speak to him.
Court records state Magnan then entered the house, noticed James
Howard, said “goodbye,” and shot him.
Karen Wolf and Lucilla McGirt were also shot. Lucilla died from
complications stemming from her gunshot wound two weeks later.

decided to call everyone who stated the obvious

favorite “examples of the public school system in

Prosecutors have filed
charges against three people
after Tulsa Police found
three children living in filth.
Matthew Prior and Angela
Prior each face one count of
child neglect.
Police went to their home in
the 1200 block of North 76th
East Avenue on Tuesday,
August 6, 2013 on a welfare
check.
According to a Tulsa Police report, officers found the couple’s three children in a filthy
home, with cockroaches, rotting food and feces on the floor.
Prosecutors also charged the children’s grandmother with child neglect. According to
investigators, Janet Marie Friend, 57, is the primary caregiver of three children -- ages 5, 3
and 2.
The children were removed in February because of the filth but were returned in May.
All three are in the Tulsa County jail with bonds of more than $150,000 each. The children
are in DHS custody.

Meth lab found at
Muldrow residence
A meth lab was discovered at
a Muldrow residence after police
received information of contraband items being harbored at the
residence.
On July 16, deputies with the
Sequoyah County Sheriff’s Department visited the residence to
investigate the claims. The owner
of the home, 41-year-old Dianna
R. Gates, met police in her driveway. According to the affidavit,
police noticed smoke coming from
behind the residence and the odor
of burning plastic.
There was loud music playing
outside the door of the residence,
a single-wide trailer, and police asked Gates to turn it off. She went
into the trailer and shut the door abruptly behind her. She turned off
the music and shut a window at the end of the home.
Police asked Gates what she was burning and she told them trash.
The deputies told Gates that they had information she may be in
possession of stolen property; she showed them an air conditioning
unit in the window of her trailer and said that a man had given her
the unit, but she didn’t know where it had come from.
Police also told the woman that they had information about a meth
lab being inside her bathroom. She denied the claim, then admitted
to having “something I shouldn’t.” She told police that there was a
meth lab in her bathroom that had been dropped off a couple days
before by a friend.
Gates told police that she was going inside to get a cigarette; police told her not to, but she asserted that she was going in and they
couldn’t stop her. Police placed Gates under arrest, but she refused
to give them her hand and kept resisting arrest. She was finally
handcuffed and placed into the patrol car.
Police searched the home and found syringes, scales and white
residue that tested positive for methamphetamine throughout the
home.
Police spoke to Gates two days later and she said she had been
buying pseudo-ephedrine for her friend and he would use it to cook
meth. She admitted to burning plastic bottles from the meth lab in
the fire behind her home.
Gates is being charged with endeavoring to manufacture controlled dangerous substances, unlawful possession of controlled
drugs and resisting an officer. Her bond was set at $10,000 and she
is scheduled to appear in court on Sept. 25, 2013.

FITTING IN
Do your kids ever fret over the
fact that they “don’t fit in”? We all
feel this way at some point in our
lives. Being alone in a room full of
people is a scary thing. We all want
to belong; to fit in. It’s beyond
instinctive, it gives us the feeling
of safety and security–no matter
what our age. So, when our kids tell us that they don’t fit in, what
they could be saying is, “I’m scared because I don’t feel safe”.
Some kids really have a tough time fitting in for a variety of
reasons. Some kids are socially awkward, and don’t know how
to start a conversation with a peer. If your child struggles with a
physical or learning disability, chances are he/she feels isolated
from the rest of the class anyway. Whatever the reason is, simply
telling them that they really DO fit in, is not as helpful as you’d
expect.
Using God’s Word to Encourage Our Children
Being a Christian parent doesn’t make dealing with these tough
situations easier. But we DO have a resource to back up what we
tell our kids, and that’s God’s Word. When we actively listen to
the pain of our children feeling like they don’t belong or fit in, we
can do more than coach them in social skills (which may be a very
important tool). We can use God’s Word to encourage them even
in these struggles.
Psalm 139:14 I praise you, for I am fearfully and
wonderfully made. Wonderful are your works; my soul
knows it very well.
I’ve found the world’s solutions to the many painful aspects of
not fitting in, being teased, or feeling isolated, are superficial at
best and not helpful at all. I mean, sticks and stones may definitely
break my bones–but words really CAN and DO hurt me!
Instead we must remind our children that God, who created
them and therefore knows every nuance of them, has a specific
plan and purpose for their lives. That HE thinks they are wonderful
and worthy of love AND friendship.

A Van, Buren, Ark.,
woman and Sallisaw man were arrested after they were
caught burglarizing a
Muldrow residence.
According to the affidavit, a man called
the Sequoyah’s Sheriff’s Department on
July 18 and told them
that he had found
two subjects, a male
and a female, burglarizing his mother’s residence.
The man told police that when he had approached the subjects,
the male subject, 53-year-old Kelly Wayne King, became angry and
walked toward him. The man said he hit King in his face.
King agreed to wait with the man until police showed up, but the
female subject left the residence on foot. King told police that a man
had told him he could take items from the residence. He added that
he didn’t break into the home, but the man that told him he could
take the items had let him in.
Police could smell alcohol on King’s person and breath. He admitted to taking items from the residence and police placed him under
arrest.
There were new sinks and faucets in the back of King’s truck that
were identified to have come from inside the home.
The female subject, Lisa Caroll Bibby, 47, was apprehended and
brought back to the residence. She agreed to speak with police and
told them that King had told her they were going to get some items
from the residence.
Bibby and King were placed under arrest and transported to the
Sequoyah County Jail.
They are both being charged with burglary in the second degree
their bonds were each set at $50,000. The burglarizing duo is scheduled to appear in court on Sept. 25, 2013.

$3,000 reward for information
leading to the arrest and
conviction of Dawaylon “Hog”
Rainey. Rainey shot and killed
two people August 4th inside a
Hugo apartment complex.
Witnesses inside the apartment
tell investigators Rainey walked
into the apartment and began
fi ring shots. Floyd Devin Clegg
and Qualin Hayden were rushed
to an area hospital where doctors
pronounced them dead.
U.S. Marshals agents, Hugo
police offi cers, and OSBI agents
have been searching for Rainey
since August 5th – the day after

Watkins sentenced
A Stilwell woman now has a lot of time on her hands to
think about her crimes.
Teena Watkins, 43, was sentenced July 31 to a ten year
prison sentence for being in possession of methamphetamine, possessing a firearm while being a convicted felon,
and introducing or bringing contraband into the Adair
County Jail.
Court documents indicate Watkins was stopped while
traveling in Adair County based on a felony warrant for her
arrest which resulted in Adair County Deputy Brad Baker
locating a loaded firearm in her waistband and multiple
items of drug paraphernalia and methamphetamine within
the vehicle.
Watkins, who had previously been convicted of multiple
felony offenses, entered into a plea agreement with the State
of Oklahoma whereby she was sentenced to a term of imprisonment of ten years on the
charges of possession of methamphetamine and possession of a firearm after felony conviction.
Additionally, Watkins sentences will be set for judicial review in one year.

Pets seldom catch much press as
it relates to vehicles, but we have
our pets in our vehicles all the
time. To many, they are a part of the family, and go with us on trips,
to run errands around town, or just out for a ride. Just as we treat
them as part of the family, we have a responsibility to them, including doing everything we can to keep them safe while in our vehicles.
This summer, we have been very fortunate in the temperature department! Only a few days so far have hit triple digits, we’ve had
pretty good rain, and it has been nice. With the temperatures lower
than they have been in the last few years at this time...it could be
easy to forget that as long as the sun is shining, the temperature inside a parked car can still rise to dangerous levels. Leaving a pet in
the vehicle for as little as 15 minutes can end up having tragic consequences. Even when the outside temps are in the 70’s, the temperatures in a closed up vehicle can reach the 90’s or higher. The best
solution is to leave your pet at home. If that is just not possible, or
you choose not to, make sure that your pet has water, and leave the
vehicle running with the air conditioning on. Make sure you don’t
leave your pet for long, because the AC could go out, and then your
pet is stuck in a vehicle that is hot, and is also blowing hot air!
Many people let their dogs ride in the bed of their pickup. We’ve
all seen those dogs with their face into the wind, riding in the back
of the pickup. Please remember that the bed of those pickups are
metal, and even if they are covered by a bed liner or similar product, the temperature can heat up the bed so hot as to be extremely
painful to your pet’s paws! Again, best solution is to leave the pet at
home, but if take them with
you, use a kennel or crate. This keeps the pet up off the hot bed
of the pickup, and also eliminates the possibility of the pet jumping
out, or even the potential of biting someone who gets too close to
the truck!
Speaking of crates, they aren’t a bad idea for inside the cab either.
Ever see a dog in the lap of a driver? Obviously this is not safe, the
pet can distract the driver, or even interfere with the safe operation of the vehicle. This puts everyone at risk, so if you are going to
travel with your pet, make sure they don’t contribute to an accident,
and keep them out of the driver’s area!

Three awaiting
sentencing
Stormy Lynn Reinsimer, 30, of Tulsa,
Jeremy Allen Carney, a/k/a “Sparkles”, 31
and Linda Jean Faries, 31, both of Muskogee, have pled guilty to Drug Conspiracy
in district federal court.
Charges arose from an investigation by
the Muskogee Police Department and the
Drug Enforcement Administration and
were indicted in June, 2013.
The Indictment alleged that beginning in
or about November 2012, the exact date being unknown to the Grand Jury, and continuing until on or about April 12, 2013,
the defendants, did willfully and knowingly combine, conspire, confederate and
agree together, and with others known and
unknown to the Grand Jury, to knowingly
and intentionally possess with intent to distribute and distribute 500 grams or more
of a mixture or substance containing a detectable amount of methamphetamine, a
Schedule II controlled substance.
Eastern US District Magistrate Judge
Kimberly E. West accepted the guilty pleas
and ordered the completion of presentence
reports. Sentencings will be scheduled following their completions. The defendants
will remain in the custody of the United
States Marshal Service pending sentencing.
The statutory range of punishment is not
less than 10 years imprisonment or more
than life and/or up to $10,000,000 in fines.

A South Carolina man was caught rubbing
buttered toast all over his neighbor’s SUV
window. Seems like a foolproof plan, how did
he get caught? According to MSN, He just
dropped the toast a few feet away from the
car and made his departure, causing a nearby
woman to notice and call the police. The police charged the now hungry man with “malicious damage to property” and estimated the
cost of damage to be about $1.
What’s the hottest you’ve ever been? Temperature-wise of course, because if it was in
physical terms, we all know we were the hottest at our 5th grade, bowl-cut, chubs stage.
But really, to what extent would you go to cool
off ?
Hopefully not so far you’d get arrested, but
this is exactly what a group of four young men
in Germany did. On a hot day, they decided to
make their own pool in a car. In a BMW no
less. A policeman noticed a very strange convertible driving down the road. Upon closer
viewing, it appeared that the bathing-suit
clad men were splashing around in the waterfi lled car, clearly intoxicated. Though there
was no law against driving around with a pool
in someone’s car, they were probably charged
for driving without a permit. Talk about hot
water.
What do you guys think about sausage? I
suppose it’s better than a hot dog, which in
turn is better than bologna (which is basically
giant hot dog slices?). And no matter what, it
has to be better than Lunchables *shudder*.
No matter your opinion, sausage was a
huge disappointment for this Phoenix man.
He attempted to rob two large businesses,
fi rst an Ace Hardware and then a Safeway. He
put his hand under his shirt to look like a gun,
but the cashier was not fooled and calmly said
“no” to his request for money. Equally unsuccessful was his attempt to rob a Safeway,
which resulted in him being escorted out of
the building. He waited a few minutes before
returning into the store to snag a small breakfast sausage and was therefore charged with
shoplifting. I guess all that failing worked up
an appetite.
