MURDER AND MARIJUANA
An Altus teen was taken into custody on murder charges after he
was found halfway across the state in Pottawatomie County.
Zachary Dale Soderlund, 18, of Altus, was charged April 13 with
murder in the fi rst degree-deliberate intent, and burglary in the
fi rst degree, in Jackson County District Court.
According to an Altus Police Department press release, the
investigation into the hit and run fatality in the early-morning
hours on April 4 of Robert Adams led investigators to focus on a
separate vehicle involved. Investigators soon excluded the vehicle
that was seized April 5 in Snyder as the suspect vehicle.
On April 8, the investigation led Altus Police and agents of the
District III Drug & Violent Crimes Task
Force to Pottawatomie County.
Soderlund was taken into custody
and transported back to Altus.
Investigators believe Soderlund
was the driver of the vehicle that
killed Robert Adams. Soderlund’s
vehicle was seized as evidence.
After the hit and run, evidence
shows Soderlund burglarized
a local medical marijuana
dispensary.
Soderlund is being held at the
Jackson County Jail on a $1M bond
for the murder charge, and $35,000 on
the burglary charge. His preliminary
hearing conference is set for
May 20 at 1:15 p.m.

LAWTON MAN CONVICTED OF BANK
ROBBERY INVOLVING A FAKE BOMB
On April 15, a federal jury in Oklahoma City
found John Scott Brooks, of Lawton, guilty
of bank robbery involving a fake bomb, announced Acting U.S. Attorney Robert J. Troester.
According to evidence at trial, on March 23,
2020, Brooks pulled up to the drive-through
teller lane at the Southwest Oklahoma Federal Credit Union located at 6714 West Gore
Boulevard, Lawton, Oklahoma, and placed
a fake bomb in the teller drawer. He immediately showed the teller a timer, which was
counting down. Brooks then attempted to
get away with the robbery by altering the appearance of his vehicle, creating a cover story, and erasing electronic information from his
cell phone. Evidence at trial included bank surveillance footage of the robbery,
a bank robbery list found at Brooks’ residence, and a vehicle image comparison analysis performed by an FBI forensic examiner. Multiple witnesses testified that they recognized Brooks in the still photo of the surveillance footage
taken from the robbery.
The trial lasted two days and the jury deliberated approximately two hours
before finding Brooks guilty of one count of bank robbery. He was acquitted
on a count of making a bomb threat.
At sentencing, Brooks faces up to twenty-five years in prison, three years of
supervised release, a fine of $250,000, and mandatory restitution. Sentencing will take place in approximately 90 days. Mr. Brooks has been in custody
since his arrest on April 2, 2020.
This case is the result of an investigation by the Federal Bureau Investigation’s Oklahoma City Field Office and the Lawton Police Department. Assistant U.S. Attorneys Wilson D. McGarry and Stan West prosecuted the case.

FORMER TRIBAL EMPLOYEE SENTENCED TO SERVE FIVE
YEARS OF PROBATION FOR EMBEZZLEMENT AND THEFT
On April 15, Cayle Leigh Klinekole, 48, of
Elgin, was sentenced to serve five years of
probation for embezzlement and theft from
an Indian tribal organization, announced
Acting U.S. Attorney Robert J. Troester.
On October 30, 2020 Klinekole pleaded
guilty to a single-count felony Indictment
charging her with embezzlement and theft
from an Indian tribal organization.
According to court documents and public
record, Klinekole worked at the Kiowa, Comanche, and Apache Intertribal Land Use
Committee (“KCA”) as the Executive Director from 2016 to 2017. The KCA is a designated representative body of each
of the three tribes authorized to manage and conduct business regarding
jointly owned lands. During the time of her employment, Klinekole stole funds
by forging checks, entering into labor agreements with companies without
proper authorization, and making unauthorized purchases on credit accounts
at different vendors.
On April 15, 2021, U.S. District Judge Charles Goodwin sentenced
Klinekole to serve 5 years of probation, including home confinement for the
first year, and 50 hours of community service. Judge Goodwin also ordered
Klinekole to pay $194,573.18 in restitution to the Kiowa, Comanche, and
Apache Intertribal Land Use Committee. In announcing the sentence, Judge
Goodwin noted the nature and circumstances of the offense and the need for
the sentence to reflect the seriousness of the offense.

40 Violent Crime Cases Include 22 Murder, Four Manslaughter, and Six Sexual Abuse Involving Minors Cases
The United States Attorney’s Office for the Eastern
District of Oklahoma announced at the end of March
it has filed forty violent crime in Indian Country cases
since the March 11, 2021, Oklahoma Court of Criminal
Appeals opinions in Bosse v. Oklahoma and Hogner
v. Oklahoma. The cases include twenty-two murders,
four manslaughters, and six sexual abuse offenses involving minor victims.
“Our goal has been and will continue to be protecting the people of the Eastern District of Oklahoma by
focusing all of our available resources on ensuring that
violent offenders are transitioned from state custody to federal custody to be tried
for the violent crimes they have been charged with committing,” said Acting United
States Attorney Christopher J. Wilson. “Our staff has been working many long
and stress-filled hours reviewing law enforcement reports and preparing charging
documents. The logistics of handling this volume of cases has been challenging
and has required the cooperation of District Attorney Offices, Sheriff Offices, the
Federal Bureau of Investigation, the United States Marshals Service, and the Oklahoma Department of Corrections.”
Many of the recent federal charges filed by the Eastern District of Oklahoma involve defendants previously convicted in state court. The Supreme Court decision
in McGirt v. Oklahoma and the recent Oklahoma Court of Criminal Appeals rulings
in Bosse and Hogner held that Congress never disestablished the reservations of
the Muscogee (Creek) Nation, Chickasaw Nation and the Cherokee Nation, and
the State of Oklahoma lacked jurisdiction to prosecute major crimes involving Native Americans occurring on these reservation lands. Based on these rulings, many
state convictions have and will be vacated. It will be the responsibility of the federal
government and/or tribal governments to prosecute the offenders. It is anticipated
additional decisions impacting the Choctaw and Seminole Nations will be issued
by the Oklahoma Court of Criminal Appeals in the coming days.
“As I stated when the recent Hogner and Bosse opinions came down, the Eastern District U.S. Attorney’s Office has been identifying cases of violent offenders
currently in custody within the areas of the Cherokee and Chickasaw reservations
which could be impacted by a change in Indian Country jurisdiction. The collective
efforts of our state, local, tribal, and federal partners have enabled our office to
have federal charges in place to avoid these violent offenders from being released
from custody. The forty cases filed to date are only the beginning. We are reviewing and making charging decisions on additional cases daily. In addition, we have
already discovered approximately 150 violent offender cases in the Choctaw and
Seminole areas over which we anticipate assuming federal criminal jurisdiction if
the OCCA renders similar rulings,” said Wilson.
“I am keenly aware of the hardship the jurisdictional change has placed on so
many victims,” said Wilson. “As the previous state convictions are being vacated
for lack of jurisdiction, victims and victim families are being forced to relive the entire process. We are committed to assisting the victims of these violent crimes as
their cases navigate through the federal criminal justice system.”
A criminal complaint does not constitute evidence of guilt. A criminal complaint
is only a method of bringing formal charges against a defendant. A defendant is
presumed innocent of the charges and may not be found guilty unless evidence
establishes guilt beyond a reasonable doubt.

A South Carolina man was caught rubbing buttered toast all over his
neighbor’s SUV window. Seems like a foolproof plan, how did he get
caught? According to MSN, He just dropped the toast a few feet away
from the car and made his departure, causing a nearby woman to notice and call the police. The police charged the now hungry man with
“malicious damage to property” and estimated the cost of damage to
be about $1.
What’s the hottest you’ve ever been? Temperature-wise of course, because if it was in physical terms, we all know we were the hottest at our
5th grade, bowl-cut, chubs stage. But really, to what extent would you
go to cool off ?
Hopefully not so far you’d get arrested, but this is exactly what a group
of four young men in Germany did. On a hot day, they decided to make
their own pool in a car. In a BMW no less. A policeman noticed a very
strange convertible driving down the road. Upon closer viewing, it appeared that the bathing-suit clad men were splashing around in the water-fi lled car, clearly intoxicated. Though there was no law against driving
around with a pool in someone’s car, they were probably charged for
driving without a permit. Talk about hot water.
What do you guys think about sausage? I suppose it’s better than a
hot dog, which in turn is better than bologna (which is basically giant hot
dog slices?). And no matter what, it has to be better than Lunchables
*shudder*.
No matter your opinion, sausage was a huge disappointment for this
Phoenix man. He attempted to rob two large businesses, fi rst an Ace
Hardware and then a Safeway. He put his hand under his shirt to look
like a gun, but the cashier was not fooled and calmly said “no” to his request for money. Equally unsuccessful was his attempt to rob a Safeway,
which resulted in him being escorted out of the building. He waited a few
minutes before returning into the store to snag a small breakfast sausage
and was therefore charged with shoplifting. I guess all that failing worked
up an appetite.
Sometimes people don’t want their babies. Throughout history, these
people have found convenient ways to get rid of them. In the middle
ages, a popular solution was to leave a swaddled infant on the doorstep
of a misfortunate new parent. Worse for the child, another option was an
orphanage. In later times, parents could even put their kid in the circus
for life. The last one, I’m actually jealous of.
It might not have been this Florida woman’s goal to give away her child,
but that’s sure what it looked like. She had gone shopping at Dillard’s,
and tried to shoplift $260 worth of clothing using her baby stroller. When
a police offi cer followed her out to her car, she fl ipped out and eventually threw her baby in its little carseat at him. The baby was not injured.
The shoplifter received three charges, including “resisting a police offi cer
without violence”. Um. What would be violent, throwing her entire family?

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

TEEN CHARGED WITH FIRST-DEGREE MURDER
An 18-year-old Duncan man is facing charges of murder in the first degree with deliberate
intent and robbery with a dangerous weapon
after he allegedly killed a 19-year-old man on
April 27.
Samuel Varela, Jr., allegedly told police that
he shot the victim because the man had disrespected his dead grandmother.
According to reports, a convenience store
employee reported an attempted robbery at a
store in the 1200 block of W. Bois D’Arc shortly
after 3 a.m. The employee called said a man
who had a handgun in his pocket tried to rob
the store.
Officers went to the store, but they were unable to immediately locate
the suspect. The employee told them that the suspect entered the store
and told the employee to give him cash. When the employee didn’t hand
over the money, the man allegedly pulled a black pistol out of his hoodie
pocket. The employee yelled for his manager. The suspect then said “never mind” and left the store.
Duncan officers went to a nearby store at 9th and Bois D’Arc to check
on the employees at approximately 3:31 a.m. They found the victim lying
facedown on the floor. He was already deceased when they arrived.
Law enforcement agencies visited other convenience stores in the area
to warn them about what was going on.
Employees at a store at Second and Main told them that a man matching the description of the suspect had been in the store multiple times
that night. Surveillance footage from the store where the victim was found
showed a man, identified as Varela, knocking on the store’s drive-thru window at 3:20 a.m. When the victim opened the window, Varela pulled out a
gun and shot at the victim. He then headed northbound on foot.
Officers detained him at the store and Second and Main.
Reports state Varela admitted to using a 9mm handgun to shoot the victim three times. He wouldn’t tell police where the murder weapon was. He
said the victim had disrespected his dead grandmother earlier that night,
so he shot him due to the disrespect.
The medical examiner determined that there were two gunshot wounds
to the victim, according to the probable cause affidavit.
Varela was arrested on complaints of murder in the first degree with
deliberate intent and attempted robbery with a dangerous weapon. Bond
information and court date were unavailable at time of publication.

Cpl. Kyle Davis, a deputy with the Washington County Sheriff ’s
Department, became involved in an altercation on March
25 with a violent inmate that was arrested on a warrant.
He was killed by the suspect in the line of duty.
An investigation into the incident is being conducted by
the Oklahoma State Bureau of Investigation, the District
Attorney’s Offi ce, the Washington County Sheriff ’s Offi ce,
and the Bartlesville Police Department.
The suspect was arrested as a result of an ongoing
investigation by the Bartlesville Police Department
and Oklahoma Bureau of Narcotics and Dangerous
Drugs. Seventeen individuals were arrested on
March 25 between 6 a.m. and 9 a.m.
The suspect was uncooperative and aggressive toward detention staff at the
Washington County Detention Center.
During a physical altercation between the suspect and staff members, a deputy
sheriff was injured and transported to the hospital, where he succumbed to his
injuries.
The OSBI, BPD and the 11th Judicial District Attorney’s Offi ce are working
together to investigate the deputy’s death.
As of press time, the name of the suspect involved in the death of the deputy
has not been released and no charges have been fi led.
