Two plead guilty
to drug charges
Two Comanche County residents are facing
lengthy prison sentences after they pled guilty to
drug charges.
John Peter McDonald, 35, of Elgin, pled guilty
Oct. 1 to manufacturing methamphetamine and
Verna Marie Mihecoby, 29, of Fletcher, pled guilty
to maintaining a premises for manufacturing
methamphetamine in Comanche County, within
Indian country, announced Sanford C. Coats,
United States Attorney for the Western District of
Oklahoma.
McDonald and Mihecoby were indicted on July
10, 2012.
At their plea hearings, McDonald admitted that he manufactured methamphetamine on April 25, 2012, in Comanche County. Mihecoby admitted
that she allowed McDonald to engage in the manufacture of methamphetamine on the property where she resided.
At sentencing, McDonald faces up to 40 years in federal prison and a $5
million fine. Mihecoby faces up to 20 years in federal prison and a $500,000
fine. A sentencing date will be set by the Court in approximately 90 days.
The case is the result of an investigation conducted by the Bureau of Indian
Affairs and the Comanche Nation Tribal Police.

More than a can of beer
A Sterling man was taken into custody in Carnegie after an officer found
more than just a beer in his car during
a traffic stop.
William McIver, 55, was charged
Oct. 25 with possession of meth after
two or more felony convictions.
According to the police affidavit,
Carnegie Police Officer Martin Frank
received a call from dispatch in reference to a possible drunk driver in a
purple Grand Prix coming into town
from the south on Highway 58. He
quickly located a vehicle matching
the description and found the driver, later identified as McIver, not
wearing his seatbelt. Frank then turned on his emergency lights and
McIver pulled over.
Frank made contact with McIver and smelled a slight odor of alcohol on his breath. Frank asked McIver if he had anything to drink
and he told Frank he only had one beer. Frank asked McIver to step
out of the vehicle, which he did, and if he had any open beer in his
vehicle, which he said no.
While Frank was writing out a citation for McIver, Frank couldn’t
help to notice that McIver was acting very nervous. He then asked
McIver if he could search his car, to which he confessed he had a
open beer in the front driver side under the seat.
When Frank searched the vehicle, he found six syringes- three of
them had a liquid substance in them, and three spoons- two of which
had a clear substance on them, and one had some cotton and clear
substance on it. He also found a little jar with a plastic baggy in it
that had a crystal-like substance inside, a pill bottle that was labeled
Alprazolam with his wife’s name on it with eight pills inside.
McIver was placed under arrest and transported to the Carnegie
jail facility were he was booked in. His bond was set at $15,000.

June 6, 1998, 16-year-old Dena
Dean left the Marvin’s Food
Store located in the Town West
shopping center in Tulsa. Dean
was never heard from again.
Dean’s vehicle was discovered
in the parking lot of the Marvin’s
Food Store. Almost a week later,
her body was found in a wooded
area a few miles away near
Berryhill.
No has been arrested in the case.

Anadarko woman sentenced
on drug charges
Norma Jean Lone Lodge, 26, of
Anadarko, was sentenced Oct. 26 by
United States District Judge David L.
Russell to serve 36 months in prison for
conspiracy to distribute methamphetamine, distribution of methamphetamine and maintaining a drug premises in Caddo County, announced Sanford C. Coats, United States Attorney
for the Western District of Oklahoma.
According to Court records, from
March 27 through May 1, 2012, Lone
Lodge and Craig Hal Nenaikita, 24,
from Oklahoma City, used a house at
30151 U.S. Highway 271, located north
of Anadarko, to receive, store, and distribute methamphetamine.
During the course of the conspiracy, Lone Lodge and Nenaikita sold
methamphetamine on multiple occasions to an informant.
The pair were indicted on July 10, 2012.
On August 30, 2012, Lone Lodge pled guilty to conspiracy to distribute methamphetamine, distribution of methamphetamine and
maintaining a drug premises. Previously, on July 25, 2012, Lone
Lodge was released to the Carver Center in Oklahoma City to complete residential drug treatment while awaiting sentencing and ordered to refrain from any use of drugs. During her stay at the Carver
Center, Lone Lodge tested positive for K2, a synthetic drug, during
a random urine analysis. Lone Lodge’s use of K2 violated the terms
of her supervision, resulting in a higher sentencing guideline range.
At the sentencing hearing, Judge Russell took into consideration
her use of this controlled substance when he sentence her to serve
36 months in federal prison, followed by three years of supervised
release when her prison terms ends.
On August 30, 2012, Nenaikita pled guilty to conspiracy to distribute methamphetamine and distribution of methamphetamine. Nenaikita awaits sentencing.

The Oklahoma District Attorneys Association
encourages defeat of State Question 762, which
would remove the Governor from the pardon and
parole process on non-violent offenders. Recent
recommendations of the Parole Board relating to
early release of inmates have prompted the Association to call for a comprehensive review of
the early release process.
In the past several months, District Attorneys
have discovered serious issues with the way the
Parole Board is handling paroles. Recent consideration of an 85% inmate after serving only 4
years of a 10 year sentence raised serious questions about the recommendations. Crime victims have been told that offenders serving time
for 85% crimes (crimes involving violence) will have to serve at least 85% of the sentence
before any chance of release. That isn’t happening on all cases. Offenders sentenced to life
without parole sentence have been considered for release. Offenders facing consecutive
sentences are being paroled through the second sentence to the street. Even though this SQ
won’t impact all those situations, they cause concern for removing the Governor from any
part of the process.
“Removing the Governor from the parole process would be a terrible mistake. There
would be absolutely no accountability for those who are tasked with releasing criminals
from our prisons. And we know based on recent cases that the Parole Board is not acting
responsibly,” said District Attorney Greg Mashburn, Norman, and President of the Association. If SQ 762 is passed, non-violent offenders, if recommended by the Board for parole,
will hit the streets within days of the decision. Drug dealers, drunk drivers, child pornographers, abusers of vulnerable adults in nursing facilities and white collar criminals will all be
eligible for release without review of the Governor. No crime is victimless. It is imperative
to keep the Governor in this process as the ultimate gatekeeper.
Let’s remember why voters required the governor and the parole board to be jointly involved in this important process. They are a check and balance on each other. State Question 762 is not right for Oklahoma. “It is imperative to keep the Governor in this process as
someone who takes this task very seriously. This way the public can be assured that no one
is released from prison to our streets that shouldn’t be,” added Mashburn.

An Anadarko man was arrested after
stabbing another man during a fight.
Christopher Don Gordon, a.k.a.
Christopher Don Ako, 23, was charged
Oct. 24 with two felony counts of assault and battery with a dangerous
weapon and a misdemeanor count of
domestic abuse.
According to the police affidavit,
Anadarko Police were dispatched
around 3:30 a.m. Oct. 23 to a stabbing
call at a home in the 700 block of W.
Alabama. When Officer Dustan Chandler arrived at the scene, he saw a man
walking towards him with cuts to his back and stomach so severe that
part of his intestines were protruding out. The victim told Chandler
that “Chris Ako” stabbed him and he was inside the house.
Chandler found Gordon lying on the living room floor bleeding
from injuries to his face. A witness standing over Gordon identified him as the one who stabbed the victim. Gordon then got up and
walked into a bedroom and shut the door.
The witness told Chandler that victim was stabbed as he tried to
stop Gordon from throwing his mother on the ground. The victim
and Gordon began to fight and Gordon grabbed a steak knife and
started stabbing the victim. When Gordon tried to stab the witness,
he said he grabbed the knife and it cut his hand.
The second witness told police she saw the men fighting and saw
the victim bleeding all over the place. She added she then called 911
and told dispatch her friend had been stabbed in the neck and arm.
Officers tried to arrest Gordon, but was met with resistance and
had to be tased.
Gordon was transported to the Caddo County Jail and booked. The
victim was taken to Grady Memorial where he underwent surgery for
his injuries.

help with cold case
Judith Elwell, 5, vanished from her parents’ northwest Oklahoma City home sometime before 9 p.m. July
6, 1967. One of her shoes was found the next day beside
an abandoned house half a block from the Elwell home,
leading police to theorize she lost the shoe while struggling with her kidnapper. No other trace of her turned up.
In the hours and days after her disappearance, hundreds of searchers swept across the area. Individual volunteers mingled with police, firefighters and Civil Air
Patrol workers, and a command post grew outside the
Elwell’s house. After three days the hunt was called off. At
some point over the past four decades, the police case file
was misplaced or destroyed.
Another little girl named Brenda White, 6, from Midwest City, went missing a month after Judith. Unfortunately, hunters found Brenda’s body in November 1967
about 11 miles east of her home in a shallow grave. Judith
has never been found. Police believe on person could be responsible for both disappearances,
as they happened so close together.

A former high school coach accused of having sex with a
female student fights to have his case dismissed.
The suspect’s attorney said the state’s age of consent law
is unconstitutional.
The controversial legal fight centers on a state law
banning sexual relationships between students and
school employees.
The former educator accused of breaking that law,
Tyrone Nash, allegedly carried on a sexual relationship
with a female student at Western Heights high school.
Nash asked the court to overturn state law.
Under the current law, it would legal for the judge in the case to have consensual
sex with a 16-year-old girl, but Nash, as a former school employee, may not
have the same right.
That’s why the defense said the law should be unconstitutional.

“I’m drunk, osifer”
A Devol man once again found himself in jail Oct. 19 for having too much
to drink and then driving.
Kelly Allen Young, 54, was charged
with felony DUI, second and subsequent, in Cotton County District Court.
According to the OHP affidavit,
Troopers Wil Hayden and Robert
Hedges were on patrol on S.H. 36
when they noticed a red Chevy truck,
driven by Young, traveling north failing to stay in his lane and crossing over
the fog lines.
The troopers pulled Young over, who
immediately admitted to them that
he was drunk. Hayden could smell the strong odor of booze coming
from inside the car and from Young. He had thick, slurred speak and
had spilled a liquid substance on the front of his shirt.
Young added he knew he was in trouble because he was drunk.
Hayden asked him to exit his truck to perform a field sobriety test,
and Young tried, but he was very unsteady on his feet. The odor of
alcohol followed him like a lost puppy.
Young said he had been out drinking with “some girl” and again
said he knew he had had too much to drink and could not pass any
sobriety tests. Hayden gave him the test anyway, and, as Young had
predicted, he failed them miserably.
Young was placed under arrest and placed in the patrol car. He was
transported to the Cotton County Jail where they bypassed the state’s
test because all would know Young would fail it.
Young was first charged with DUI in Cotton County in 1990, then
again in 1991 and 1992. In 2000, he was charged with possession of
meth.
At his arraignment Oct. 22, Young pled not guilty to the charges.
His bond was set at $50,000 and his preliminary conference was set
for Nov. 29 at 9 a.m.

Four inebriated partiers caught the attention of an officer after a passenger in
the car vomited right in front of him in
the parking lot of a convenient store.
All four were taken into custody and
charged with various misdemeanors, but
one, a passenger, Zachory Kohler, 21, of
Dallas, was acting especially rowdy toward the officer.
According to the police affidavit, Sergeant Milton Honeycutt pulled up to
the Chisholm Corner in Walters to get
gasoline when he noticed a black Caddy
parked next to the building. Four people were inside the car being
very loud and obnoxious. Just then, a woman in the back seat opened
the car door and began puking.
Honeycutt went inside the store to pay for his gas, and when he
came back out, he saw the Caddy leaving the store dragging something behind it and making a loud noise. When he followed the car,
he noticed the driver cross the center line and pulled him over.
Backup arrived shortly thereafter and each person was field sobriety tested. They all failed. All had gone relatively well until they
tested a passenger, Kohler, who got belligerent with the officers. He
started dropping f-bombs and refused to be cuffed. Finally, an OHP
trooper had to twist Kohler’s wrist to get him to comply. More fbombs flew from Kohler’s mouth.
At the jail, everyone went along with officers and behaved except
for Kohler. He was screaming insults and threatening he was going to beat the officers up. He was taken into another room until he
calmed down enough for booking.
One of the girls in the car was changing into jail clothing when she
pulled a beer from her cleavage, gave it to the jailer, and said Kohler
had given it to her.
Kohler pled not guilty at his arraignment and was ordered back to
Feb. 2 at 10 a.m.
