Michael Dewayne Smith
Michael DeWayne Smith was a member of the
Oak Grove Posse, a subset of the Crips gang in
Oklahoma City. On November 8, 2000, three
members of the Oak Grove Posse attempted to rob
Tran’s Food Mart in south Oklahoma City. The
three robbers were Teron “T-Nok” Armstrong,
Kenneth “Peanut” Kinchion, and Dewayne
“Pudgy-O” Shirley. During the course of the
robbery attempt, the owner of the store shot and
killed Armstrong. Kinchion and Shirley were
eventually arrested. Smith was not involved in the
attempted robbery but had close personal ties to
Armstrong.
On Friday, February 22, 2002, two days before
the trial of Kinchion and Shirley was scheduled to start, Smith left his apartment in
the Del Mar Apartments in Oklahoma City early in the morning. His roommate,
Marcus Berry (also known as Marcus Compton), saw Smith take a .357 caliber
revolver with him. Smith went fi rst to Janet Moore’s apartment looking for her
son Phillip Zachary who he believed was a police informant. Smith had earlier told
Berry that “snitches need to be dead.”
The evidence supports the conclusion that Smith arrived at Moore’s apartment
sometime before 6:30 a.m. Shoe prints indicated that Smith kicked in her front
door and then her bedroom door. Moore began screaming, and, at approximately
6:30 a.m., a downstairs neighbor heard arguing between a man and a woman and
then a single “pop” followed by footsteps.
Later that morning around 7:30 a.m. Smith arrived at A-Z Mart, a convenience
store approximately fi fteen miles from the Del Mar Apartments. A-Z Mart was
immediately next door to Tran’s Food Mart, the site of the earlier robbery attempt
where Armstrong had been killed. The clerk on duty that morning at A-Z Mart
was Sarath “Babu” Pulluru. Pulluru was fi lling in for the store owner who was
taking the day off. Smith told detectives that he emptied two pistols into Pulluru,
took some money, and used bottles of Ronsonol lighter fl uid to start fi res in the
store. Smith said he set fi re to the cash register, Pulluru’s body, and a back room
in order to destroy evidence. Shoeprints at the scene tracked Pulluru’s blood from
the cash register area, where his body was found, down the aisle to where the
Ronsonol lighter fl uid was displayed for sale. The bloody shoe prints at the A-Z
Mart were similar to the shoe prints found at Moore’s apartment.

Doyle Latimer, 56, and his wife, Cynthia
Latimer, 57, both from Elgin, were
sentenced August 10 for conspiracy defraud
the government by the theft of military jet
fuel.
Doyle Latimer was sentenced to serve 12
months and one day in prison, followed by
two years of supervised release.
Cynthia Latimer was ordered to serve
two years of probation. The couple was
also ordered to jointly pay $109,818.91 in
restitution to the United States.
The government purchases jet fuel
(Jet Propellant 8 or JP-8) from fuel depots in Oklahoma City and
Wynnewood to supply the jet fuel needs at various military bases,
including Altus Air Force Base, Tinker Air Force Base, and Sheppard
Air Force Base. Latimer Trucking LLC (“Latimer Trucking”), owned
and operated by Doyle Latimer, transported the JP-8 for the military
and picked up JP-8 jet fuel from the fuel depots for delivery to the air
force bases. Cynthia Latimer was employed by Latimer Trucking in
the office and kept the business records.
The Latimers were indicted on December 13, 2011, and charged
with one count of conspiracy to defraud the United States. Both
defendants pled guilty to the conspiracy on May 4, 2012.
As part of his plea, Doyle Latimer admitted that from 2001 through
2007 he stole JP-8 jet fuel belonging to the United States and
intended for delivery to military bases by draining it from the tankers
and using it to operate his trucks. He further admitted that he knew
his wife was creating false fuel receipts to cover up the use of the JP-8
jet fuel in operating his trucks.
Cynthia Latimer admitted to conspiring with her husband to cover
up the theft of JP-8 by preparing false fuel receipts which appeared to
document legitimate diesel fuel purchases for Latimer trucks when,
in fact, there had been no purchase of diesel fuel. In carrying out this
conspiracy, the Latimers were able to reduce the costs of their daily
trucking operation.

The OSBI has fielded many inquiries about why gun licensing
is taking longer than usual.
In April 2012, when OSBI
reported FY 2012 3rd Quarter
numbers, the bureau’s Self Defense Act (SDA) unit was processing applications without
exceptions (no problems with
fingerprints, arrest records, etc.)
within 52 days of receipt. In the
month of May, processing time increased to 60 days, in early June
it surpassed 60 days, and in late June to over 90. OSBI is holding
steady at a processing time of approximately 97 days and is diligently
working to bring down that number.
To process the onslaught of applications more quickly, OSBI has
hired three new employees, established a temporary night shift effective August 1, 2012, and added two additional temporary employees. The bureau is utilizing every available employee in every division to assist SDA with the volume of applications received.
SB 1733, which makes it legal for SDA license holders to openly
carry handguns starting November 1, 2012, was signed by Governor
Fallin on May 15, 2012. Increases in applications preceded the signing of the law, but information regarding the proposed legislation
was prominent in the news before the bill’s passage and may have
impacted the interest of potential SDA applicants. OSBI expects applications to rise even more due to the recent shooting massacre in
Colorado.
The state currently has 127,445 active approved license holders.
OSBI regrets any inconvenience this unprecedented backlog may
have caused gun license applicants and those renewing their license.
As stated above, the bureau is utilizing as many resources as possible
to resolve the problem.

Unsolved Cases
Fifteen years ago, on July 26, 1997, 19-year-old
Tiffany Johnston was abducted from the Sunshine
Car Wash at 7709 N. W. 23rd in Bethany. Her
vehicle was found abandoned at the car wash. Her
body was found the next day on Gregory Road in
Canadian County two-tenths of a mile south of
Interstate 40.
Bethany Police Department requested OSBI assist with the
homicide investigation. The medical examiner’s offi ce ruled the
Bethany resident died of strangulation.
OSBI agents and Bethany detectives have conducted numerous
interviews concerning the disappearance and murder of Johnston.
In late 2005, the case became inactive with no more leads to follow.
Last year, the agent assigned the case retired. Johnston’s case has
now been reassigned. That agent is currently pouring through case
fi les and has requested a reward be offered to focus attention on the
murder and, perhaps, create new leads. This is the second time a
reward has been offered.
The OSBI is now offering up to a $10,000 reward for information
leading to the arrest and conviction of the person(s) responsible for
Tiffany Johnston’s murder. If you have any information helpful in

A Lawton woman was accidentally
shot by police August 19 as they
tried to disarm a man who aimed a
gun at a crowd outside a local club.
The Lawton Police Department
requested OSBI agents work the
shooting at the Gateway 4 Recovery
Room at 2705 N.W. Sheridan.
According to the OSBI, at
approximately 1:45 a.m., officers heard a gunshot coming from the
parking lot outside the club. In that parking lot about 300 people had
gathered. As officers approached the man they believed fired the shot,
they commanded him to drop his weapon.
The officer who fired his gun told investigators the subject raised
his weapon toward the group of bystanders. The officer then fired one
round missing the subject. The bullet hit a parked vehicle next to the
subject, traveled through several windows, and ultimately hit Jerry
Ann Short in the chest. The 24-year-old woman was taken to a local
hospital where she was treated and released. The subject fled the area.
Agents spent the night collecting evidence, interviewing many of the
people who witnessed the shooting, and interviewing officers at the
scene. Once the OSBI investigation is complete, agents will provide the
district attorney a comprehensive, written report. The district attorney
will determine if the shooting was justified.

As the summer heat rages on,
and rain seems to be a distant
memory for much of the state, fires
are becoming an everyday occurrence across Oklahoma. Many of
these could be prevented, and this month I’ll talk about a few ways to
cut down on the possibility of inadvertently starting a fire that may
destroy lives and property.
One of the things Trooper’s see almost every day is the cigarette toss
out the window. For some reason, people don’t want to extinguish
their cigarettes and put them in an ashtray in their car; they just flick
them out the window. What you are saying when you do that is, you
don’t care about the people in that area, or their property. Every time
you throw one of those out, you take a chance of starting a fire that
can devastate a community. If you smoke, use an ashtray or some
type of container in your car to keep your butts in, don’t throw it
out. If a Trooper sees you throw one out, expect the very expensive
citation that comes with that charge!
Another thing that has started fires are things like safety chains on
trailers being too long, and dragging on the pavement. This causes
sparks, which is all it takes to get our drought-stricken grass to burn.
Also, keep bearings greased, as a seized bearing has been known to
spark and cause fires. Be careful driving a car through tall grass, as
the catalytic converter on cars gets hot enough to catch grass on fire.
OBEY THE BURN BAN! Yes, this means you! No reason that you
can justify burning trash, brush piles, having a campfire, or open
grill will be adequate to the people who lose a home when it gets
out of control. If you are violating a burn ban, you are telling your
neighbors that you just don’t care about them or their property.
Also, be alert and aware of what is going on around you. Arson is
certainly a cause of several wildfires across our state. Alert motorists
can help catch an arsonist before they do too much damage, but only
if you are a good witness. Try to get a good description of the person,
their vehicle, a tag if possible, clothing they are wearing, etc, and try
to get that info to law enforcement as soon as you can! You could be
the difference between someone losing a home or just having a close
call.
Lastly, go and thank a firefighter or law enforcement officer for
the work they have been doing recently. These men and women
are battling every day to save lives and property, and getting people
out of harm’s way, in extreme conditions. I know that many of you
donate water and food, and on behalf of all of us in the Emergency
Response community, we thank you for that! Thanks for reading,

Two Anadarko men were taken into custody July 31 and are facing
several felony charges after they fired at least six shots into a house on
East Georgia.
Kyle Kent Ware, 20, and Brandon Joe Osceola, 21, both face felony
charges of use of a vehicle in discharge of a weapon, conspiracy, knowingly concealing stolen property, and a misdemeanor drug paraphernalia in Caddo County District Court.
According to the police affidavit, Anadarko Police Officer Shannon
Lyon responded to a shots fired call around 9 p.m. in the 600 block of
E. Georgia where he saw several shell casings in front of the house in
the roadway. Witnesses said they heard six shots, one of which made
a hole by the door of a neighboring house. No one was injured in the
incident.
Several neighbors said they saw a gray or silver Chevrolet Impala
with dark tinted windows at the house. One said he saw the passenger
point a gun at the residence and fire approximately six rounds into it.
While marking the evidence in the roadway, Lyon looked up and saw
the Impala drive by. He then got into his patrol unit and followed the
Impala to the Gas Mart on East Central. There he saw a man walking
away from the vehicle and into the store. When he came back outside,
he took off running.
Ware and Osceola were ordered out of the Impala at gunpoint. After
they were frisked and secured, Lyons searched the car and found an
unspent Winchester 40 caliber bullet laying in the front passenger seat,
as well as a holster with an empty Glock 40 magazine. Under the seat,
he found the pistol the the magazine belonged to, but it was loaded with
another magazine that
had 10 rounds in it. The
gun had been reported
stolen from Lawton.
Lyons also found
beer, some opened, and
a glass pipe used for
smoking marijuana.
Both men were transported to the Caddo
County Jail on booked
in without incident.

Three years ago, on August 23,
2009, Carol Daniels, pastor of the
Worthy Temple Christ Holy Sanctified Church in Anadarko, was found
murdered. Pastor Daniels lived in
Oklahoma City and drove to the
small church every Sunday for services.
Anadarko Police requested OSBI
assistance on the case. Crime scene
agents spent hours inside and outside of the church collecting possible evidence. In the past three years,
OSBI agents have run numerous leads across Oklahoma and
many outside the state. No suspects have been identified at
this point.
The OSBI has renewed its $10,000 reward, the maximum
by law, for information that leads to an arrest and conviction. If anyone has information, please call the OSBI hotline

OHP Trooper Tim Brinson was called to a
one-vehicle accident just north of Walters just
after midnight on August 22, according to
the affidavit. When he arrived, he saw a gold
Chevy pickup with damage on its driver’s side.
The driver, Jeffrey Miller, 45, had apparently
left the road and traveled over 140 feet until he
hit a concrete bridge rail.
Miller was sitting in a Walters police unit,
so Brinson asked him to move to his patrol
car. Miller was so intoxicated, Brinson and a
deputy had to hold him by the arms to the car
to keep him from falling down. When asked
what had happened, Miller said he had swerved to miss two armadillos
in the road.
While Brinson was trying to talk to Miller, he passed out several times
and his speech was very thick and slurred. Since Miller did not smell
of alcohol, Brinson asked him if he had taken any medication and he
admitted taking Xanax and Ambien.
Miller was taken to the Cotton County Jail and four vials of blood were
drawn from Miller by a paramedic. He was then booked in on a complaint
of DUI-D.

A homeless man has found residence at the
Cotton County Jail after he attacked an attorney and deputies during a court proceeding
August 9.
According to the police affidavit, Deputy
Kody Kinder had eight inmates seated in the
juror box in the courtroom. Attorney Don
Gutteridge approached the juror box and began talking to James Lamont Owens, 42, who
was an inmate at the jail. After a few seconds,
Owens began screaming at Gutteridge, who in
turn pointed his finger at Owens and told him
he didn’t need to speak to him like that. Owens,
who was shackled, stood up and whacked Gutteridge in the head with a black book that was near him, later identified
as a Bible.
Deputy Kinder pulled Owens from the juror box, subduing him by
his hands, shackles, and jumpsuit. He then told the court reporter to go
quickly and get help, as Owens was screaming threats and struggling
against him.
Help soon arrived and they escorted Owens back to jail. He was later
charged with two counts of felony assault and battery on a peace officer, one count of felony assault and battery upon a officer/state district
court after a former felony conviction. He pled not guilty at his first
appearance August 21 and bond was set at $75,000.
