The former announcer for the OKC Thunder
has turned himself into authorities after two
counts of lewd molestation charges were filed
against him Nov. 7 in Garvin County.
James Alan Miller, 44, is already facing
charges related to the sexual abuse of children
in Pontotoc and Oklahoma Counties.
Miller pled not guilty Nov. 9 to the charges
and was released on a $50,000 bond.
The charges stem from an investigation that
began earlier in the year when the Garvin County
Sheriff’s office was contacted by the Pontotoc
County Sheriff’s office with information they
had uncovered while investigating allegations against Miller in a case
in Pontotoc County. Miller allegedly committed sex crimes against a
10-year-old family member during a visit with relatives in Stratford.
Miller was charged June 5 with six counts of child sexual abuse in
Pontotoc County District Court in which two girls accused Miller of
repeated abuse between 2000 and 2007.
In Oklahoma County, he is also facing two counts of lewd acts with a
child under 16, in connection to a 2010 incident involving an 8-year-old
boy.
Miller’s preliminary hearing is set for Dec. 21 at 10 a.m.

Investigators need
help with cold case
Judith Elwell, 5, vanished from her parents’ northwest Oklahoma City home sometime before 9 p.m. July
6, 1967. One of her shoes was found the next day beside
an abandoned house half a block from the Elwell home,
leading police to theorize she lost the shoe while struggling with her kidnapper. No other trace of her turned up.
In the hours and days after her disappearance, hundreds of searchers swept across the area. Individual volunteers mingled with police, firefighters and Civil Air
Patrol workers, and a command post grew outside the
Elwell’s house. After three days the hunt was called off. At
some point over the past four decades, the police case file
was misplaced or destroyed.
Another little girl named Brenda White, 6, from Midwest City, went missing a month after Judith. Unfortunately, hunters found Brenda’s body in November 1967
about 11 miles east of her home in a shallow grave. Judith
has never been found. Police believe on person could be responsible for both disappearances,
as they happened so close together.

Tulsa Police arrested a Sand Springs man in the
early-morning hours of Nov. 9 after he allegedly
shoplifted from a QuikTrip store.
Jail records show Justin Levi Brimer, 24, was
arrested on complaints of driving under the influence, assault and battery on a police officer and endangering others while eluding police.
Justin Brimer stole a case of beer and some taquitos from the QT at I-244 and Sheridan at around 2
a.m, according to a report. As Brimer was fleeing
the scene in his truck, a Tulsa police officer pulled
into the store’s parking lot just the clerk went outside. The clerk pointed at the truck and the chase
was on.
Police officers caught up with him on I-244 and,
after a short chase, Brimer pulled his pickup truck over. The beer and food
were found in his truck.
After much ado, Brimer was taken to the Tulsa County Jail and booked.

that leads to the arrest and
conviction of the person or
persons responsible for the
murders of two men in Pittsburg
County December 5, 2010.
David Smith (d.o.b. 6/1/1964)
and Mark Anthony Hall, Jr.
(d.o.b. 9/23/1982) were shot
to death inside Smith’s home
approximately four miles north of Hartshorne on Webber Hill.
At the beginning of the case, many possible suspects were identifi ed.
However, through thorough investigating, those persons have been
eliminated as suspects. Agents are currently running strong leads but
still need the public’s help.
“The OSBI is hopeful such a large reward for information will
encourage someone with crucial information to come forward,” Jessica
Brown, OSBI PIO, says.

OSBI Renews Reward in Pittsburg County 2010 Double Murder
Deaths in crashes involving drunk drivers
with a blood alcohol
concentration (BAC) of
.08+ dropped in 2010,
but despite this decrease, there were still
10,228 lives lost – that’s
one person every 51
minutes. That makes it
everyone’s problem.
It seems that many people were doing their part to put a stop to
this completely preventable epidemic. Alcohol-related traffic fatalities reached a low point in the late 1990s. Research also indicates
that 62% of Americans exposed to the now-iconic Friends Don’t Let
Friends Drive Drunk campaign have personally intervened to stop
someone from driving drunk, no doubt saving countless lives.
However, since the late 90’s, alcohol-related driving deaths have
been steadily increasing. It seems that though the campaign was
very successful, it did not change the behavior of many potential impaired drivers. Many thought the messages to be targeted at overtly
drunk drivers, and not them. When decision time came, they would
consider themselves merely “buzzed” and get behind the wheel.
The new PSAs created to address this gap were released in December 2005 with the objective to inspire dialogue and recognition
of the dangers of “buzzed” driving and subsequently, to motivate
people to stop driving buzzed. The next installment expands on this
message, equating buzzed driving and drunk driving and demonstrating the devastating consequences that can occur as a result of
buzzed driving. The overall campaign hopes to educate people that
consuming even a few drinks can impair driving and that Buzzed
Driving is Drunk Driving.

Oklahoma City: Dennis Newton was on trial for the
armed robbery of a convenience store in a district court
when he fi red his lawyer. Assistant district attorney
Larry Jones said Newton, 47, was doing a fair job of defending himself until the store manager testifi ed that
Newton was the robber. Newton jumped up, accused
the woman of lying and then said, “I should of blown
your (expletive) head off.” The defendant paused, then
quickly added, “if I’d been the one that was there.” The
jury took 20 minutes to convict Newton and recommended a 30 year sentence.
A motorist was unknowingly caught in an automated speed trap that measured his speed using radar and
photographed his car. He later received in the mail a
ticket for $40 and a photo of his car. Instead of payment, he sent the police department a photograph of
$40. Several days later, he received a letter from the
police that contained another picture... of handcuffs.
The motorist promptly sent the money for the fi ne.
A woman was reporting her car as stolen, and mentioned that there was a car phone in it. The policeman
taking the report called the phone and told the guy
that answered that he had read the ad in the newspaper and wanted to buy the car. They arranged to meet,
and the thief was arrested.
Drug Possession Defendant Christopher Jansen,
on trial in March in Pontiac, Michigan, said he had
been searched without a warrant. The prosecutor said
the offi cer didn’t need a warrant because a “bulge” in
Christopher’s jacket could have been a gun. Nonsense,
said Christopher, who happened to be wearing the
same jacket that day in court. He handed it over so the
judge could see it. The judge discovered a packet of
cocaine in the pocket and laughed so hard he required
a fi ve minute recess to compose himself.
Detroit: R.C. Gaitlan, 21, walked up to two patrol
offi cers who were showing their squad car computer
equipment to children in a Detroit neighborhood.
When he asked how the system worked, the offi cer
asked him for identifi cation. Gaitlan gave them his
drivers license, they entered it into the computer, and
moments later they arrested Gaitlan because information on the screen showed Gaitlan was wanted for a
two-year-old armed robbery in St. Louis, Missouri.

An Ardmore man was arrested
in Wynnewood after he alerted
officers to his state of mind by
spinning out his tires right in front
of them.
James Kent, 32, was charged
Nov. 19 with DUI and DUS in
Garvin County District Court.
According to the police affidavit,
Wynnewood Police Officer Nathan
Mullett was driving north on Dean
A. McGee when he observed a
white Chevy pickup truck heading
north. The driver, later identified
as Kent, pulled into a driveway
located in the 300 block of N. Dean A. McGee. Suddenly, Kent
put the truck into reverse and backed out of the driveway and
onto Dean A. McGee. Mullett then saw the pickup tires spinout and Kent pulled back into the drive.
Deputy Shane Rich was following Mullett, and as Mullett
turned around to make contact with the driver, he saw Rich
walking up to Kent. Rich asked Kent if everything was ok
as Mullett walked to the drivers side door. He immediately
smelled the odor of booze.
Kent told the officers he forgot his drivers license and Mullett
asked him his name and date of birth. When his license was
ran through dispatch, it came up flagged. Further investigation
found Kent was arrested for D.U.I. back in 2002 and also in
2011.
Mullett asked Kent if he had been drinking and he stated,
“Yes I have been.” When asked how many, he stated “two,
maybe a few.”
Rick gave Kent the Standardized Field Sobriety Test, which
he failed. He was arrested and transported him to the Garvin
County Jail where he is booked in for DUI and DUS.

Executed Nov. 6, 2012
Convicted murderer Garry Thomas Allen,
whose Oklahoma execution had been halted
three times while legal questions about his
mental health were debated, was put to death
by lethal injection Nov. 6, a state prison
spokesman said.
Allen, 56, killed the mother of his two children
on November 21, 1986, gunning her down in
front of daycare workers after she arrived to
pick up the couple’s 2- and 6-year-old sons.
Gail Titsworth, 24, had moved out of Thomas’
home four days earlier and rebuffed his pleas
to return.
Allen was drunk and shot the woman four
times before a police offi cer found him in a nearby alley and shot him in the
face during a struggle over the offi cer’s gun.
Allen lost his left eye and sustained brain damage from the gunshot
wound, according to court testimony, but a jury found him competent to
stand trial.
Allen, who had a long history of drug and alcohol abuse and had been
hospitalized for psychological problems, insisted on entering a “blind” guilty
plea to murder, meaning the plea was entered without his knowing what his
punishment would be.
His plea was intended to spare the emotions of his family and the family of
the woman he killed, records show.
Allen was the fi fth inmate executed in Oklahoma this year and the 36th in
the United States. He was pronounced dead at 6:10 p.m. local time at the
Oklahoma State Penitentiary in McAlester, said state prison spokesman
Jerry Massie.
Allen delivered a rambling and often unintelligible fi nal statement that
touched on the presidential election, including a prediction that “it’s going
to be a very close race,” Massie said.

A pair of Byers women face a
burglary charge after completing a
summertime robbery.
April Schrader, 36, and Amanda
Dial, 31, are accused of breaking into
a home located on the 44000 block of
120th Street on June 9.
The pair reportedly broke a window
with a piece of firewood to get into the
house, according to the affidavit. Dial
told a witness that she and two others
broke into the residence, saying she
dropped a group off on a hilltop so
they could gather loot. She said she
saw three big bags and a TV and
speaker were taken.
Schrader said she took Dial out and
dropped her off on a county road,
then picked her up. She confirmed
the theft of a duffle bag and the
TV/speaker combination. She also
said she thought they were robbing
someone else at the time.
Officers determined a Wii fit system
and a Bose subwoofer were also stolen, according to the
affidavit.
The women were arrested Nov. 6, right after police received
warrants for their detainment. Dial posted a $10,000 bond
the next day, but Schrader is still in custody. Schrader pleaded
not guilty Nov. 6 and Dial pleaded not guilty Nov. 9. They face
between two to seven years in prison for the charge.
Dial and has a court date set for 9 a.m. Dec. 6, but her partner
in crime will appear at 9 a.m. Nov. 21.

Today, I’m going to discuss who
has the biggest impact on our
new drivers that hit the road each
and every day. First, the Oklahoma Driver’s Education classes and
schools across the state are second to none, and do a fantastic job
of educating our young drivers on the law, and proper way to safely
operate a motor vehicle. I would like to point to some other folks, who
I believe have a far greater impact on how our youngsters approach
driving, and address them, and that is the adults who these young
drivers look up to: the parents, older siblings, and extended family.
If you fit in this category, please pay attention. I believe that our
kids learn their driving behavior not from the Oklahoma Highway
Patrol, other law enforcement, or driver’s education instructor, but
from you, the parents and family. I know I learned that way! Let me
give you some examples.
You are a dad, and for whatever reason, when you are driving in
town, or on a county road, you just don’t buckle up. Maybe its because
you don’t drive fast in these areas, or have a farm tag and just don’t
have to; however, you do buckle up when you get on highways or go
on long drives. The message you are sending is that when you are in
the vehicle there are certain times that it is ok not to wear your seat
belt. If dad doesn’t have to do it, I don’t either! In fact, at least 50%
of all accidents happen on county roads, and you are more likely to be
in an accident within 10 miles of your residence than otherwise. So
the real message you are sending is, don’t buckle up during the times
that you are most likely to need it!
Next, mom gets off work at 5:00, and one of the kids has a ball
game in another town at 5:30. She can get there if she speeds. After
all, it is important to get to those activities, and it won’t hurt to push
the speed just a little. The message you send to your kids is, its ok to
speed, as long as you can justify it! The facts are that unsafe speeds
kill more young people 16 to 25 than any other single thing! The
message here needs to be that its ok to slow down and show up a few
minutes late.....it is much better than the alternative, which is never
showing up at all because you’ve been involved in an accident.
Please remember, when you are driving, you are setting the example
for someone....and they are watching you all the time. What message
are you sending? I hope it’s the one that says, I’ll lead by example
because I love you, and want to do my part to keep you safe! Thanks

A Norman man and his friend were
arrested in Purcell en route to a drug
deal after police say they decided
to shoot up drugs in a convenience
store bathroom.
Just before 8 p.m. Nov. 4, officer
Joe Santmyer responded to the
Love’s Convenience Store on Green
Street after receiving a report of two
suspicious males walking in and out
of the store repeatedly.
Kristopher Shawn, 29, had just
exited the bathroom and a store
worker cleaning the restroom found
a used syringe in there immediately
after he used it. David Edwards,
26, was in the backseat of Shawn’s
car when Santmyer arrived. When
the officer spoke to him, he started
crying, according to the affidavit.
Santmyer found Shawn in the
store with dilated pupils and fresh
puncture marks on his right arm, he
said.
Both men admitted to shooting up
methadone in the bathroom and they
were arrested on a public intoxication complaint. During a patdown search of Shawn, Santmyer found $405 in cash, as well
as a small black pouch with several more syringes and a bent
spoon and a cellophane wrapper with drug residue. Even more
syringes, a bottle of methadone and spoons with drug residue
were on Edwards’ seat when he was arrested.
Santmyer did a more complete search of Shawn’s car, which
turned up a gray backpack with prescription bottles, a silver
Apple laptop computer, a package of small jeweler’s bags
with naked lady imprints, scales and a tub with 181 grams of
marijuana. Unfortunately for the pair, McCurdy Park was less
than 300 feet away from the drug-filled car. Shawn said they
were on their way to a concert, according to the affidavit.
Edwards was previously convicted of two counts of seconddegree burglary in June 2010, receiving six years of probation
after spending a year in jail with credit for time served.
Shawn posted a $6,000 bond Nov. 6 and pleaded not guilty
Nov. 9. He has court set for 9 a.m. Dec. 5. Edwards posted a
$500 bond Nov. 19 after a judge reduced his bond. He has
court set for 9 a.m. Nov. 28.

these children, many of these parents are slapped
on the wrist told to take a few classes then let go
freely. Then these children fall prey to the same
thing happening over and over. Oklahoma does not
take serious offenses seriously, too many kids are
abused and sent back to the parents who abused
them (foster and real). Then they end up seriously
injured or worse. His bond is set low for what he did.
Sadly unless some big changes happen they won’t
even throw a piece of paper at him...

for him, I’d like to rip his out of his chest still beating

is so much crap in this world no one knows what

William Lewallen, a 47-year-old Tulsa
man, was jailed Nov. 11 after police found
three unattended, naked children on his
property. One child was found locked in a
dog cage, covered with feces.
According to police, officers were
dispatched to Lewallen’s residence after
a neighbor heard the screams of a child
who had been stripped naked and locked
outside in the cold while the boy’s father
was passed out inside.
Investigators say officers arrived at the
residence and could immediately hear a
child screaming from inside the residence.
While looking for an open entrance
into the house, officers came upon an
18-month-old girl who was naked, covered
in feces and locked inside a dog cage.
When the officers kicked in the home’s
back door, they encountered a second
naked child inside who seemed to be
unattended. A further sweep of the house
revealed a third naked child who was
asleep on a bed in the master bedroom.
Officers also found Lewallen who was
passed out next to
the child.
During a police
i n t e r v i e w ,
Lewallen stated
that he fell asleep
after ingesting
a combination
of pain meds, a
muscle relaxer
and anti-seizure
medication.
“The screaming child in the dog kennel
did not wake the defendant nor did the
officers kicking the door down to rescue
the toddler in the dog cage,” stated a police
arrest affidavit.
Officers also noted in their report that the
home had no heat (it was about 40 degrees
that day) and there was little food in the
house to eat.
Lewallen was booked into jail and charged
with felony child neglect. His bond has
been set at $50,000.

A Marietta man faces more prison time after
authorities in Sequoyah County said he stole a
car, crashed it and took off on foot Oct. 24 after
being released from prison in Arkansas less than
48 hours before.
Gerry Westmoreland, 41, was arrested on
complaints of knowingly concealing stolen
property, eluding an officer and giving false
information in Sequoyah County.
Sequoyah County deputies were alerted to
a stolen Tahoe out of LeFlore County heading
toward Sallisaw. The OnStar system had been
activated and it tracked the SUV on I-40 near
Vian.
A deputy caught up with the Tahoe and when he turned on his patrol
car’s emergency lights, a short chase ensued and the driver, later identified
as Westmoreland, veered off the road, over a ditch and crashed into a tree,
the affidavit show.
Westmoreland took off on foot into the wooded area beside the highway,
but was found by another deputy 45 minutes later lying in a ditch about a
half of a mile away from where he crashed the Tahoe.
Westmoreland was taken to the Sequoyah County Jail where he was
booked in. He gave deputies a false name at first, but his true identity was
discovered shortly thereafter, according to the affidavit.

A Thackerville man was taken into custody
in Garvin County on complaints of DUIdrugs after he caused several cars to crash on
I-35 near Paoli.
OHP Trooper Douglas George was
contacted by radio at approximately 3:20
p.m. on Oct. 20 of a possible intoxicated
driver traveling north on I-35. Several *55
calls were coming into Oklahoma Highway
Patrol Headquarters regarding a white
Hyundai traveling all over the roadway.
While attempting to catch up to the
Hyundai, the Hyundai’s driver, Dennis
Boulton, 65, caused two other vehicles to
collide on I-35 while trying to avoid Boulton’s erratic driving. Paoli
Police Department attempted to stop the Hyundai as it approached
McClain County. Boulton finally stopped near mile marker 83.
Officer John Sumner of Paoli Police Department approached
Boulton and asked him for his driver’s license and vehicle insurance.
Boulton was visibly intoxicated, showing many signs and symptoms.
George administered the state’s sobriety test, but was quickly
terminated for Boulton’s safety. Boulton was arrested and agreed
to take the states blood test. He was transported to Pauls Valley
Regional Hospital to draw blood and then transported to Garvin
County jail and released to jail staff.
