An Elmore City man who is accused
of killing and dismembered his girlfriend’s ex-boyfriend has claimed he
acted in self-defense, according to his
defense attorney Irven Box.
Justin Hammer, 30, pled not guilty
to first-degree murder charges in the
August 7 death of Brandon Duran,
32. Duran’s body parts were found
in cement-filled buckets in a pond on
Hammer’s property.
Box said Hammer claims to have
shot Duran after Duran forced his way
into Hammer’s home.
OSBI agents began searching for Duran’s body after a witness
told authorities that Hammer said he shot Duran, panicked, and
then cut up the body with a saw and placed the parts into 5-gallon
buckets that he then filled with cement.
Duran’s remains were found August 10.
Hammer remains in the Garvin County jail without bond. His
hearing has been delayed until November 2.
Hammer pleads not guilty

“Pep, The Cat-Murdering Dog” was a black
Labrador Retriever admitted to Eastern
State Penitentiary on August 12, 1924. Prison
folklore tells us that Pennsylvania Governor
Gifford Pinchot used his executive powers
to sentence Pep to Life Without Parole for
killing his wife’s cherished cat. Prison records
support this story: Pep’s inmate number (C2559) is skipped in prison intake logs and
inmate records.

A 23-year-old man was taken into custody
early September 16 after he led Stratford police
on a high-speed chase down 177 and ended at
the man’s home in Sulphur.
Alvaro Corpus, Jr. was charged September 17
with felony endangering others while eluding/
attempting to elude police after two or more
felony convictions and misdemeanor DUI in
Garvin County District Court.
It all began just after 12:30 a.m. when Stratford Police Officer Shannon Farnan was sitting off the roadway just
north of Jan Street on Magnolia when a white Chevy pickup, driven
by Corpus, zoomed past him, almost hitting his patrol car. Farnan
activated his emergency lights and took off after the truck.
The affidavit Farnan submitted to the courts said the truck
reached speeds of 65-85 mph in Straford and was all over the roadway, zig-zagging through town. Corpus finally reached Highway 177
and turned south toward Sulphur.
Farnan reported Corpus was traveling at about 100 mph in the
northbound lane for about a mile and then weaved across the center lane back and forth several times before coming upon a truck
pulling a trailer two miles from Sulphur. He sped past the truck, not
slowing down at all.
In Sulphur, Corpus turned into a residence at the corner of Tulsa
and Division Streets. Farnan got out of his patrol unit and took Corpus down and cuffed him. After he was secured, he placed Corpus’
female passenger into custody.
Corpus told Farnan he ran because he was scared, but didn’t
elaborate why. Farnan could smell the booze emitting from Corpus,
and Corpus admitted to having at least 12 beers between 8:00 p.m.
and midnight.
Farnan then spoke to the passenger and she said she tried the entire time to get him to stop, but he refused. She added that she was
afraid for her life.
Corpus was transported to the Pauls Valley ER where blood was
drawn and then on to the Garvin County Jail.
Go Speed racer, go!

Innocent Until Proven Guilty Carter County october, 2012 | 7
Dear Readers,
You will notice in this issue of OK Jailbirds there is no information from Carter County. You
deserve an explanation.
When we started OK Jailbirds serving McClain, Garvin and Carter Counties, Sheriff Ken
Grace was as kind and as cooperative as any of the 52 Sheriffs we’ve worked with throughout
the state, in fact, we began a quite nice friendship with him.
This week, as we began the process of gathering data for publication of this edition, we ran
into obstacles in Carter County. The person who normally provides the reports and transmits
them to us, David Gilley, was not as cooperative as he has been in the past months.
We called and emailed Mr. Gilley for almost a week with no response and finally, one of the
owners of OK Jailbirds contacted Mr. Gilley personally only to learn the department has held
a meeting and decided not to cooperate with OK Jailbirds in the future.
They sited nothing that we had done that caused this change of heart, only that it took “too
much time” each month to prepare the report for us. We deal with Sheriff’s departments all
over the state. The average amount of time a department spends preparing and sending information to us is 10 minutes. Time is not the issue.
We’ve had complaints from readers that apparently some persons arrested were not published in the Carter County section of OK Jailbirds. We assured them that every person
booked in Carter County that we know about is published in OK Jailbirds. The Sheriff is the
only person who can withhold, from publication, photos and information on persons arrested.
Gilley said, “It takes so much time to scrub the information before sending to you.” We don’t
need the information SCRUBBED. We wish to have it clean and complete. It’s the only way we
can handle this and maintain credibility.
All information we publish in OK Jailbirds is subject to the Oklahoma Open Records Act. It is
a violation of state law for the Carter County Sheriffs’ Department to withhold this information
from us and/or from you, the public.
We will proceed with steps necessary to include Carter County information in the next and
future issues of OK Jailbirds. We pray we return to a cooperative relationship with Ken Grace’s
department.
Respectfully,
OK Jailbirds

An 32-year-old Ardmore woman and her
boyfriend were arrested September 17 after
narcotics officers raided the motel room they
were using to sell meth.
Marissa Lewis, 32, and Gregg Chetpatananont, 33, of Oklahoma City, were
charged September 19 with possession of
methamphetamine with intent to distribute
in Carter County District Court.
The Carter County Sheriff’s Department and Ardmore Police Department narcotics
divisions received information they were renting motel rooms in Ardmore and selling
meth out of them. That led to an investigation and to the eventual arrest of the pair.
Reports state that when the officers entered the room, Lewis tried to distract them
by falling onto a bed while Chetpatananont ran into the bathroom and tried to flush
the meth down the toilet. Officers were able to recover approximately 5 grams of
meth.
During a search of the room, officers also found baggies and scales commonly used
to package and distribute the drug.
Both Lewis and Chetpatananont are being held on a $40,000 bonds each. Their
next court date is scheduled for October 23 at 9 a.m.

OK Jailbirds is cooperating with the efforts of Oklahoma
Department of Human Services to impact the huge social
problem of irresponsible parents who are not paying the
child supports ordered by our courts.
If these biological-only parents won’t honor the courts
order, perhaps public shame will get their attention.
If you know how to reach any of the Deadbeat Parents found on this page, please call the Oklahoma Department of Human Services
Child Support HotLine at 1-800-522-8014
It’s ALL about the KIDS!
Importance of Child Support
Children are our future and child support helps make sure they have a chance at a
productive life. Children have the right to get support from both parents and do not
lose this right when a parent leaves the home.
When children do not receive child support, they can:
Suffer both Emotionally and Physically
Live within a Reduced Standard of Living
Have their Basic Needs Unmet
Become Non-Supportive when they become Parents.
When one or both parents do not support their children, taxpayers often pay the cost
of raising children. When children receive public assistance and their parents pay no
child support, all taxpayers bear the cost of supporting the children.

Abuse can happen in many forms. Physical, emotional and
sexual are common expressions of abuse and many people
just don’t know how to handle it. If you are an
abuser, stop it. If you are the victim of abuse,
let the words of the Bible guide you as you
decide how to handle the relationship with the
abuser. If you’re in danger, you need to get
away immediately. If your abuse is not life
threatening or is something in your past
that you still struggle with, take some time
to meditate on God’s Word on this subject.
The LORD rescues the godly;
he is their fortress in times of trouble.
The LORD helps them,
rescuing them from the wicked.
He saves them,
and they find shelter in him.

was dispatched around 1:00 p.m. to
a vehicle traveling northbound in the
southbound lanes of 1-35 from Johnson
Road. The witness who called in the
incident following the driver, Gardenhire, and said she was traveling across the lane lines from grass edge to grass edge. He was able
to make contact with her because she stopped for a moment on the
inside edge of the interstate near mile marker 101. The man also
said she tried to drag him in the car with her and was very violent;
he also had to hold her in the car to keep her from running into traffic.
When Pittman arrived, Gardenhire was pushing Purcell Police Lt.
James New in the chest and being very belligerent. She was placed
on the ground and handcuffed, then escorted to Pittman’s patrol
car.
While Pittman was trying to read the implied consent, Gardenhire
kept interrupting Pittman, so he had to read it again. She would not
give an answer and he told her it would be a considered a refusal.
Pittman then read her the Miranda Warning. She said she drank
three shots of Vodka at 11:00 a.m. and had been in a fight with her
ex.
Pittman noticed she had a strong smell of an booze coming from
her breath as she sat in his patrol car. She also had red and watery
eyes and admitted to drinking. Pittman transported her to the McClain County Jail where she was booked in.

Anthony Banks
A federal appeals court has rejected the
appeal of an Oklahoma death row inmate
convicted of fi rst-degree murder for the
slaying of a woman more than 30 years ago.
The 10th U.S. Circuit Court of Appeals
ruled in the case of Anthony Banks, who
was convicted of the June 6, 1979, killing of
24-year-old Sun Travis.
Travis was abducted and raped and her
partially clad body was found near a trash
heap. She had been shot in the head.
Banks was convicted largely on the basis of DNA evidence found on
Travis.
Banks is also serving a life sentence for the 1978 murder of a Tulsa
convenience store clerk. He wasn’t in custody when Travis was slain.

A Noble man was taken into custody
August 30 after investigators found child
pornography on his computer.
Members of the Oklahoma Internet
Crimes Against Children Task Force arrested William Allen Barwick, 50, at his
residence, 1003 North 5th Street in Noble.
The case was initiated by Noble Police
receiving information that Barwick had
child pornography on his laptop computer.
Noble Police and the OSBI ICAC Unit
initiated a joint investigation. In the early
morning hours of August 30, task force members followed Barwick
from a Wal-Mart in Norman where he was employed. Task force
members detained Barwick when he did not go straight home and
asked him to accompany officers to his residence. Barwick agreed
and upon arriving at his home, task force members conducted a
search. Child pornography was found on Barwick’s laptop computer and on a hard drive. Several other pieces of computer equipment were seized and all evidence was sent to the OSBI Computer
Crimes Unit for forensic examination. The investigation continues
to determine if any local children are in the images.

What you’re saying
about this on...
Guy E: You gave permission to give swats.
What did you think they were gonna do give
him a little tap?
Lavender B: I say let the parents paddle that
administrator!
Shawn H: Boy is 13, why would parents allow
the school to punish? If they did and it was
not excessive, it is on them for handing the
responsibility of raising their children off to
someone else.
Rosemary L: I thought government schools
couldn’t spank anymore. When I was in 7th
grade they couldn’t. (I’m 31 now)
Kim P: I swear, this is what’s wrong with
kids nowadays. They are such pansies, along
with their parents. When we got “swats” or
punished by our parents we did not want to
call DHS, or go to the ER..... geez suck it up
parents!! YOU GAVE PERMISSION!!
Kimberly D: If this happened at home that
mother would be facing charges, the school
has no right to put bruises on any child. What
makes a school better than a parent?
Mark C: Oh that poor poor kid, how terrible
that he got a spanking for committing an act of
violence against another kid... Boo (beep) hoo,
and people wonder why kids are so spoiled and
think they can do whatever they want these
days... I can’t believe this is all over the news...
Rick S: Seriously. It’s a punishment. It’s not
supposed to feel good. What’s wrong with
people. Jailbird magazine may not be so full
if more kids had their backsides paddled. I got
them every day just like a one a day vitamin!
Probably kept me out of jail. Get swats at
school and get them for getting them at school
when you get home. Parents loving their kids
straight to jail !
Chelsea D: Just because u gave them
permission doesn’t mean they can leave
bruises like that! That was uncalled for! No
child should have to be taken to the er from
swats
Brittany P: i thought society today look
at spanking as child abuse? But their doing
it in school? Im all for a butt whoopin if my
children are not acting right, these days if you
spank your child in public its abuse and will
scar the child for life with embarrassment
and could get dhs involved, beating and
disciplining the child is two diff things! I know
my children will not grow up acting like fools,
that’s what’s wrong with this world kids get
away with anything, have no boundaries or
rules plus no guidance, i for one will not let the
school do my job in disciplining my child, they
can get suspended and get their punishment
when they get home, whether it is a spanking,
grounding or sentence writing.
Tina: I chose my kids not to be spanked and
here is why...... The DHS steps in if they hear
we are spanking our kids, so why should the
school be able to? As for this case, Had that
been the parents who spanked that kid and left
a bruise and someone at school seen it, you bet
your bottom that the DHS would be involved
and the parents investigated so it is not “ O,
they chose for their kid to be spanked so it is
what it is” Those parents and that kid trusted
that person enough to believe he would be
spanked the right way, and that does not
include bruises folks.
Christina A: some of you people are
completely ignorant. giving verbal permission
to “swat” your kid is a big difference between
hitting them hard enough to leave marks and
bruises. he was being punished for violence
but lets turn around and punish with more
violence?
Joseph B: Detention never helped me, but a
spanking set my a** straight
Jeffrey L: Wow. How times have changed.
I got my butt busted plenty. Always got butt
busted when i got home after getting busted at
school. I turned out great. Definitely knew right
from wrong. I had bruises on top of bruises n
never cried like a lil b**ch. Suck it up n get
tough. This is what i call the wimpification of
America. I, in NO way condone child abuse.
However, there has to be punishment of some
sort. Oh and not everyone gets a blue ribbon.
Somebody’s got to lose to teach n learn a
lesson. Life will go on.
April H: To all the parents out there that do
not believe in spanking, you need to bend over
and grab the chair yourselves. You are the
reason this generation is so delinquent and
misbehaved. If your mother was like mine, I
got my a** beat, I spanked all 4 of my kids and
if I do say so, they are very well behaved and
good honorable young adults!!
Be happy someone is trying to mold your kids
into people you obviously are not!!!!!
Richard W: the parent gave permission to
discipline the child, not to abuse the child!
Cordell Police said they are looking into a
school punishment that left a mark.
The mother of an Oklahoma elementary
student said her son was left bruised in a
recent paddling last week.
Linda Drew said her 6th grade son was caught
fighting at Cordell Elementary.
She and her husband were given the option of
suspension or swats.
They gave the school permission to spank
their child because they thought suspension
or detention would have hurt his grades and
football practice.
Hours later, their son was being checked out in the emergency room with
severe bruising.

THREATNING A VIOLENT ACT
By Lt. Jeff James
Oklahoma Highway Patrol
One of the things that is becoming
more prevalent, and with the
passing of the new open carry law,
will only continue to rise, is the number of people walking and driving
around armed. For law enforcement, this obviously creates some
challenges in our dealings with the public. I am going to attempt to
explain what we would like from the citizens who choose to go armed,
and what they can expect from us.
First, all people who wish to carry a gun on their person are
required to attend an approved concealed carry class. This goes for
those who wish to carry concealed or open. Upon completion of the
course and the requirements needed, you will be issued a Concealed
Carry License, or CCL. Let me point out, that having a CCL is a
privilege, not a right. It is issued by the state, and with it come some
responsibilities.
One of those responsibilities, and the one that is most important
to us law enforcement professionals, is the obligation to notify us
IMMEDIATELY upon contact. Lets say you get stopped for speeding
and you are a CCL holder and are armed, whether it is on your person
or just in your vehicle. The Trooper gets out of their car and asks
you to step back to them with your driver’s license and proof of
insurance. You should, before anything else, declare that you have
a CCL and are armed. Don’t wait until we see the CCL in your wallet
to tell us....that’s too late! They will then instruct you on what they
would like you to do to address this situation. There are several
things we may do at this point to accomplish this.
We may ask you to say (not reach for or move towards) where
the weapon is. Simply say the location, keeping your hands on the
steering wheel or where they can be seen. If its on your person, we
may wish to disarm you for the duration of the traffic stop, and will
give instructions accordingly. We may simply separate the weapon
from the ammunition and make the weapon safe, and then leave it
in your vehicle. Each officer will handle this in the way that he or
she chooses in order to maintain their own safety. None of these
methods are meant to infer that we feel threatened by a CCL holder,
or that we think you are a criminal or bad person. They are simply
ways that we can deal with the issue of a gun being present in order
to maintain our safety and the safety of others.
Hopefully, this will give you some guidelines on what we are
expecting when you come in contact with us while carrying a
firearm. With respect and understanding, we can all feel safe with an
armed citizen, while respecting that citizen’s right to carry. Thanks
for reading, buckle up, and be safe!
