Presumed Innocent Until Proven Guilty GARVIN COUNTY 3 | DECEMBER 2022
A 47-year-old Pauls Valley man was put behind
bars after he allegedly failed to renovate a home
he was paid to complete.
Reports state the Garvin County Sheriff’s Department was contacted on October 11, 2021,
and advised about a possible fraud incident. A
resident said Elmer Guardado was hired to remodel a mobile home.
Guardado, a remodeling contractor, signed a
written agreement to complete the work on November 8, 2021. He was paid $84,000 to remodel
the mobile home. The remodel was never completed, however.
The resident attempted to contact Guardado
several times. Every attempt failed until May 2022.
Guardado then signed another agreement promising to complete the
remodel by June 30. Once again, no work was completed and Guardado
stopped answering the resident’s phone calls.
Guardado is being charged with violating the Home Repair Fraud Act.
His bond was set at $5,000, and he is scheduled to appear in court on
December 2, 2022.

THE KEY THAT UNLOCKS MANY DOORS
Marietta man Brent Fincher, 58, was arrested early last month for allegedly robbing
a gas station after he didn’t want to pay for a
fountain drink.
According to reports, Fincher went to the
Marietta One Stop to buy a soda. He walked
into the store, made himself a fountain drink,
and walked up to the register. He told the
cashier that he wasn’t going to pay for the
drink. He also advised the cashier that it was
a robbery.
The cashier froze, so Fincher walked around
the counter and started going through the
cash register. At some point, he put his hand
in his pocket acting like he had a weapon,
but he wasn’t actually armed. He also didn’t leave the store with any money.
When another customer walked into the store and he noticed that the cashier was calling 911, Fincher left the store with the key that opened the cash
register drawer.
Officers reviewed security footage from the store. An employee identified
the man as Fincher.
Officers went to the man’s residence near Oak Street and Driftwood Avenue. Fincher still had the cash register key in his possession.
When officers confronted the man, he stood in a fighting stance and refused to comply with officer demands.
Officers placed the man under arrest and transported him to jail.
Fincher is being charged with first-degree robbery and resisting arrest. His
bond was set at $100,000, and he is scheduled to appear in court on December 21, 2022.

16 | DECEMBER 2022 MURRAY COUNTY Presumed Innocent Until Proven Guilty
DECEMBER IS DRUNK DRIVNG
PREVENTION MONTH
Despite the fact that it’s illegal to drive drunk, one person was killed every 45 minutes in a drunk driving crash on our nation’s roads in 2020. That’s a total of 11,654
people who died in alcohol-impaired driving crashes in one year. Even a small amount
of alcohol can affect driving ability. In 2020, there were 2,041 people killed in alcohol-related crashes where a driver had a BAC of .01 to .07.
Be Responsible: Have a Plan
Your life and the lives of others on the road are at risk every time a driver gets behind
the wheel after drinking. Here are a few tips to stay safe.
• Before drinking, choose a designated driver, or schedule a ride-sharing, ride-hailing or taxi service.
• If you are hosting a party where there’s alcohol, offer non-alcoholic drink options
and make sure all guests leave with a sober driver.
• Always wear your seat belt — it’s the best defense against drunk drivers.
• If you see a drunk driver on the road, safely pull over and call law enforcement.
The Cost of Drinking and Driving
Drunk drivers face jail time when they’re caught, and the financial impact is devastating. On average, a DUI can set you back $10,000 in attorney’s fees, fines, court
costs, lost time at work, higher insurance rates, car towing, and more. And, drinking
and driving can result in losing your driver’s license and your car — imagine trying to
explain that to your friends, family and boss.
The Effects of Blood Alcohol Concentration
Alcohol consumption impairs your thinking, reasoning and muscle coordination —
all vital to operating a vehicle safely. You begin to feel the effects of alcohol at a BAC
under .08.

Graham Price of South Wales ripped off the bank where he worked, but he wasn’t
completely duplicitous. He left a note in the safe: “Borrowed, seven million pounds”—
signed “Graham Price.”
A Good Samaritan noticed an elderly man being robbed, so he jumped in and
punched the thief. The thief was so upset, he called the police to complain.
When Stephan Crane broke into the Ravelli Republic (Montana) newsroom, he used
the computers to watch porn and check Facebook. Then Crane doused the offi ce with
a fi re extinguisher, took some candy, and left. It wasn’t diffi cult to fi nd him, however; the
police just followed the trail of stolen M&Ms that led to his sister’s place across the way.
When police in Vancouver, Canada, asked to search Jason Pauchay’s apartment
for drugs, he was not a suspect—in fact, they were looking for someone else. That all
changed when they got a look at how his name was listed on his cell phone: “Jason
Pauchay Drug Dealer.”
Two men decided a back-to-school event at an offi ce supply store would be the perfect time to do some shoplifting. After all, store clerks would be busy helping an infl ux of
shoppers. The sale happened to coincide with the annual “Shop with a Cop” day when
about 60 police offi cers show up to help children pick out school supplies.
Adan Juarez Ramirez had it all fi gured out—he could be a cop without having to take
the boring test. But he was arrested in Grapevine, Texas, after pulling over a driver in his
pickup truck, outfi tted with fl ashing lights. He even had an ID badge, which he’d made
by blacking out a restaurant gift card and etching in the word “POLICE.” However,
he’d kept the restaurant’s logo, a jalapeño pepper surrounded by the words “Chipotle
Mexican Grill.”
A Target store in Augusta, Georgia, agreed to take back a printer from a dissatisfi ed
customer. Then the clerk noticed some work the customer forgot to remove from the
machine: Counterfeit bills.
Two machete-wielding men barged into a Sydney, Australia, bar demanding money.
They didn’t know the club was hosting a bikers’ meeting at the time. One of the robbers
ended up in the hospital, the other hog-tied with electrical wire.
In Mesa, Arizona, a home break-in was foiled when the burglar jumped through the
bedroom window—and got trapped in a clothes hamper. Cops took it from there. (That
defi nitely wasn’t the kind of clean getaway he had planned.)

AROUND THE STATE
Gotta catch ‘em all!
For the past several months, the Tulsa
Police Department has been investigating a
fraudulent Pokémon Card Scam.
Detectives were contacted by five victims
across the United States. Victims in Hawaii,
Arizona, Texas, Colorado and Ohio all reported buying rare and high value Pokémon
cards from the suspect in Tulsa, identified as
Michael McCoy.
Each victim purchased the cards for thousands of dollars only to find out the cards
they received were fake.
During the investigation, Detectives partnered with a special prosecutor with the Tulsa County District Attorney’s Office
who specializes in intellectual property and trademark infringement. Through
collaborations with Nintendo Corporation, a representative determined that
the Pokémon cards were in fact counterfeit. The cards that were sold by the
suspect had little to no value on their own, however were being sold as “rare
collectors cards” for $350 per card.
On November 1, Officers arrested Michael McCoy at a local Post Office as
he was in the process of mailing more counterfeit cards to another potential
victim.
McCoy is now charged with:
- Obtaining Merchandise by False Pretense over $1000 x 5
- Violation of Trademark Anti-Counterfeiting Act
McCoy also had warrants for his arrest out of Arkansas.
This is an arrest, not a conviction.
