AROUND THE STATE
Armstrong won’t be able to use the “Get out
of Jail Free” card for this one.
On November 26, around 6:30 p.m., officers responded to a call of shots fired at a
home near 4th Pl. and 91st E. Ave. after a
family game night turned violent.
The caller said John Armstrong chased
them down the street with a gun and fired a
shot at the caller and her father. Officers arrived and took Armstrong into custody.
The investigation revealed that the family
was drinking alcohol and playing Monopoly
when a fight broke out between John Armstrong and his stepfather. After knocking over
the Monopoly board and turning over furniture, another family member told
Armstrong and his stepfather to take the fight outside.
During the fight outside, Armstrong suffered a cut to his head, then pulled
out a pistol and chased his stepfather and stepsister down the street at gunpoint. Armstrong admitted to firing one round.
Officers found Monopoly money and game pieces scattered around the
living room. Neighbors reported hearing a gunshot from the street. Officers
believe Armstrong hid the pistol before they arrived, and the gun was not
located.
He was arrested for Assault with a Deadly Weapon.

PROTECTIVE ORDER VIOLATION
6 | JANUARY 2023 Presumed Innocent Until Proven Guilty LOVE COUNTY
MISTAKES WERE MADE
A Marietta man thought he could outrun
the sheriff and other law enforcement officers
during a traffic stop early last month; he was
wrong.
Gary Lynn Clifton, 52, was charged December 13 with DUI, eluding/attempting to elude a
police officer, DUS, TOC, and resisting an officer in Love County District Court.
According to Sheriff Andy Cumberledge in
a press release, shortly after 1:00 pm on December 12, Sheriff Cumberledge and Reserve
Deputy Wilhite were traveling back to the office
after having dropped off a patrol vehicle in Ardmore for maintenance. While in route back on
Highway 77, a vehicle passed them and the
vehicle in front of them at a high rate of speed in a no passing zone. Once
safe, they passed as well, and at that time, the vehicle again passed another
vehicle in a no passing zone, going even faster. Once in a safe area, they
passed the second vehicle and activated the emergency lights to stop the
vehicle.
The driver, later identified as Clifton, then sped up to speeds over 100 mph
in an attempt to evade and elude. He continued on until turning onto Memorial in Marietta, then turned onto C.E. Colston Drive and into the Dollar General,
where he parked the car and got out.
During the course of the investigation, it was determined that Clifton had
a suspended license, he was under the influence of alcohol, and when he
was told he was under arrest began to resist and fight. He was arrested and
booked into the Love County Justice Center.
Clifton pleaded guilty at his preliminary hearing and was sentenced to one
year in jail with all but 60 days suspended.
Sheriff Cumberledge wishes to thank Marietta Police Officers Allen, Fox,
and Carroll for assisting with this incident.

A CHUNK OF COAL FOR CHRISTMAS
An Ardmore man is facing several felony
charges and five misdemeanor charges after
he allegedly attacked his parents, ran from
police, and then tried to ram his truck into a
deputy’s patrol unit.
Justin Wade Herriott, 43, was charged with
two count of misdemeanor domestic assault
and battery, disrupt/prevent/interrupt emergency telephone call, eluding/attempting to
elude police officer, and resisting an officer.
He also faces felony charges of assault and
battery with a dangerous weapon and malicious injury to property over $1000, in Carter
County District Court.
Court records state that on December 6,
Herriott allegedly attacked his parents, ripped out their land-line phone by
the cord, and threw his dad’s his cell phone across the yard. He then fled the
scene, destroying multiple gates and fences, along with other items belonging
to his parents. Total loss was valued at over $1000.
Deputies eventually caught up with Herriott, but he tried to elude the deputies by attempting to ram his Silverado truck with hay spikes into the deputies’
patrol units.
Herriott was taken into custody and placed under arrest. His bond was set
at $250,000 and he is scheduled to appear in court for his preliminary hearing
on January 12, 2023.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.
Thank you and God Bless

Oklahoma Bureau of Narcotics agents, along with
the Murray County Sheriff’s Department and Oklahoma Highway Patrol, seized a sizable amount of illegal
drugs and arrested a suspect during a sting operation
in Murray County.
Efren Favela-Diaz of Wichita, Kansas, was charged
December 12 with aggravated trafficking methamphetamine, in Murray County District Court.
Reports state the investigation netted five pounds
of methamphetamine at a pre-determined drop location near State Highway 7 and Interstate 35 in Murray
County, and an additional eight pounds of meth was
discovered by Kansas law enforcement investigators
in Kansas.
Favela-Diaz was taken into custody and transported to the Murray County jail. His bond was set at
$200,000 and he is scheduled to next appear in court
on January 26 for his preliminary hearing.

Presumed Innocent Until Proven Guilty MARSHALL COUNTY 19 | JANUARY 2023
A sex offender who was on the run for 15 years
was apprehended in Marshall County last month.
According to reports, 65-year-old David Vance
Smith recently moved to Kingston from Texas. He
had not registered as a sex offender since 2007 in
Abilene, Texas.
In 1991, he was convicted of indecency with a
14-year-old.
Part of his sentencing included being required
to verify his information to authorities yearly.
The Marshall County Sheriff’s Office found
the man in the southeast part of the county and
placed him under arrest.
Smith is being charged with failure to register as
a sex offender and falsely impersonating another to create a liability. His
bond was set at $2,500, and he is scheduled to appear in court on January
25, 2023.

Joseph Goetz’s alleged attempt to rob a York, Pennsylvania, bank met with some
snags. Cops say the fi rst teller he tried to rob fainted and the next two had no more
cash in their drawers. Fed up, Goetz stormed out, threatening to write an angry letter
to the bank.
A German bank robber sent mocking emails to local police, ridiculing their eff orts to
arrest him. First, he let them know they had his age, build, and accent wrong. Then he
corrected their announcement that he’d escaped on foot; no, he had a getaway car!
The cops got the last word in, though, when they arrested the guy a few hours later.
They used his email to trace him.
After a man kicked in the front door of a Texas home at 3:30 a.m., the resident fl ed
and called police. When cops arrived, they were surprised to fi nd that the intruder
hadn’t stolen a thing. Police found the man in the bathroom, enjoying a warm bath.
Robby Rose lost his fi rst-place medal and was charged with a felony after it was
discovered that he’d cheated in a Texas fi shing tournament by stuffi ng a one-pound
weight down the throat of a bass he’d caught. Offi cials became suspicious when they
placed Rose’s fi sh in a tank and it sank to the bottom.
According to the bus driver, it was a brutal, unprovoked attack. A woman got on his
bus and assaulted him with a half-eaten banana. “I had banana all over me,” he insisted. “On my tie, my shirt, and my eye.” The woman explained that the driver had almost
hit her car and that when she entered the bus to rationally discuss the matter, the banana slipped … right into his tie, his shirt, his eye … The court may not have believed
that, but it did believe her when she argued that it was “unreasonable that a banana
could cause this much damage.” They slapped her with a fi ne of only about $100.
Police in Pico Rivera, California, had an easy time pinning a four-year-old murder on
Anthony Garcia. That’s because he pinned it on himself—with an elaborate tattoo on
his chest, depicting the killing. Cops noticed the incriminating ink when taking Garcia’s
mug shot for a petty crime. The tattoo revealed all the details of the night, from the
Christmas lights and bent streetlamp near the liquor store where the body was found to
the image of an angry helicopter—Garcia’s nickname was Chopper—machine-gunning
the victim.
James Rhyne of Memphis was charged with forgery after he handed a waitress a
$100 bill. The waitress knew something was funny with the money: Instead of the portly
visage of Ben Franklin, it was the star of the $5 bill, Abe Lincoln, who was staring back
at her.
A woman in Somerset, Massachusetts, was arrested for breaking and entering. But
she was quickly caught thanks to her ankle bracelet … the one fi tted with a GPS system … that she had gotten from the police … for being on probation from an earlier
breaking-and-entering case.

STRIKE TWO
The McClain County Sheriff’s Office seized 1,800 marijuana plants Wednesday, December 7, at an illegal marijuana grow operation in Blanchard.
Deputies assigned to execute a Forcible Entry and Detainer Writ of Assistance at the address discovered the facility was an illegal grow.
Deputies later executed a Search Warrant at the facility where more than
1,800 marijuana plants were located in various stages of growth. Deputies
seized the illegal plants and released several workers pending further investigation.
This is the second time an illegal grow facility has been shut down at the
facility this year. The Oklahoma Bureau of Narcotics, Dibble Police Department, and McClain County District 3 Commissioners Office assisted with the
operation. Sheriff Landy Offolter is committed to holding persons accountable
for operating outside the confines of the Oklahoma Medical Marijuana Act and
is thankful for partnerships with State and Local Law Enforcement Agencies.

CHILD ENDANGERMENT
Presumed Innocent Until Proven Guilty MCCLAIN COUNTY 23 | JANUARY 2023
BEWARE OF CYBER CRIME!
With new tablets, gaming consoles, smartphones, and other electronic
devices being purchased for you or the children in your home, it’s essential to be aware of the risks involved with children using electronics with
internet access.
With a variety of new social media applications, online forums, and chat
rooms increasingly being used by young people, the risk of children and
teenagers being contacted by online predators continues to rise. Young
people may participate in in-game chat conversations or other online conversations with people they believe to be their peers. However, child predators often use these forums to masquerade as young people. Although
these conversations may start innocently, grooming can be a gradual process that increases in severity until sexually explicit requests are sent to
the unsuspecting child.
If you have children in your home or under your supervision, it is important to be aware of their online activity and any changes in their behavior.
It can also be helpful to have conversations with children regarding online
safety and protecting their privacy. Letting children in your care know that
they can always talk to you regarding concerning interactions can also be
a key step in prevention, as many predators warn potential victims to stay
silent due to a fear of not being believed.
The OSBI’s Internet Crimes Against Children (ICAC) Unit works diligently
to protect Oklahoma’s children, but we never want to see your name or
the name of your loved one come across our desk. To help us protect your
children, you can learn more about the warning signs of online grooming
and how to discuss online safety with children you love at this link from InternetMatters.org: https://www.internetmatters.org/.../protect-your-child/.
You can learn more about the National Center for Missing and Exploited
Children’s NetSmartz program, which teaches children age-appropriate
online safety at...
