offi cer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. this
is not true. we feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
there are companies who do take money to remove a
person’s arrest information. oK Jailbirds never has and
never will. if an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

Blackwell man McElvie Palmer Herrington, 28, told an
officer all he wanted was a beer after police found him sitting fully nude with his frank and beans fully exposed in a
rock fire pit.
According to the affidavit, Blackwell police were dispatched to a residence in the 400 block of E. Blackwell Avenue in the early morning hours of April 27, after residents
complained that there was a man screaming in the backyard.
When police arrived, they found Herrington sitting in the
fire pit, nude and screaming that he wanted a beer. He was
also bleeding from random cuts on his body.
The thirsty nudist told the arresting officer, "I'm bored,
what are you going to do?”
After police smelled the stench of alcohol coming from Harrington's breath and person, it was no doubt that they knew what they had to do.
Getting arrested probably wasn't what Herrington had in mind.
The naked lone reveler continued his bizarre behavior by picking up a large rock (the
arresting officer estimated it to be a foot long and weigh 25 pounds) and throwing it at
the officers.
Luckily, no officers were harmed, but Herrington's naked tirade was coming to an end.
At that point, officers attempted to arrest Herrington, but Herrington resisted and
would not comply with officer commands. An officer was eventually able to place handcuffs on the unclothed suspect.
Herrington kicked an officer a couple of times before he was placed in the patrol vehicle and transported to jail.
Herrington is being charged with assault and battery with a deadly weapon and resisting an officer. His bond was set at $2,500, and he was scheduled to appear in court on
May 16, 2014.

Mary Elizabeth Morgan Pewitt, 25, was found inside her
residence in Comanche, on June 4, 1988. A divorced mother of
two, Mary worked at a local bar and had closed the establishment
around midnight June 3. After driving over to the bar owner’s
house where she dropped off the day’s proceeds, she returned
home where she was met by a boyfriend. Mary and her boyfriend
visited for a short while before he left the residence, becoming
the last person known to have seen her alive. It was shortly after
the boyfriend’s departure that investigators believe someone
entered the house and viciously stabbed Mary to death. Mary
had recently been involved in a volatile relationship regarding
child support. On the night she was murdered, Mary’s children
were not at the home because they had spent the night with Mary’s parents. The OSBI
did not enter the case until 1997 when the agency asked to assist the Comanche Police
Department.
Mary’s family is holding an event June 4, 2014 in Comanche at Jackson Park. It is a
celebration of Mary’s life and a rally for justice for her. For more info on the event, and to

Oh, to be young again…
Police have arrested a high school sophomore after they learned she gave them a false
name and is actually 31 years old.
KLTV reported the Longview, Texas, investigation found Charity Anne Johnson is 31.
Johnson was enrolled at New Life Christian
School as “Charity Stevens.”
School officials said a person claiming to be
her guardian brought her to enroll.
She gave the school a fake birth date that
would have made her 15.
The school discovered her false identity Tuesday.
She has been at student at the school since October 2013.
Resident Tamica Lincoln said Charity told her she was 15 and needed a place to stay back in March.
“I sympathized with her and invited her into my home,” Lincoln told
KLTV. “I took her in as a child, did her hair, got her clothes and shoes.”
Lincoln said Charity claimed she was abused by her biological father
and that her mother was dead.
Lincoln told KLTV she acted as Charity’s guardian and even met
with Charity’s 10th grade teachers at New Life Christian School.
“I just don’t know why she did it,” Lincoln said. “Why put yourself
and others at risk to do something like this? I have deep concerns
about her being who, we don’t know she is, and then she’s out there
at the school.”
Lincoln said she called police and went straight to the school as soon
as soon as she realized Charity was using a fake identity.
“Teachers were crying and students were crying and her best friend
just couldn’t believe it,” Lincoln said.
Johnson was arrested for failure to identify/giving false, fictitious
information.
KLTV said she is in the Gregg County Jail on $500 bond.

A Bartlesville man with his man chest
exposed in a park was arrested when
police found him passed out on a bench
on May 5.
According to the affidavit, a Bartlesville officer was on patrol when he saw
a sleeping man sitting upright on a park
bench with no shirt on.
Police approached the man and stood
around him with their flashlights on.
The man didn't wake up from the lights,
nor did he respond to verbal commands.
An officer shook the suspect by the shoulder and he eventually
woke up.
The sleeping suspect, identified as 19-year-old Dakota Layton
Jackson, smelled strongly of alcohol. When the officer asked him
what his name was, Jackson mumbled some words that the officer couldn't understand.
Jackson continued to ramble without making any sense until the officer asked him if he had been drinking. He responded,
"Yeah, a little."
Jackson then allegedly told the officer, "I know what you got to
do. I know, I know."
The officer asked Jackson if he had any warrants, and Jackson
said no. He was wrong.
The officer placed him under arrest for the warrant and asked
him if he had anything illegal on him. Jackson said no, then told
the officer, "The weed in my pocket is probably mine."
Well, whom else would it belong to?
In Jackson's front pocket, the officer found a small marijuana
pipe with a burnt residue.
Jackson is being charged with unlawful possession of drug paraphernalia and public intoxication. He was released on a $1,000
bond and is scheduled to appear in court on May 27, 2014.

Going my way?
A Tennessee woman is behind bars after police say she broke into an
Englewood fire station and stole an ambulance.
Authorities say 41-year old Terri Efaw broke into the fire station on Carroll
Street and drove straight through the large bay door early Saturday morning.
“The ambulance crew heard a vehicle start up,” said Englewood Fire
Chief Billy Roach. “They heard the racket, came outside and she was driving
straight through the bay doors.”
Storms that moved through the area knocked out power to the security
system on the doors so Efaw was able to break in without alerting authorities.
“This week we had storms and the power went off,” Roach said. “We have
electronic codes on them and once the powers out, if the battery back up doesn’t kick in, it unlocks
the door.”
They say Efaw only made it about two miles before she was stopped by police. Englewood
police officer Nick Purkey said when the call came out, they immediately began looking for the
ambulance.
Authorities spotted it on Highway 39 and with the assistance of the McMinn Sheriff’s
Department were able to stop the vehicle on Highway 30 in Athens by blocking her in.
Officials estimate the damage to the door at $3,000 and the ambulance at $5,000. The
ambulance is valued at $100,000.
Efaw was arrested without incident. Authorities said she told them she was pregnant and had
to rush to the hospital. She is charged with theft, vandalism, and criminal trespassing.
She’s currently at the McMinn County jail on an $11,000 bond.

Not many people wear fanny packs anymore, but when they do, they just might
be hiding something suspicious.
Apparently, no one told John Frederick Hutchinson that fanny packs were so
90s, because the 56-year-old Purcell man was caught wearing one with a plethora
of illegal items inside.
Maybe he just likes to keep his drugs within reach.
According to the affidavit, Chandler police were advised on April 11 that
Hutchinson, who was wanted on a Lincoln County felony warrant, was walking
southbound on Dewey wearing a fanny pack. Police located a man that matched
the description of the suspect walking southbound on Iowa north of Eighth Street.
They made contact with the suspect and positively identified him as Hutchinson,
and placed him under arrest for his warrant.
Before placing Hutchinson in the patrol vehicle, the officer conducted a search and asked him if he
had anything the officer needed to know about. Hutchinson admitted that he had marijuana in his
fanny pack.
That wasn’t the only thing.
Hutchinson told the officer where to locate the drug. The officer bravely went where not many have
gone before — inside another man’s fanny pack to locate the weed.
The officer found a green leafy substance that tested positive for marijuana, two packages of rolling
papers, a syringe and three lighters.
Someone was ready to party out of his fanny pack.
Hutchinson is being charged with possession of a controlled dangerous substance and unlawful
possession of drug paraphernalia. His bond was set at $3,000.

AG’s Statement on Execution Review
“It is important to review the events
surrounding the execution of Clayton
Lockett to ascertain what transpired
and to ensure the death penalty is
administered correctly. It’s equally
important that any such review
be conducted with a commitment
to objectivity. Transparency and
impartiality in the fact-fi nding
surrounding this execution will give
Oklahomans confi dence and lend
credibility to the state’s most solemn of
duties: carrying out the sentence of death.
As the state’s chief legal offi cer, and to ensure the fair administration
of justice, I am taking the following actions:
• Assigning investigators from the Attorney General’s
Offi ce to work with DPS Commissioner Michael Thompson as he
gathers information on the execution of Lockett;
• Designating a special advisor(s) to assess the results of
the review of Lockett’s execution, and Department of Corrections’
procedures, and then to recommend, if necessary, any changes
surrounding such issues;
• Instructing my staff to work with lawmakers on any
relevant legislative proposals emanating from the review;
• Ensuring victims’ concerns in the process are addressed.

Tulsa man Samuel David McWhirt Jr., 39, was arrested in Wynona on May 11 because he just couldn't
seem to keep his vehicle in his lane.
An Osage County deputy pulled over McWhirt at
Fourth and Main Street after observing McWhirt's vehicle traveling all over the road, and McWhirt stopping
five feet short of a stop sign.
As soon as McWhirt stopped his truck, he exited and
started walking toward the deputy.
The deputy told McWhirt to get back in his truck, but
McWhirt shook his head no and kept walking.
He asked the deputy, "What the f--- did you stop me
for?"
The deputy instructed McWhirt to place his hands on the hood of the patrol car.
After being shown a Taser, McWhirt complied.
The deputy asked McWhirt if he had any weapons. McWhirt allegedly replied,
"Yes, an AK-47." After McWhirt tried to resist being searched, the deputy placed
him in handcuffs for his safety, but didn't find any weapons.
McWhirt showed several signs of intoxication, including slurred speech and red,
bloodshot, watery eyes. He also smelled of alcohol and was unsteady on his feet.
When the deputy told him he was under arrest for driving under the influence,
McWhirt told him, "There is no way you could tell I was drunk. You only followed
me for one block!"
The deputy put McWhirt in the patrol vehicle and called for a wrecker for McWhirt's truck.
McWhirt became angry and told the deputy he had the right to call a family member to come get his truck. When the deputy told him that was incorrect, McWhirt
asked him, "What do you know [expletive]? What, have you been a cop for two
days?"
As the deputy transported the angry man to jail, McWhirt called him a series of
names, including "four eyes" and others that we're not allowed to publish here.
He told the deputy that he was going to "get out of this" because he had more
money and better lawyers than the deputy.
A check of McWhirt's criminal history revealed that that McWhirt had four previous DUI convictions.
McWhirt is being charged with driving a motor vehicle while under the influence.

on June 20, 2014.

June’s Officer of the Month Award goes to…
Athena • Pushmataha County
Athena
Officer of the Month
Athena is a K-9 Officer with the Pushmataha
County Sheriff’s Office. She was nominated for her
loyalty and quick action when a deputy was being
assaulted by a suspect. She is one of three K-9 officers the county has on the street.
On April 8, Antlers dispatch radioed that an officer needed help on NE A Street in Antlers. The
suspect, Barney Sutterfield, was being placed under
arrest for an outstanding warrant when he ran from
police. After a Pushmahata deputy later located Satterfield, Satterfield again resisted arrest and tried
to escape. Several times Satterfield was warned to
stop resisting or the deputy would release his K-9,
Athena, and he would be bitten. Satterfield did not
heed the warning and began kicking the officer. On her own, Athena bit Sattefield on the leg.
Athena’s actions forced Satterfield to stop assaulting the deputy and was taken into custody.
Because of Athena’s quick action, she has been named OK Jailbird’s Officer of the Month
for June, 2014.

If a victim does not say “no” or
does not “fight back,” it is not
sexual assault.
False. Sexual assault victims may not say
“no” or not fight back for a variety of reasons
including fear and confusion. Rape victims often
report being “frozen” by fear during the assault,
making them unable to fight back; other victims
may not actively resist for fear of angering the
assailant and causing him to use more force in
the assault. Pressure to be liked and not be talked
about negatively by a peer will sometimes cause
adolescents or children to avoid fighting back or
actively resisting.

Cleveland man Evan Cole Baird, 20, became angry
after he was arrested for driving under the influence on
May 3, and he threatened to "take that badge off" an officer's neck.
According to the affidavit, a Cleveland police officer
pulled over Baird's vehicle at the intersection of Broadway and Wichita after he noticed that the vehicle did not
have working tail lamps.
While speaking to Baird, the officer noticed the odor of
alcohol emanating from Baird's breath and person.
The officer asked Baird to step out of the vehicle. Baird
was unsteady on his feet; when the officer asked, he admitted in slurred speech to drinking two beers before
driving.
After sobriety tests showed Baird definitely wasn't sober, the officer placed him in the
patrol car and went to speak with Baird's passengers.
Baird wasn't having any of that.
He started yelling and screaming and used his mouth to unlock the car and roll down
the window. He yelled at the officer for shining a flashlight in his vehicle, and told the
officer he was violating his 4th amendment rights.
The officer rolled the window back up and locked it, but Baird just became angrier and
started banging his head against the window.
Once they were at the jail, Baird told an officer that he was going to "have" his job. He
said he was going to sue the officer, get him fired and have him put in prison.
He also told another officer that he was going to take the badge off of his neck.
Good luck with all of that!
Baird is being charged with driving a motor vehicle while under the influence of alcohol and improper tail lamps. He was released on a $5,000 bond and is scheduled to
appear in court on June 3, 2014.

As the weather starts to warm
up, recreational thoughts naturally
turn to the wonderful lakes
and other waterways in the state of Oklahoma. Along with the
increase of activity in and around the water, comes the potential
for drownings or near drownings, most of which can be prevented
with the use of Personal Floatation Devices. I’ve talked about them
before, but a refresher never hurts, so here goes!
First, let me just say that there are 5 types of PFDs. I’m not
going to get into their descriptions, just which types are required
for what situation. All PFDs must be U.S. Coast Guard approved,
and used in accordance with their label. The label will also state
the type. All vessels must carry one wearable (Type I, II, III,
or V) USCG approved PFD for each person on board or being
towed. In addition to that, vessels 16 feet in length or longer
must have one Type IV USCG approved PFD on board and readily
accessible. Oklahoma Law requires that all children under 13 years
of age wear an approved PFD whenever underway in a vessel less
than 26 feet in length. Each person on a personal watercraft or
sailboard must wear an approved PFD. Anyone being towed on
water skis or similar devices must wear an approved PFD. Ski belts
are not approved PFDs.
Now, besides being USCG approved, all PFDs must be: In good
serviceable condition. They must also be readily accessible. Readily
accessible means you must be able to put the PFD on in a reasonable
amount of time in an emergency. PFDs should not be stowed in
plastic bags, in locked compartments, or have other gear stowed on
top of them. They must also be of the proper size for the intended
wearer. Sizing for PFDs is based on body weight and chest size. A
good way to test this, especially for children, is to put it on, adjust
the straps, and have the wearer raise their arms up, and try to pull
it up off them. If it can come off, it is not the right size for the
wearer.
Those are the requirements, so now lets talk about the
suggestions. If you have children in or around water, make
sure they have a PFD on. Air mattresses, floaties, and other toy
floatation objects don’t count. There have been way too many
stories of toddlers near the water’s edge falling in and drowning,
and these could be prevented by following this suggestion. Also,
keep a watchful eye on those kids...even if they are only out of
your sight for a few seconds, its long enough for them to get in
trouble around the water. Last, wear one on boats even if you don’t
have to. In an emergency, you may not have enough time to put it
