On May 28, an officer with the Poteau Police Department was
dispatched to an apartment complex to investigate multiple reports of a disturbance. When he arrived, a crowd of people told
him that an apartment in the complex was on fire.
According to the police report, the crowd also gave a description of the subject, later identified as Eric Scott Branstetter, 36,
but the Poteau man was not immediately located.
The officer noticed a female victim lying on the sidewalk in
front of the apartment. She identified herself as Branstetter’s
girlfriend and told the officer that she and Branstetter had got
into an argument earlier that evening. She said Branstetter
began breaking things in the apartment and struck her with a
glass mug, causing her vision to blur.
The victim believed she momentarily lost consciousness and
said when she regained consciousness, she could smell smoke
in the apartment.
Another victim spoke to the officer and said Branstetter had also assaulted her. She explained that she went to the apartment to check on Branstetter’s girlfriend and saw the subject sweeping up broken glass.
She allegedly told Branstetter that she was going to the police and he told her that he would
stab her. According to the victim, Branstetter retrieved a pocketknife from his pocket and
chased the victim for a few seconds before running from the apartment complex.
About an hour later, police located Branstetter and attempted to place him under arrest.
When Branstetter saw the emergency lights of the patrol car, he took off running and ignored
the officer’s multiple commands to stop.
The running arsonist reached toward his front pockets and the officer, remembering the
victim’s allegations that Branstetter had a pocket knife in his pocket, activated his Taser. He
ordered Branstetter once more to stop running; when Branstetter refused to comply, the officer deployed the Taser and Branstetter dropped to the ground.
Branstetter continued to exercise defiance and actively resisted the officers that attempted
to place him in handcuffs.
He is being charged with first-degree arson, two counts of assault and battery with a dangerous weapon and obstructing an officer. Branstetter’s bond was set at $75,000 and he is
scheduled to appear in court on June 25, 2013.

angered by acts
of ungodliness,
unrighteousness, injustice, and inequity. These things anger
God as well.
But if you are angry because someone has disturbed
your pride, self-sufficiency, status, prestige, or power.
your reaction will likely be sinful. And sinful anger is often
expressed in harshness, cruelty, bitterness, and a lack of
control.
We must examine our hearts when our kids make us angry.
If it is righteous anger, let it motivate you to take action and
deliver consequences. Sin needs to be addressed, and we
honor God by delivering those consequences with empathy
and love. If it is sinful anger, pray for the courage to confess
it, repent, and resolve it.
Examine your anger to determine the motives behind it.
(Ephesians 4:26-27) 26 And “don’t sin by letting anger
control you.” Don’t let the sun go down while you are still
angry, 27 for anger gives a foothold to the devil.

2013 for some reason seems to
be the year of the drowning. There
seems to have been a large number
of drownings so far on Oklahoma lakes and waterways, the majority
of which could easily have been prevented. I am going to cover
some of the rules on wearing Personal Floatation Devices, as well as
some strong suggestions regarding them, in the hopes that we can
slow down this alarming trend!
First, let me just say that there are 5 types of PFDs. I’m not going
to get into their descriptions, just which types are required for what
situation. All PFDs must be U.S. Coast Guard approved, and used
in accordance with their label. The label will also state the type. All
vessels must carry one wearable (Type I, II, III, or V) USCG approved
PFD for each person on board or being towed. In addition to that,
vessels 16 feet in length or longer must have one Type IV USCG
approved PFD on board and readily accessible. Oklahoma Law
requires that all children under 13 years of age wear an approved
PFD whenever underway in a vessel less than 26 feet in length. Each
person on a personal watercraft or sailboard must wear an approved
PFD. Anyone being towed on water skis or similar devices must
wear an approved PFD. Ski belts are not approved PFDs.
Now, besides being USCG approved, all PFDs must be: In good
serviceable condition. They must also be readily accessible. Readily
accessible means you must be able to put the PFD on in a reasonable
amount of time in an emergency. PFDs should not be stowed in
plastic bags, in locked compartments, or have other gear stowed on
top of them. They must also be of the proper size for the intended
wearer. Sizing for PFDs is based on body weight and chest size. A
good way to test this, especially for children, is to put it on, adjust
the straps, and have the wearer raise their arms up, and try to pull it
up off them. If it can come off, it is not the right size for the wearer.
Those are the requirements, so now lets talk about the suggestions.
If you have children in or around water, make sure they have a PFD
on. Air mattresses, floaties, and other toy floatation objects don’t
count. There have been way too many stories of toddlers near the
water’s edge falling in and drowning, and these could be prevented
by following this suggestion.
Also, keep a watchful eye on those kids...even if they are only out
of your sight for a few seconds, its long enough for them to get in
trouble around the water. Last, wear one on boats even if you don’t
have to. In an emergency, you may not have enough time to put it
on.

An angry McAlester woman refused to
bury the hatchet, but instead attacked a
man.
Lydia Hutchings, 55, was arrested for assault and battery with a dangerous weapon
after she attacked a man with a knife.
According to the affidavit, McAlester police were dispatched to a residence on June
12 on a report that a male victim’s wrist had
been cut with a hatchet.
When police arrived, they found the victim sitting in a chair in the backyard and
observed that he was bleeding from his left wrist. The victim alleged
Hutchings had cut him with a hatchet. Officers asked the victim
where Hutchings was and he told them she was inside the residence.
Police noticed a chopping knife covered with blood lying on the
ground. There was also a large pool of blood on the ground from
where the victim had been holding his wrist. EMS arrived to take
care of the wrist and Hutchings was placed into custody.
Hutchings had blood on her legs and skirt, but told police she
was fine and didn’t need medical attention. An officer began to read
Hutchings her Miranda Rights, but she interrupted and said she already “knew all of that and understood it.”
The officer continued despite Hutchings’ familiarity with her rights
and she agreed to speak to the officer.
Hutchings explained that she and the victim were outside drinking and he hit her. She alleged that the victim hits her “all the time.”
After that, Hutchings said she went inside to change clothes and
couldn’t remember anything else because she was drunk.
The victim refused to give police a statement, but medical personnel told police he had three cuts on his wrist and one of the cuts possibly cut his artery.
Hutchings was transported to the Pittsburg County Jail where she
is being held on a $50,000 bond.

In today’s naked man news, a Des
Moines, Iowa, man was arrested after
he was found wandering around the
streets of McAlester naked as a jaybird.
On June 6, a McAlester police officer was dispatched to investigate a report of a male walking around with no
clothes on.
The officer found the naked man,
identified as 49-year-old Davis William
Allison, walking in the center median
with his clothes in his hand. According
to the police report, the officer instructed the man to put his clothes on and
Allison responded by asking the officer
if he was naked.
The officer told him that he was and again commanded Allison to
put on his clothing. Allison complied and the officer asked him why he
was walking around naked. Allison gave the officer a completely plausible explanation: he said that he was paranoid because he thought
someone was following him.
He had attempted to get someone to call the police department, but
when that didn’t work, Allison decided that he would walk around
naked to get the police to come to him.
Makes sense, right?
Once Allison was sufficiently dressed, the officer asked him if he
had taken any narcotics; he said he had smoked weed about an hour
earlier. As if he even had to ask, Allison inquired if he was going to
be arrested for indecent exposure. The officer obviously replied yes.
Allison’s plan to lure police worked a little too well and he was
placed under arrest. While searching Allison, officers found a used
needle and a clear plastic bag containing a white residue.
The paranoid nudist was transported to Pittsburg County Jail and
is being charged with indecent exposure, possession of controlled
dangerous substance and unlawful possession of drug paraphernalia.
His bond has been set at $250,000 and he is scheduled to appear
in court on July 17, 2013, after undergoing a competency evaluation.

Tulsa police arrested a man accused of holding his exgirlfriend’s children hostage for $100.
Police said the children’s mother called them and
said she was fighting with her ex-boyfriend, Cody Lee
Panther, and he took both of her children without her
permission.
She told police Panther then started texting her that
he would not bring the kids back if she did not pay him
$100. Police arrested Panther on two counts of child
stealing.

A Eufaula man pled guilty in federal
court on June 10 to felony Drug Conspiracy charges.
The charges against Clinton McKenzie
Bevenue, 36, were a result from an investigation by the Oklahoma Bureau of
Narcotics, the McIntosh County Sheriff’s
Office, District 25 District Attorney’s Drug
Task Force, Eufaula Police Department,
the Mesquite Police Department in Texas
and the United States Marshal Service.
Bevenue was indicted in March, 2013.
The indictment alleged that beginning
in or around December 19, 2012, Bevenue
did willfully and knowingly combine, conspire, confederate and agree
with others to knowingly and intentionally possess with intent to distribute and distribute 500 grams or more of a mixture or substance
containing a detectable amount of methamphetamine, a Schedule II
controlled substance.
Bevenue will remain in the custody of the United States Marshal
Service pending sentencing.
The statutory range of punishment is not less than 10 years imprisonment, and/or up to a $10,000,000 fine.

Shoplifting is never a good idea; trying to run from police while
throwing items at a police car while trying to escape after shoplifting is definitely never a good idea.
But, 49-year-old John Edward Hysell obviously wasn’t aware
of this when he decided to do all of the above on June 3.
According to the affidavit, Checotah police were advised of a
shoplifter at Walmart; dispatch told police that the bandit had
escaped in a green van. Police spotted the van and attempted to
stop the vehicle.
The driver, Hysell, refused to pull his getaway van over and
engaged police in a pursuit. During the chase, police say the
McAlester man drove in the wrong lane, trying to hit oncoming
vehicles. He managed to run three vehicles off of the road and
narrowly avoided being hit by two cars when he ran a stop sign.
Apparently realizing that police were not going to abandon the chase, Hysell began throwing items at the patrol cars and caused one patrol car to lose control and hit a fence. The
pursuit came to an abrupt stop when Hysell lost control of the van, drove through a fence and
rolled the vehicle.
Police found the vehicle upside down and Hysellf attempting to crawl out of the driver’s
side window. The crook was placed into cuffs and EMS was called to take him to the hospital.
Hysell is being charged with eluding/attempting to elude a police officer, assault and battery with a dangerous weapon, driving under suspension and petit larceny. His bond has been
set at $100,000 and he is scheduled to appear in court on August 7, 2013.

Guns are not toys and illegal guns probably shouldn’t be fired, especially while
the shooter is intoxicated.
Mathew James Gazaway, 34, of Midwest City, and Nathan Miles Butler, 33,
of Del City, learned that the hard way after they took the name of their location
too literally and got a little reckless at Crazy Woman Campground on May 25.
Haskell County police were dispatched to the area after hearing reports that
someone had been shooting guns in the area.
While investigating the call, officers spoke to a man that was fishing at the
loop and asked if he or anyone with him had been shooting a firearm. He said
no, but told police to check at the end of the loop. According to the affidavit,
police then heard a single gunshot and shined a spotlight down by the water.
They noticed a group of approximately 12 people; all but two people in the
group were minors. Two male subjects, later identified as Gazaway and Butler,
walked toward police with their arms raised in the air and said, “Don’t shoot.”
Police asked the men who had been shooting and one of the subjects said, “We
are.”
Police located the guns and noticed an 18-pack of beer sitting on the ground
near expended shotgun hulls and a box of shotgun shells. The subjects admitted
that they had been drinking,
While unloading the guns, an officer noticed one of the shotguns was an illegal
weapon due to the barrel length. Butler said it was his shotgun and had been
given to him by someone. Gazaway said the other shotgun was his.
Police started to run warrant checks on both subjects and stolen gun checks
on the firearms and discovered that the serial numbers on Gazaway’s gun had
been scratched off.
An officer explained to the men that both guns were illegal — one due to the
length of the barrel and the other due to the serial numbers scratched off. After
speaking to subjects about how much alcohol they had consumed and the odor
of alcohol, police determined that the men were intoxicated.
The gun-loving duo is being charged with possession of a sawed-off shotgun,
reckless conduct with a firearm, public intoxication and carrying a firearm while
under the influence. Their bonds were set at $10,000 and they are scheduled to
appear in court on July 23, 2013.

Antonio Younger, a 39-year-old convicted
sex offender, was jailed while wearing a wig
and sharpie marker eyebrows after Tulsa Police
picked him up on a warrant for failing to register as a sex offender.
According to Tulsa Police, Younger was arrested during a traffic stop in which he was
found sporting a wig and sharpie marker eyebrows.
Investigators say the warrant had been issued back in July 2011 when he failed to register as a sex offender or notify authorities of his
whereabouts following his release from prison.
According to court records, Younger served 5
years of a 9-year prison sentenced after he was
convicted of first-degree rape and intimidating
a witness. Upon his release, Younger was ordered to register as a sex offender
and notify authorities within 3 days anytime he had a change of address.
Younger apparently thought wearing a wig for the rest of his life would be a
far easier task to deal with.
He was booked into the Tulsa County Jail and charged with failing to register
with authorities.
