Donald Edward Brooks, 61, of Poteau, was sentenced to two years probation, a $5,000 fine, and
forfeiture of $75,720.73 for Receipt In Interstate
Commerce Of Misbranded Drugs And Devices.
The charges arose as a result from an investigation by the Food and Drug Administration Office of
Criminal Investigation.
The Information alleged that on or about December 4, 2013, the defendant, Donald Edward
Brooks, received, and caused the receipt of, misbranded drugs and devices in interstate commerce, namely Xeomin, Restylane, and Juvederm; and delivered and proffered for delivery those misbranded drugs
and devices for pay or otherwise.
The Honorable Steven P. Shreder, Magistrate Judge in the United States
District Court for the Eastern District of Oklahoma, in Muskogee, presided
over the hearing. Assistant United States Attorney Rob Wallace represented the United States.

54-year-old Gary Lee Branson was put behind bars and his whiskey-making business
was shutdown after officers found an illegal
distillery at his Eagletown home in January
2019.
He was arrested in April for the crime.
According to the affidavit, ABLE officers
were advised by a McCurtain County deputy in early January that there was an illegal
moonshine operation going on somewhere in
Eagletown.
The deputy said they learned during an investigation that Branson was allegedly making the booze at his home in the 3300 block
of Union Valley. The man was then taking the
moonshine to a nearby convenience store,
Short’s Beer To Go, who would sell it to customers.
Undercover officers bought some moonshine from the business on two
separate occasions.
In late January, officers went to Branson’s home.
As officers approached his property, they smelled an odor associated with
the manufacture of illegal moonshine.
They obtained a search warrant and returned to the man’s residence a
short time later.
During the search, officers from multiple law enforcement agencies seized a
variety of items, including collection pots, cookers, burners, thumpers, glass
containers (some were filled with liquid), bags of sugar, containers of yeast,
mash barrels and other items that were marked with Branson’s name.
The suspect was not home at the time of the search.
Branson is being charged with operation of whiskey still or distillery without
distiller’s license. His bond was set at $2,500, and he is scheduled to appear
in court on August 2, 2019.

Adair man Michael Tayler Conseen, 21, was
busted for selling drugs after police found illegal substances and paraphernalia in his campus apartment on April 25.
The affidavit states that an Eastern Oklahoma State College campus police officer
received a call from a student around 1:58
p.m., who said he smelled marijuana in the
common area of his campus apartment building. The housing directors went to the apartments and noticed that the smell became
stronger as they approached apartment B4,
which was leased to Conseen. No one answered when they knocked, so they entered
the apartment.
During the health and welfare check, the
housing directors found a total of 15 bags
containing a green leafy substance, a bag containing a crystal-like substance,
a vial of liquid labeled “Twisted Gear,” a small digital scale, and some hypodermic needles.
The directors turned the items over to police and the locks on the door were
changed.
The substances found in the apartment were identified as marijuana and
meth.
At approximately 7:46 p.m., an officer saw Conseen’s truck parked outside
the apartments. He went up to the man’s apartment to investigate. When he
walked inside, he found Conseen, who had climbed through the window and
was in the process of moving some of his stuff out of the apartment.
Conseen is being charged with possession of controlled drug with intent to
distribute within 2,000 feet of park or school possession of controlled dangerous substance within 2,000 feet of school with intent to distribute and unlawful possession of drug paraphernalia. His bond was set at $5,000, and he is
scheduled to appear in court on May 21, 2019.

An inmate fell through the ceiling while trying to escape from a jail in Indiana.
Jackson County Sheriff Rick Meyer posted on Facebook that 28-year-old Blaze
Ayers bolted from officers and locked himself in a medical room. When officers
got into the room, Ayers had made his way into the ceiling. The sheriff says
Ayers eventually fell through the ceiling and onto the floor of the jail’s booking
area. Officers used a stun gun to subdue him after he refused to surrender. The
sheriff says the attempted escape caused extensive damage to the ceiling.
Ayers was treated for minor injuries and is charged with attempted escape and
criminal mischief.
A teenager is on the run after leaving a literal paper trail at a robbery. Daniel
James Furstenfeld, 18, allegedly stole $2,000 from a home during a robbery in
northwest Harris County, Texas. Harris County deputies say a resident called
911 after he spotted a person wearing a ski mask in his home about 10pm in
the 18200 block of Arbormont Drive. The intruder ran out of the house and the
resident chased him. During the chase, the suspect turned toward the resident
and pulled what appeared to be a gun at him. At that point, the homeowner
gave up the chase and went home. Deputies say the intruder took $2,000 in
cash and other items from the home. When deputies arrived, they found a
traffic ticket and a cell phone near the spot where the suspect had reportedly
pulled the gun during the chase. Furstenfeld’s name was on the ticket. Witnesses also identified Furstenfeld as the suspect in the case. Furstenfeld is charged
with aggravated robbery with a deadly weapon and a warrant has been issued
for his arrest. Bond for the case has been set at $30,000.
Peter Fields realized something was wrong when he came home and found
his door broken. As he walked inside his Trenton, NJ, home, he heard his shower running, and couldn’t believe what he saw. “When I go in the house he
had smashed the alarm system off the wall and he was in the shower, taking
a shower,” Fields said. Peter Fields is a contractor who lives on Edgewood
Avenue. “I would never imagined this would have happened but it did,” he
said. Just one of those things.” Fields couldn’t believe the nerve of this thief.
Not only was he standing in his shower and rifling through his belongings, but
he’d been helping himself to a bottle of whiskey as he searched the house for
loot. “I saw him. I watched him. I gave the police the information while I was on
the phone watching him making sure he didn’t escape,” Fields said. And that
wasn’t all. The thief already had some of Fields’ clothes packed up for when he
left. They were all set out on a bed. “He got some clothes together, he went and
took some alcohol, had some alcohol you know,” Fields said. “You would have
thought he’d lived here. Police arrived quickly, arresting 28-year-old Antwan
Whiting as he was soaping up in the shower. The suspect hasn’t come clean,
and he’s being held on $50,000 bail charged with burglary, theft and criminal
mischief. Peter Shields says he’s been targeted before, but never by a thief who
wanted to clean up before he cleaned him out. “Some of the strangest things
happening in the city now,” he said.
Police are on the lookout for a brazen thief who broke into a YMCA through
the ceiling to steal cash from a register. The trouble is -- neither the cash nor the
register were real. Security footage captured the man kicking through the duct
work in the ceiling of the YMCA Child Development Center in Indio, California,
KESQ-TV reports. He then drops to the floor to break into a cash register, stealing all the money inside before making a daring escape out the door. There’s
just one problem: The cash register in question is a children’s toy, filled with play
money that is worth next to nothing. The Indio Police Department believes this
might not be the first acoustic ceiling tile-crushing caper this cat burglar has
sunk his claws into. “Thieves tend to have specific MOs, with stuff that they
follow and stuff that they are comfortable with. They don’t get caught doing it
once and they figure, ‘Hey, it’s a tried-and-true method,’ and then they stick to
it,” explains IPD Sgt. Dan Marshall.

Duane Allyn Bundy, 40, of McAlester, entered a
guilty plea in federal court to Possession With Intent To Distribute Methamphetamine. The crime is
punishable by not less than 10 years and not more
than life imprisonment, a fine up to $10,000,000,
or both.
The Superseding Indictment alleges that on or
about January 30, 2019, Bundy did knowingly and
intentionally possess with intent to distribute 50
grams or more of methamphetamine (actual), a
Schedule II controlled substance.
The charges arose from an investigation by the
McAlester Police Department, the Oklahoma Bureau of Narcotics and Dangerous Drugs Control,
and the Drug Enforcement Administration.
The Honorable Kimberly E. West, U.S. Magistrate Judge in the United
States District Court for the Eastern District of Oklahoma, in Muskogee,
accepted the plea and ordered the completion of a presentence investigation report.

A 27-year-old McAlester man was put behind
bars after he allegedly sneaked into a woman’s
home on April 29 and stole quite a bit of her important belongings, including her orange OSU
sweatshirt.
According to the police report, a McAlester
officer responded to a residence in the 900
block of Sixth to investigate a burglary. A woman told him that she was sleeping on her couch
when she woke up and noticed that it was light
outside and her phone alarm didn’t wake her
up. She got off the couch and walked to the
back door when she noticed something orange
go by her window.
The victim told the officer she watched as a
man wearing her OSU sweatshirt and carrying
two backpacks jumped on a bike and took off down the street.
The woman checked her stuff and noticed that the following items were
missing: her driver’s license, two credit cards, a checkbook, a debit card, a
Walmart gift card, nearly $100 in cash, her cellphone and charger, and two
computers. The suspect had also went through her kitchen cabinets and
refrigerator.
The woman explained the she wore a CPAP machine when she slept, so
she didn’t hear anything weird while she was sleeping. She also said that her
backdoor was extremely easy to open, even when it was locked.
Later that day, the officer was advised that the suspect, identified as Michael Paul Wright, was possibly at Walmart. Loss prevention officers had detained the man in the store. In his belongings, police found most of the items
that the victim had identified as stolen, including her debit card.
The victim advised officers that Wright had already used her card several
times. Officers found multiple receipts in Wright’s possession to prove it.
Wright is being charged with burglary in the first degree and unauthorized
use of a credit card. His bond was set at $2,500, and he is scheduled to appear in court on May 31, 2019.

June is Internet Safety Month
Computer interconnectivity has produced
enormous benefits, but has also enabled
criminal activity that exploits this interconnectivity for financial gain and other malicious purposes, such as internet fraud, child
exploitation, identity theft, and terrorism. The
Internet can give identity thieves, hackers,
and scammers online access to your computer, financial and personal information and
more. Additionally, today’s mobile devices are well integrated with the internet
and have far more functionality than mobile phones of the past. They are
increasingly used in the same way as personal computers, potentially making them susceptible to similar threats affecting computers connected to the
Internet.
For youths, the internet often serves as a positive and powerful arena for
socializing and learning. However, the use of the internet also brings about
risks to their safety, including the dangers of sexual solicitation, online harassment and bullying, and exposure to illegal content. By discussing responsible socializing and communicating, parents -- regardless of whether they
are technologically savvy -- can help their kids make better decisions about
online behavior.
Efforts to address cybercrime include activities associated with protecting
networks and information, detecting criminal activity, investigating crime, and
prosecuting criminals, . The Administration has taken significant steps to better protect America against cyber threats and has developed a pragmatic
and focused cyber-security legislative proposal for Congress to consider. The
proposed legislation is focused on improving cyber-security for the American
people, our Nation’s critical infrastructure, and the Federal Government’s own
networks and computers.

Two men allegedly broke into a man’s home on
April 28 and assaulted him over a gun.
The suspects, Kinta man Ethane Steve Hogan,
29, and 20-year-old Quinton man Colten Chance
Yandell were later arrested for the crime.
According to the affidavit, a Stigler officer was dispatched to an apartment complex around 9:40 p.m.
to investigate an assault that had just occurred. The
victim, who had a busted lip, cut ear, black eye, and
missing/loose teeth, told the officer that he had just
been assaulted by two men. He said he bought a
gun from Hogan for $350. Hogan recently contacted him and said he wanted the gun back because
it was stolen.
The man replied he wanted his $350 back or he
would take the gun to the police. The man never
heard from Hogan again, so he assumed it was
over.
Earlier that evening, he was in his apartment
when the door handle jiggled. Assuming it was his
girlfriend, he opened the door. Instead, Hogan and
Yandell kicked and threw him to the ground.
Hogan picked up a chair and broke it over the man’s head.
During the attack, the suspects kept yelling, “Where is the gun, m-----
f-----?”
They also destroyed his TV.
A neighbor told police she head some loud noises, so she opened her
door to see what was going on. She saw Hogan and Yandell running from
the residence. She also said that Yandell yelled at the victim that he “better
have [his] s--- in the next four days, or next time would be worse than this.”
A Haskell County deputy found both men at a residence in Kinta at approximately 10:50 p.m. Hogan and Yandell told the deputy that had been
at the residence all night. The suspects were also extremely intoxicated.
The deputy placed both men under arrest and transported them to jail.
Yandell is being charged with burglary in the first degree, assault and
battery with a dangerous weapon, aggravated assault and battery, threaten to perform an act of violence and two counts of conspiracy.
Hogan is being charged with burglary in the first degree, aggravated assault and battery, conspiracy to commit a felony, and assault and battery
with a dangerous weapon.
Both men’s bonds were set at $50,000, and they are both scheduled to
appear in court on June 24, 2019.

Kenneth Edward Parnell, 45, of Haskell County,
entered a guilty plea to Felon In Possession Of
Firearm in federal court. The crime is punishable
by not more than 10 years imprisonment, up to a
$250,000 fine, or both.
The Indictment alleges that from in or about
November, 2018, until on or about December 26,
2018, Parnell, having been convicted of a crime
punishable by imprisonment for a term exceeding
one year, did knowingly possess in and affecting
commerce, a Savage Arms (Canada) Inc., Model
64, .22 caliber semi-automatic rifle, which had
been shipped and transported in interstate and
foreign commerce.
The charges arose from an investigation by the Haskell County Sheriff’s
Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
The Honorable Steven P. Shreder, U.S. Magistrate Judge in the United
States District Court for the Eastern District of Oklahoma, in Muskogee,
accepted the plea and ordered the completion of a presentence investigation report.
