A Mena, Arkansas, man was arrested in Leflore County on
September 18 after a high-speed pursuit crossed state lines.
According to the police report, a state trooper joined in
on the chase in Oklahoma around 12:46 a.m. He was dispatched to the intersection of Walker Mountain Road and
Wiles Road where some Leflore County deputies were set up
in intercept the suspect.
Their plan worked, and the chase finally came to a stop.
The driver, identified as 42-year-old Tommy Emmit
Black, had red, watery eyes and his pupils were dilated. After standard field sobriety tests, an officer placed him under
arrest for being intoxicated while driving.
The initial pursuing officer told the trooper Black was “very reckless” during
the chase and traveled at speeds in excess of 100 mph for the majority of the
pursuit. The officer said approximately .5 miles north of the intersection of Haw
Creek Road and U.S. Highway 259, Black did a u-turn and drove directly toward
him.
The officer said he was forced into the southbound lane to avoid a head-on
collision with Black -- he believed Black was trying to crash into his patrol car.
The registration on Black’s vehicle didn’t match the car. Black said he bought
the car about five months ago, but he never got a registration or insurance for it,
so he stole the registration from a similar car he found disabled on the roadside.
Black’s license was also suspended out of Arkansas.
Black is being charged with endangering others while eluding/attempting to
elude police officer, assault and battery with a dangerous weapon, driving a motor vehicle while under the influence of drugs, driving with license canceled/
suspended/ revoked, failure to maintain security and altering license plate/ decal. His bond was set at $17,000, and he is scheduled to appear in court on
October 8, 2015.

We often receive calls asking if there is a price
to keep someone out of our publication. The short
answer to that question is NO! OK Jailbirds has never
accepted money or favor to not publish a photo.
We hear many times from people that the arresting
officer of someone at the jail told them all they have
to do is pay us money and we will not publish their
photo. This is NOT true. We feel that taking money
in exchange for not publishing an arrest photo is
extortion and, as such, should be a crime.
There are companies who do take money to remove
a person’s arrest information. OK Jailbirds never has
and never will. If an arrest doesn’t make our paper, it
is only because we didn’t receive it or we didn’t have
a photo we could match up.

A September 21 prank gone wrong ended up with
one woman injured and another in jail.
According to the police report, a McAlester officer
was dispatched to some apartments in the 200 block
of East Carl Albert Parkway around 3:50 p.m. due to
a person being stabbed. When he arrived, he made
contact with the victim, who had a small wound on
her right bicep. She was applying pressure to stop the
bleeding.
The victim said she had her friend’s dog at her
house, and she decided to play a joke on the friend,
identified as 31-year-old Krystle Ann Bernstein. She
texted Bernstein and told her that the dog had been
run over and put down by the vet.
Well, Bernstein obviously loved her pet, because she immediately went to the
victim’s apartment to see what was going on. When she heard the dog barking,
she pulled out a pair of scissors from her pocket and stabbed the victim in the
arm. After stabbing the victim, she continued to yell at her.
Police found Bernstein in the 300 block of East Washington. An officer asked
her how she was doing -- she told him she was doing better now. She told the officer about the text messages, and she said they made her upset. An officer then
placed her under arrest and asked where the weapon was. She said the scissors
were in her residence.
As the officer was walking Bernstein to his patrol car, she told him she was going to plead not guilty due to temporary insanity.
Bernstein is being charged with assault and battery with a dangerous weapon.
Her bond was set at $10,000, and she is scheduled to appear in court on October
16, 2015.

Hugo man Gary James Cook, 37, tried to get away from a vehicle
safety checkpoint, but a state trooper didn’t let him off that easily.
When the trooper searched the man’s pockets, it was easy to see why
the man wanted to get away!
Troopers were conducting a vehicle safety checkpoint at E and
Choctaw Street in Hugo on September 23 when Cook pulled up
around 10 p.m., according to the police report. A trooper noticed
a black truck pull up to the location, then start backing up. He motioned for the truck to keep on coming his way.
The driver was identified as Cook.
Cook wasn’t wearing his seatbelt, and he was also sweating so
badly that his shirt was soaked. The trooper asked him why he was
sweating so badly -- Cook said he had just left work. The trooper asked the man to step out
of his car and have a seat in the patrol car.
Before getting in the patrol car, however, the trooper asked Cook to empty his pockets.
When Cook pulled some stuff out of his right front pants pocket, it looked like he was trying
to hide something in the middle of several dollar bills.
The trooper asked what he was trying to hide. Cook handed him a red plastic pipe and
told the trooper he had smoked meth before going to work. The pipe field-tested positive for
methamphetamine.
Cook is being charged with possession of controlled dangerous substance, possession of
paraphernalia, driving under suspension and failure to wear seatbelt. His bond was set at
$8,000, and he is scheduled to appear in court on October 8, 2015.

DISOBEY LAWFUL ORDER
An Antlers man was arrested September 15 after he allegedly broke
into a car at a hospital and took some stuff while the vehicle’s owner was
inside.
After stealing the items, 21-year-old Shaun Allen Smith threw some of
them on the side of the road.
According to the police report, an Antlers police officer was dispatched
to the hospital to investigate a burglary. The caller said someone broke
into his car while he was in the hospital and took some stuff out of the
glove compartment. He said he was missing a spare key to the car, some
paperwork and a pair of binoculars.
But, the victim was about the make the officer’s search for the suspect easier. He showed
the officer a picture of Smith and said he saw the man walking around the cars at 1 p.m.
The officer went to Smith’s residence and asked him where the stolen property was. Smith
tried to deny that he took anything, but he eventually gave in and took the officer to the stolen
stuff.
In a ditch at the corner of SE D Street, the officer found a black case that contained the
spare key. Further down D Street, he found the paperwork.
Smith then led the officer to a residence in the 400 block of SE Fifth Street where the binoculars were.
Smith is being charged with burglary in the second degree. His bond was set at $10,000,
and he is scheduled to appear in court on October 14, 2015.
Antlers man arrested for
hospital car burglary
An unlikely culprit allegedly stole a welder from a Coalgate business in September. Coalgate man Dillon Shane Gage, 22, was found
with the welder, which he apparently took from his dad’s shop.
Daddy didn’t care Gage was his son -- the man was arrested and
locked up!
According to the police report, a Coalgate police officer was dispatched to the business at the corner of Ohio and Newell street
shortly after 6 a.m. on September 22. The business owner told the officer someone had broken into his shop between September 20 and
September 22 and took a welder that was valued at $3,000.
During the investigation, the officer noticed some tire tracks that
were backed up to the garage door. The garage, where the suspect
entered the business, had two locks. One of the locks was a padlock that had been cut off, and
the other was a keyed lock. The officer asked the victim who had a key.
The victim said, “I’m afraid my son (Gage) has one and stole the welder.” He said he wanted
his son arrested if he indeed took the welder, and he was going to Atoka to try to find his son.
An officer with the Atoka police department called the Coalgate officer and told him they
found the stolen welder in the back of Gage’s truck.
Gage was placed under arrest and transported to the Coal County Jail.
Gage is being charged with burglary in the second degree. His bond was set at $10,000, and
he is scheduled to appear in court on October 8, 2015.

Durant man Derek Lee Stonebarger, 23, was arrested on September 19 in Calera for a stolen vehicle.
Around 2:48 a.m., a Calera officer saw a silver car
in front of him at the signal light on North McKinley Street at the U.S. Highway 69/75 intersection.
Remembering a radio broadcast from earlier, he
checked the vehicle’s tag; it was the stolen car.
The officer stopped the vehicle on the highway just
north of the South 9th Street intersection. The driver
was identified as Stonebarger, and he didn’t have a
valid license.
The officer told Stonebarger the vehicle had been
reported stolen. He asked why he was driving it.
Stonebarger said he and his friend met two women at the casino and they needed
a ride home. The other man had the car, and he asked Stonebarger to drive because he didn’t have a license.
The officer asked him why he would drive since he didn’t have a license either.
Stonebarger said, “I know -- that was stupid.”
Stonebarger said the first time he saw the car was when his friend took him to
it in the parking garage.
The officer asked him if video surveillance would show him walking alone or
with the other man.
According to the police report, Stonebarger looked like he had been caught in
a lie. He said, “I knew something was up when he didn’t want to go in the garage
and get it.”
The officer told him it was hard for him to believe that his friend sent him into
the garage and told him to get into one car he had never seen before.
Stonebarger insisted it was the truth.
The male passenger said Stonebarger told him the car belonged to a friend. The
man said he asked Stonebarger if the car was stolen. Stonebarger told him no. A
woman passenger said Stonebarger said, “S---!” when he was pulled over. When
she asked if the car was stolen, he replied, “Maybe -- I don’t know.”
Video surveillance showed Stonebarger walking out of the casino by himself
shortly after 1 a.m. He then picked up his three passengers in the valet area.
Stonebarger is being charged with possession of stolen vehicle and driving
with license canceled/suspended/revoked. His bond was set at $10,500, and he
is scheduled to appear in court on November 5, 2015.

While searching for some stolen items in a motel room on
September 22, Atoka police officers came across two guns that
belonged to a convicted felon.
Atoka man Jimmy Mark Fleming, 41, told officers to go
ahead and arrest him when they found the firearms.
According to the police report, officers were dispatched to
the motel in the 300 block of N. Mississippi Avenue shortly
after 10 p.m. to look for some stolen items. They made contact
with a woman in the room who told them there was nothing
stolen in the room, but they were welcome to search the room.
There were two other people in the room -- one of them
was identified as Fleming. Police didn’t find any of the items.
They did, however, find a pair of men’s boots with the butts of
two pistols sticking out of the them. One of the firearms was a
loaded 38 special revolver and the other was an unloaded .22
caliber revolver.
There was also a used syringe in the bottom of the boot.
Fleming told the officer, “Go ahead and arrest me.” He explained that he was a convicted
felon and was currently in drug court.
After verifying the man’s information, the officer placed him under arrest. He found three
38 caliber rounds, four 22 caliber rounds and three pocket knives in Fleming’s pockets.
Fleming is being charged with possession of firearm after former felony conviction. His
bond was set at $50,000, and he is scheduled to appear in court on September 30, 2015.

Checotah man Richard John Turner, 45,
admitted to stealing some jewelry from his
neighbor’s late husband when he did some
work for her on September 23. He told a
deputy he took them because he needed
drug money, but he felt too badly to trade
them for drugs.
On September 18, a McIntosh County
deputy took a stolen property report in Checotah. The victim told him her neighbor told
her that she was trying to kick her boyfriend,
Turner, out of her house. The victim told the
woman to pack up his stuff and put it outside so he didn’t have a
reason to go inside the house.
Turner’s girlfriend returned to the victim’s house a little later and
told her she found two gold rings she had never seen before while
packing up his belongings.
The victim said Turner had done some work for her in the past, so
she asked to see the rings.
According to the affidavit, the rings belonged to her deceased husband.
On September 23, the deputy went to Turner’s residence and
placed him under arrest for warrants out of Woodward County.
Turner’s girlfriend told the deputy the same story as the victim
-- she kicked Turner out of her house and started packing up his
belongings. She found a black bag, so she opened it and found two
men’s gold rings. She told her neighbor about the rings, and the
neighbor identified them as belonging to her late husband.
Turner admitted to taking the rings. He said he did some work
for the victim and one day he found a box in her shed. He looked
through it and found the rings. Turner said he thought they might
be worth some money and since he needed some money for drugs,
he took them. He said he felt so badly they belonged to the woman’s
late husband that he never traded them for drugs.
Turner is being charged with knowingly concealing stolen property. His bond was set at $10,000, and he is scheduled to appear in
court on November 19, 2015.

A Valliant man admitted to stealing a $400
refrigerator from a rent house and moving it
to his residence because he didn’t have one.
Gregory Dean Overbeck, 32, took the
fridge to his house, hooked it up and filled it
up with food before he was arrested on September 16.
McCurtain County deputies were dispatched to the 400 block of Seminole Street
in Millerton shortly after 5 p.m. on September 14. The reporting party told them a
woman had just moved out of her rent house,
and the refrigerator was missing. She said she tried to contact the
woman on her cellphone, but she was unable to reach her.
On September 16, deputies were responding to a burglary north of
Valliant when they made contact with Overbeck at his residence on
Browning Road. According to the affidavit, the man was seen driving
around the house where the burglary took place in Millerton. During the conversation, Overbeck mentioned his girlfriend (the woman
who had lived in the rent house) several times. A deputy asked Overbeck if his woman was at home. He said she was at work and asked
police why they wanted to know.
The deputy explained they wanted to ask her about a stolen fridge.
Overbeck told police, “I took the refrigerator from the rent house
-- she had nothing to do with it.
He said he went to the house when his girlfriend was at work and
took the refrigerator because they didn’t have one. He took police to
his residence and led them inside to the refrigerator.
The fridge was returned to the owner.
Overbeck’s girlfriend told police she didn’t know anything about
the stolen fridge. She said she knew Overbeck was moving their
things out of the Millerton house, but she didn’t notice the refrigerator at their new place.
Overbeck is being charged with petit larceny. He was released on a
$750 bond and is scheduled to appear in court on October 14, 2015.
