SPIRO POLICE INVOLVED IN
OFFICER-INVOLVED-SHOOTING
The following update is based on an active
and ongoing investigation. The OSBI’s initial
understanding of the facts and circumstances may evolve over the course of the investigation as witnesses are interviewed and evidence is collected and analyzed.
Upon completion of the OSBI investigation, agents will submit a report summarizing
their investigation to the District Attorney’s
Office. The District Attorney will determine
whether or not to file charges.
The Oklahoma State Bureau of Investigation (OSBI) is investigating an
officer-involved-shooting involving police officers from the Spiro Police Department. Based on the initial investigation, this is what is known at this
time:
• The evening of February 8, 2023, Spiro police were notified that a man
was brandishing a handgun near the 200 block of Broadway in Spiro.
• The Spiro Police Chief located the man and recognized him as Damon
Dante Henderson (12/21/1992).
• Henderson ran and the Chief pursued him.
• Henderson stopped and fired his gun at the Chief hitting the tailgate
of his police truck.
• Henderson ran again and was located a short time later hiding in a
residence in Spiro.
• Several tactical officers arrived; however, Henderson was able to
evade law enforcement again.
• Officers searched for Henderson throughout the night.
• Henderson was located in the afternoon of February 9, 2023, near
South Ash Street in Spiro.
• Spiro officers attempted to approach Henderson, who ran on foot.
• An officer followed Henderson by vehicle to the 200 block of Southeast 4th Street when Henderson stopped and faced the Spiro officer who
was in the driver’s seat of the vehicle.
• The officer was attempting to de-escalate the situation when Henderson fired his weapon hitting the driver’s door of the unit.
• The officer returned fire hitting Henderson.
• Additional officers arrived and began rendering aid until paramedics
arrived.
• Henderson was transported to the hospital where he died.
The investigation is ongoing. There is no additional information to be
released at this time.

MUDDLE-HEAD IN MASSACHUSETTS
Brian Walshe is a ‘dumb as dirt’ alleged criminal:
legal experts
Alleged wife-murderer Brian Walshe is up a creek
without a paddle after his arraignment, legal experts say
— and his situation will only get worse if authorities find
the body of his missing spouse, Ana.
Walshe, 47, is accused of murdering his wife, who
went missing on New Year’s Day, and prosecutors presented a slew of damning evidence at his arraignment.
“If these allegations are true, it’s stunning how
dumb as dirt this guy appears to be,” Mark Bederow,
a high-profile criminal defense attorney, told The Post.
“It’s unbelievable.”
Bederow, a former prosecutor for the Manhattan District Attorney’s Office, said Walshe’s internet searches
will not only be used as evidence of his alleged crime but
might work against his ability to blame mental health issues.
“His internet searches — as sick as they may be — are rational in a cogent thought
type of way,” the lawyer said. “There appears to be a lot of planning and it appears to
be well thought out.”
Prosecutors revealed the dad of three used his son’s iPad to google “how to stop a
body from decomposing,” “how long before a body starts to smell,” “hacksaw best tool
to dismember” and “can you identify a body with broken teeth?”
Police have yet to locate the body of Ana, 39, a real estate manager who lived with
Brian and their kids in Cohasset, Mass., but worked in Washington, DC.
“Without the body, [the case] is not a slam-dunk case for the prosecution,” former
New York prosecutor and current criminal defense attorney Duncan Levin said. “If they
find her body, the case will obviously become much more difficult for the defense to have
a fighting chance.”
Levin explained that even though the prosecution’s argument looks strong, the case is
still young, and all the evidence gathered by authorities is “subject to attack.”
“It’s too early to tell what holes there may be in any of the evidence,” he said. “Obviously from what we know, there is an extremely strong circumstantial case against Brian
Walshe.
“You could not have planned a worse murder if you tried,” Levin added, saying Walshe
appeared to have “bungled every aspect of this from beginning to end.”
He also suggested the defense might try to move the trial outside Cohasset, which is
home to less than 10,000 people, because of how much attention the case has received.
“On the flip side, the pre-trial publicity in this case has been so significant that a judge
may well find that there would not be any less publicity in a different area of the state,”
he said.
Prosecutors said Wednesday that during Walshe’s previously reported trip to Home
Depot to buy $450 of cleaning supplies with cash, his purchases included a Tyvek body
suit, mops and baking soda.
Worse, a man in a Volvo matching Brian’s description was caught on surveillance
footage lugging heavy trash bags into dumpsters.
When searching through trash bags originally dumped at Walshe’s mother’s home,
police found a hatchet, blood, hacksaw, trash bags, used cleaning supplies and a rug.
They also found a Prada purse and Hunter boots matching what Ana was believed to be
wearing when last seen, along with a COVID-19 vaccination card in her name, the Tyvek
suit her husband had purchased, towels and tape, prosecutors revealed.

was pronounced dead at the scene and was
pinned in his patrol car for about two hours.
Brannon Oden was transported to a hospital,
treated, and released that day. Deputy Duncan had just completed a twelve-hour shift
and was driving to his home in Wister when the accident occurred. Deputy

months having joined the previous October but had been a law enforcement
officer for seven years prior serving with the Wister Police Department and the
Le Flore County Sheriff’s Office prior to becoming a Latimer County Deputy.
Deputy Dustin Duncan was engaged to be married when he died.
Dustin Duncan is buried in Greenhill Cemetery, Cameron, Le Flore County,
Oklahoma.
In May 2009, the State Highway 112 bridge crossing the Poteau River in

A man who shot himself in the face and
ran down Interstate 24 armed with the
handgun was taken to two hospitals last
month, a Rutherford County Sheriff’s supervisor said.
Deviset Patton, 41, of Nashville was
treated by paramedics while transporting
him to Ascension St. Thomas Hospital in
Murfreesboro. He was later taken to Vanderbilt University Medical Center in Nashville.
Detective Sgt. Ty Downing said Patton’s girlfriend was driving on I-24 when they
began arguing about 5:30 pm.
“He shot himself once in the face,” Downing said.
She pulled over and called 911. Sheriff’s deputies, Tennessee Highway Patrol
troopers, Murfreesboro Police and Murfreesboro Fire & Rescue responded.
“As they approached, he took off on foot running down the interstate with a
pistol in his hand,” Downing said. “Deputies led by Sgt. David Alford closed traffic
in both directions because of an armed man running on the freeway.”
Patton refused Alford’s commands to drop the weapon.
The SWAT Team responded. A K9 stopped Patton and SWAT Team deputies
took him into custody.

TALES FROM THE FLORIDA SWAMP...
‘YEP IT’S OFFICIAL…CRIMINALS DO THE
DUMBEST THINGS AND THIS ONE GETS
THE AWARD FOR “DUMB CRIMINAL OF THE
WEEK!!”’
On February 10, while at one of our Brevard
County Parks, our victims, a female and her
boyfriend, were confronted by Donovan Tyler
Adkins, who was armed with a firearm, and accused the victims of robbing his people!! Really…this guy has people?
As Adkins pretended to talk to someone on
the phone, he forced the female victim into the
woods with the firearm and told the male to
stay put. After taking the female victim deeper into the woods, Adkins kept
the gun pointed at her and ordered her to perform sexual acts on him!!
According to the statement of the victim, with Adkins pointing the gun at
her face, she refused to comply and told Adkins he would have to shoot
her first!! Adkins at this point had exposed himself and the victim began
screaming. The victim’s boyfriend was quickly approaching their location
in the woods which startled the suspect, causing him to trip and thereby
giving the victim a brief opportunity to escape!!
The victim quickly made it back to her boyfriend at which time they were
collecting their belongings when Adkins returned to the area and stole the
victim’s cellphone before fleeing.
Based upon the testimony of the victims, another person in the park
who was familiar with the suspect, and subsequent investigation by our
Agents, Adkins was later positively identified as the perpetrator and was
taken into custody by members of our team.
Adkins was transported to “Ivey’s Iron Bar Lodge” on a “No Bond” status for Robbery With A Firearm, Aggravated Assault With. Deadly Weapon,
False Imprisonment, Sexual Battery, Petit Theft, Possession Of A Firearm
By A Convicted Felon, and Resisting Arrest Without Violence!! Holy crap
this guy has more charges than my wife’s credit card!!
On a positive note he won’t have to look very far for his Valentine on
Tuesday as he is still sitting in the “Iron Bar Lodge” and will have an entire
cell block to pick one from!! Sadly though, I don’t think we offer those big
candy hearts in the jail commissary so I’m guessing a honey bun will have
to suffice!!

Nelson Onaro, 61, of McAlester, entered a guilty
plea to Count Six of a Superseding Information which
charged him with six counts of Unlawful Distribution
and Dispensing of a Controlled Substance, punishable by up to 20 years of imprisonment, a fine up to
$1,000,000 or both.
Dr. Onaro was initially charged by a federal grand
jury in September 2020 with twenty-four counts of
Unlawful Distribution and Dispensing of Controlled
Substances. During the hearing, Onaro admitted to
writing a prescription for the controlled substance
Adderall for one of his staff members with the understanding that the staff member would fill the prescription and deliver the pills back to Onaro for his personal use.
As part of the plea agreement, Onaro has agreed to surrender his Oklahoma
medical license.
The charges arose from a long-term investigation by the Drug Enforcement
Administration, the United States Department of Justice Healthcare Fraud
Strikeforce, and the Oklahoma Bureau of Narcotics.
Onaro was released on a personal recognizance bond pending sentencing.

FEDERAL JURY CONVICTS MCALESTER
RESIDENT OF COMMITTING CHILD ABUSE
Paula Amber Chisholm, 37, of McAlester,
was found guilty by a federal jury of Child
Abuse in Indian Country.
The jury trial began with testimony on
Monday, January 9, 2023 and concluded on
Thursday, January 12, 2023 with the guilty
verdict.
During the trial, the United States presented evidence that on December 3, 2019, a
five-year-old boy was rushed to the hospital after school officials became concerned
about his physical state and demeanor at
school. During a medical evaluation it was revealed the child had multiple wounds, abrasions, and bruises from his head to his toes
and was extremely malnourished. Chisholm is the child’s aunt who resided in
the home and was his primary caregiver. During the subsequent investigation,
the child and his sister named Chisholm as the person responsible for causing the injuries.
The guilty verdict was the result of an investigation by the McAlester Police
Department and the Federal Bureau of Investigation.
The United States Attorney’s Office for the Eastern District of Oklahoma
prosecuted the case because Chisholm is a member of a federally recognized
Indian tribe and the crime occurred in Pittsburg County, within the boundaries
of the Choctaw Nation Reservation, and within the Eastern District of Oklahoma.
Sentencing will be scheduled following completion of the report. Chisholm
was remanded to the custody of the United States Marshal pending the imposition of sentencing.

March is National Youth Violence
Prevention Month
The National Association of Students
Against Violence Everywhere is a nonprofit
aiming to provide safer environments for
our youth. Its mission is to decrease the
potential for violence in our schools and
communities by promoting meaningful student involvement, education and service
opportunities.
SAVE’s Vision: Schools and communities will be safer and more secure, free of
fear and conducive to learning as a result of
students being actively involved in meaningful violence prevention efforts.
How It Got Started: SAVE was started by students in Charlotte, North Carolina in 1989 after the tragic death of a classmate who was trying to break up a
fight at an off-campus party. A group of students who did not want this death
to be “just another statistic” took action and created a violence prevention
program.
Chapters: SAVE has evolved into a national association with chapters in
elementary, middle and high schools as well as at colleges and community organizations across the country. Today, there are more than 200,000 students
involved nationwide.
Activities: Student members take the lead in planning chapter activities by
using the three SAVE Essential Elements: conducting crime prevention activities, conducting conflict management activities and providing meaningful service through projects in schools and communities. SAVE chapters also plan
safety rallies and safety awareness campaigns, engage in peer mentoring to
younger students, and conduct fun and educational meetings.

Presumed Innocent Until Proven Guilty MCINTOSH COUNTY 13 | MARCH 2023
An Illinois sex offender was taken into custody
after he failed to register when he moved to Eufaula.
Scotty Dewayne Burns, 52, was charged February 3 with failure to register as a sex offender, possession of firearm AFFC, possession of meth, and
possession of paraphernalia in McIntosh County
District Court.
According to information filed in the case, Burns
moved to Oklahoma from Illinois and did not register as a sex offender with the county. Burns was
convicted of sexual assault in Dunkin County,
Mo., in October of 1991.
When deputies went to his residence outside of
Eufaula, they found a small pistol in the home, methamphetamine, and a
glass smoking pipe known to be used by drug abusers.
If convicted, he could face imprisonment for no more than five years and
a fine not to exceed $5000 and/or both.
Burns’ bond was set at $40,000 and he was ordered back to court for his
preliminary hearing on March 1, 2023.

14 | MARCH 2023 MCINTOSH COUNTY Presumed Innocent Until Proven Guilty
On March 7, Oklahoma voters will have a say on whether or not to legalize
recreational marijuana use with SQ 820 on the ballot. If this question passes,
how do you think this will affect crime in our state? Should driving under the
influence of drugs become a felony? Should those convicted of misdemeanor
marijuana charges in the past be cleared?
Let us hear your opinion!
Misttina B: Colorado crime rate skyrocketed after legalizing marijuana. It should
be treated like any other mind altering substance for DUI.
Rockey L: Yes, it should be felony for driving under the influence of drugs and
for those whom had misdemeanors for marijuana charges should not be cleared
as they knew they were breaking the law at the time they were caught.
April F: Rockey Lee the part that makes it a felony or misdemeanor is the fact
of how many charges you prior or if your caught with a large amount..it is really no
difference than DUI with alcohol
Monkeys P: I don’t think it will affect crime but we need it to pass. We need the
jail space for violent criminals. It should have already become federally legal . It is
not deadly like tobacco and alcohol
Rockey L: Monkeys P Just like cigarettes marijuana can cause emphasima and
copd which can be deadly and alcohol is deadly when consumed and you get
behind the wheel of a car. So where do you draw the line ?
Robbie W: Driving under the influence of anything that visibly impaired you driving should be a felony in the first place. I really don’t think it will effect crime. It might
drop from fewer marijuana arrests. And all you can hope for is that these people
strung out on worse drugs choose pot because it’s legal.
Jerry K: I’m trying to figure this out. Last vote, it was said that this is a needed
medicine for some people. Now some are wanting to use it recreationally. What
other medicine do we do that with??? I don’t remember the last time I took a anti-biotin for a fun Saturday night. Look at what it did to Colorado.
Robbie W: Jerry K alcohol
Jerry K: Alcohol is not used as medicine unless you are talking rubbing alcohol.
Maria M: Man marijuana is not a drug in the first place it is and always has been
a plant. So no it shouldn’t be a felony for that worry about the drunk drivers alcohol is legal and more people get killed by drunk drivers than anything else. Really
have you heard of any wrecks where they smoked??? And yes so many people
have been punished harshly for smoking a plant that is natural. It is time for our
society to open their eyes and see this plant is helping people with their mental
and physical issues.
