Presumed Innocent Until Proven Guilty MCCURTAIN COUNTY 5 | MARCH 2019
On May 1, 2018, the Idabel Police Department
requested the OSBI to assist with the investigation into the homicide of Melvin Pondexter, age
46. On that date, Pondexter was stabbed in the
chest at the auto repair shop where he worked.
Robert Coleman, 47, was arrested and charged
with Murder in the First Degree. It was determined
that Coleman had been angry with Pondexter because he had paid Pondexter to fix his truck and
did not feel that it had been fixed properly. This
ultimately led to the confrontation in which Pondexter was killed.
On January 24, 2019, a McCurtain County Jury
found Coleman guilty of Murder in the First Degree and recommended a sentence of Life without Parole. The jury took
only 29 minutes to return the verdict. Coleman will be sentenced on March
4, 2019.

A man in Florida stole some medication out of his roommate’s lockbox. They
were labelled Hydrocodone. But, they weren’t. They weren’t opioids. They were
laxatives. And yes, he did find out the hard way. His roommate called the cops
when the pills went missing. He admitted he stole them and then threw the rest
out. So, not only did he get a horrible stomach ache, he was publicly humiliated... and arrested.
Also in Florida, a guy was with his wife. She was upset over an issue she was
having with a family member. She wanted to talk about it with him, but he went
into Taco Bell and got himself lunch instead. When he got back, he tried to give
his wife a burrito. But he was dangling it in front of her, making fun of her for
being so upset. That wasn’t a smart move... she grabbed it and threw it on the
floor. Apparently, that’s a fighting act. He picked up the burrito and shoved it in
her face and up her nose. He was arrested for battery... by a burrito.
In Kansas, a family was playing Monopoly and wound up getting into a fight.
It escalated and as two cousins were arguing, one guy’s girlfriend hit the other
cousin and shoved him into a mirror. Then she took off running. The guy went
to the hospital for stitches but they are still looking for the girlfriend who is now
wanted on assault charges. And you know, when they catch her, she will have
to go directly to jail... without passing go... and without collecting her 200 dollars.
A guy was pulled over in Florida for having a light out. But, he was on probation and driving with a suspended license so he decided to make a run for
it. He ditched his car and tried to hide from police under a tree in a field. And it
may have worked if it weren’t for some crime fighting horses. There were three
horses that apparently didn’t like him in their field and started chasing him. He
hopped a fence, where he was promptly taken into custody.
A man was caught on surveillance footage sitting in front of a porterhouse
steak, a lobster tail and a 20-ounce beer in a California restaurant before pocketing the hunk of meat and walking out.
“What type of person will take a steak and watch the juice drip off and then
wrap it in a linen napkin?” said House of Beef lead server Denise Loya. “It’s just
highly unusual.”
Loya said the man dressed in a suit came into the Oakdale restaurant and
asked for a table for four. She said he looked like a villain from an ‘80s movie.
“Definitely a used car salesman or bad real estate agent. Slimeball,” she told
KTXL.
His actions were just as animated. The video shows his eyes shifting constantly as he looks up at the surveillance camera and over his shoulder.
“Just keep your eyes on this person ‘cause his eyes, you can see him, you
know, he’s watching,” said the restaurant’s owner, Steve Medlen.
One last look into the camera and the man picks up the slab of meat then
folds it into the napkin lifted from the bread basket. He’s unethical,” Medlen
said. “He’s out to commit a crime.”
Medlen said he decided to post the video on social media to catch the steak
smuggler.
“The monetary part is not part of the equation,” he told KTXL. “The part that
we want to do is take this person off the street.”
In the final moments, the man picks up his haul and walks away, all while a
little girl watches in his direction.
“Be great if he would come in and pay his bill and apologize but I highly doubt
that’s gonna happen,” Loya said.
The staff said if he had truly been starving they would have helped.
“We always help people,” Loya said. “When they come in off the streets, we
will buy them a bowl of soup or a sandwich.”
The staff says that was a $56 meal. The owner did file a police report with the
Oakdale Police Department but no arrests had been made.

OSBI Arrests son and his mother
in murder investigation
A man and his mother are facing felony
charges after a hunter found the burned remains of a man near Cloudy, Okla.
OSBI stated that on January 21, 2019,
Pushmataha County Sheriff BJ Hedgecock
requested OSBI investigative assistance with
human remains of a male victim, located in
Pushmataha County near Cloudy, Oklahoma.
The body was found by a local hunter and
had been burned. On January 23, 2019, the
Oklahoma Office of Chief Medical Examiner
made positive identification of the victim. The
victim was identified as Davey Jo Moore, 56.
OSBI and the Pushmataha County Sheriff’s
Office investigated the matter and identified
Brian James Dunlap (Mack), 25, as the person responsible for Moore’s death. On January 23, 2019, Dunlap was arrested for Murder in the First Degree. Dunlap’s mother Misty
Lea Mack, 44, was also arrested for Accessory After the Fact (Murder-Second Degree).
OSBI continues to investigate the matter.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.
Thank you and God Bless

The National Association of Students
Against Violence Everywhere is a nonprofit
aiming to provide safer environments for
our youth. Its mission is to decrease the
potential for violence in our schools and
communities by promoting meaningful student involvement, education and service
opportunities.
SAVE’s Vision: Schools and communities will be safer and more secure, free of
fear and conducive to learning as a result of
students being actively involved in meaningful violence prevention efforts.
How It Got Started: SAVE was started by students in Charlotte, North Carolina in 1989 after the tragic death of a classmate who was trying to break up a
fight at an off-campus party. A group of students who did not want this death
to be “just another statistic” took action and created a violence prevention
program.
Chapters: SAVE has evolved into a national association with chapters in
elementary, middle and high schools as well as at colleges and community organizations across the country. Today, there are more than 200,000 students
involved nationwide.
Activities: Student members take the lead in planning chapter activities by
using the three SAVE Essential Elements: conducting crime prevention activities, conducting conflict management activities and providing meaningful service through projects in schools and communities. SAVE chapters also plan
safety rallies and safety awareness campaigns, engage in peer mentoring to
younger students, and conduct fun and educational meetings.

Tulsa Man Admits to Creating Sexually Violent Images of
Children Using Photographs Downloaded from Facebook
A 35-year-old Tulsa man entered a guilty
plea today in U.S. District Court for digitally
producing images depicting the sexual abuse
of children and distributing almost 500 other
graphic image and video files of the sexual
abuse of children, announced U.S. Attorney
Trent Shores.
At the plea hearing, Jerry Matthew Berry admitted to producing obscene visual representations of the sexual abuse of children and distributing child pornography in 2017 and 2018.
Cyber Crimes detectives from the Tulsa Police
Department and agents from Homeland Security Investigations discovered Berry’s illicit activities during a peer-to-peer file sharing undercover investigation. After executing a search warrant on Berry’s apartment,
investigators also discovered hundreds of additional images and videos
of child pornography on his phone. Berry, a former private school teacher
in Oklahoma City, admitted to distributing child pornography on file sharing programs. He also admitted to downloading pictures of children from
Facebook and digitally altering the photographs to depict himself sexually
assaulting and physically harming the children.
“Tulsa Police Department Cyber Crimes detectives and Homeland Security special agents are resilient and committed to the fight to defend our
children from online perpetrators. Their dedicated efforts enable the U.S.
Attorney’s Office to bring child sex offenders to justice,” said U.S. Attorney
Shores. “These days, parents must be ever vigilant because predators
like Mr. Berry are lurking about on the internet. The facts of this case are
a stark reminder that parents should check their privacy settings on social
media and be aware when posting photos of their children.”
U.S. District Judge Claire V. Eagan accepted Berry’s guilty plea and set
sentencing for May 7, at 10 a.m. At that time, Berry faces a mandatory
minimum sentence of 5 years and up to 20 years in federal prison, at least
five years and up to life of supervised release, and a $250,000 fine for each
count. He remains in custody.
The Tulsa Police Department’s Cyber Crimes Unit and Homeland Security Investigations conducted the investigation. Assistant U.S. Attorney
Christopher J. Nassar prosecuted the case.
This case is part of Project Safe Childhood, a nationwide initiative
launched in May 2006 by the United States Department of Justice to
combat the growing epidemic of child sexual exploitation and abuse. Led
by the United States Attorney’s Offices and the Criminal Division’s Child
Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children, and to identify and rescue victims.
For more information about Project Safe Childhood, please visit www.

CEMETERY GATES
A Rattan man with a death wish was
taken into custody after he led authorities
on a high speed chase through Hugo that
ended in a local cemetery.
Trinity Ryan Ashley, 36, was charged January 31 with burglary- second degree, larceny
of auto, aircraft, or other motor vehicle vehicle,
endangering others while eluding/attempting
to elude police officer, leaving the scene of
an accident- property damage, driving with
license/cancelled/suspended/revoked, and
failure to wear seatbelt properly, in Choctaw
County District Court.
According to the Hugo Police Department,
on January 29 at approximately 7:42 am,
Choctaw County Sheriff Terry Park attempted
to initiate a traffic stop on a reckless driver.
Little did he realize that the 1966 Chevy pickup, which was being driven by
Ashley, had just been stolen from J&J Restoration.
Ashley accelerated west on Jackson St. near Wal-Mart in an attempt to
elude Sheriff Park. The pursuit continued west on Jackson St. to the intersection of 8th St., where Hugo Police Department units intercepted them. Ashley
then turned south on 8th St. traveling at a high rate of speed and weaving
through morning school traffic.
The pursuit continued south across the bypass and ended at Springs Cemetery where the Ashley veered the truck to the left and struck the cemetery
fence and several headstones. He exited the vehicle and ran southeast into
a field with Sheriff Park in foot pursuit. Officers converged on the area and
contained Ashley to a small, overgrown one acre woodlot approximately 1/4
mile southeast of the traffic incident.
Officers searched the woodlot and located Ashley a short time later.
Bond for Ashley was set at $60,000 and is scheduled to appear in to court
on February 26 for his preliminary hearing.
