IDABEL MAN AWAITS
SENTENCING
An Idabel man has pleaded guilty to shooting
another man in the head, killing him.
At the plea hearing last month, Zachary Carlton Ty Capps, 28, pleaded guilty to one count of
Second Degree Murder in Indian Country and
one count of Use, Carry, Brandish, and Discharge of a Firearm During and in
Relation to a Crime of Violence. Capps admitted during the plea hearing he
discharged a firearm to commit the murder.
According to investigators, Capps was seen with the victim in a white truck
on November 15, 2022. Later that evening, law enforcement located Capps
at a house in Idabel. During a search of the residence, agents located and
recovered a revolver that was reported to be in Capps’s possession earlier in
the night. Two days later, the victim was discovered in the same white truck,
having been shot in the head. According to forensic reports, the revolver recovered from the Idabel residence fired the fatal bullet.
Capps was remanded to the custody of the U.S. Marshals pending sentencing.

AROUND THE STATE
Overly passionate pastor
On October 2, Tulsa Police Officers arrested
a former pastor from a local church after an investigation revealed three years of inappropriate
behavior with a young girl starting when she was
15 years old.
The victim reported in May 2023 that the suspect, identified as Matthew Martinez, sexually
abused her, including kissing and groping her while threatening her not to tell
anyone.
Detectives learned Martinez, an associate pastor at the church, started texting the victim as a tutor in Fall 2020 before the messaging became more personal and the in-person contact became more physical – touching her hands
and feet at first before putting his hand up her skirt multiple times and touching her chest. The victim said Martinez would make her touch him as well.
In September, Detectives recovered thousands of text messages between
Martinez and the victim which included Martinez texting her “sexual hypotheticals” and talking about kissing her.
A warrant was issued for Martinez on September 28 and he was arrested
shortly after. He’s been charged with two counts of Sexual Battery.

SENTENCED FOR SEXUALLY
ABUSING A CHILD
Kevin Stuart Pollard III, 23, of Clayton, was sentenced
to 57 months in prison for one count of Sexual Abuse of
a Minor in Indian Country. Pollard was also sentenced
to 24 months in prison each for two counts of Abusive
Sexual Contact in Indian Country. All sentences were
ordered to run concurrently.
The charges arose from investigations by the Federal Bureau of Investigation and the
Pushmataha County Sheriff’s Office.
On August 10, 2022, Pollard pleaded guilty to one count of Sexual Abuse of a Minor in
Indian County and two counts of Abusive Sexual Contact in Indian Country. At the hearing,
Pollard pleaded guilty to sexually abusing a minor under the age of 16 years old. Pollard
also pleaded guilty to engaging in sexual contact through the clothing of the minor in
2019. The crimes occurred within the boundaries of the Choctaw Nation Reservation, in
the Eastern District of Oklahoma.
The Honorable Scott D. Palk, U.S. District Judge in the United States District Court for
the Western District of Oklahoma, sitting by appointment, presided over the hearings in
Oklahoma City. Pollard will remain in custody of the U.S. Marshal pending transportation
to a designated United States Bureau of Prisons facility to serve a non paroleable sentence
of incarceration.

ARREST MADE IN
BURGLARY CASE
At approximately 8:30pm on September 24th,
2023, deputies with our office were on patrol and
noticed a vehicle that matched the description of
a vehicle driven by Autry Cowley.
Cowley was a person of interest in a recent burglary that occurred in Centerpoint where a side-by-side and other items were
stolen.
Upon further investigation, it was determined that the side-by-side pictured
below in a trailer pulled by Cowley’s truck, was the side-by-side stolen in the
burglary. Cowley was also identified in video of the incident provided to our office
by the victims.
Cowley was arrested and transported to the Atoka County Jail for second
degree burglary, grand larceny, and knowingly concealing stolen property.
This is an arrest,
not a conviction.
Cowley is presumed innocent
until proven guilty
by a court of law.

More than 100,000 children and
youth in the U.S. foster care system
are awaiting permanent families.
National Adoption Month is a time
to raise awareness about the adoption of children and youth from foster care.
The Children’s Bureau in partnership with AdoptUSKids and Child
Welfare Information Gateway sponsors the initiative each November as a way to focus public attention on the
urgent need for adoptive families for children and youth waiting in foster
care for a permanent family. This year’s focus, “Partnering for Permanency,” builds on the social media theme from last year. A special web page
on Information Gateway’s website helps child welfare professionals, prospective adoptive parents, and youth partner for permanency. The website
contains resources, stories, and videos on topics such as getting started
with social media, how to build a recruitment campaign, and how social

DENA ANN DEAN
At approximately 10:00 pm on June 6, 1998,
16-year-old Dena Dean left the Marvin’s Food
Store located in the Town West shopping center
in Tulsa. Dean was never heard from again.
Dean’s vehicle was discovered in the parking
lot of the Marvin’s Food Store. Almost a week later, her body was found in a
wooded area a few miles away near Berryhill.
No has been arrested in the case.

ROAD RAGE RESULTS
IN MURDER CHARGES
A road rage incident on September 21 resulted
in the death of a Calera man.
A 62-year-old Durant man, Herbert Eugene
Frank Burnett, was later arrested in the victim’s
death.
According to reports, the victim was traveling eastbound on US-70 while it
was pouring rain. Just before 5 p.m., his vehicle hydroplaned, ran off the road,
and overturned. Emergency responders took him to the hospital where he was
pronounced dead.
During the investigation, Oklahoma Highway Patrol troopers determined that
the man’s death was actually due to a road rage incident, not just the bad weather. Burnett was allegedly chasing after the victim’s car and trying to hit it with his
F-150 before the crash occurred.
Investigators seized Burnett’s truck. They believe another vehicle may have
also been involved in the road rage incident. If you saw the incident happen or

Burnett is being charged with murder in the second degree. His bond was set
at $250,000, and he is scheduled to appear in court on November 1, 2023. SHAWN

A FATEFUL DAY
A Boswell man is awaiting sentencing after a
federal jury convicted him of shooting and killing his mother.
Chase Lane Rocha, 21, was found guilty by
a federal jury of one count of Involuntary Manslaughter in Indian Country.
The jury trial began with testimony on October 2, 2023, and concluded on October 4, 2023,
with the guilty verdict.
During the trial, the United States presented evidence that on January 24,
2023, Rocha caused the death of the victim by shooting her in the chest with
a single-action revolver.
Reports state Rocha got into an argument with his step-father on that fateful day at a home on Unger Rd. near Boswell. Rocha’s mother tried to intervene between the two and Rocha shot her in the chest. She was pronounced
dead at a Hugo hospital.
Rocha fled the scene on a four wheeler.
Rocha’s girlfriend convinced him to turn himself in to police. He told investigators he was in shock over what he’d done and was suicidal.
The sentencing will be scheduled following completion of the report. The
defendant will remain in custody of the United States Marshal until sentencing. LUCAS
