A Broken Bow man was locked up after a telephone apology to his mother and a feeble attempt to escape being arrested.
McCurtain County deputies received information on Sept.
24 that several guns that had been reported as stolen from
Garvin were at an Idabel residence, according to the affidavit.
Deputies arrived at the residence and made contact with
the owner, 28-year-old Seth Eric Aebischer. According to
police, Aebischer was a known convicted felon.
The deputies told Aebischer why they were at his residence; he gave them consent to search his residence and told
them that he did have guns in the residence that he believed
were stolen.
Once police were inside the home, they could smell the “distinct” odor of burnt marijuana.
During a search of the residence, deputies located four rifles that Aebischer said belonged to
him and four pistols that were confirmed as stolen from a recent burglary in Garvin.
In the living room, police found a clear plastic bag that contained a crystal-like substance
that field-tested positive for methamphetamine, 120 unused plastic bags, a plastic bag that
contained a green leafy substance that field-tested positive for marijuana, rolling papers,
pipes with residue and two digital scales. Aebischer admitted to police that he sold meth.
Police told the man that he was under arrest. Apparently knowing that he might be locked
up for a long time, Aebischer called his mom on the phone and told her he was sorry. He
then dropped the phone and ran out the front door. Deputies caught the fleeing felon a short
distance later.
Aebischer is being charged with unlawful possession of controlled dangerous substance
with intent to distribute after former conviction of a felony, possession of firearm after conviction of felony, knowingly concealing stolen property, possession of controlled dangerous
substance and unlawful possession of drug paraphernalia. His bond was set at $30,000 and
he is scheduled to appear in court on Oct. 17, 2013.

Well, the temperatures are
dropping, and fall is almost here,
and these things signal the start
of football season in Oklahoma! Not only have our major colleges
had their first home games, but all across the state, people are
traveling to and from football games from 4th graders on up to high
school. With that in mind, here are a few tips to make this football
season safe.
Lets start with college. Whether you are a Sooner, Cowboy, or
Golden Hurricane fan, one thing is for sure...you aren’t alone! There
are thousands of fans for each home game traveling to the
stadiums. This volume of traffic demands your consideration. First,
if you can, leave early! The closer to game time, the worse the traffic
gets, so if you can, get to the stadium early. There are plenty of
things on a game day that are going on prior to kickoff that you can
spend your time enjoying. There are usually lots of free stuff for the
kids to do that make the whole game day experience wonderful for
them as well.
Second, be patient! You WILL run into traffic, so plan ahead, and
don’t get frustrated with it. Turn on the radio, listen to the pregame hype, and remember to be a safe, courteous driver. Getting
frustrated, and getting into a hurry, can result in a traffic accident
that will delay your arrival, and could end up being very expensive,
not to mention the potential for injury.
Last, be aware that there are usually some temporary traffic
control changes on game days. Both before and after the games,
law enforcement will be at intersections controlling the traffic
lights, and making adjustments to keep the traffic flowing in the
best possible manner. Be alert and aware, and recognize when and
where these temporary traffic controls are taking place!
Now, on to the local games! The biggest thing I remember from
growing up is that parents are usually running late to get to games,
because of what time they got off work. This has not changed... we
Troopers are stopping folks who are speeding trying to get to a kid’s
ball game all the time. While we understand, (we have kids too!)
we also see all too often what happens when accidents happen as
a result of unsafe speed. If you get stopped by us, you’re going to
be even later, and possibly on the hook for a hefty fine. If you get
involved in an accident, you may not make the game at all.
Finally, when you do get there, be a good fan! Cheer your team,
don’t denigrate the other team. Use appropriate language in the
stands; remember, there are kids of all ages in the stands with you.
We Oklahomans love our football, just remember to show your
support in a positive way!

Broken Arrow police arrested a man accused of sexually assaulting
two nursing home patients.
The women are 93 and 80 years old, and are patients at Franciscan
Villa in Broken Arrow. Police say what helped in their investigation is
how quickly the staff there contacted police.
Police say Uqbasilassie Zerie admitted to sexually assaulting the two
women several times over the past six or seven months. They say the
situation came to light when one of his co-workers saw something
unusual.
“She goes into the elderly patient’s room, turns on the light and sees
the suspect pulling up his pants,” said Cpl. Leon Calhoun, of the Broken Arrow Police
Department.
The staff at Franciscan Villa called police that very day, September 11, 2013.
The next day when Zerie came into work, the staff says he admitted assaulting the woman
in that room.
Officers say, when they interviewed him, he also admitted to assaulting the second victim.
Zerie’s Facebook page says he worked for St. John, the company that owns the Villa, but
he didn’t say what his job was.
Zerie’s not listed as a licensed nurse on the state’s website.
Police say that early reporting was key.
“It’s better to get out there and verify there’s not a problem than to be called after the fact
and miss a chance to prosecute someone, because there’s no evidence or he’s gotten out of
the area,” Calhoun said.
Police say the suspect is working in this country on a green card from East Africa. They
say he’s been working in the Broken Arrow area for the past two years. Now, he faces five
counts of sexual assault.

An Atoka ex-con could have a longterm stay inside the county’s prison
after police say he set a local home on
fire with people inside Oct. 2.
Just before 1 a.m. that day, Atoka
police officers responded to the scene
of a house fire, when they discovered
three people were asleep inside the
home when the fire was set. The three
occupants barely made it out of the
house in time, according to the Atoka
Fire Department. Two hours later,
the department deemed the home a
total loss, and firefighters believed
the incident was an act of arson.
Throughout their investigation, police determined Robert Lee
Mitchell, 51, was living in the house for about three months. Two
hours before the fire, he and one of the occupants got into a heated
verbal argument over Mitchell being unemployed. Both were drinking, which escalated the altercation. Eventually, the occupant threw
Mitchell’s items out of the house and told him to leave, to which
Mitchell replied, “Your house is gonna go up in flames!”
Just before 3 a.m., Mitchell was arrested on a public intoxication
complaint by another officer. In an interview, Mitchell initially denied having anything to do with the fire. But ultimately he confessed,
saying “I went over for McDonald’s and I sat for an hour before I went
back over and burned the house.” He didn’t want to hurt the three occupants, instead just wanting to show them he was mad, he said. The
fire started when Mitchell used a cigarette lighter to ignite his jeans,
which he then threw against one of the walls, Mitchell said.
Lee faces one count of first-degree arson, and his last court date
was 9 a.m. Oct. 9. He remains in custody.

Anthony Banks was executed
September 10, 2013. In July,
he waived his right to seek
clemency from the state
Pardon and Parole Board.
“I can’t express the terrible
things I’ve done. I’m sorry,”
Banks reportedly said before
his execution. “To know that
I took lives hurts me. This is
justifi ed. I’ve done one good
thing in my life and that is to
become a Jehovah’s Witness.
For that, I’m eternally
grateful.”
Banks was convicted in the 1979 rape and murder of
Sun I. Kim Travis in Tulsa County. The conviction came
20 years after the crime because of newly discovered
DNA evidence. Banks had been serving a no-parole life
sentence for an unrelated killing in which he originally
had been sentenced to death. An appeal reversed that
conviction, and he made a plea bargain to avoid death.
A co-defendant, Allen Wayne Nelson, received a life
sentence.
Banks and Nelson were charged in August 1997 when
the DNA of both men was detected in evidence found on
the victim.
Banks has been on death row since November 14, 1999.

Police trying to fi gure out who egged and toiletpapered a house in a south-central Montana town
cracked the case after fi nding a grocery bag and a
receipt in the backyard.
Livingston Police Chief Darren Raney said that
a resident reported his house had been targeted by
vandals on Aug. 29.
Investigating offi cers tracked the bag and receipt
to a Livingston store, where video from a surveillance
camera showed a group of teenage boys purchasing
eggs and toilet paper.
Raney tells the Livingston Enterprise the boys,
ages 15 and 16, were referred to the juvenile
probation offi cer.
An Ohio man has been cited for public
drunkenness and criminal trespass for a notso-great eff ort to commandeer a freight train in
northwestern Pennsylvania.
Police say 28-year-old Robert Nerone Jr., of
Jeff erson, Ohio, somehow hopped aboard the
eastbound CSX train in Ashtabula, Ohio and moved
car to car as the train slowed to a stop in Millcreek
Township. That’s in Pennsylvania, just outside of
Erie, about 120 miles north of Pittsburgh.
Millcreek police Capt. Randy Faipler tells the
Erie Times-News that Nerone reached the train’s
main engine and banged on the windows, telling the
engineer and conductor he was commandeering the
train about 3:30 a.m.
Online court records don’t list an attorney for
Nerone, who doesn’t have a listed phone.
There are people who feel the way some motorists
park should be a crime. In this case, it was - sort of.
Police in New York State say a man wanted on a
probation violation ended up being arrested because
he parked so poorly.
A state police investigator spotted a man as he
tried to back his vehicle into a parking space at a
truck stop in Rotterdam, New York.
Police say the investigator took note of the man
because he parked crookedly, taking up two spaces
in the process.
When the man walked away, he recognized
Matthew Bergeron from previous arrests - and knew
he was a suspect in a burglary and was wanted on
outstanding warrants in a neighboring county.
He was taken into custody without incident - and
sent to jail.
That’s something you might not want to post on
Facebook.
The online message said the pot dealer would
be in a store parking lot in a black and silver Ford
Taurus for anyone who wanted to buy.
Police in Bemidji, Minnesota, went looking for the
pot dealer.
But a local paper reports offi cers didn’t fi nd
anyone.
The pot sale notice was posted on a community
for-sale page.
The man who set up the page says police asked
that the marijuana listing be left up, so offi cers could
try to catch the dealer.

A Clayton senior citizen faces felony
charges after he led police on a highspeed drunken chase throughout the city
Sept. 14.
Around 5 p.m. that day, officer John
Lance was on patrol in the city when
he saw a tan SUV drive past a stop sign.
Lance followed the SUV and initiated a
traffic stop, and when he approached the
vehicle, the driver, Eddy McIntosh, 65,
had bloodshot eyes and looked confused.
A quick look through the window of
the SUV revealed McIntosh was driving
with a shotgun, and that, combined with the strong smell of alcohol,
prompted the officer to ask him to get out of the car. But McIntosh
wouldn’t go to jail that quietly.
McIntosh told Lance, “F--- you” and sped off, driving past multiple stop signs and throwing his middle finger out the window in
Lance’s direction. During the chase, McIntosh was driving in and
out of lanes and nearly hit an oncoming car. The officer sped up to
get in front of McIntosh and clear the traffic lanes for the chase, but
doing so prompted McIntosh to rear-end the patrol car twice.
Eventually, McIntosh led Lance to a neighborhood, where his
mother was waiting for him. She began arguing with McIntosh, but
wouldn’t cooperate with police either, blocking their way to arresting him. Eventually, backup arrived, pulled McIntosh’s mother away
from the scene and handcuffed him.
McIntosh faces charges with assault and battery with a deadly
weapon, driving under the influence, resisting an officer and carrying a weapon while intoxicated, among others. He posted a $5,000
bond Sept. 16 and has court set for 9:30 a.m. Oct. 16.

A Coalgate man with a history of domestic abuse was arrested for assault and battery after he allegedly threw a television remote at his girlfriend.
On Sept. 12, a Coalgate police officer and a Coal County
deputy were contacted by dispatch about a possible domestic
dispute. When they arrived, they made contact with the victim at the front door of the residence. According to the affidavit, police noticed that the victim had a knot on her forehead.
They asked her what happened, but a man inside the residence started yelling obscenities and told the victim to get
back in the house. The victim told police, “Ya’ll need to leave.”
The man continued yelling a barrage of obscenities.
The victim stepped outside and again asked the officer and deputy to leave.
The deputy told the witness that they would leave if she told them what happened to her
forehead.
She said that her boyfriend, Randy Scott Fugate, 37, had thrown a remote at her and hit
her in the forehead.
Police entered the residence and told Fugate that he was under arrest. Fugate refused to
stand up. A struggle ensued to secure the man in handcuffs, but the bad guy usually loses and
Fugate was soon locked up in cuffs and transported to jail.
Fugate has two prior domestic violence charges, according to the affidavit.
Fugate is being charged with domestic abuse assault and battery. He was released on a
personal recognizance bond and is scheduled to appear in court on Oct. 10, 2013.

A Bokchito woman was arrested after she was caught
smoking weed with a minor.
On Sept. 21, a Bryan County sheriff’s deputy received
a call about suspicious activity that was taking place on
Haworth Road.
When the deputy arrived, he saw a white car sitting
in the driveway of a residence. He made contact with
the driver, Grace Lynn Smith, 19, and her underage passenger. According to the police report, the deputy could
smell the odor of burning marijuana.
The deputy asked them what they were doing; Smith
told the deputy that the residence belonged to the passenger’s uncle. The deputy told her that the residence
was not the girl’s uncle’s, because the reporting party
that had called in the suspicious activity lived in the
house.
The deputy asked if there was anything illegal in the car; Smith said, “No, not that
I know of. It’s not my car.”
The deputy asked whom the car belonged to and if Smith had permission to drive
it. She said it belonged to the passenger’s father and, after whispering to the passenger, told the deputy that she didn’t have permission to drive the vehicle.
The deputy asked Smith to step out of the vehicle and observed that she had red
bloodshot eyes and dilated pupils. The deputy told her that he could smell the odor
of marijuana and asked if there were any drugs or paraphernalia in the car.
She said, “It’s not my car, but I don’t think so.” She gave the deputy permission to
search the vehicle.
The deputy found a lighter, a baby sock full of a green leafy substance inside and
an empty soda can that had been altered to be a smoking device.
Smith is being charged with encouraging a minor to participate in a drug-related

August 23, 2009, Reverend Carol
Daniels made her weekly trip from her
home in Oklahoma City to the Christ
Holy Sanctifi ed Church in Anadarko.
Most Sundays no one attended services,
as many parishioners were elderly.
However, she didn’t miss an opportunity
to share her faith with others.
Between 10 o’clock that morning, when
Daniels arrived at the church, and noon,
when police offi cers found her body,
someone murdered Daniels by stabbing
her multiple times in the upper body. The
Anadarko Police Department requested
OSBI assistance with the case.
For months, OSBI investigative agents,
crime scene agents, criminal analysts, and Anadarko police offi cers
gathered evidence and information involving the case. Agents have
traveled across the United States following leads. Eventually, investigators
exhausted their list of leads. Even though many other murder cases have
occurred since Daniels’, her case has always remained a priority.
Little more than a year ago, OSBI assigned a well-seasoned agent
to focus solely on cold cases as an OSBI Special Investigator. With his
extensive experience in investigating violent crimes across the state and
without a formal caseload as an OSBI Agent, this Special Investigator
has helped resolve two cold cases and aided in developing viable leads
in several other cases. He has recently been assigned to help agents
investigating the Carol Daniels’ case.
The OSBI wishes every murder could be solved quickly so victims’
families can experience some level of justice. Even with today’s
advancements in forensic technology, proving a person’s guilt in a
homicide case is a formidable task when an abundance of evidence is
available. Unfortunately, some homicide cases yield little evidence and
often may lack credible information.
The OSBI’s goal in every case is to bring the guilty to justice and to
provide support to families of murder victims.

A Sawyer burglar was arrested for stealing
items from the residence of a recently deceased
man.
On Sept. 13, a woman went to the Choctaw
County Sheriff’s Office and told a deputy that
someone had stolen items from her father’s farm.
She said that she thought the theft had occurred
the day before her dad’s memorial service. A man
that was with her told the deputy that the day her
father had passed away, they installed cameras
on the property because they were worried someone might try to steal items from the farm.
They said that an ATV, a trailer and some horse tack were missing.
They gave the deputy memory cards from the cameras that had been
installed.
The deputy viewed the video on the memory cards and saw a man enter the property. According to the affidavit, the deputy thought that the
man looked familiar, but he didn’t know who he was. In the footage, the
man left the property with the ATV on the trailer.
The deputy printed off pictures of the suspect; an employee at the
sheriff’s office was able to positively identify the man as Brandon Douglas Campbell, 30.
Police went to Campbell’s residence, but no one was home. The deputy
asked a neighbor what kind of vehicle Campbell drove and the neighbor
described a vehicle that matched the one in the footage from the farm.
Police were able to locate Campbell at his father’s residence. The deputy told Campbell that he wanted the property that he had stolen. Campbell denied taking anything, but after the deputy told him he had proof,
Campbell said he could get the property back. He told the deputy that
the property was at a residence in McCurtain County.
The property was recovered from the residence of one of Campbell’s
previous coworkers who was unaware that the property was stolen and
was not happy about it being on his property. Campbell was taken to jail
where he admitted to stealing the items.
Campbell is being charged with second-degree burglary and larceny of
an automobile. He is being held on a $50,000 bond and is scheduled to
appear in court on Oct. 29, 2013.
