CAUTION URGED ABOUT CHARITY
SCAMS FOLLOWING HURRICANES
Oklahoma Attorney General Mike Hunter today is warning Oklahomans of charity
fraud and other scams in the
wake of Hurricanes Harvey
and Irma.
Attorney General Hunter
said the work of charitable
organizations is key to the recovery process after a disaster. However, some
see it as an opportunity to run scam operations asking for money the victims
never see.
“As the tragedy on the Gulf Coast continues to unfold, I know Oklahomans will step up to help in a multitude of ways, like we see after all disasters,” Attorney General Hunter said. “I am urging individuals looking to
donate money to use caution and research to ensure a charity is registered
to solicit in the state to avoid becoming the victim of a charity scam.”
Before donating, Attorney General Hunter said one of the easiest ways
to find out if a charity is registered is to look it up on the secretary of state’s
website at: www.sos.ok.gov/charity/, or by calling (405) 521-3912. Charities looking to solicit donations in Oklahoma must be registered through the
secretary of state.
Additionally, the attorney general’s consumer protection unit offers the following guidelines to avoid becoming a victim of charity fraud.
• Donate only to charities that you know and trust;
• Be wary of charities that seem to have been formed specifically in response to a particular disaster;
• Ask for written information regarding the solicitor’s charity, including the
name, mission, administrative costs and how your donation will be used;
• Listen carefully to the name of the purported charity. Scam artists often
claim to be associated with a charity that mimics the name of a well-known,
reputable organization;
• Be suspicious of any solicitor that uses high pressure or aggressive
tactics, asks for donations in cash or promises prizes in exchange for a
donation.
For more information and tips on how to select a charity, visit www.charitywatch.org. To report suspected fraud or scams, contact the attorney general’s public protection unit at (405) 521-2029 and local law enforcement.

6 | OCTOBER 2017 PUSHMATAHA COUNTY Presumed Innocent Until Proven Guilty
Michael Keith Beall, 61, of McAlester, pled
guilty to possession with intent to distribute, a
crime punishable by not more than 20 years imprisonment, and up to a $1,000,000 fine or both.
The Indictment alleged that on April 17, 2017,
Beall did knowingly and intentionally possess with
the intent to distribute a mixture or substance
containing a detectable amount of methamphetamine, a Schedule II controlled substance.
The charge arose from an investigation by the
Pittsburg County Sheriff’s Office, the Oklahoma Bureau of Narcotics, and the Oklahoma Highway Patrol.
The Honorable Steven P. Shreder, U.S. Magistrate Judge in the United States District Court for the Eastern District of
Oklahoma, in Muskogee, accepted the plea and ordered the completion of
a presentence investigation report.
BEAUTY AND THE BEAST
AROUND THE AREA
BEALL
TIPS FROM A TROOPER
Today we are discussing “Failure to display required
lighting when required on a vessel.” This is covered under Title 63-4207 Lights and other equipment. You need
to know what area your vessel falls in to make sure you
are doing not only what is legal, but also what is safe for
you, occupants of your vessel, and any other vessel in
the vicinity or your vessel. If your vessel does not display
the proper lighting, this would be the equivalent of driving your vehicle on the
roadway without headlights. If the driver cannot see you, they will more than
like not be able to avoid you.
Navigation Lights
The required navigation lights must be displayed between sunset and sunrise and during periods of restricted visibility.
Power-Driven Vessels When Underway
If less than 65.6 feet long, these vessels must exhibit the lights as shown
below. Remember, power-driven vessels include sailboats operating under engine power.
The required lights are:
•Red and green sidelights visible from a distance of at least two miles
away—or if less than 39.4 feet long, at least one mile away—on a dark, clear
night.
•An all-round white light or both a masthead light and a sternlight. These
lights must be visible from a distance of at least two miles away on a dark,
clear night. The all-round white light (or the masthead light) must be at least
3.3 feet higher than the sidelights.
•The masthead light and sternlight may be combined as an all-round white
light on vessels less than 39.4 feet long.
Unpowered Vessels When Underway
Unpowered vessels are sailboats or vessels that are paddled, poled, or
rowed.
If less than 65.6 feet long, these vessels must exhibit the lights as shown
below.
The required lights are:
•Red and green sidelights visible from at least two miles away—or if less
than 39.4 feet long, at least one mile away.
•A sternlight visible from at least two miles away.
•An alternative to the sidelights and sternlight is a combination red, green,
and white light, which must be exhibited near the top of the mast.
If less than 23.0 feet long, these vessels should:
•If practical, exhibit the same lights as required for unpowered vessels less
than 65.6 feet in length.
•If not practical, have on hand at least one lantern or flashlight shining a
white light as below.
•Vessel operators should never leave shore without a flashlight. Even if you
plan to return before dark, unforeseen developments might delay your return
past nightfall.
All Vessels When Not Underway
All vessels are required to display a white light visible in all directions whenever they are moored or anchored outside a designated mooring area between sunset and sunrise.

200 E. COURT
ATOKA, OK 74525
(580) 889-2424
25-year-old Anthony Garcia thought that he had just committed the perfect crime
and got away with it. In 2004, the gang member robbed a liquor store in California.
During the heist, he fatally shot the store owner and was on the run for the next four
years. In 2008, he was picked up for driving on a suspended license. While having
his mugshot taken, a police officer noticed the detailed tattoos across his chest. The
officer connected the dots and discovered that Garcia was the gunman in the 2004
shooting. Thankfully, Garcia spent years perfecting his tattoos, which also gave officers the crime scene in pretty exhausting detail. Garcia was convicted of first-degree
murder and could face life in prison for the crime.
Mario Garcia, 39, and Domingo Garcia-Hernandez, 28, planned to rob a West Rogers Park
restaurant. The men entered the restaurant and demanded food but when the owner told them he was too busy, Garcia-Hernandez said, “I will kill you, I have a gun with
me’’, according to a police report. The masterminds were also using squirt guns to
intimidate the owner. After the owner requested them to return in an hour, the two men
obliged to his request. Meanwhile, the owner informed police, who arrived on scene
to investigate the matter. As the police were preparing the investigation report, Mario
and Domingo returned with their squirt guns; who were apprehended by police on
spot. The men were charged with one count of attempted aggravated robbery each.
Mauricio Fierro drove a stolen car to rob a pharmacy. Fierro left the car running for
his quick
getaway and went in to rob the store. Little did he know, as he was robbing the
store, another thief sprinted over to the vehicle and took off in it. When Fierro exited
the store with his bag full of money, he was stunned to discover that his getaway
vehicle was gone. Fierro, angry and short on time, started looking around to find another getaway vehicle; when another man ran by, grabbed his loot and took off. Fierro
was furious with the situation and decided that he deserved some justice. He went to
the police station to report his car and loot being stolen. There, he came across the
pharmacy owner who was making a report about the robbery. The owner recognized
him and informed the police, who apprehended him. When local news stations heard
of the story, they requested authorities to interview him; which they allowed. During
the interview, Fierro complained about the “insecurity” of the city and how he was not
able to enjoy the car he had robbed, which cost him “a lot of blood, sweat and tears”
to attain.
Matthew Allan McNelly and Joey Lee Miller decided to break into a man’s house in
Carroll, Iowa. They had a well-planned strategy ready to be executed but the only
problem was that their strategy was only as good as their IQ’s. The two men decided to conceal their identity in an unusual way. They decided to use no ski masks or
stockings pulled over their heads; not even hoods to cover their face. The pair instead
streaked their faces with permanent black marker. After both men fled the house, the
owner informed the police, who quickly arrived at the scene. Luckily, the officers pulled
over a car that matched the description and the strange disguise made it easier for
officers to identify the culprits. Both men were charged with attempted burglary, and
McNelly was charged additionally with operating a vehicle while intoxicated.

DURANT MAN PLEADS
GUILTY TO BANK ROBBERY
Graham Allen Helms, 29, pled guilty to two
counts of bank robbery, a federal crime punishable by not more than 20 years imprisonment, and up to a $250,000 fine or both.
The Indictment alleged that on or about
July 24, 2017, Helms, by force, violence and
intimidation, did take from the person and
presence of another, money belonging to and
in the care, custody, control, management
and possession of IBC Bank, located in Ardmore, a bank whose deposits were then insured by the Federal Deposit Insurance Corporation.
The Indictment further alleged that on or
about August 1, 2017, Helms, by force, violence and intimidation did take from the person and presence of another,
money belonging to and in the care, custody, control, management and possession of Shamrock Bank, located in Coalgate, a bank whose deposits were
then insured by the Federal Deposit Insurance Corporation.
The charges arose from an investigation by the Ardmore Police Department,
the Coal County Sherriff’s Office, and the Federal Bureau of Investigation.
The Honorable Kimberly E. West, U.S. Magistrate Judge in the United
States District Court for the Eastern District of Oklahoma, in Muskogee, accepted the plea and ordered the completion of a presentence investigation
report.

A Ponca City man has been charged in the hit
and run death of a tribal elder and a spiritual leader with the Otoe-Missouria Tribe.
Antonio Reyes, Jr., 49, was charged August 28
with felony leaving the scene of a fatality accident
in Noble County District Court.
According to reports, Randall Whitehorn, 64, of
Red Rock, was having car trouble near Yearling
Road, south of Marland, on S.H. 177, and was
pushing his vehicle on the shoulder when he was
struck by another vehicle on July 9. The other vehicle did not stop.
After investigating the accident, Kay County
deputies arrested Reyes on August 22 and he was transported to the Noble County jail. His bond was reduced from $50,000 to $25,000 and his
