Stillwater police officers arrested a local man Feb. 16 after they say
he took advantage of hotel hospitality.
That day, officer Ricardo Inciarte was dispatched to the Quality Inn
Hotel at the 2500 block of W. 6th Ave. after receiving a report of a
burglary. When he arrived, he spoke to two victims who said they saw
a man with dreadlocks, later identified as Devin Decker, 26, around
their vehicles acting suspiciously. Decker reportedly stole surveillance
equipment, computers, cash, credit cards and other things related to
their home business.
Inciarte went to Decker’s home at the 2400 block of W. 8th Ave. to
ask him about the situation. However, when the officer tried to speak
to Decker, he immediately became nervous and slammed the door once he went outside. He
declined to give consent to search his house, but he admitted having drug paraphernalia inside, which resulted in his detainment. Under a Miranda warning, Decker also said he had a
shotgun and rifle in the residence.
Near the home, officers found a red suitcase, which matched the description of the stolen
items. In an interview, Decker said he broke into the car and took some of the property inside.
The next day, officers got a search warrant for Decker’s house and found the firearms, marijuana and narcotic pills, as well as two credit cards belonging to the victims. Decker said he
brought the drugs to Stillwater to “get rid of.”
Decker faces charges of second-degree burglary and possession of controlled substances.
He posted bond the day after his arrest and has a court date set for 1:45 p.m. March 23.

A Perkins ex-con who tried to trade sexual
favors for drugs and guns now faces felony
charges as of Feb. 11.
On Jan. 25, OSBI officer Brandon Myers
started having undercover conversations
with Matthew Lowe, 34, over Facebook,
which turned into text message chats. Myers
talked to Lowe about the sale of drugs and
firearms, and in several conversations Lowe
said he wanted to trade the items for hand
jobs or foot jobs.
Myers gathered evidence from the conversations and got a search warrant for Lowe’s residence at the 100
block of Timberline Drive, where he found four shotguns matching
Lowe’s description. Lowe wasn’t home during the search, but his
roommate Robert Adame, 28, was. Adame is also an ex-con, and under Miranda he admitted he had firearms and said they may have
been stolen from another home in Perkins.
Myers found out Lowe was in the area, so they found and arrested
him. A pat-down search turned up a blue container that had a bag
of methamphetamine inside and several items with drug residue on
them. In an interview, Lowe told Myers where the guns were and
said he was trying to sell them for Adame, adding that he also believed they were stolen.
Lowe was convicted in 2009 and 2011 of possession of methamphetamine and manufacture of methamphetamine, respectively. He
received suspended prison sentences in each case. Adame was convicted of attempted grand larceny in 2009 and received a two-year
suspended sentence.
Lowe and Adame remain in custody. Lowe pleaded not guilty Feb.
19 to charges of knowingly concealing stolen property, possessing
firearms as a felony, possession of controlled substances and possession of drug paraphernalia.
They have a court date set for 9 a.m. March 4.

In this installment of Tips From
a Trooper, I’m going to talk about a
violation that we see every day. It
is something I am sure most of my
readers have done, many times, without giving it another thought. I
doubt if most have even considered it to be unsafe, much less illegal,
but it is. The violation is passing on the shoulder, and it happens all
the time.
The car ahead of you is stopped in the lane of traffic, and you see the
left turn signal on. Its not turning because of oncoming traffic, which
it must yield to before turning, so you just slide your vehicle over to
the right, onto the shoulder, or maybe even just the widened part of
the road where the intersection is, and pass right by them. Maybe
you slowed down a little, just to be safe, or maybe not. You are in a
hurry, and don’t want to slow down to wait for traffic to clear. Doesn’t
seem like a big deal does it? Well, passing on the shoulder is illegal,
and can be a very dangerous situation!
The Statute governing this scenario is actually in the section that
states when passing on the right is permitted...it gives a few examples,
one of which is when a vehicle is preparing to make a left hand turn.
Sounds like its covered and should be legal, right? The last sentence
of this Statute is where you find the restriction for passing on the
shoulder.
It states:
The driver of a vehicle may overtake and pass another
vehicle upon the right only under conditions permitting such
movement in safety. In no event shall such movement be made
by driving off the pavement or main traveled portion of the
roadway.
Statute also defines roadway for us: That portion of highway
improved, designed or ordinarily used for vehicular travel, exclusive
of the shoulder.
The reason for this Statute is simple, and for this exact scenario...
not only is the vehicle in front of you turning left, but the oncoming
vehicle is also going to turn left, and visibility of your vehicle is
blocked by the stopped one, which makes a blind spot, and the
potential for the oncoming vehicle to turn left in front of you, just as
you are passing the other vehicle! We work accidents where this is the
causation all the time, and they can all be prevented by obeying this
law, and practicing some patience! How much time do you think you
actually save when doing this, anyway? Next time you see someone
do it, watch and see if you don’t catch them at the next traffic light...
they really didn’t save anything, and a couple of seconds aren’t worth
risking an accident and a life.

Under cover drug agents defuse a mini meth lab found inside a
porta-potty in the middle of a golf course in Purcell.
Staffers noticed strange sports drink bottles with chemicals inside
the porta-potty and called police.
Officers arrived and soon realized someone had been inside making
meth using the “shake and bake” method.
Three bottles were found, two of them exploded before detectives
arrived.
Agents were able to neutralize the third one without the harmful
chemicals erupting.
“If someone would have been in the porta-pot when it happened
they might have gotten hurt by the flying plastic and the chemicals,”
Purcell Dt. Cpl. Scott Stephens said.
Investigators said they have a lead on one suspect but said they
believe others could be involved.
The inside of the unit was damaged but agents were able to submit latent fingerprints to a
crime lab.

A Tulsa man’s reckless driving landed him in jail for his second DUI
Feb. 16.
Around 12:20 a.m. that day, officer Reginald Smith was on patrol at the
200 block of East Harrison Street, where he saw a white pickup truck run
a stop sign. He initiated a traffic stop and confronted Ryan Geisler, 30.
Geisler turned over his driver’s license but didn’t have his insurance.
He said he was visiting his parents at a nursing home and then decided
to go to the Blow Out bar. However, Smith smelled alcohol coming from
Geisler’s breath, so he asked some more questions.
Geisler said he drank between three and four beers and had a shot
before driving, so the officer had him perform some field sobriety tests. Unfortunately for
Geisler, he was unsteady, could barely speak clearly and had to use the truck to keep his balance. Also, Geisler almost fell down multiple times, so Smith stopped the test and arrested
him.
Officer Jade Terbush searched the pickup and found a silver marijuana pipe on the driver’s
side floor board. When Smith asked Geisler about contraband, he admitted to having the
pipe, saying he smokes, “marijuana, pot, you know.”
Smith took Geisler to the hospital to get a blood draw and then transported him to jail.
Geisler posted a $6,000 bond Feb. 19 and pleaded not guilty the same day. He has a previous DUI conviction in Texas, where he received a 120-day sentence.
Geisler will next appear in court at 9 a.m. March 28.

A traffic stop ended with a California
teenager and his friends in Logan County
lockup on suspicion of drug trafficking
Feb. 8.
Just before midnight that day, officer
Jade Terbush reported seeing a white
Chevrolet Malibu with a broken tail light.
Terbush initiated a traffic stop and confronted the driver, Syria Rawlins, 20, who
said she didn’t have her driver’s license
with her.
A check of her records revealed Rawlins’
license was suspended and she had unconfirmed insurance, so she was arrested on a driving under suspension complaint. During her arrest, Rawlins said the car didn’t belong
to her, so she gave Terbush the owner’s information. The owner of
the car gave consent to search, so the passengers, mostly teenagers,
had to get out of the car.
During the search, Terbush found a backpack with multiple bags
of marijuana inside. None of the passengers, Jaychelle Markella
Price, 19, Xavier Bosley, 19, Dillon Davis, 20, and Deondre James,
19, admitted ownership of the backpack, so they were all detained
and eventually arrested.
Also in the car was a .45 caliber pistol with nine bullets in the magazine, as well as a digital scale. There were six bags of marijuana in
the backpack, Terbush said.
While searching Davis, the officer found nearly $1,200 in cash,
which Davis said was from his tax return.
Price posted bond Feb. 12, and James was released on bond Feb.
20. Bosley and Davis remain in custody on bonds of $31,000 each.
Rawlins is in custody on a $33,000 bond. They all face marijuana
distribution charges.
Everyone will appear in court March 28 on the preliminary announcement docket.

Parents of the year
A McCloud woman was taken into custody Feb. 1 after she abandoned her children
in Lincoln County.
Michelle Warren, 30, was charged Jan. 29
with five counts of child neglect in Lincoln
County District Court. The children’s father,
Rocky Beeson, 32, was also charged with
five counts of child neglect.
According to court records, Warren left
the home in September, 2012, after suffering abuse from Beeson. Two months later
he was arrested for stealing checks from his
mother. After his arrest, Warren refused
to go home and instead initially left her children in the care of her
22-year-old brother and his girlfriend. Numerous family members
had been staying with the children, but no one stayed permanently
with them. She would visit occasionally and knew the children were
living in “squalid living conditions.”
On top of that, she was receiving $1000 per month in food stamps,
yet the children were reportedly hungry and little food was in the
home. She allegedly did not clean the house or buy groceries until the
children were taken into state’s custody.
Warren’s bail was set at $15,000 and her initial appearance is
scheduled for March 4.

Randal Wade Byus, 43, pleaded guilty to reduced charges
in May 2008 and agreed to cooperate with authorities. He
testifi ed against Gilbert Postelle, whom he said did most of the
shooting on that fateful Memorial Day.
Postelle and his family blamed Swindle for causing a
February 2003 motorcycle wreck that left the elder Postelle
with brain damage and other injuries. They went to Swindle’s
trailer looking for revenge and vowing to kill anyone who got
in their way.

An Okfuskee County man was arrested at his parent’s home
near Paden after he went to his estranged wife’s home in Stroud
and assaulted her and her roommate.
Joe Capps, Jr., was charged Feb. 12 with assault and battery
with a dangerous weapon in Lincoln County District Court.
According to the police affidavit, officers were called to the 600
block of N. Cedar in reference to a man who had been stabbed in
the face. When officers arrived, they found the victim standing
outside the apartment with blood dripping from a cut under his
left eye. It was on the pavement and inside the apartment.
The male victim said Capps had knifed him when he tried to
break up a physical fight between the estranged wife and Capps.
The woman told officers Capps had come to the apartment and
they got into an argument. Capps then slapped her twice and
bashed her head into a kitchen cupboard. Officers observed redness on the left side of the
woman’s face.
Officers also took note that the apartment was in complete disarray with blood everywhere,
broken dishes in the front room, a shattered coffee pot in the kitchen, and a large hole in the
dining room wall.
Capps was taken into custody near his parents’ home, but denied he ever had or used a
knife. The knife was found at Capps’ parents’ home on top of the refrigerator.
Capps was later taken to the Lincoln County Jail. Bond was set at $6000 and he was ordered to stay away from the victims. His next court appearance is scheduled for May 13.
