HATE CRIME RESULTS
IN PRISON TIME
A second Oklahoma man, Brandon Wayne Killian, 31, of Midwest City, was sentenced August
14 to serve 72 months in federal prison, followed
by three years of supervised release, and ordered
to pay $43,007.76 of a total restitution amount of
$113,644.40 for his role in a racially-motivated attack in Shawnee.
On January 18, 2022, a federal grand jury returned a two-count indictment
charging Killian and co-defendant Devan Nathanial Johnson, with physically assaulting a Black man, as well as the Black man’s white friend, in the parking
lot of a Shawnee business on June 22, 2019. According to the indictment, the
assault occurred because of the Black man’s race and color. Both Killian and
Johnson are white. Killian pleaded guilty to one count of committing a hate crime
in September 2022, and was sentenced on August 14, 2023. Co-defendant
Johnson was sentenced to 10 years in prison, and ordered to pay $68,186.64
in restitution on July 25, 2023.
“The sentencing of both defendants responsible for this racially-motivated and
violent assault secured justice for the victim and the community,” said Assistant Attorney General Kristen Clarke for the Civil Rights Division. “Preventing,
investigating and prosecuting bias-motivated crimes remains a top priority for
the Justice Department, and we will continue our enforcement efforts around
the country, holding individuals accountable for committing violent hate crimes.”
“The defendants targeted a Black victim for a brutal attack simply because of
the color of his skin,” said U.S. Attorney Robert J. Troester. “Hate-fueled criminal conduct cannot be tolerated in a civilized society and my office will remain
steadfast in our mission to protect those victimized by hate. I commend the
work done by our law enforcement partners and prosecutors who continue to
seek justice in these cases.”
“The FBI worked in close partnership with the U.S. Attorney’s Office to bring
justice for the victim of this horrific attack,” said FBI Oklahoma City Special Agent
in Charge Edward J. Gray. “Defending the civil rights of every American citizen is
one of the FBI’s highest priorities, and we simply won’t tolerate acts of violence

key factors that define the quality of life in a community.

AROUND THE STATE
PULLING A GUN ON STREET PHONE VENDOR AND DRINKING BOX WINE IN PUBLIC
On August 15, around 9:00 a.m., officers responded to a 6000 S. Peoria in Tulsa for a call
about a disturbance with a gun.
The caller said they saw the suspect, later identified as Kenneath Gustavis,
point a gun at a vendor issuing government cell phones on the corner. The caller
also said the suspect was arguing with others in the parking lot.
The first officer arrived and quickly spotted Gustavis drinking wine out of a
box in public. Initially, Gustavis put his hand on his waistband, implying he had
a weapon.
Gustavis then put his hands up and started to comply with the Officer, but then
turned and ran, as seen in the photo.
Officers took Gustavis into custody just a few blocks away and recovered the
gun he was carrying. Gustavis appeared to be intoxicated at the time.
The cell phone vendor later said Gustavis initially became upset when he
was told he needed an ID to get a free
phone. The vendor said Gustavis then
spit and hit his vehicle, then pulled out a
gun and pointed it at him.
Kenneath Gustavis was arrested for:

- Carrying a Firearm While Intoxicated
- Obstructing/Interfering with a Police
Officer
- Consuming Intoxicants in a Public
Place

ESCAPE
Just after 8:00pm [August 15] we had a jail
trustee run from the Johnston County Jail. I immediately activated an emergency recall of all
Sheriff’s Deputies. Tishomingo Police was immediately aware of the situation and Chief Shannon
Smith also activated an emergency recall of his personnel. I also requested assistance from the Chickasaw Lighthorse Police, Marshall County Sheriff’s Office,
Madill Police Department, Love County Sheriff’s Office, Murray County Sheriff’s
Office, Bryan County Sheriff’s Office, Oklahoma Highway Patrol, Durant Police
Department, Oklahoma ABLE Commission and the Chickasaw Nation Emergency Management. Johnston County Sheriff’s Dispatch and Johnston County
Emergency Management also sent out a Hyper Reach communication to all residents in the area letting them know what was going on and to keep an eye out.
Law enforcement immediately flooded the area where the escapee was last
seen entering the Pennington Creek area off of 8th street. We set up a tight
perimeter along the Pennington Creek area north of the Main Street crossing
and deployed law enforcement officers, K-9’s and thermal drones. At 9:54pm
units located the escapee in Pennington Creek, east of Elks Road and north of
Brandi Dr.
The escapee was taken into custody without further incident and has been returned to confinement
at the Johnston County Jail. An internal investigation has been launched and we will identify what

Seminole woman Heather Nichole Harbison,
39, was arrested and put behind bars after officers caught her trespassing at a condemned
home on August 12.
She also had paraphernalia and drugs in her
possession.
According to the police report, Seminole police officers were dispatched to 34
Jefferson at approximately 9:22 a.m. to investigate a burglary in progress. One
of the responding officers had been at the residence before, and she knew it was
condemned and ready for demolition.
When she arrived, the officer saw a woman walking in the backyard of the residence. The woman then went behind the privacy fence of a neighboring yard.
The officer also saw a male in the backyard. He walked toward the privacy
fence where the woman had disappeared to, but officers stopped him. He said
he was getting some stuff from the residence because he used to live there.
Officers advised that no one was allowed there and he was trespassing.
The man started resisting officers and they placed him in handcuffs. He also
had a pill bottle on his person.
The woman officers saw earlier walked around the side of the home. To confirm, the officer asked the man in cuffs if that was the same woman who had
been in the backyard earlier. He said yes.
The woman was identified as Harbison.
When an officer asked why she was at the house, she said she wanted to
get some things to bring to her friends. The officer advised the woman she was
being arrested for trespassing. She then looked through the woman’s bag and
found a container with a crystal-like substance inside, a glass smoking device,
two small vials containing a crystal-like substance, and another vial containing
three white pills. The crystal-like substance field-tested positive for meth.
The officer asked Harbison what the substance was. She replied, “A lot of
meth.” She said she didn’t know what the pills were.
Harbison is being charged with trafficking in illegal drugs. Her bond was set at
$40,000, and she is scheduled to appear in court on September 7, 2023 KYLON

ADA MAN ENTERS PLEA
TO FEDERAL DRUG AND
FIREARM CHARGES
An Ada man will soon know the inside of a
federal prison after he pleaded guilty to drug
and gun charges.
Timothy Ray Brown, 40, of Ada, entered a
guilty plea to Possession with Intent to Distribute Methamphetamine and Possession of a Firearm in Furtherance of a Drug
Trafficking Crime.
The charges arose from an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Pontotoc County Sheriff’s Department.
The Indictment alleged that on March 10, 2022, Brown knowingly and intentionally possessed a quantity of methamphetamine with the intent to distribute it and knowingly possessed a firearm during and in relation to drug
trafficking.
The Honorable Jason A. Robertson, United States Magistrate Judge in the
United States District Court for the Eastern District of Oklahoma, accepted
the plea in Muskogee, Oklahoma, and ordered the completion of a presentence investigation report. Brown was remanded to custody of the U.S. Marshal pending sentencing. CHRISTOPHER

An 18-year-old man in DeKalb County basically turned himself into police after a robbery
attempt turned ice cold...literally.
On Saturday, July 15, 2023, around 6:41 p.m. the Waterman Police Department in Waterman, Illinois responded to a call about a man being stuck in a
freezer at a local food establishment called Fay’s Finest Foods.
So how did this man get himself locked in a freezer? That is where the story
gets interesting.
According to WSPY News, 18-year-old Gabriel J. Morales locked himself
in the freezer at Fay’s Finest Foods while attempting to ROB the joint, AND
he called 911 himself.
