Midwest City man Daniel Thomas Levi
Bean, 29, was arrested after he had a
little too much alcohol while gambling at
a McLoud casino on October 15. He tried
to escape by walking down I-40, but an
officer caught up to him and took him to
jail.
According to the police report, a Citizen Potawatomi Nation police officer was
contacted by casino security shortly after
1:15 a.m. to assist with an intoxicated
patron. When the officer arrived at the casino, located in the 700 block of Grand
Casino Boulevard, he was advised that
the suspect had taken off running toward
I-40 shortly before his arrival.
A security guard pointed toward the interstate.
The officer could see a figure walking in the median.
Police went to the area and made contact with the suspect, identified as Bean, on the westbound ramp of I-40 at mile marked 178. Bean
smelled like alcohol, he was unsteady on his feet, and he slurred his
words while speaking to officers.
After checking the man’s person for weapons or contraband, the officer
placed him under arrest and put him in the patrol car. Bean complained
that the handcuffs were too tight on his wrists. The officer explained that
he would fix them after moving off of the interstate. The officer drove to
the travel plaza parking lot, where he fixed Bean’s handcuffs. He then
transported the man to jail.
Bean pled guilty to the charge of public intoxication, and he was ordered to pay a fine of $100.

Stuart man Terry Joe Hall, 43, tried to
act like it was no big deal when a deputy
caught him behind the wheel of a stolen
semi-truck in the middle of someone’s
land.
According to the affidavit, a Johnston
County deputy was dispatched to Luffy
Chapel, a ½ mile north from Slab Road.
The caller said a semi-truck had run
through his gate and was parked in his
field.
When the deputy arrived, he knocked
on the truck. A man in the driver’s seat
threw his hands up in the air. The deputy
yelled at the man, identified as Hall, to
turn off the truck and open the door. He
noticed that the ignition was separated
from the dashboard, as though it had been started without a key.
Hall exited the vehicle and told the deputy that he was just working on
the truck for a friend. The deputy asked him if he knew where he was. Hall
replied, “Yeah, I’m in Ashland (Pittsburg County).”
The deputy informed him he was actually in Johnston County.
When the deputy told Hall he didn’t believe his story, the man said he
found the semi at Luffy Chapel and Rock Hill Road.
While the deputy was speaking to the man, he noticed that Hall appeared to be under the influence of methamphetamine. The deputy also
knew that Hall was known to participate in “chop shops” and was a suspect in a recent burglary. He asked Hall when he last used meth -- Hall
said it had been a few weeks. Hall admitted to taking some pills for back
pain, but he said he didn’t know what they were.
Dispatch advised the deputy that the semi had been reported stolen
from a truck stop parking lot in Pontotoc County.
The deputy placed Hall under arrest, but the man continued to insist that
he did nothing wrong.
A state trooper conducted a drug recognition evaluation and determined
that the man was under the influence of methamphetamine and depressants.
The inside of the truck was a mess, as though it was in the process of
being “chopped” up. Various parts of the interior were disassembled and
strewn around the truck.
Hall is being charged with possession of stolen vehicle and malicious
injury to property over $1,000. His bond was set at $100,000, and he is
scheduled to appear in court on January 9, 2017.

Both State Questions 780 and 781 passed on November 1. Do you think these
new laws will help or hurt our justice system?
To refresh your memory:
State Question 780 would reclassify certain offenses, such as simple drug possession and property crimes, as misdemeanors rather than felonies. The reclassification of the drug possession offense is intended to be applied to persons who use
the drugs, not to those who are selling or manufacturing the drugs. The measure
also would change the dollar amount threshold for property crimes charged as
felonies from $500 to $1,000.
The goal of this measure is to reduce the size of the state’s prison population and
to reduce the amount of state funds being spent on prisons. SQ 780 proposes to
change Oklahoma statutes, not the constitution.
SQ 781 would create the County Community Safety Investment Fund. That fund
would hold any cost savings achieved by reducing numbers of people incarcerated—a decrease resulting from reclassifying certain property crimes and drug possession as misdemeanors. The new In-vestment Fund would be a revolving fund
not subject to fiscal year limitations. Any savings or averted costs would be calculated by the Office of Management and Enterprise Services.

won’t help the cause of the problem. Making them felons just guarantees that they
won’t be able to get a decent paying job to try and turn their lives around and will
be stuck in a vicious cycle of poverty and drug abuse
Adam C: Mental health issues and trauma? Funny. Majority of people I used to
know that are druggies didn’t have mental health issues. They made the decision
to do drugs and got hooked. I work with adults with legitimate mental health issues
and not one of them are like that. Maybe instead of making excuses for them let
them take responsibility for their actions.

According to the affidavit, dispatch
contacted a Holdenville officer shortly after 3 p.m. when Leary walked in
with the gun. Leary was in an agitated
state, and a dispatcher quickly took
control of the firearm.
When the officer arrived and tried to
speak to the woman, she kept talking
over him. She told him she was there
about a restraining order served to
her by a former landlord. She said the
document was not legal, and she knew her rights.
When the officer tried to ask Leary about the gun, she replied, “What
gun?” and “I brought a gun in?”
The deputy advised her that yes, she did. She told him, “That gun is
stolen. That’s what I’ve been trying to tell you.”
When he tried to ask her where she got it from, she said, “You are
stupid and don’t know the law. I want to speak to the chief deputy.”
The officer and deputy tried to get the woman to calm down. Upon
further inspection of the gun, they realized the serial numbers had
been filed off.
Leary didn’t seem to understand what the officers were saying. At
one point, the deputy asked if she used meth. She replied, “I take my
medications.”
While they were speaking to her, Leary’s boyfriend called the police
department and asked about Leary. He asked officers to tell her to
answer her cellphone. Leary said she didn’t have one. When an officer asked if she left it in the truck she arrived in, she said, “So I drove
here?”
Leary gave officers permission to search the vehicle for her phone.
In her purse, they found a second magazine for the handgun and a
syringe.
When officers asked her what the syringe was for, she told them she
took meth for a medical condition, to keep her alive. Due to the paraphernalia and the woman’s odd behavior, an officer placed her under
arrest and took her to jail.
Leary is being charged with altering firearm serial number, unlawful
possession of drug paraphernalia and public intoxication. Her bond
was set at $5,000, and she is scheduled to appear in court on November 18, 2016.

A Palm Beach Gardens man is facing charges that he pointed a gun at another motorist during a road rage incident, according to an arrest report.
If the accusation proves true, then Jack Michael Haberkorn picked the
wrong victim.
The person Haberkorn allegedly threatened turned to be an off-duty Palm
Beach Gardens police officer.
Haberkorn, 22, is now facing charges of aggravated assault with a deadly
weapon, carrying a concealed weapon, improperly exhibiting a firearm and
possession of a controlled substance without a prescription and is being held
in the Palm Beach County Jail in lieu of $81,000 bail.
The road rage incident took place eastbound on PGA Boulevard and began
when a 2014 Volkswagon Jetta driven by Haberkorn cut in front of the off-duty
officer and “continuously” braked hard, the report said.
The officer said she pulled up along the Jetta and said, “Really … really?”
Haberkorn allegedly responded by reaching down and pointing the weapon
out the window and at the woman while stating, “You better watch who the
[expletive] you’re [expletive] with,” the report said.
The officer alerted police and followed the Jetta until it ran a red light at the
intersection of PGA Boulevard and Lake Victoria Gardens Avenue.
Police tracked down Haberkorn and found a loaded .40-caliber Glock in his
possession as well as Xanax and burglary tools inside his vehicle. The off-duty
officer positively identified Haberkorn as the person who pointed the weapon
at her.
Authorities say an assistant principal at a Tampa area high school ended up
going to a hospital and then to jail after she tried some pot-laced cookies for
her 50th birthday.
Pasco County Sheriff’s spokesman Kevin Doll says Donna Lynch Haff overdosed Monday on cookies made with cannabis oil.
He says the educator’s daughter, 19-year-old Allison Haff, had obtained the
cookies from a co-worker and brought them home after her mother said she
wanted to try marijuana for her 50th.
Doll says both were released from jail that day and that they were charged
with felony possession of a controlled substance.
It’s unclear if the women have retained attorneys.
School district officials say the assistant principal has been placed on administrative leave from her high school in Holiday.
A woman was arrested after she injured her husband with a sword after an
argument over drugs and their relationship, deputies say.
The Clay County Florida Sheriff’s Office responded Nov. 5 to a home in the
1680 block of Baxley Road in Middleburg.
During an argument, Brandi Oberdeck, 25, threw a wrench at Peter Oberdeck and hit him in the thigh, deputies said.
Peter Oberdeck got a sword, caused damage to the home and dropped the
sword, the report said.
CCSO said Brandi Oberdeck grabbed the sword and struck the victim’s
stomach, forearms and right side.
Peter Oberdeck was taken to Orange Park Medical Center for treatment.
Peter and Brandi Oberdeck have been married for about four years.
Deputies said it appears that they were under the influence of alcohol or
drugs. Deputies found two swords inside the home.
Brandi Oberdeck is charged with aggravated battery. CCSO said she was
placed on suicide watch.

Oklahoma City man Vicente Hill-Aguilera, 20, allegedly threatened the mother of his child after she refused to let him
see the kid on October 18.
She claimed she didn’t want their child
around him while he was on drugs.
According to the affidavit, a Wewoka
officer was dispatched to a residence in
the 1300 block of South Eufaula around
7 p.m. because a man was in the yard
and was threatening to shoot a woman.
When the officer arrived at the residence, a woman told him that Aguilera had left the residence headed
north. She advised that the victim, her sister, was at a residence down
the street.
The officer went to the home west of 10th Street where he found the
victim standing outside. She told him Hill-Aguilera was her boyfriend.
She said he called her and told her if she didn’t let him see his child,
he was going to beat her up and shoot her just like he did to his older
brother.
The woman said she told the man she didn’t want her child to be
around him while he was on drugs.
The officer told dispatch what the man allegedly told the victim, and
he requested that officers go to Hill-Aguilera’s residence and speak to
him about the incident. About 30 minutes later, the officer was advised
that Seminole County deputies has placed the man under arrest for
driving under suspension. They also found three .22-caliber rounds in
his pocket.
Hill-Aguilera is being charged with harassing and threatening electronic communication, and driving with license canceled/suspended/
revoked. His bond was set at $3,000, and he is scheduled to appear in
court on December 6, 2016.

An Ada man wasn’t too pleased when he found
a man sleeping in the same bed as his estranged
wife on October 27.
46-year-old Raymond Gene Townsend was so
enraged that he allegedly attacked the man with
a baseball bat.
According to the police report, an Ada officer
was dispatched to the 700 block of W. 13th Street shortly after 6 a.m. to investigate the incident.The officer made contact with the victim, who was lying in
the kitchen floor with two large lacerations to the top of his head.
The officer asked the man who attacked him -- the victim said Townsend hit
him with a baseball bat.
The victim told the officer he was asleep in bed with Townsend’s estranged
wife. The victim said they were just talking and fell asleep in different directions. He was woken up by being hit in the head. He said he didn’t remember
much of what happened -- he just remembered running out of the house after
Townsend stopped hitting him.
The officer spoke to Townsend’s wife, who said she was asleep when the
incident happened and she didn’t see anything. She did hear Townsend tell the
victim, “I told you to stay away from my wife.”
An officer saw a black bat with blood on it leaning up against the wall. When
he asked the woman if the bat was used in the assault, she shook her head
yes.
Another couple in the home also told the officer they didn’t see anything.
When the officer went to the hospital to speak with the the victim, the victim told him that everyone in the house was awake during the incident, and
Townsend’s wife saw they whole thing.
The man had lacerations on his head and shins, and bruising on his wrist
and elbow.
Another officer located the suspect at a residence in the 700 block of W.
Tenth Street. Townsend denied knowing anything about the incident.
When officers asked to see some of his belongings, they found dried blood
on the sleeve of his hoodie. Townsend said it wasn’t blood -- he then told police
he must have bled from his knuckle.
