Shawnee Man to Serve 210 Months in federal
Prison for Unlawful Possession of Firearms
Adrian David Ray Gerdon, 38, of Shawnee,
has been sentenced to 210 months in federal
prison for being a convicted felon in possession of a firearm, announced Robert J. Troester
of the U.S. Attorney’s Office for the Western
District of Oklahoma.
According to court records, state authorities issued felony arrest warrants in unrelated
cases for Gerdon on December 28, 2017. An
investigation led law enforcement to Gerdon,
who had been hiding out in a trailer in Newalla.
During Gerdon’s arrest on January 24, 2018,
law enforcement discovered a Smith and Wesson, Model 3913, 9mm pistol in the trailer,
along with a Savage Arms, Mark II, .22 caliber
rifle.
Further investigation revealed that Gerdon had previous felony convictions
in Pottawatomie County for domestic assault and battery by strangulation,
burglary in the first degree, assault with a dangerous weapon, possession of
illegal drugs, bringing illegal drugs into a jail, and domestic assault and battery
resulting in great bodily injury.
Under federal firearms laws, Gerdon was prohibited from being in possession of any firearm because of his prior felony convictions.
On March 7, 2018, Gerdon was indicted by a federal grand jury for being in
unlawful possession of a firearm following his felony convictions. He pleaded
guilty on May 17, 2018.
At his sentencing hearing on September 28, United States District Judge
Vicki Miles-LaGrange found that Gerdon’s criminal history makes him an
Armed Career Criminal, which increases his minimum punishment to 15 years
in prison. Judge Miles-LaGrange ordered the 210 months to be served concurrently with several previously-imposed state-court sentences.
Additionally, Gerdon was ordered to serve three years of supervised release
after his prison term.

A South Carolina man was caught rubbing buttered toast all over his
neighbor’s SUV window. Seems like a foolproof plan, how did he get
caught? According to MSN, He just dropped the toast a few feet away
from the car and made his departure, causing a nearby woman to notice and call the police. The police charged the now hungry man with
“malicious damage to property” and estimated the cost of damage to
be about $1.
What’s the hottest you’ve ever been? Temperature-wise of course, because if it was in physical terms, we all know we were the hottest at our
5th grade, bowl-cut, chubs stage. But really, to what extent would you
go to cool off?
Hopefully not so far you’d get arrested, but this is exactly what a group
of four young men in Germany did. On a hot day, they decided to make
their own pool in a car. In a BMW no less. A policeman noticed a very
strange convertible driving down the road. Upon closer viewing, it appeared that the bathing-suit clad men were splashing around in the water-filled car, clearly intoxicated. Though there was no law against driving
around with a pool in someone’s car, they were probably charged for
driving without a permit. Talk about hot water.
What do you guys think about sausage? I suppose it’s better than a
hot dog, which in turn is better than bologna (which is basically giant hot
dog slices?). And no matter what, it has to be better than Lunchables
*shudder*.
No matter your opinion, sausage was a huge disappointment for this
Phoenix man. He attempted to rob two large businesses, first an Ace
Hardware and then a Safeway. He put his hand under his shirt to look
like a gun, but the cashier was not fooled and calmly said “no” to his request for money. Equally unsuccessful was his attempt to rob a Safeway,
which resulted in him being escorted out of the building. He waited a few
minutes before returning into the store to snag a small breakfast sausage
and was therefore charged with shoplifting. I guess all that failing worked
up an appetite.
Sometimes people don’t want their babies. Throughout history, these
people have found convenient ways to get rid of them. In the middle
ages, a popular solution was to leave a swaddled infant on the doorstep
of a misfortunate new parent. Worse for the child, another option was an
orphanage. In later times, parents could even put their kid in the circus
for life. The last one, I’m actually jealous of.
It might not have been this Florida woman’s goal to give away her child,
but that’s sure what it looked like. She had gone shopping at Dillard’s,
and tried to shoplift $260 worth of clothing using her baby stroller. When
a police officer followed her out to her car, she flipped out and eventually threw her baby in its little carseat at him. The baby was not injured.
The shoplifter received three charges, including “resisting a police officer
without violence”. Um. What would be violent, throwing her entire family?

A Healdton man has been taken into custody
on alleged rape charges.
Agents with OSBI made an arrest October 5 in a
rape investigation that allegedly occurred at Murray State College in Tishomingo. OSBI assistance
was requested by Murray State Chief of Police
Sam Hunt. OSBI agents arrested 20-year-old Dakotah Martin, who was a Murray State student.
Martin was booked into Johnston County jail
on one count of first degree rape. His bond was
set at $75,000 and his next court appearance is
scheduled for November 26 at 9 am.

AG Hunter Calls on the FCC to Adopt New Rules to
Crack Down on Robocalls and Sca m Phone Calls
Attorney General Mike Hunter and a bipartisan coalition of 34 state attorneys general have sent a letter
to the Federal Communications Commission (FCC),
calling on the commission to adopt new rules to allow telephone service providers to block robocalls and
scam phone calls before they reach consumers.
The added authority sought by the attorneys general
will allow service providers to use new technology to
detect and block illegal robocalls – even those coming
from what appear to be legitimate, local phone numbers. Service providers will be ready to launch this new authentication method in
2019.
Attorney General Hunter said the Consumer Protection Unit in his office received
over 4,000 phone calls in the last year regarding phone scams, more than half of
all the calls the unit received.
“Illegal robocalls are irritating and disconcerting, and phone scammers are successfully able to steal personal information, leaving Oklahomans susceptible to
identity theft,” Attorney General Hunter said. “It is time to take more action and give
service providers more tools in order for them to protect consumers from these
scams. I appreciate my colleagues for continuing this fight to protect our families,
neighbors and loved ones across the Unites States. Working together with state
partners, the federal government and law enforcement personnel, we will find a
way to end these calls and give Oklahomans protection and peace of mind.”
In the formal comment sent to the FCC, attorneys general write about the difficulty of enforcement efforts and why more authority needs to be given to service
providers.
“Our respective Consumer Protection Offices receive and respond to tens of
thousands of consumer complaints each year concerning the disruptive and abusive nature of these calls,” the letter reads. “We then attempt to identify and target
potential wrongdoers. However, it is common for our efforts to be frustrated, as
these types of calls travel through a maze of smaller providers. If the calling party is
found at all, he or she is most often located overseas, making enforcement difficult.
Due to the nature of this problem, investigations and enforcement actions cannot
serve as the sole solution.”
Attorneys general also explain how scammers have found ways around the Call
Blocking Order the FCC implemented last year. Despite new authority given to
service providers, which increased their ability to block robocalls, the problem is
still getting worse.
Last year, reports reflect that American landline and wireless subscribers received an estimated 30.5 billion illegal robocalls, up from the 2016 estimate of
29.3 billion calls, attorneys general write. By the end of this year, industry experts
estimate more than 40 billion robocalls to be made to consumers.
First Orion, a tech company that provides phone carriers and their customers
caller ID and call blocking technology, predicts nearly half of all cellphone calls next
year will come from a scammer.
Attorney General Hunter was joined on the comment by the attorneys general
of Arizona, Arkansas, Connecticut, Delaware, District of Columbia, Florida, Illinois,
Indiana, Iowa, Kansas, Louisiana, Maryland, Massachusetts, Minnesota, Mississippi, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico,

jury Convicts Oil Company Owner of Fraud
A jury has convicted Kevin Wieck, 56, of
Cromwell, on ten counts of wire fraud and five
counts of money laundering.
On July 3, 2018, a federal grand jury returned
a fifteen-count superseding indictment against
Wieck, who owned and operated Wieck Oil
Company, LLC. According to the indictment,
Wieck’s fraudulent scheme involved two types
of oil wells: three “vertical” wells and a “horizontal” well. Wieck sold working interests in
the vertical wells that supposedly guaranteed
investors percentages of oil revenue. He allegedly kept the majority of the money for himself
rather than paying investors. Wieck sold and
attempted to sell percentages of his supposed ownership interest in the
horizontal well, when he in fact never actually owned—and therefore had
no right to sell—any portion of that well.
The five money laundering counts involved transfers of criminal proceeds in amounts larger than $10,000 between bank accounts. According to the indictment, Wieck fled to Mexico around late August 2014. He
has been in the custody of the U.S. Marshals Service since April 11, 2018.
Trial began on September 11, 2018. Eight investors from Tulsa, Edmond, Michigan, Illinois, and elsewhere testified about Wieck’s false promises and misrepresentations in connection with the vertical wells. These
investors had invested cash, co-signed loans with Wieck, or provided inkind services such as drilling, road work, and construction on the wells at
reduced rates. Two investors testified that Wieck solicited investments in
the horizontal well. A local energy company executive who later assumed
control of the three vertical wells confirmed that Wieck had a right to participate in the horizontal well but had never paid to exercise that right. He
further explained that Wieck filed oil and gas assignments late and failed
to secure division orders to pay investors directly. Instead, he exercised a
“quick pay” option, which funneled all revenue into his own bank accounts.
An FBI forensic accountant confirmed during trial that Wieck received
more than $1.17 million in revenue and—even after production and operating costs—pocketed at least $600,000, in addition to the value of investors’ in-kind contributions. Wieck’s ex-wife corroborated that she and
Wieck splurged on hotel stays, vacations, and large purchases when investments came in.
After three days of testimony, a jury deliberated for approximately two
hours before returning guilty verdicts on all counts on September 14.
Sentencing will take place in approximately 90 days. Wieck could receive 20 years in prison on each count of mail fraud and ten years on each
count of money laundering. Each conviction could also carry a fine of up
to $250,000 and supervised release of up to three years. He will also be
required to pay restitution to victims of his fraudulent scheme.

Month is a time to raise awareness about
the adoption of children and youth from

The Children’s Bureau in partnership
with AdoptUSKids and Child Welfare Information Gateway sponsors the initiative
each November as a way to focus public
attention on the urgent need for adoptive families for children and youth
waiting in foster care for a permanent family. This year’s focus, “Partnering for Permanency,” builds on the social media theme from last year. A

A 32-year-old Ada man is in jail after he allegedly shot and killed a man during an argument on
October 3.
Reports state the shooting happened on County
Road 3536 near Laffa High School. The suspect,
K.C. Cole, and the victim’s girlfriend had apparently been arguing for a few weeks because the
woman kept letting her pit bull run loose.
Cole confronted the victim about the dog while
the man was sitting in his truck.
At some point, the victim punched Cole, prompting Cole to grab a gun and fire it approximately six
times at the man.
Cole was still on scene after the incident, waiting for officers to arrive.
Cole is being charged with first-degree manslaughter and shooting with
intent to kill. He was denied bond and is scheduled to appear in court on
October 23, 2018.
