Claremore Man Convicted of
Sexually Exploiting a Child
A Claremore man entered a guilty plea in federal court on November 9 to sexual exploitation of a child, announced U.S. Attorney Trent
Shores.
Zachary Newberry, 25, admitted that he coerced the minor victim into performing sexual
acts with him and recorded the encounter on
his cell phone.
On July 30, the Tulsa Police Department
received Newberry’s phone in an anonymous
package, which was accompanied by a note
stating the phone contained child pornography. Detectives from the police department’s
Cyber Crimes Unit forensically examined the
phone and discovered that it had been used to
film a single video of child pornography. Other
information recovered from the phone led detectives to Newberry, who eventually confessed to filming himself sexually abusing the adolescent victim.
“Newberry’s heinous crimes involving the exploitation of a child were discovered because someone sent to law enforcement a package containing his
cell phone. Inside the package, this anonymous tipster left a note that child
pornography would be found on the phone. I don’t know the identity of the
tipster, but I thank him or her for helping us. The anonymous package was
vital in bringing Newberry’s despicable, criminal offenses to light,” said U.S.
Attorney Trent Shores. “We as a society must band together to stop the proliferation of child pornography. We must stop those creating and supplying it,
as well as those who sickeningly demand it. Tulsa’s Cyber Crimes detectives
are at the forefront of this battle. They deftly take up the charge to locate and
apprehend these perpetrators. The Tulsa Police Department acted swiftly and
with urgency to track down this perpetrator. Their efforts also resulted in our
identifying and rescuing a child victim from further sexual abuse.”
U.S. District Judge John E. Dowdell set Newberry’s sentencing for Feb. 25,
2019. Newberry faces a minimum penalty of 15 years in prison and a maximum penalty of 30 years in prison along with a $250,000 fine.

Foster suspected of murder after
body found in fire
A 32-year-old Bixby man could be facing
charges of murder and arson after a victim’s
body was found by firefighters in a travel trailer on November 15.
Reports state firefighters called law enforcement to the scene after finding the body while
battling the blaze. The man appeared to have
been killed by a wound on the abdomen. An
investigator with the medical examiner’s office
said it appeared the man was already dead
with the fire started. The fire seemed to have
been started by someone, due to the presence of accelerants at the scene.
During the investigation, Kevin Foster was
arrested as a prime suspect.
Foster and the victim had been involved in a
dispute involving some cemetery plots where
the victim’s wife was buried, and where he would be buried when he died.
According to reports, Foster filed sham legal documents to Tulsa County allegedly that he owned the plots. He also removed a headstone that displayed
the victim’s name and replaced it with one that did not show the man’s name.
During the investigation, officers went to the Claremore cemetery where the
plots were. The headstone that displayed the victim’s name had been kicked
over.
A witness said a man who matched Foster’s description was at the cemetery for approximately 30 minutes before leaving in a hurry.
While looking into the man’s murder, investigators were advised that the
victim had won a major victory in a civil suit against Foster a week before his
death.
Foster denied being in Claremore the day the man allegedly died, despite
surveillance footage from a gas station that proved otherwise.
Foster, who is currently behind bars at the Tulsa County Jail, could possibly
face charges of murder in the first degree and arson in the first degree through
Rogers County.

CONTEMPT OF COURT
Presumed Innocent Until Proven Guilty MAYES COUNTY 11 | DECEMBER 2018
Former deputy indictED on
Federal charges
A former Mayes County Deputy Sheriff
and Lieutenant has been indicted on federal
charges.
Brett Alan Mull, 47, of Pryor, is charged
with destroying, mutilating, and concealing
evidence with intent to impair its integrity or
availability for use in an official proceeding,
and with using deception and his position as
a Mayes County Deputy Sheriff and Lieutenant in charge of the narcotics unit to steal
methamphetamine that had officially been
seized as evidence.
According to the complaint, investigators
discovered Oklahoma State Bureau of Investigation evidence submittal envelopes during a search of his residence, on July 3, 2018. The envelopes appeared to have previously contained methamphetamine seized during Mayes
County law enforcement operations. The complaint alleges that Mull admitted
to officers that he had removed the evidence from the Criminal Investigations
Unit, which he supervised, for his own personal use.
“This case demonstrates the destructive lure of methamphetamine,” said
U.S. Attorney Trent Shores. “More importantly, Mr. Mull has allegedly violated
the public’s trust and abused his position as a deputy sheriff. Those serving
in law enforcement must maintain a justice system that fosters trust among
the people of this nation who count on these men and women. The U.S. Attorney’s Office will seek to hold Mr. Mull accountable in a court of law.”
The FBI is the investigative agency.

THE TOWN OF SOUTH COFFEYVILLE WOULD LIKE TO KEEP YOU OUT OF JAIL!
If you have a warrant with the Town of South Coffeyville, and would like to get rid of that
warrant once and for all, you can contact the Court Clerk at 1-918-255-6045, option 1. When
a warrant is issued, the amount is sent to a collection agency. At that time, the collection
agency will have an additional fee of 25% of the amount of the warrant added onto the
amount due. The town is offering two options at this time. If you would like a pay order, you
will need to pay 35% down of the amount due and sign a pay order. After 35% is paid and
a pay order is signed, the warrant will be recalled and the collection agency will be paid. If
you want to pay the warrant and collection fee, a discount on the warrant will be given for a
total that is over $500. No discounts will be given for pay orders. This will not apply to new
arrests. (Partial list, more to come)

“Monkey Island” Pipe Bomb Suspect
Convicted
A 36-year-old resident of Grove has pleaded guilty to possession of an unregistered destructive device discovered at a residence in
Afton, announced U.S. Attorney Trent Shores.
In his plea agreement, Richard C. Cole admitted to possessing a pipe bomb which was
capable of exploding and for not taking the
required steps to apply for and register the
destructive device with the National Firearms
Registration and Transfer Record according
to federal laws. The bomb was located at his
former rental apartment in Afton.
“Improvised explosive devices such as
these are dangerously volatile,” said Shores.
“The pipe bombs here involved “exploding targets” consisting of binary explosives,
which when the two components are mixed
become explosives. These types of IEDs are subject to federal law and federal storage requirements. Mr. Cole acted criminally and irresponsibly by possessing these pipe bombs. Thank goodness they were discovered, and the
Oklahoma Highway Patrol Bomb Squad was able to render the devices safe.”
On Aug. 25, 2018, Delaware County Sheriff’s deputies were called to Cole’s
apartment unit after the landlord discovered a suspected improvised explosive device (IED). The landlord made the discovery as he was inspecting the
apartment following Cole’s eviction. Authorities then contacted the Oklahoma
Highway Patrol Bomb Squad who, upon arrival, observed two, one-pound
canisters containing “mixed Tannerite” which is a binary explosive. They also
found two boxes of ammunition along with an IED, commonly referred to as
a “pipe bomb,” in an ammunition container. The explosive experts then rendered the device safe at that time.
A conviction for possessing an unregistered device carries a possible sentence of 10 years in prison and a $250,000 maximum fine. U.S. District Judge
Claire V. Eagan will impose sentencing Feb. 8, 2019. Cole was permitted to
remain on bond pending that hearing.

Police out helping keep the streets clean arrested a man suspected of
stealing a street sweeper.
According to Sacramento Police, officers out on patrol near Truxel
Road and Brewerton Drive saw a street sweeper truck peel out of a
parking lot and onto the street.
The truck promptly ran a red light – and didn’t have its headlights on –
prompting the officers to try and pull the street sweeper over. However,
police note, the driver pushed on and didn’t stop until he had hit three
parked cars. The driver then bolted from the truck.
A police perimeter was set up in the area, but the suspected driver –
18-year-old Lavonn Dill – eventually surrendered himself to a K-9 officer.
Dill now faces charges of fleeing, possession of a stolen vehicle and
hit-and-run charges.
A Florida man who was doing a mean-spirited Santa Claus impression
might be spending Christmas behind bars after getting caught in the
chimney of a Naples, Fla., home during an attempted burglary.
Richard Tyler Brandon, 25, got trapped in a chimney after running out
of cash during a night out. His friend, Derek Grenfell, alerted two Naples
police officers about the situation after it became apparent Brandon was
stuck.
A team of police officers and local fire department officials broke into
the home and saw Brandon’s foot hanging in the fireplace.
“I said, ‘Dude, you’re not Santa Claus, what are you doing?’” Grenfell
reportedly said to the police.
It took two hours, but Brandon was freed from the chimney and taken to the hospital for treatment of issues including leg pain and trouble
breathing. It could have been worse.
“There is a chance he could have died,” said Naples Detective Robert
Young. “That space he was jammed into was really tight. He couldn’t
move.”
Brandon was hit with two burglary charges and Grenfell was charged
as an accessory to the crime after the fact.
A Vero Beach, Fla., man who was angry with his wife left a phony bomb
on a kitchen counter, an Indian River County Sheriff’s Office spokesman.
Randolph Smith, 51, was arrested on charges of aggravated assault
with a deadly weapon, planting a hoax bomb and resisting arrest without
violence.
Deputies received a call from a woman who said her husband left a
gray pipe with a wire protruding from one end on the kitchen counter.
There were several hand-written notes on the counter, including one that
read, “This is (an) explosive. (It’s) a bomb.”
Smith’s wife told deputies she is in the process of getting a divorce.
The bomb squad was called and determined that the device didn’t
contain any explosives.
Deputies tracked Smith down at a Burger King and arrested him.
During questioning, Smith tried to leave the interview room and had to
be handcuffed, according to the arrest report.
Smith told detectives that he left the hoax bomb on the counter because his wife “pissed him off.”

Presumed Innocent Until Proven Guilty 23 | DECEMBER 2018 CRAIG COUNTY
Kaylynn Dee Meyer, 36, of Vinita, was indicted
November 9 on federal charges for Failure of a
Sex Offender to Notify of International Travel.
Meyer allegedly failed to report information required by the Sex Offender Registration and Notification Act that she intended to and, in fact, traveled outside the United States.
Meyer was previously convicted of enabling
child sexual abuse in Pawnee County in 2013 and
was required to register as a sex offender and
meet specified requirements.
She is currently not on the Oklahoma sex offender registration website and has outstanding
warrants for failing to register as a sex offender in
Craig County and failure to comply with sex offender registration in Pawnee County.
The U.S. Marshals Service, Immigration and Customs Enforcement’s
Homeland Security Investigations, and the Oklahoma Department of Corrections are the investigative agencies.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.
Thank you and God Bless

Two visitors from Missouri are being charged
in Oklahoma after an altercation with police on
November 4.
According to the affidavit, a Quapaw Tribal
officer on patrol at the Downstream Casino
was advised that an underage customer had
been drinking alcohol near the Legends Bar at
approximately 12:55 a.m. While trying to speak
to the underage female and her mom, the girl’s
dad, identified as Joplin man Kevin Dale Maples, 42, approached the officer and seemed
to be intoxicated. His eyes were bloodshot, he
had slurred speech and he was unsteady on
his feet.
When the officer requested that they walk
with him to the back, Maples grabbed the officer’s arm.
The officer told the man to let him go.
Maples asked him, “Or what?”
The officer advised that he was just trying to
speak to them about the drinking allegations,
and there was no need to make a scene. Maples started clenching his teeth and fists.
Another officer came to the scene and
placed the man in handcuffs. They walked to a
back room in the casino. Maples started yelling
at the officers, calling them “p---y a—mother
f------” repeatedly.
His wife attempted to calm him down, but Maples just told her to “shut
the f--- up.” He continued to cuss and yell while officers told him to sit
down. A deputy assisted the man in sitting down in the chair.
Another woman who had walked to the back with the group, identified
as 20-year-old Katelynn Marie Maples from Walnut Grove, punched the
deputy in the side of his face. She was also placed in handcuffs.
When officers advised Kevin Maples he was under arrest for public intoxication, he laughed and told them, “I hope you have a lot of f------ money!”
Kevin Maples is being charged with public intoxication. His bond was set
at $300, and he is scheduled to appear in court on April 2, 2019.
Katelynn Maples is being charged with assault and battery upon police
officer. Her bond was set at $5,000, and she is scheduled to appear in
court on December 17, 2018.

Driver of SUV with 11 Illegal Immigrants Pleads
Guilty to Federal Charge
A Mexican citizen pleaded guilty November 6
to unlawfully driving himself and 10 other illegal
aliens from Arizona to Kansas, U.S. Attorney Stephen McAllister said.
Alex They Maya-Dimas, 37, a citizen of Mexico,
pleaded guilty to one count of transporting illegal aliens. In his plea, he admitted he was driving
a 2002 GMC Yukon when a Ford County deputy
stopped him. Maya-Dimas and 10 other occupants of the vehicle were Mexican citizens who
were in the United States illegally. The passengers
told investigators Maya-Dimas drove them from Arizona to Kansas City
through Albuquerque, New Mexico.
Sentencing is set for Jan. 24. He faces up to five years in federal prison
and a fine up to $250,000. McAllister commended the Ford County Sheriff’s Office, Homeland Security Investigations and Assistant U.S. Attorney
David Lind for their work on the case.

LARCENY OF AN AUTOMOBILE
Presumed Innocent Until Proven Guilty OTTAWA COUNTY 27 | DECEMBER 2018
DECEMBER IS NATIONAL DRUNK AND
DRUGGED DRIVING PREVENTION MONTH
Deaths in crashes involving
drunk drivers with a blood alcohol concentration (BAC) of .08+
dropped in 2010, but despite
this decrease, there were still
10,228 lives lost – that’s one
person every 51 minutes. That
makes it everyone’s problem.
It seems that many people
were doing their part to put a stop to this completely preventable epidemic.
Alcohol-related traffic fatalities reached a low point in the late 1990s. Research
also indicates that 62% of Americans exposed to the now-iconic Friends
Don’t Let Friends Drive Drunk campaign have personally intervened to stop
someone from driving drunk, no doubt saving countless lives.
However, since the late 90’s, alcohol-related driving deaths have been
steadily increasing. It seems that though the campaign was very successful, it did not change the behavior of many potential impaired drivers. Many
thought the messages to be targeted at overtly drunk drivers, and not them.
When decision time came, they would consider themselves merely “buzzed”
and get behind the wheel.
The new PSAs created to address this gap were released in December
2005 with the objective to inspire dialogue and recognition of the dangers of
“buzzed” driving and subsequently, to motivate people to stop driving buzzed.
The next installment expands on this message, equating buzzed driving and
drunk driving and demonstrating the devastating consequences that can occur as a result of buzzed driving. The overall campaign hopes to educate
people that consuming even a few drinks can impair driving and that Buzzed
Driving is Drunk Driving.
