No matter how much you lie, you
can’t argue with DNA evidence.
A Duncan man learned this truth after he repeatedly denied breaking into
a Duncan residence and stealing antique coins, a TV, a pistol and a watch.
On Jan. 25, a victim reported to
Duncan police that someone had
broken into his home and taken the
items. When police arrived, they say
that the back door had been kicked in
and found a yellow box with what appeared to be freshly-dried blood on it.
The victim called a local coin shop
and found the missing coins and
watch.
A couple days later, the victim called police and said he “had heard”
that 28-year-old Zachary Deon Smith had broken into his home and
stolen the items. He positively identified Smith’s picture in a photo
lineup. The owner of the coin shop also positively identified Smith’s
picture as the man that had sold him the coins and watch.
On March 4, police interviewed Smith. He admitted to selling the
coins and watch, but said that his did not break into the victim’s
home and take them. He said the victim had traded him the coins
and watch for other things.
Police requested to take a DNA sample from Smith to see if it
matched the blood on the box, but he refused.
After obtaining a search warrant, police retrieved a DNA sample
from Smith and the lab results revealed that the blood on the box
was indeed that of Smith.
A warrant for arrest was issued on July 1 and Smith was arrested
shortly thereafter.
Smith is being charged with burglary in the second degree and
knowingly concealing stolen property. He is being held on a $10,000
bond and is scheduled to appear in court on Sept. 11, 2013.

A Marlow man was arrested after police found him drunkenly
walking around his broken pickup truck.
On June 30, a trooper with the Oklahoma Highway Patrol was dispatched to a road north of Hwy 7 in Marlow in reference to a possible grass fire. When he arrived, he saw a tan pickup truck with the
driver’s side front wheel missing and the brake assembly and axle
sitting on the asphalt.
The truck was not on fire, but the trooper noticed a field east of
the vehicle that had been on fire, but was extinguished by the fire
department.
The trooper came into contact with 42-year-old Dustin Ray Moser,
Marlow, who told him that the truck belonged to him, but that his
brother-in-law had been driving.
The trooper asked where Moser’s brother-in-law was and he said that he had gone home
to “get a truck to put out the fire.”
Thinking his story was a bit odd, the trooper continued to question Moser and noticed that
Moser exhibited signs of being intoxicated.
The trooper said Moser’s clothing was also “very soiled” and it looked like he had blown
his nose on his shirt.
The trooper made contact with Moser’s brother-in-law and the man told the trooper he
was at the Olive Garden in Lawton.
The trooper told Moser that his story didn’t make sense; Moser asked the trooper if it
would help him if he were honest.
Moser explained that he had been driving when the wheel fell off of the truck. He had
initially lied because “the judge” had told him not to be driving and he didn’t want to get in
trouble.
The trooper conducted sobriety tests on Moser. He didn’t do very well and was placed under arrest for driving under the influence of alcohol.
About that time, Moser’s brother-in-law arrived on the scene, sober and well dressed. He
said he wasn’t present at the time of the crash and was released.
According to information on the affidavit, Moser has numerous previous DUIs.
Moser is being charged with operating a motor vehicle under the influence of alcohol. His
bond was set at $25,000 and he is scheduled to appear in court on Sept. 11, 2013.

On July 4, Duncan police were dispatched to
investigate a report of a disturbance in a vehicle
in front of a fire station. When they arrived, firefighters gave police a description of the vehicle.
Police located the vehicle and watched as it
stopped in front of a dumpster where the driver
dropped an item into it; the driver then backed
down the wrong side of the street toward police.
An officer noticed that the child in the front
seat was not wearing a seatbelt.
The officer made contact with the driver,
30-year-old Aaron William Keenan. According to the affidavit, Keenan nearly “fell on his
face” when he exited the vehicle. The officer asked Keenan how many narcotics he had taken
and he said that he had taken two Xanax earlier that day. He then changed his story and said
that he had actually taken two Klonopins. The officer said that Keenan had glassy, bloodshot
eyes and was very unsteady on his feet.
The two children that were in the vehicle told police that Keenan and their mother, 32-yearold Teri Renee Keenan, had been arguing about something their father had. They said that
their father had thrown a small black box in the dumpster when he saw police.
The officer retrieved the box from the dumpster and found that it contained a clear glass
pipe with a white crystal-like burned substance inside.
Aaron Keenan was placed under arrest for driving under the influence and, as they were
talking, his wife walked up to the men. The officer observed that she had glassy bloodshot
eyes and was very unsteady on her feet. Police said she was unable to pronounce the officer’s
names, even though she had dealt with them before.
On the way to the jail, Aaron Keenan excitedly told the officer that he knew the meth pipe
that the officer found was in his vehicle and he knew that he would probably get stopped and
did not want to get caught with it. He added that it had been in his wife’s purse before he
threw it away.
Teri Keenan is being charged with child endangerment and her bond was set at $7,500.
Aaron Keenan is being charged with child endangerment, possession of controlled dangerous substance and unlawful possession of drug paraphernalia. He is being held on a $15,000
bond.
The couple is scheduled to appear in court on Sept. 11, 2013.

Anthony Rozelle Banks
An Oklahoma death row inmate set to die
in September has waived his right to seek
clemency from the state Pardon and Parole
Board.
Anthony Rozelle Banks is set to be executed
on Sept. 10. He was convicted in the 1979
rape and murder of Sun I. Kim Travis in
Tulsa County. The conviction came 20 years
after the crime because of newly discovered
DNA evidence. Banks had been serving a noparole life sentence for an unrelated killing
in which he originally had been sentenced to
death. An appeal reversed that conviction,
and he made a plea bargain to avoid death.
A co-defendant, Allen Wayne Nelson, received a life sentence.
Banks and Nelson were charged in August 1997 when the DNA of both
men was detected in evidence found on the victim.
Banks has been on death row since November 14, 1999.

CRAPPY WAY TO GO TO JAIL
A woman taking her 7-year-old daughter to the restroom at a
Keystone Lake park saw a man looking up at her from inside a public
toilet. The man, 52-year-old Kenneth Webster Enlow, was arrested
on a Peeping Tom complaint.
Tulsa County Sheriff’s Deputies were called to White Water Park
women’s bathroom July 7 by a park ranger. The park, on the southeast
side of Keystone Dam, has toilet facilities that include a septic tank
under a cement slab. A plastic toilet seat sets over the hole that allows
access for septic service, according to an arrest report.
Deputy Brian Osman said in his arrest report that he saw Enlow
standing in the septic tank. Keystone Fire and Rescue helped Enlow climb out of the toilet
and used a fire hose to clean him off.
Enlow first told authorities his girlfriend “Angel” hit him in the head with a tire iron and
dumped him in the toilet. Enlow did not have any fresh injuries that backed up his story.
Enlow was taken to Tulsa County Jail where he was booked on a Peeping Tom complaint
and on outstanding warrants from Okmulgee County.

An 18-year-old Chickasha teen
was taken into custody June 23 after police caught him riding his motorcycle in the buff.
According to the police affidavit,
Billy Buckley rode a motorcycle naked for 20 minutes on a $50 bet,
but when he pulled the bike over,
he used a boot to cover his family
jewels. He was then booked on outraging public decency.
"The fact that he was holding his
boot over his business tells me that
he was at least a little modest," Police Major Elip Moore said.
Buckley apparently rode commando on his bike from Chickasha
Lake to Chickasha and police got at least three phone calls.
Buckley originally told police his clothes had been taken, but he
eventually fessed up to the wager.

A Chickasha man found himself in
his own emergency after he tied up
the emergency line by repeatedly calling 911.
According to the police affidavit,
46-year-old Harry “Eddie” Foster
called 911 June 18 repeatedly asking
for an officer to come to his house.
When the dispatcher asked the disgruntled man what his emergency
was, Foster replied with threats like,
“It's going to be your emergency not
mine” and they “didn’t want to make
him go ‘crazy’ tonight.”
Apparently he was angry over a ticket his wife had gotten earlier in the day.
The dispatcher warned him not call again and directed him to a
non-emergency number, but Foster responded by saying it's the
only phone he had to call.
Foster faces charges of misusing 911. His next court date is scheduled for September 26 at 9 a.m.

I’ve touched on this subject
before, but it never hurts to revisit important topics, and with the
warm weather we are experiencing
right now, motorcycles are back out in force on the roadways. I’m
going to talk about some more ways to share the road and make
things safe from both the motorcyclist’s point of view as well as the
more common four wheeled motorists!
First, for those of you who are out riding your motorcycles,
always watch the other person, and assume they are not watching
you! Leave yourself an out and be prepared for any situation. Make
yourself seen! Try to make eye contact with other drivers, and use
your turn signals every time you change lanes or turn. “Cover”
your brakes! This does not mean to ride your brakes, just have
your hand or foot on them in case you need them. Make this a
habit and you will greatly increase your chances of getting out of a
bad situation. The acceleration capabilities of a motorcycle allow
them to gain speed much quicker than cars. Just remember that
this acceleration can carry you into a dangerous situation quicker
as well. At 60 miles per hour, you are covering over 80 feet of
roadway per second. Concentrate on the road in front of you and
avoid daydreaming. Road debris are not your friend and can get you
in trouble quickly!
Wear protective clothing! Use gloves, long sleeve shirts and
pants, and always wear boots! Skin and asphalt do not go well
together! Wear your helmet, it’s a choice in Oklahoma, but look
at the choice professional riders make...they wear them every
time! There are a lot of options out there as far as leathers,
reinforced jackets, etc. that are out there that will protect you in
case of an accident. Last, obey all laws of the state, and look into
taking a safety course designed for motorcycles. These are relatively
inexpensive and can enhance your operator skills a great deal. You
will be amazed at what you learn and you will be eager to pass this
information on to fellow riders.
Now for the four or more wheeled motorists. Be a defensive
driver. Check mirrors and blind spots before entering or leaving a
lane of traffic and at intersections. Signal your intentions before
changing lanes or merging with traffic. Allow 3 to 4 seconds when
following a motorcycle so they have time to maneuver. Road
conditions which are minor annoyances to vehicles pose major
hazards to motorcycles! Make eye contact with motorcyclists, it lets
them know you see them! Finally allow the motorcyclist a full lane
width.
Finally, these are only a few tips and suggestions to help keep
everyone safe. Most of this information comes from brochures from
