A Duncan man ran into more than just
computer problems after he took his computer
in for repairs and the tech found child porn on
it.
Roy Calvert, 68, was charged with
possession of child pornography Oct. 29 in
Stephens County District Court.
A computer tech was working on Calvert’s
computer when he discovered what he
believed to be child pornography on the
computer, according to the affidavit. He then
notified the Stephen’s County Sheriff’s Office.
Search warrants were prepared and signed to
take possession of the computer and its contents. It was taken to the
OSBI Computer Crimes Unit in Weatherford and an exact copy of the
hard drive was made for an in-depth examination. The examination
revealed child pornography on the computer.
Calvert was interviewed at the Sheriff’s office Oct. 28 and he
admitted to downloading child pornography out of curiosity and then
watching it.
Bond was set at $5000 and he was forbidden to use the internet
and to start psychiatric treatment.

A Duncan man spent his 32nd
birthday in the Stephens County
Jail after he stole a gun from a local
pawn shop and then kidnapped a
man with it.
The next day, on Nov. 6, felony
charges of kidnapping and grand
larceny were filed against the man,
Casey Stephens, in Stephens County
District Court.
According to the police affidavit,
officers were dispatched to Danny’s
Gun when the owner called and said
a man, later identified as Stephens,
had snatched a gun and ran from the
shop after another customer had laid it down on the counter.
He added the thief had a barbed wire tattoo around his neck, a
bandana around his head, and ran south from the building.
In the area of 14th and Walnut, Stephens carjacked a motorist
in an old Chevy pickup and told him he had stolen a gun and was
running from the law. They eventually ended up at EZ Pawn and
was arrested there after the clerk recognized him.
During an interview, Det. Fitzhugh read Stephens his Miranda
Rights.
“Do you want to talk to Casey Stephens or the devil?” Stephens
asked the detective.
“Do you want to talk to me in your right mind or not?” Fitzhugh
replied.
Stephens said yes and he admitted he was at the gun shop with
a friend. As the questioning continued, Stephens seemed to drift
away from the conversation and said, “All lying, cheating bitches
need to die.”
His bond was set at $100,000 and ordered to appear for his
preliminary hearing conference 9 a.m. Jan. 30.

Investigators need
help with cold case
Judith Elwell, 5, vanished from her parents’ northwest Oklahoma City home sometime before 9 p.m. July
6, 1967. One of her shoes was found the next day beside
an abandoned house half a block from the Elwell home,
leading police to theorize she lost the shoe while struggling with her kidnapper. No other trace of her turned up.
In the hours and days after her disappearance, hundreds of searchers swept across the area. Individual volunteers mingled with police, firefighters and Civil Air
Patrol workers, and a command post grew outside the
Elwell’s house. After three days the hunt was called off. At
some point over the past four decades, the police case file
was misplaced or destroyed.
Another little girl named Brenda White, 6, from Midwest City, went missing a month after Judith. Unfortunately, hunters found Brenda’s body in November 1967
about 11 miles east of her home in a shallow grave. Judith has never been found. Police believe
on person could be responsible for both disappearances, as they happened so close together.

murders of two men in Pittsburg
County December 5, 2010.
David Smith (d.o.b. 6/1/1964)
and Mark Anthony Hall, Jr.
(d.o.b. 9/23/1982) were shot
to death inside Smith’s home
approximately four miles north of Hartshorne on Webber Hill.
At the beginning of the case, many possible suspects were identifi ed.
However, through thorough investigating, those persons have been
eliminated as suspects. Agents are currently running strong leads but
still need the public’s help.
“The OSBI is hopeful such a large reward for information will
encourage someone with crucial information to come forward,” Jessica
Brown, OSBI PIO, says.

A foul-mouth 23-year-old
woman was taken into custody
after she caused a ruckus at a
Burger King in Duncan.
Veronica Chavez, of Comanche,
was charged Oct. 17 with
outraging public decency.
According to the police
affidavit, Chavez was in Burger
King around 6:30 p.m. on Oct.
11 singing very loudly at a booth
and creating a disturbance. When
Chavez’s mother got up from
the booth to go to the bathroom,
Chavez stayed in her seat and
sang even louder.
After a few minutes, Chavez got up from the booth and went
to the bathroom where her mother was and began banging on
the door and cursing. The manager walked over to Chavez and
asked her to stop or she would have to leave. What Chavez said
to the manager is not publishable in anything except a smutty
magazine.
Chavez was then told to leave.
Outside, Chavez continued to yell profanities, even as a
customer walked up to the restaurant with her toddler. When
the customer asked her to stop, she grabbed her crotch and
continued her trashy talk. The manager rescued the woman
and told Chavez the police were on their way.
Chavez and her mother left the Burger King, but then went
to Carl Jr.’s where police placed Chavez under arrest. She was
transported to the Stephens County Jail and jailed until her
court date on Nov. 8. She pled guilty to the charge and received
a one-year suspended sentence and a $500 fine plus costs.

A 23-year-old man was arrested at a Walmart
Nov. 5 after flashing his breast implants at fellow
shoppers before spitting blood at police.
Jeremy Owens, from Pennsylvania, was arrested
for his alleged bizarre behavior at the Lackawanna
County store.
Police found him on a local bus which he then
refused to get off.
After he was arrested and put into a police car,
Owens, who calls himself ‘Jamie’ banged his head
against the window and cut himself, which allowed
him to spit blood at officers.
The 23-year-old was jailed for aggravated
assault, drug possession, and making terrorist threats.
He was not charged for indecent exposure.
Owens was arrested two weeks ago for lying to police about the abduction of a friend
and previously in March following a disturbance at a doughnut shop when he allegedly
spat on two female customers.

William Lewallen, a 47-year-old Tulsa
man, was jailed Nov. 11 after police found
three unattended, naked children on his
property. One child was found locked in a
dog cage, covered with feces.
According to police, officers were
dispatched to Lewallen’s residence after
a neighbor heard the screams of a child
who had been stripped naked and locked
outside in the cold while the boy’s father
was passed out inside.
Investigators say officers arrived at the
residence and could immediately hear a
child screaming from inside the residence.
While looking for an open entrance
into the house, officers came upon an
18-month-old girl who was naked, covered
in feces and locked inside a dog cage.
When the officers kicked in the home’s
back door, they encountered a second
naked child inside who seemed to be
unattended. A further sweep of the house
revealed a third naked child who was
asleep on a bed in the master bedroom.
Officers also found Lewallen who was
passed out next to
the child.

Lewallen stated
that he fell asleep
after ingesting
a combination
of pain meds, a
muscle relaxer
and anti-seizure
medication.
“The screaming child in the dog kennel
did not wake the defendant nor did the
officers kicking the door down to rescue
the toddler in the dog cage,” stated a police
arrest affidavit.
Officers also noted in their report that the
home had no heat (it was about 40 degrees
that day) and there was little food in the
house to eat.
Lewallen was booked into jail and charged
with felony child neglect. His bond has
been set at $50,000.

but despite this decrease, there were still
10,228 lives lost – that’s
one person every 51
minutes. That makes it
everyone’s problem.
It seems that many people were doing their part to put a stop to
this completely preventable epidemic. Alcohol-related traffic fatalities reached a low point in the late 1990s. Research also indicates
that 62% of Americans exposed to the now-iconic Friends Don’t Let
Friends Drive Drunk campaign have personally intervened to stop
someone from driving drunk, no doubt saving countless lives.
However, since the late 90’s, alcohol-related driving deaths have
been steadily increasing. It seems that though the campaign was
very successful, it did not change the behavior of many potential impaired drivers. Many thought the messages to be targeted at overtly
drunk drivers, and not them. When decision time came, they would
consider themselves merely “buzzed” and get behind the wheel.
The new PSAs created to address this gap were released in December 2005 with the objective to inspire dialogue and recognition
of the dangers of “buzzed” driving and subsequently, to motivate
people to stop driving buzzed. The next installment expands on this
message, equating buzzed driving and drunk driving and demonstrating the devastating consequences that can occur as a result of
buzzed driving. The overall campaign hopes to educate people that
consuming even a few drinks can impair driving and that Buzzed
Driving is Drunk Driving.

Executed Nov. 6, 2012
Convicted murderer Garry Thomas Allen,
whose Oklahoma execution had been halted
three times while legal questions about his
mental health were debated, was put to death
by lethal injection Nov. 6, a state prison
spokesman said.
Allen, 56, killed the mother of his two children
on November 21, 1986, gunning her down in
front of daycare workers after she arrived to
pick up the couple’s 2- and 6-year-old sons.
Gail Titsworth, 24, had moved out of Thomas’
home four days earlier and rebuffed his pleas
to return.
Allen was drunk and shot the woman four
times before a police offi cer found him in a nearby alley and shot him in the
face during a struggle over the offi cer’s gun.
Allen lost his left eye and sustained brain damage from the gunshot
wound, according to court testimony, but a jury found him competent to
stand trial.
Allen, who had a long history of drug and alcohol abuse and had been
hospitalized for psychological problems, insisted on entering a “blind” guilty
plea to murder, meaning the plea was entered without his knowing what his
punishment would be.
His plea was intended to spare the emotions of his family and the family of
the woman he killed, records show.
Allen was the fi fth inmate executed in Oklahoma this year and the 36th in
the United States. He was pronounced dead at 6:10 p.m. local time at the
Oklahoma State Penitentiary in McAlester, said state prison spokesman
Jerry Massie.
Allen delivered a rambling and often unintelligible fi nal statement that
touched on the presidential election, including a prediction that “it’s going
to be a very close race,” Massie said.

Chickasha police officers busted a
burglar at the Best Western motel Nov.
7.
Officer David Harper-Head received
a report about a man who had his
property stolen from the 1200 block
of W. Florida Ave. The man said he
saw Kandace Lindsay, 34, leave the
residence with his belongings.
Just before midnight that day,
Harper-Head responded to a
disturbance at the Best Western, where
he saw two males sitting under the
awning and Lindsay sitting on the edge of a curb. Lindsay was
holding a white bag with a black leather bag inside of it, HarperHead said.
One of the men under the awning was the victim in the earlier
incident and he told Harper-Head the home belongs to his
friend, who is Lindsay’s father. The victim said he is a retired
investigator from the Cleveland, Garvin and McClain Counties
District Attorney’s Office and that Lindsay stole his badge,
social security card, driver’s license, passport, radio and old
commission card.
Lindsay, for her part, said all the property in the bag belonged
to her. She told Harper-Head he couldn’t look inside, prompting
him to get a search warrant. Lindsay’s father said his daughter
moved out of the home on W. Florida Ave. three weeks before
after a fight. He changed the locks and Lindsay was not allowed
to go in the house, he said.
Ultimately, Lindsay gave consent to search the bag, which, sure
enough, had the former investigator’s information inside. She
was arrested and eventually charged with first-degree burglary
and knowingly concealing stolen property.
Lindsay remains in custody on $10,000 bond. She has court
set for 1:30 p.m. Dec. 5.

A Chickasha man’s drunken altercation
with family resulted in his arrest for a
felony assault charge Nov. 7.
Just after 4:30 p.m. that day, officer
David Harper-Head met a man at the
1000 block of S. 2nd Street after receiving
a domestic disturbance call. The man had
a large cut and severe swelling on the left
side of his face, Harper-Head said.
The man said Troy Delonte Morgan,
24, assaulted him following an invitation
to visit his residence for a barbecue. He
was trying to repair his relationship with
Morgan, he said.
Another officer found Morgan in Centennial Park, where he
immediately smelled alcohol coming from his breath. Morgan did not
even remember what happened and denied even seeing the victim
that day, according to the affidavit. The suspect also said he is not
supposed to see the victim by court order, so he sent his girlfriend
over to pick up a food stamp card.
Morgan’s day got even worse after he tried to resist his arrest,
however. When Harper-Head tried to cuff him, Morgan pulled the
officer forward and tried to run away. Another officer on the scene
tried to tackle Morgan to the ground, but he kept trying to push
up against them. Harper-Head ultimately used his Taser, stunning
Morgan with a shot to the abdomen. Morgan screamed, turned over
onto his stomach and kept kicking at the officer, eventually striking
Harper-Head in the leg.
Morgan received another stun shot in his back and was finally
arrested, screaming and crying the whole way to jail. Even after
being cuffed, Morgan kept kicking at the door of the patrol car and
had to be placed in a hobble, according to the affidavit. It was only
after hearing his charges that Morgan said he did not mean to assault
the officers.
Morgan remains in custody on a $20,000 bond. He has court set
for 1:30 p.m. Dec. 5.

One of the things that is becoming
more prevalent, and with the
passing of the new open carry law,
will only continue to rise, is the number of people walking and driving
around armed. For law enforcement, this obviously creates some
challenges in our dealings with the public. I am going to attempt to
explain what we would like from the citizens who choose to go armed,
and what they can expect from us.
First, all people who wish to carry a gun on their person are
required to attend an approved concealed carry class. This goes for
those who wish to carry concealed or open. Upon completion of the
course and the requirements needed, you will be issued a Concealed
Carry License, or CCL. Let me point out, that having a CCL is a
privilege, not a right. It is issued by the state, and with it come some
responsibilities.
One of those responsibilities, and the one that is most important
to us law enforcement professionals, is the obligation to notify us
IMMEDIATELY upon contact. Lets say you get stopped for speeding
and you are a CCL holder and are armed, whether it is on your person
or just in your vehicle. The Trooper gets out of their car and asks
you to step back to them with your driver’s license and proof of
insurance. You should, before anything else, declare that you have
a CCL and are armed. Don’t wait until we see the CCL in your wallet
to tell us....that’s too late! They will then instruct you on what they
would like you to do to address this situation. There are several
things we may do at this point to accomplish this.
We may ask you to say (not reach for or move towards) where
the weapon is. Simply say the location, keeping your hands on the
steering wheel or where they can be seen. If its on your person, we
may wish to disarm you for the duration of the traffic stop, and will
give instructions accordingly. We may simply separate the weapon
from the ammunition and make the weapon safe, and then leave it
in your vehicle. Each officer will handle this in the way that he or
she chooses in order to maintain their own safety. None of these
methods are meant to infer that we feel threatened by a CCL holder,
or that we think you are a criminal or bad person. They are simply
ways that we can deal with the issue of a gun being present in order
to maintain our safety and the safety of others.
Hopefully, this will give you some guidelines on what we are
expecting when you come in contact with us while carrying a
firearm. With respect and understanding, we can all feel safe with an
armed citizen, while respecting that citizen’s right to carry. Thanks

An ex-con has some new felony charges to
deal with after his arrest Oct. 20.
A man stopped Chickasha police officer
David Harper-Head while he was on patrol at
the intersection of 9th and Frisco, telling him
Anthony Torralba, 40, was armed with a large
rifle, high on drugs and could possibly hurt
someone. Torralba said he was going “to do
some damage” and was driving a white Ford
Thunderbird, the man said.
Harper-Head called dispatch, who told him
they received a phone call from a woman who
said she knew Torralba was armed and trying to
find her. Another officer saw the Thunderbird
driving southbound on N. 8th St., where he and Harper-Head eventually
found Torralba. The suspect refused to follow officers’ orders to get on
the ground, according to the affidavit.
A woman at the scene told Harper-Head the Thunderbird belonged to
her and she gave him permission to use it. She gave consent to search the
car, which turned up a loaded Remington 710 model rifle and a cooler
full of alcohol.
At the scene, Torralba kept flexing his biceps and had constricted
pupils. However, his intoxication did not stop him from threatening to
file charges on the officers for false arrest. He also denied ownership of
the rifle.
A pat-down search revealed two prescription bottles with alprazolam
and oxycontin. The alprazolam was prescribed to Torralba but the
oxycontin did not have a readable label, according to the affidavit.
After the interview, Torralba continued to be uncooperative, requiring
the officers to physically carry him into a car. When he was in the car, he
kept his legs rigid so Harper-Head would be unable to close the door. The
officer used his Taser to get Torralba to comply.
Torralba faces charges of endeavoring to perform an act of violence
and possession of a controlled substance. He has previous convictions of
distribution of marijuana, eluding a police officer, multiple DUIs, grand
larceny, intimidation of a witness and leaving the scene of an injury
accident. He spent two years in prison and is on probation until 2015,
according to his rap sheet.
Torralba remains in custody on a $250,000 bond. He will appear in
court at 1:30 p.m. Dec. 5.

Tulsa Police arrested a Sand Springs
man in the early-morning hours of Nov.
9 after he allegedly shoplifted from a
QuikTrip store.
Jail records show Justin Levi Brimer,
24, was arrested on complaints of driving
under the influence, assault and battery
on a police officer and endangering others
while eluding police.
Justin Brimer stole a case of beer and
some taquitos from the QT at I-244 and
Sheridan at around 2 a.m, according to a
report. As Brimer was fleeing the scene in
his truck, a Tulsa police officer pulled into the store’s parking lot
just the clerk went outside. The clerk pointed at the truck and the
chase was on.
Police officers caught up with him on I-244 and, after a short
chase, Brimer pulled his pickup truck over. The beer and food
were found in his truck.
After much ado, Brimer was taken to the Tulsa County Jail and
booked.
