A Duncan physician was arrested Aug.
18 after he allegedly shot his ex-wife’s
boyfriend in the “lower part of his body”
during an argument.
Oscar Morales Jr., 54, was charged the
next day with a felony count of assault and
battery with a deadly weapon in Stephens
County District Court.
He is accused of shooting 57-year-old
Kelly Ray McKinnon in the driveway of
his ex-wife’s house.
According to the police affidavit, Morales
had returned his children to his ex-wife’s home when he got into
an argument with his ex’s boyfriend outside the house. That’s
when Morales allegedly shot the victim in the lower part of his
body. When police arrived, they found Morales holding pressure
to the wound. They also found the gun and a spent shell casing
near the two men.
The victim’s wound was not life-threatening.
Morales was arrested and transported to the Stephens County
Jail. Bond was set at $100,000 and he was ordered to turn over all
firearms and his passport. His next court date is set for October 16.

A Comanche woman was arrested
for driving under the influence
of several drugs after garnering
concern from employees and
customers at a local grocery store.
On Sept. 1, a Comanche police
offer was on patrol when he was
notified that a person who was
possibly intoxicated had just left the
parking lot. People in the parking
lot also expressed concern and told
the officer that the suspect appeared
to be intoxicated on some kind of
stimulant.
According to the affidavit, the officer located the vehicle and
saw that the driver had over-exaggerated movements. Her head
was moving very rapidly and her body kept moving excessively
with the direction of her head movements.
The officer initiated a traffic stop and made contact with the
driver, 38-year-old Nichole Leann Lawler. The woman still had
fast, sharp movements and was taking exaggerated breaths.
The officer asked Lawler to step out of the car for a sobriety
evaluation. She kept slapping her sides and told the officer, “I
know you will end up arresting me. You will find something.”
Lawler was unable to perform the sobriety tests and said it
was because she was “uncoordinated.”
She told the officer, “I know you are going to arrest me.”
After determining that Lawler was under the influence of
some substance, he placed her under arrest. He conducted an
inventory of the vehicle and found a chrome pipe in the console.
The pipe had a green substance in the bowl and had the odor of
marijuana. The substance in the bowl later field-tested positive
for marijuana.
Lawler told the officer she had previously smoked some
marijuana and that she was the owner of the pipe.
Lawler agreed to the state’s blood test; the officer transported
her to the hospital to obtain a sample of her blood. The nurse
told him that Lawler had a higher than normal heart rate.
The blood test showed that Lawler had methamphetamine,
Xanax and marijuana in her system.
Lawler is being charged with possession of a controlled
dangerous substance and driving under the influence of drugs.
Her bond was set at $5,000 and she is scheduled to appear in
court on Nov. 13, 2013.

Stolen mail, fireworks, vehicle theft — oh my!
On Sept. 10, Duncan police responded to a report of a van that
had been trying to burglarize vehicles in a Duncan neighborhood.
According to the affidavit, officers were unable to locate the van, but
the passenger was described as wearing glasses.
Later that night, Duncan police were alerted of other events: a van
was looking in mailboxes in another neighborhood, there were small
grass fires near an intersection and a vehicle was reported stolen.
Officers responded to a service call at an apartment complex about
the use of fireworks. Police were advised that the subjects were shooting
fireworks into the courtyard.
There was a van parked in the complex that matched the description
and tag number of the suspect’s van from earlier calls.
Police looked inside the van and saw beer bottles in the console,
miscellaneous merchandise and Roman candle fireworks inside the
van and on the ground.
Two suspects approached the officers — one was wearing glasses
and carrying a bottle of beer.
The suspects identified themselves as Zachary Houston Todd
Spencer, 23, and Brendon Seth Henson, 23; an officer could smell an
odor of alcohol on Henson’s breath and person.
After administering a sobriety test, the officer placed Henson under
arrest and placed him in the patrol car.
Spencer gave police consent to search the van; inside, they found
mail that was addressed to the victim of the stolen car. Police placed Spencer under arrest.
Spencer’s girlfriend told police the men had been gone for most of the evening. When they
returned, they brought back items that did not belong to either of them; the items included a
large green duffle bag full of clothes, electronic items and a smaller bag that contained CDs
and DVDs.
During the investigation, an officer located the vehicle that had been reported stolen earlier.
Spencer and Henson were taken to the Duncan Police Department for questioning.
They both agreed to speak to police. Spencer said that he had stolen the mail and shot the
Roman candles from the van, causing the grass fires. He added that Henson was the one who
had stolen the car.
Both of the men are being charged with larceny of an automobile, possession of stolen
property and public intoxication. Spencer’s bond was set at $5,000. Henson’s bond was set at
$7,500. Both men are scheduled to appear in court on Nov. 13, 2013.

Mark Gregory Valdez, a 33-year-old inmate at the
Oklahoma County Jail, incurred an additional charge
when officers found a loaded handgun hidden inside his
rectum.
According to the Oklahoma County Sheriff’s Office,
Valdez was being held at the Oklahoma County Jail on
a minor charge when a fellow inmate told authorities
that Valdez had been bragging about a handgun that he
managed to sneak into jail.
After turning Valdez’ cell inside out looking for the
firearm, officers conducted a body cavity search. That’s
when officers found a loaded Derringer pistol hidden
inside Valdez’ rectum.
Investigators say Valdez was taken to a local hospital
after the gun was removed. The gun was found in operational condition and loaded
with a single round of ammunition.
Investigators say Valdez submitted to a pat-down search when he was booked
into jail, but somehow managed to be processed without passing through a metal
detector.

August 23, 2009, Reverend Carol
Daniels made her weekly trip from her
home in Oklahoma City to the Christ
Holy Sanctifi ed Church in Anadarko.
Most Sundays no one attended services,
as many parishioners were elderly.
However, she didn’t miss an opportunity
to share her faith with others.
Between 10 o’clock that morning, when
Daniels arrived at the church, and noon,
when police offi cers found her body,
someone murdered Daniels by stabbing
her multiple times in the upper body. The
Anadarko Police Department requested
OSBI assistance with the case.
For months, OSBI investigative agents,
crime scene agents, criminal analysts, and Anadarko police offi cers
gathered evidence and information involving the case. Agents have
traveled across the United States following leads. Eventually, investigators
exhausted their list of leads. Even though many other murder cases have
occurred since Daniels’, her case has always remained a priority.
Little more than a year ago, OSBI assigned a well-seasoned agent
to focus solely on cold cases as an OSBI Special Investigator. With his
extensive experience in investigating violent crimes across the state and
without a formal caseload as an OSBI Agent, this Special Investigator
has helped resolve two cold cases and aided in developing viable leads
in several other cases. He has recently been assigned to help agents
investigating the Carol Daniels’ case.
The OSBI wishes every murder could be solved quickly so victims’
families can experience some level of justice. Even with today’s
advancements in forensic technology, proving a person’s guilt in a
homicide case is a formidable task when an abundance of evidence is
available. Unfortunately, some homicide cases yield little evidence and
often may lack credible information.
The OSBI’s goal in every case is to bring the guilty to justice and to
provide support to families of murder victims.

Anthony Banks
Anthony Banks was executed
September 10, 2013. In July,
he waived his right to seek
clemency from the state
Pardon and Parole Board.
“I can’t express the terrible
things I’ve done. I’m sorry,”
Banks reportedly said before
his execution. “To know that
I took lives hurts me. This is
justifi ed. I’ve done one good
thing in my life and that is to
become a Jehovah’s Witness.
For that, I’m eternally
grateful.”
Banks was convicted in the 1979 rape and murder of
Sun I. Kim Travis in Tulsa County. The conviction came
20 years after the crime because of newly discovered
DNA evidence. Banks had been serving a no-parole life
sentence for an unrelated killing in which he originally
had been sentenced to death. An appeal reversed that
conviction, and he made a plea bargain to avoid death.
A co-defendant, Allen Wayne Nelson, received a life
sentence.
Banks and Nelson were charged in August 1997 when
the DNA of both men was detected in evidence found on
the victim.
Banks has been on death row since November 14, 1999.

Huff and puff
Robert Pry, a 21-year-old Arkansas man, was jailed after he
allegedly spent the night inside a Kmart huffing 16 cans of air
duster.
According to Jonesboro Police, officers were dispatched to a
local Kmart store early Sept. 1 morning after employees found
Pry asleep inside a storage room.
Officers arrived to find two feet sticking out from a cubby hole
underneath a set of stairs. Those feet belonged to Pry, who was
covered with his own urine and vomit.
Pry told officers that he entered the store just before closing time
and hid out until the employees left. That’s when he commenced
huffing 16 cans of air duster. The empty cans were found scattered
about the room where Pry was found unconscious.
Pry also stated that he borrowed a friend’s truck, drove to a
nearby Walmart, and purchased $100 worth of air duster. Officers located the truck where
they found several more empty air duster cans.
Investigators say Pry spent “all of his money” on air dusters, but wanted more. He later
told police that he was “addicted to huffing.”
Pry was taken to a local hospital before he was booked into the Craighead County
Detention Center. He was charged with commercial burglary, theft, inhaling intoxicating
compounds and failure to appear. His bond has been set at $1,700.

The following is a list of early
warning signs that someone may
be abusive. This list was put
together by survivors of domestic
violence who reflected on the
early phases of the battering
relationship and identified some of
the early warning signs of abusers.
Someone who:
• Wants to move too quickly into the relationship.
• Does not honor your boundaries.
• Is excessively jealous and accuses you of having affairs.
• Wants to know where you are all of the time and frequently calls,
emails and texts you throughout the day.
• Criticizes you or puts you down; most commonly tells you that
you are “crazy,” “stupid” and/or “fat,” or that no one would ever want
or love you.
• Says one thing and does another.
• Takes no responsibility for their behavior and blames others.
• Has a history of battering.
• Blames the entire failure of previous relationships on their
partner; for example, “My ex was a total bitch.”
• Grew up in an abusive or violent home.
• Insists that you stop spending time with your friends or family.
• Seems “too good to be true.”
• Insists that you stop participating in leisure interests.
• Rages out of control and is impulsive.
Pay attention to the “red flags “and trust your instincts. Survivors
of domestic violence frequently report that their instincts told them
that there was something wrong early on but they disregarded the
warning signs and didn’t know that these signs were indicative of
an abusive relationship. Always take time to get to know a potential
partner and watch for patterns of behavior in a variety of settings.
Keeping in touch with your support system and participating in
good self-care can lower your risk of being involved in an abusive
relationship.

Broken Arrow police arrested a man accused of sexually assaulting
two nursing home patients.
The women are 93 and 80 years old, and are patients at Franciscan
Villa in Broken Arrow. Police say what helped in their investigation is
how quickly the staff there contacted police.
Police say Uqbasilassie Zerie admitted to sexually assaulting the two
women several times over the past six or seven months. They say the
situation came to light when one of his co-workers saw something
unusual.
“She goes into the elderly patient’s room, turns on the light and sees
the suspect pulling up his pants,” said Cpl. Leon Calhoun, of the Broken Arrow Police
Department.
The staff at Franciscan Villa called police that very day, September 11, 2013.
The next day when Zerie came into work, the staff says he admitted assaulting the woman
in that room.
Officers say, when they interviewed him, he also admitted to assaulting the second victim.
Zerie’s Facebook page says he worked for St. John, the company that owns the Villa, but
he didn’t say what his job was.
Zerie’s not listed as a licensed nurse on the state’s website.
Police say that early reporting was key.
“It’s better to get out there and verify there’s not a problem than to be called after the fact
and miss a chance to prosecute someone, because there’s no evidence or he’s gotten out of
the area,” Calhoun said.
Police say the suspect is working in this country on a green card from East Africa. They
say he’s been working in the Broken Arrow area for the past two years. Now, he faces five
counts of sexual assault.

A Chickasha man is in jail after a
traffic stop yielded evidence that he had
stolen property from his father.
A Chickasha police officer was on
patrol Sept. 9 when he noticed a truck
with a visibly damaged license plate.
He pulled the truck over and made
contact with the driver, Trever Wayne
McKenna, 28.
The officer ran a check on McKenna
and discovered that his driver’s license
was suspended. McKenna did not have
an insurance verification card for the
vehicle. The officer placed McKenna
under arrest and began an inventory of the subject’s truck.
During the inventory, the officer found a vial that contained a
crystal type residue and a spoon that had a crystal type residue on
it. The residue field-tested positive for methamphetamine.
The officer noticed that there were multiple knives in the
vehicle. The officer asked McKenna about the meth and the knives.
McKenna said the knives were his, but that the meth likely belonged
to a friend.
After booking McKenna into jail, the officer learned that
McKenna’s father had filed a police report earlier that day. The
victim said that someone had stolen a comic book collection and
knife collection from his residence. He said that his son, McKenna,
had a key to his residence and he suspected him of stealing the
items.
McKenna told the officer that his dad had given him the knives.
The officer spoke to the victim and searched McKenna’s truck
again, per a search warrant. The officer found many knives and
samurai swords in the truck that the victim had reported missing.
McKenna is being charged with knowingly concealing stolen
property, possession of controlled dangerous substances, possession
of paraphernalia and driving under suspension. He is being held on
a $15,000 bond and is scheduled to appear in court on Oct. 2, 2013.

Four people were arrested in Chickasha after an officer pulled over their
vehicle for an improperly working tag light.
On Aug. 31, a Chickasha police officer was on patrol when he noticed
the car.
He stopped the car and made contact with the driver, Ashley Marie
Winter, 24. The Ninnekah woman told the officer that they were coming
from a friend’s house.
According to the affidavit, the officer could smell the odor of an alcoholic
beverage coming from the vehicle; he asked who had been drinking. Winter
told the officer that her three passengers had been drinking, but she hadn’t
been.
The officer ran a routine driver’s license and warrant check on all of
subjects. He identified the other three passengers: Jesse Lee Still, 32,
Chickasha; Brook Ellen Mosier, 24, Amber; and Cass Ryan Marchant,
22, Chickasha.
Dispatch told the officer that Still had a felony warrant of out Texas; he
asked Still to step out of the vehicle. After the officer told him multiple
times to get out of the car, Still finally complied. While getting out, he
leaned into the vehicle and said, “Cass, do something,” multiple times.
The officer placed all subjects in investigative detention. During this
time, the officer found three open bottles of beer on the rear driver side
floorboard.
Mosier admitted to drinking beer and smoking marijuana. The officer
could smell alcohol on both Mosier and Marchant.
During an inventory of the vehicle, the officer found a loaded handgun
on the rear passenger floorboard. Mosier told the officer that the gun
belonged to Marchant, but all of the subjects denied ownership of the gun.
Marchant is being charged with public intoxication. He was released
on a personal recognizance bond and is scheduled to appear in court on
Oct. 4, 2013.
Winter is being charged with transportation of an open container
and failure to display tail lamps. Her bond was set at $1,000 and she is
scheduled to appear in court on Oct. 4, 2013.
Mosier is being charged with unlawful carrying of a weapon and public
intoxication. Her bond was set at $2,500 and she is scheduled to appear
in court on Oct. 4, 2013.
Still is being charged with possession of firearms after conviction or
during probation, obstructing an officer and public intoxication. He is
being held on a $10,000 bond and is scheduled to appear in court on
Oct. 2, 2013.

A Chickasha man went crazy and stabbed
another man after the victim told his
girlfriend to leave a residence.
On Sept. 7, a Chickasha police officer was
dispatched to a residence to investigate a
report of an assault with a knife. When
he arrived, he saw the victim sitting on
a sidewalk in front of the residence. The
victim was holding his left thigh and the
officer asked who had stabbed him. The
victim pointed to the porch of the residence
where a man, later identified as David Paul
Dill, Jr., 22, was sitting in a chair.
According to the affidavit, Dill became very upset and started
screaming that the victim had attacked him first. The officer
ordered Dill to the ground at gunpoint; another officer arrived to
assist and put Dill in handcuffs.
The officer asked the victim what had happened. The victim told
him that the owner of the residence asked him to come over and
tell Dill’s girlfriend to leave because her kids were causing problems.
The victim said Dill became very angry and threw a knife at him.
The officers performed a protective sweep of the house and
located a butcher knife in one of the house’s bedrooms.
Witnesses told them that Dill shared the home with three other
people. Police spoke to witnesses that were inside the home at the
time of the assault. The witnesses told them that the victim came
over to ask Dill’s girlfriend to leave; Dill allegedly went “crazy”
and stabbed the victim.
An officer then spoke with Dill. He told police that the victim
had told his girlfriend to leave. He said he became upset because
they (victim and other residents) “can’t force” his girlfriend to leave.
He alleged that the victim grabbed him first. Dill said he was
afraid of the victim, so he grabbed a knife to protect himself. He said
he threw the knife at the victim because the victim went after him.
Dill is being charged with assault and battery with a dangerous
weapon. His bond was set at $40,000 and he is scheduled to appear
in court on Oct. 2, 2013.

Such wisdom can be cherished or trashed. Serious legal
and personal problems will likely occur if this wisdom is not

Well, the temperatures are
dropping, and fall is almost here,
and these things signal the start
of football season in Oklahoma! Not only have our major colleges
had their first home games, but all across the state, people are
traveling to and from football games from 4th graders on up to high
school. With that in mind, here are a few tips to make this football
season safe.
Lets start with college. Whether you are a Sooner, Cowboy, or
Golden Hurricane fan, one thing is for sure...you aren’t alone! There
are thousands of fans for each home game traveling to the
stadiums. This volume of traffic demands your consideration. First,
if you can, leave early! The closer to game time, the worse the traffic
gets, so if you can, get to the stadium early. There are plenty of
things on a game day that are going on prior to kickoff that you can
spend your time enjoying. There are usually lots of free stuff for the
kids to do that make the whole game day experience wonderful for
them as well.
Second, be patient! You WILL run into traffic, so plan ahead, and
don’t get frustrated with it. Turn on the radio, listen to the pregame hype, and remember to be a safe, courteous driver. Getting
frustrated, and getting into a hurry, can result in a traffic accident
that will delay your arrival, and could end up being very expensive,
not to mention the potential for injury.
Last, be aware that there are usually some temporary traffic
control changes on game days. Both before and after the games,
law enforcement will be at intersections controlling the traffic
lights, and making adjustments to keep the traffic flowing in the
best possible manner. Be alert and aware, and recognize when and
where these temporary traffic controls are taking place!
Now, on to the local games! The biggest thing I remember from
growing up is that parents are usually running late to get to games,
because of what time they got off work. This has not changed... we
Troopers are stopping folks who are speeding trying to get to a kid’s
ball game all the time. While we understand, (we have kids too!)
we also see all too often what happens when accidents happen as
a result of unsafe speed. If you get stopped by us, you’re going to
be even later, and possibly on the hook for a hefty fine. If you get
involved in an accident, you may not make the game at all.
Finally, when you do get there, be a good fan! Cheer your team,
don’t denigrate the other team. Use appropriate language in the
stands; remember, there are kids of all ages in the stands with you.
We Oklahomans love our football, just remember to show your
support in a positive way!
