OSBI INVESTIGATING OFFICER-INVOLVED
SHOOTING IN CLAREMORE
The Oklahoma State Bureau of Investigation (OSBI), at the request of the Federal
Bureau of Investigation (FBI) and the Rogers
County Sheriff’s Office, is investigating an
officer-involved-shooting involving deputies
from the Rogers County Sheriff’s Office and
a Marshal with the Cherokee Nation Marshal
Service. Based on the initial investigation, this
is what is known at this time:
Rogers County Sheriff’s Office responded
to a disturbance call at a business located at
6492 East Tower Lane, Claremore, OK.
Deputies were initially informed of a man with a nail gun causing a disturbance inside the business.
The subject, William Fairweather, 39, locked himself in an office in the business, and refused to exit.
Rogers County deputies and a Marshal with the Cherokee Nation Marshal
Service attempted to speak with Fairweather, but Fairweather remained uncooperative.
Fairweather threatened law enforcement with the nail gun and law enforcement fired upon Fairweather, striking him. Fairweather was pronounced dead
at the scene.
The Medical Examiner’s Office will determine cause and manner of death.
The OSBI is being assisted in the investigation by the FBI, Cherokee Nation
Marshal Service, Rogers County Sheriff’s Office, and Rogers County District
Attorney’s Office.
The investigation involves Native Americans and falls under the McGirt Supreme Court decision. The OSBI investigation is ongoing. There is no additional information to release at this time.

A Claremore man who abused a 5-month-old
infant at a home in Vinita was sentenced October 28 in federal court, announced U.S. Attorney
Clint Johnson.
Chief U.S. District Judge John F. Heil III sentenced Keldon Keith Summers, 28, to 12 years
in federal prison followed by five years of supervised release.
“My office will vigorously prosecute criminals
who cause harm to the most innocent in our
communities- our children,” said U.S. Attorney
Clint Johnson. “Keldon Summers’ violent abuse
of an infant left the child with permanent injuries and the need for continued care. This child
abuser will spend 12 years in federal prison to
account for his despicable crime.”
“I am extremely proud of the collaborative effort that brought Keldon Summers to justice for his detestable crime,” said FBI Oklahoma City Special Agent
in Charge Edward J. Gray. “Today’s sentence ensures there is one less abuser
victimizing the most innocent and vulnerable members of our communities.”
Summers previously pleaded guilty to child abuse in Indian Country. In his
plea agreement, Summers admitted that in the early morning hours of Nov. 8,
2020, he was taking care of a 5-month-old while the infant’s mother was at
work and during that time, he abused the infant. The child suffered bruising
on his cheek down to his chin that resembled a bite mark, and bruising on his
arm, his buttocks, and on his back and chest. He further suffered a swollen
penis and left testicle, a fracture of his upper tibia, and extensive retinal hemorrhaging.
Additionally, the child tested positive for methamphetamine. The child had
multiple seizures after being life flighted to the hospital that day. He remained
in the hospital for three weeks and today requires medication, therapy, and
continued care as a result of his injuries.
The FBI and Vinita Police Department conducted the investigation. Assistant U.S. Attorneys Stacey P. Todd and Vani Singhal prosecuted the case.

AROUND THE STATE
Gotta catch ‘em all!
For the past several months, the Tulsa
Police Department has been investigating a
fraudulent Pokémon Card Scam.
Detectives were contacted by five victims
across the United States. Victims in Hawaii,
Arizona, Texas, Colorado and Ohio all reported buying rare and high value Pokémon
cards from the suspect in Tulsa, identified as
Michael McCoy.
Each victim purchased the cards for thousands of dollars only to find out the cards
they received were fake.
During the investigation, Detectives partnered with a special prosecutor with the Tulsa County District Attorney’s Office
who specializes in intellectual property and trademark infringement. Through
collaborations with Nintendo Corporation, a representative determined that
the Pokémon cards were in fact counterfeit. The cards that were sold by the
suspect had little to no value on their own, however were being sold as “rare
collectors cards” for $350 per card.
On November 1, Officers arrested Michael McCoy at a local Post Office as
he was in the process of mailing more counterfeit cards to another potential
victim.
McCoy is now charged with:
- Obtaining Merchandise by False Pretense over $1000 x 5
- Violation of Trademark Anti-Counterfeiting Act
McCoy also had warrants for his arrest out of Arkansas.
This is an arrest, not a conviction.

Despite the fact that it’s illegal to drive drunk, one person was killed every 45 minutes in a drunk driving crash on our nation’s roads in 2020. That’s a total of 11,654
people who died in alcohol-impaired driving crashes in one year. Even a small amount
of alcohol can affect driving ability. In 2020, there were 2,041 people killed in alcohol-related crashes where a driver had a BAC of .01 to .07.

• Before drinking, choose a designated driver, or schedule a ride-sharing, ride-hailing or taxi service.

• Always wear your seat belt — it’s the best defense against drunk drivers.

CARRYING A BIG STICK
Grove woman Tasha Nicole Smith, 32, was
put in jail after she allegedly tried to break into
her neighbor’s home using a stick on October
16.
According to the affidavit, a Grove officer
was dispatched to a residence in the 2200
block of Fairview Drive at approximately 3:34
a.m. to investigate a woman trying to break
into a home. When he arrived, a man waved
him down and said his neighbor had just
busted out his living room window and front
door window.
The man said the neighbor, identified as
Smith, had been harassing him and other
members of the community.
Officers saw the suspect and went to go talk to her. Smith admitted to busting out the windows. She said she was trying to yell for her daughters. She
also said she went inside her neighbor’s home.
The victim told police that no one else was in his residence. He added that
DHS had taken Smith’s daughters from her.
The victim said Smith started pounding on the walls and door and yelling at
him. He told her several times to go home. She then broke the door window
and living room window with a wooden stick. She also tried to pull out the air
conditioning unit in an attempt to enter the home.
Smith is being charged with burglary in the first degree after the former
conviction of a felony and malicious injury to property under $1,000. Her bond
was set at $5,500, and she was scheduled to appear in court on November
10, 2022.

PEAS IN A POD
Three female inmates at the Ottawa County Jail are
facing first-degree arson charges after they allegedly
started a fire in their pod on October 25.
According to the police report, an Ottawa County detective was advised that three women started a fire in B
Pod. He reviewed video footage of the fire that occurred
at 8:45 p.m.
The three women in the video were identified as
21-year-old Jayla Elise Harvey, 26-year-old Shelby Clements, and 38-year-old Karla Lassen.
In the video, he saw the women light some toilet paper on fire. He watched as Clements and Harvey moved
some items around.
Larsen took the burning toilet paper and lit the ceiling
baffle on fire.
There were several other women in the pod when the
incident occurred.
Fortunately, a jail employee saw the fire and put it out
with a fire extinguisher.
When the detective tried to speak to the women
about the fire, they all refused to speak to him.
All three women are being charged with arson in the
first degree. Their bonds were set at $50,000.
Harvey and Lassen were scheduled to appear in
court on November 16, 2022.
Clements is scheduled to appear in court on November 30, 2022.
