AROUND THE STATE
I WANNA ROCK!
Two suspects arrested after claiming they inherited the guitar.
On May 9, we received a report about a burglary from a car where a guitar, amp, and other
sound equipment were stolen from a vehicle near
81st and Yale in Tulsa.
On May 10 around 6:00 p.m., Officers were
called out to a guitar store near 71st and Mingo.
The store reported that two men, identified as
Scott Hill and Matthew Prior, brought the stolen
equipment to the store and tried to sell them.
The store employees recognized the equipment
from social media posts. Employees also said the
two suspects appeared to have little to no knowledge about the items they were selling or their value. The employees at the store were dialed into
the local music world and immediately recognized the stolen equipment from a
social media post. It was also apparent that the two suspects weren’t musicians
and had no idea of the value of the equipment nor what it was they were actually
trying to sell.
The two suspects told employees they inherited the guitar and equipment.
They later changed their story and told Officers they received the property from
someone else in exchange for a debt being paid.
The victim was contacted and his equipment was returned. The recovered
property has a total value of around $3200.
Scott Hill and Matthew Prior were both arrested for Knowingly Concealing
Stolen Property. The burglary from vehicle is still under investigation.

A Elk City woman was charged with arson after lighting up motel last month.
Elk City woman Fallon Tia Borzea, 40, allegedly set the Kings Inn motel on fire April 21.
According to reports, she was caught on
film at the scene of the crime earlier that morning. The surveillance footage
showed her walking from a room at the motel shortly before 1:30 a.m.
She then walked to some dumpsters close to Third Street. Shortly after, a
fire was caught on film as she walked away from the area and headed toward
the motel’s laundry room.
After a visit to the laundry room, Borzea went back to her room. There was
smoke coming from the laundry room.
When officers arrested the woman later that afternoon at her home in the
900 block of West Second Street, she admitted that she had burned some
papers in the dumpster.
Borzea is being charged with arson in the first degree. Her bond was set at
$100,000, and she is scheduled to appear in court on July 10, 2023.

WASH, RINSE,

Wagoner County Sheriff’s deputies apprehended a wanted man AGAIN after a tip led them to a
home in Redbird.
The Wagoner County Sheriff’s Office stated in a
press release that on April 25, Lonnie D. Replogle,
of Coweta, was out on bond and was scheduled to be in district court for his
existing charges. He arrived for his hearing, but before his case could be heard
by the judge, Replogle asked if he could step out of the courtroom and make a
phone call. Upon stepping out, he proceeded to leave the courthouse.
This resulted in new warrants being issued for his arrest. Replogle became
a fugitive from justice due to leaving the courthouse, resulting in the Wagoner
County Sheriff’s Office conducting a two-week exhaustive manhunt for the suspect.
The Sheriff’s Office received multiple tips throughout the two weeks, leading to
multiple areas searched.
On May 11, Wagoner County Deputies received information that Replogle was
hiding in the Redbird area at a residence. Upon receiving this information, deputies proceeded to the area to attempt to take the wanted subject into custody.
Upon locating the suspect residence, multiple deputies set up a perimeter to
contain the suspect. Deputies A. Rogers, M. Gray, G. Javine, and Investigators
managed the perimeter.
Wagoner County Captain R. Kawano, Lieutenant J. Halfacre, Investigator
C. Wright, and K-9 Deputy M. Baldwin made several announcements before
breaching the rear door of the residence to search for the suspect. After a short
search, Replogle was located hiding in a bathroom vanity and was taken into
custody without incident.
Replogle was booked into the Wagoner County Detention Center under the
following existing charges:
Kidnapping X2 , AWDW, Malicious injury to property, Resisting Executive Officer, Failure to Maintain Security X 2, DUS, Domestic Assault and Battery X 4,
Conspiracy, Obstructing Officer, Domestic Assault and Battery by Strangulation,
Eluding a Peace Officer, and an Application to Revoke previous sentence. AARON

BEYOND IMAGINABLE
A Marble City man was sentenced in federal
court for the horrific murder of his mother and
grandmother in 2019.
Joseph Allen Hernandez, 34, of Marble City, was
sentenced for his role in two homicides. Hernandez was sentenced to life in prison for two counts of Murder in Indian Country,
and 20 years imprisonment for one count of Arson in Indian Country.
A jury found Hernandez guilty in November 2021 of the murders of his mother
and grandmother. During the trial, the United States presented evidence that
Hernandez doused both victims in accelerant and set them on fire at their home
in Marble City.
The guilty verdicts were the result of an investigation by the Sequoyah County
Sheriff’s Office and the Federal Bureau of Investigation.
“The crimes committed by Hernandez were horrific, and there is no question
the sentencing is just,” said FBI Oklahoma City Special Agent in Charge Edward
J. Gray. “We hope the life sentence handed down today brings a sense of closure and healing for the family of his victims. The FBI is proud to have worked
alongside our partners at the Sequoyah County Sheriff’s Office and the U.S.
Attorney’s Office in this investigation.”
“The sentencing of Joseph Hernandez to life imprisonment ensures he will be
held accountable for the heinous act he committed upon members of his own
family and never again step outside the confines of a federal penitentiary to victimize others,” said United States Attorney Christopher J. Wilson.
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted the case because the defendant is a member of a federally-recognized
Indian tribe and the crimes occurred in Sequoyah County, within the boundaries
of the Cherokee Nation Reservation and the Eastern District of Oklahoma.
The Honorable Charles B. Goodwin, U.S. District Judge in the United States
District Court for the Western District of Oklahoma in Oklahoma City, presided
over the hearing. Upon sentencing, Hernandez was remanded to the custody
of the United States Marshal.

ADAIR COUNTY RESIDENT
PLEADS GUILTY TO
AGGRAVATED SEXUAL
ABUSE IN INDIAN COUNTRY
Bryan Udale Jones, 63, of Stillwell, Oklahoma, entered a guilty plea to Aggravated Sexual Abuse in Indian Country, which is punishable by not less than
thirty years imprisonment.
Government prosecutors alleged that beginning in
2003 and continuing until 2010, the defendant engaged in sexual acts with a child
who had not yet attained the age of 12. As a part of the plea allocution, the defendant
also admitted to sexually assaulting three other children, all less than 12 years old at
the time of the abuse.
The charges arose from an investigation by the Adair County Sheriff’s Office and the
Federal Bureau of Investigation.
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted
the case because the defendant is a member of a federally recognized Indian tribe
and the crimes occurred in Adair County, within the boundaries of the Cherokee Nation Reservation, and within the Eastern District of Oklahoma.
The Honorable Jason A. Robertson, U.S. Magistrate Judge in the United States
District Court for the Eastern District of Oklahoma, in Muskogee, accepted the pleas
and ordered the completion of a presentence investigation report. Sentencing will be
scheduled following completion of the report. Jones was remanded to the custody of
the United States Marshal pending the imposition of sentencing.

Presumed Innocent Until Proven Guilty MUSKOGEE COUNTY 23 | JUNE 2023
LUCKY NUMBER 13
A Muskogee man is facing 13 years in federal
prison after he pleaded guilty to beating his victim
nearly to death.
Joseph Eugene Meyer, 39, of Muskogee, was
sentenced to 156 months in prison for Assault
with a Dangerous Weapon with Intent to Do Bodily Harm in Indian Country and
Use, Carry, and Brandish of a Firearm During and in Relation to a Crime of Violence.
The charges arose from investigations by the Federal Bureau of Investigation,
Muskogee Police Department, and Wagoner County Sheriff’s Office.
Between December 7 and December 10, 2019, Meyer beat the victim with a
revolver and other objects. As a result of the assault, the victim suffered from a
subdural hematoma, broken ribs, a collapsed lung, and other wounds, bruises,
and contusions.
On November 2, 2021, Meyer pleaded guilty to one count of Assault with a
Dangerous Weapon with Intent to Do Bodily Harm in Indian Country and one
count of Use, Carry, and Brandish of a Firearm During and in Relation to a Crime
of Violence.
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted this case because the victim is a member of a federally recognized Indian
tribe and the crimes occurred within the boundaries of the Cherokee Nation
Reservation and the Eastern District of Oklahoma.
The Honorable Ronald A. White, U.S. District Judge in the United States District Court for the Eastern District of Oklahoma, presided over the hearings in
Muskogee, Oklahoma. Meyer was remanded to the custody of the U.S. Marshal
pending transportation to a designated United States Bureau of Prisons facility
to serve a sentence of incarceration.
Assistant United States Attorney Benjamin D. Traster represented the United
States.

JUNE IS
INTERNET
SAFETY MONTH
Computer interconnectivity has produced enormous benefits, but has also
enabled criminal activity that exploits
this interconnectivity for financial gain
and other malicious purposes, such
as internet fraud, child exploitation,
identity theft, and terrorism. The Internet can give identity thieves, hackers, and
scammers online access to your computer, financial and personal information
and more. Additionally, today’s mobile devices are well integrated with the internet and have far more functionality than mobile phones of the past. They are
increasingly used in the same way as personal computers, potentially making
them susceptible to similar threats affecting computers connected to the Internet.
For youths, the internet often serves as a positive and powerful arena for socializing and learning. However, the use of the internet also brings about risks to
their safety, including the dangers of sexual solicitation, online harassment and
bullying, and exposure to illegal content. By discussing responsible socializing
and communicating, parents -- regardless of whether they are technologically
savvy -- can help their kids make better decisions about online behavior.
Efforts to address cybercrime include activities associated with protecting
networks and information, detecting criminal activity, investigating crime, and
prosecuting criminals, . The Administration has taken significant steps to better protect America against cyber threats and has developed a pragmatic and
focused cyber-security legislative proposal for Congress to consider. The proposed legislation is focused on improving cyber-security for the American people, our Nation’s critical infrastructure, and the Federal Government’s own networks and computers.
