A HISTORY OF ABUSE
A 42-year-old Chelsea man was sentenced in
federal court last month after he plead guilty to
domestic violence charges.
According to reports, Patrick Ethan Brashers
plead guilty to one count of assault resulting
in serious bodily injury in Indian Country, and
one count of assault by striking, beating, and
wounding.
In the plea agreement, Brashers admitted to domestic violence in front of
his and the victim’s child. He admitted to stomping and breaking the kneecap
of the victim.
In a separate incident, he admitted to more violence in front of children.
He admitted to pushing down the victim in front of their children. He also
said he put his foot on the victim’s back, pushing her down again.
A U.S. district judge sentenced the man to 20 months in prison followed by
three years of supervised release.
According to court documents, Brasher has a lengthy criminal record.
He also has quite a few McGirt dismals, including allegations of domestic
abuse, unlawful possession of drug paraphernalia, indecent exposure, driving under the influence of alcohol, possession of a controlled dangerous substance, and more. THOMAS

ROTTING IN PRISON
A Rose man was sentenced last month in federal
court for sexually abusing a 2-year-old toddler and
filming the abuse.
Billy Scott McDonald, 48, to 30 years in prison followed by a lifetime of supervision upon release.
On November 30, 2022, McDonald plead guilty to
Aggravated Sexual Abuse of a Minor in Indian Country, Production of Child Pornography, and Possession of or Access with Intent to View Child Pornography.
“Billy Scott McDonald not only engaged in sexual acts with a toddler. He also photographed the sexual acts resulting in the producing and possessing child pornography charges,” said U.S. Attorney Clint Johnson. “Federal prosecutors and our law
enforcement partners will do everything in our power to protect minors from sexual
exploitation and bring to justice those who have harmed them.”
“This individual preyed on the innocence and vulnerability of a child to fulfill his demented desires,” said Homeland Security Investigations (HSI) Dallas Special Agent
in Charge Lester R. Hayes Jr. “Thanks to the outstanding teamwork of HSI Tulsa, the
Mayes County Sheriff’s Office and the U.S. Attorney’s Office for the Northern District
of Oklahoma, he will spend the next 50 years behind bars where he will no longer be
able to take advantage of our children.”
According to court documents, Billy Scott McDonald engaged in oral sex with
a 2-year-old toddler in 2022. The disturbing images and video of McDonald sexually
abusing the toddler were discovered by a family member on McDonald’s phone. The
family member reported the images and video to Mayes County Sheriff’s Office. The
toddler is a member of the Miami Tribe of Oklahoma and the crimes occurred in the
Cherokee Nation.
During a post-Miranda interview with Homeland Security Investigation Agents,
McDonald admitted that he had “sexual thoughts about children for a very long time”
and often tried to “keep himself away from children to avoid getting in trouble.” That
while he watched the toddler for a neighbor, he photographed and videoed himself
engaging in sexual abuse with the toddler.
McDonald will remain in custody pending transfer to a U.S. Bureau of Prisons
facility.
The U.S. Immigration and Customs Enforcement’s Homeland Security Investigations and the Mayes County Sheriff’s Office investigated the case. RAYMOND

DECEMBER IS NATIONAL IMPAIRED
DRIVING PREVENTION MONTH
Two of the most celebrated dates in December –
Christmas Eve and New Year’s Eve – are also among
the most dangerous. In 2018, drunk driving crashes
claimed 108 lives in those two days alone, accounting
for nearly half of total traffic deaths.
That is why Mothers Against Drunk Driving® (MADD)
is teaming up with law enforcement agencies across the
country throughout the month of December, which has
been recognized as National Impaired Driving Prevention Month for the 39th consecutive year.
During December 2018, 839 people died in alcohol-related crashes, according to the National Highway
Traffic Safety Administration. While drunk driving deaths
typically represent around a third of all traffic fatalities,
that increased to nearly 50 percent on Dec. 24 and Dec.
31.
On Dec. 25, 2018, 35 people died in drunk driving crashes.
This is staggering.
The pain caused by one person’s choice to drive impaired is often permanent. Every single
death left a permanent empty seat at the table and turned a time of celebration into tragedy.
And every single death was 100 percent preventable.
We’re asking everyone to take personal responsibility this holiday season by making a plan
for a safe ride home before your celebrations begin. Designate a non-drinking, unimpaired driver.
Take a taxi, a bus, or a train. Use a rideshare app like Uber. If you’re a host, provide an alternative
to your guests, such as festive, non-alcoholic drinks offered by our partner Mocktail Beverages.
You can also show your commitment to drive sober by displaying one of our Tie One On for
Safety red ribbons or magnetic decals on your vehicle, which are available at our local MADD
offices around the country.
Drunk driving crashes increase throughout the month of December as more people travel and
attend events where alcohol is served. That is why every U.S. President since Ronald Reagan
has proclaimed December National Impaired Driving Prevention Month. President Donald Trump
continued in that tradition this month, reaffirming his administration’s commitment to prevent
tragedies by making the decision to drive sober.
The proclamation also remembers victims of impaired driving, offers prayers for grieving families impacted by these tragedies and honors law enforcement who are on the front lines of the
violent, preventable crime of impaired driving.

Daniel Wayne Guthrie, 45, was caught by officers breaking into Tractor Supply on November 4.
He was lying next to some go karts.
According to the police report, Grove police officers responded to an alarm call at the store at
approximately 12:24 a.m. Apparently, some cables had been cut, which set off
the alarm. While an officer was checking the equipment, he saw a man lying on
his side next to the go karts. The man was wearing a black skull mask, black
coat, black gloves, and some jeans.
Officers gave commands to the man, but the man, later identified as Guthrie,
refused to comply. One of the officers put his hands on the man. Guthrie went
limp. When an officer started putting handcuffs on the man, however, Guthrie
started responding.
The officer removed the man’s mask and noticed that Guthrie was extremely
sweaty, his eyes were wide open, and his pupils were dilated. He requested
emergency medical services come to the scene due to a possible overdose.
Guthrie told the officer that he wasn’t competent due to a brain injury.
The officer responded that since he was wearing a mask, he knew that what
he was doing was wrong. Guthrie didn’t reply.
The officer then asked him when he last smoked or shot up meth. Guthrie said
he had put some meth in his coffee.
The officer noticed that some security cables were cut to the go kart.
He saw a pair of silver vice grips attached to the go kart. They were engraved
with “DW,” Guthrie’s initials.
After he was medically cleared for arrest, Guthrie was booked into the Delaware County Jail.
Guthrie is being charged with felonylarceny of merchandise from a retailer,
unlawfully wearing a mask or hood, and public intoxication. His bond was set at
$3,000, and he is scheduled to appear in court on November 17, 2023.

Needin’ some down-home cookin!
For most people, prison would be something
you’d escape from and never look back if you
ever found yourself in that predicament; but for
these Texas prisoners, they just needed their creature comforts before coming
right back. According to Dallas News, an inmate who was locked up in a federal
facility in Beaumont snuck out only to get booze, tobacco, snacks, and food to
bring back with him since, you know, the food in prison is probably really bad.
And it isn’t just this one incident, either. Inmates have apparently been using
a back door to skip out to land nearby, picking up contraband left behind for
them, and coming right back. Sheriff’s Deputy Marcus McLellan recently told the
Beaumont Enterprise that inmates have been essentially making up their own
in-and-out privileges at the facility “since day 1.”
Sherrif’s deputies in Jefferson County finally realized what was happening and
laid in wait to watch it all go down. Around 5:45 PM, a duffel bag was dropped
off on the adjacent property, and around 7:30 p.m., 27-year-old Joshua Randall
Hansen was observed leaving the prison to retrieve the bag. On Hansen’s way
back into the facility after picking it up, he was arrested.
Once confiscated, the authorities said the duffel bag was full of alcohol (whiskey and brandy, specifically),
packages of tobacco, snacks,
fruits, and plenty of home cooked
food.
Hansen was already in the process of serving a little over two
years for conspiring to distribute designer drugs, but now will
likely do additional time as he faces escape and marijuana possession charges.

AROUND THE STATE
On November 5, around 4:15 p.m., a GMC
pickup was driving erratically on I-244 EB and
nearly hit an officer who was en route to another
call. The Officer had to maneuver out of the way
to avoid being struck by the truck.
The officer stopped the driver, later identified as
Juan Diaz-Rodriguez. Diaz-Rodriguez gave the
officer multiple names and birthdates, and he did
not have a license or any identification.
While the officer and a backing officer were taking Diaz-Rodriguez into custody, he began pulling away and attempting to escape. Diaz-Rodriguez kicked the officers and bit one of them.
Diaz-Rodriguez managed to break away and ran into oncoming traffic across
the interstate, which was filled with traffic at the time.
Officers immediately set up a perimeter in the area. Minutes later, officers received a call about Diaz-Rodriguez attempting to break into a house. Officers in
the area quickly responded and took Diaz-Rodriguez into custody.
Juan Diaz-Rodriguez was arrested for Assault & Battery on a Police Officer (2
counts), Obstructing Justice, Resisting Arrest, No License, and DUI/Drugs.
The Officers involved were not severely injured in the arrest. This is an arrest,
not a conviction.

CONFESSES GUILT
A Missouri man pleaded guilty on October 30 to assault with a dangerous weapon with intent to do bodily
harm in Indian Country in federal court.
According to the plea agreement, Koby Caiden
Stark, 22, admitted to discharging a firearm at vehicle
that contained three other people. Stark admits that he
was not acting in self-defense. The incident occurred
within the boundaries of the Ottawa reservation. All
three victims are tribal members. One victim is a member of the Cherokee Nation, the
second is a member of the Choctaw Nation, and the third is a member of the Chickasaw
Nation, according to U.S. Attorney Clint Johnson.
According to the affidavit filed back in May of this year in Ottawa County District Court,
Miami police officers were advised that a drive-by shooting had taken place near the
intersection of E Street NW and West Central Avenue at approximately 1:31 a.m. An
officer found the suspect’s vehicle in the 400 block of F Street NW. The victims positively
identified the vehicle as the shooter’s car. The officer also saw an AR-style pistol in the
black floorboard of the man’s vehicle.
The officer saw two men exit a residence and walk toward the vehicle, so he detained
them. One of the men, Koby Caiden Stark, said that he owned the vehicle.
While the officer was trying to advise him of his Miranda Rights, Stark said “Bro, just
put me in the damn car” and “I did it, damn.” He also told the officer, “I did it, but they
shot at me too.”
Stark said that he was involved in a road rage incident. He saw a man walking toward
him and Stark thought the man had something in his hand, so he shot at him.
The officer noticed that Stark appeared to be intoxicated.
While processing the man’s vehicle, officers discovered that the tag matched another
car. They also retrieved the AR-style pistol, a loaded magazine, a loose round, a digital
scale, a freshly opened alcoholic beverage, some marijuana, a flashlight modification for
a firearm, and a piece of metal trim that appeared to have a bullet fragmentation.
One of the victims said they saw the vehicle drive by in an aggressive manner after the
driver tailgated and flashed his lights at them. They kept driving, and the vehicle turned
back toward them. The driver slowed down beside them and fired two shots at their
vehicle.
Stark has been in custody and will remain until he is sentenced at a later date. He faces
a penalty of up to 10 years in prison.
A federal district court judge will determine any sentence or fine after considering the
U.S. Sentencing Guidelines and other statutory factors. MICHAEL

SENTENCED AFTER A
FEDERAL JURY CONVICTION
FOR METH CONSPIRACY
On November 2, U.S. District Judge John F.
Heil sentenced Adam Douglas Sherwood, 43, to
100 months in prison followed by five years of
supervised release.
In November of 2021, a federal jury found
Sherwood guilty for drug conspiracy, possession of methamphetamine with
intent to distribute, and three counts of unlawful use of a communication
facility.
“Distributors like Sherwood have little regard for the lives lost to addiction
and violence resulting from their criminal operations,” said U.S. Attorney Clint
Johnson. The U.S. Attorney’s Office will continue to work with our federal
partners to investigate, disrupt, and prosecute criminal networks who pose a
threat to communities in the Northern District of Oklahoma.”
Sherwood’s coconspirator, Kenneth Rosenberg, was sentenced on Oct.
25, 2021, to 60 months in federal prison, followed by 5 years of supervised
release, after he pleaded guilty to possessing a firearm in furtherance of a
drug trafficking crime.
