SENTENCED FOR
MURDER
Dakota Shay Fox, 27, of Idabel, was sentenced to 210 months in prison for Murder in
Indian Country—Second Degree.
The charges arose from investigations by the
Federal Bureau of Investigation and the Oklahoma State Bureau of Investigation.
On October 11, 2022, Fox plead guilty to one count of Murder in Indian
Country—Second Degree. On January 4, 2018, Fox shot the victim, who was
reportedly a door-to-door salesman, at an Idabel intersection. The victim was
later pronounced dead at an area hospital. The crime occurred in McCurtain County, within the boundaries of the Choctaw Nation Reservation, in the
Eastern District of Oklahoma.
Fox will remain in the custody of the U.S. Marshal pending transportation
to a designated United States Bureau of Prisons facility to serve a non-paroleable sentence of incarceration

RESIDENT PLEADS
GUILTY TO MURDER
Devon Leroy Battiest, 43, of Broken Bow, entered a guilty plea to an Information charging him
with Murder in Indian County—Second Degree.
The Information alleged that Battiest unlawfully
killed the victim with malice aforethought. According to investigators, on May 6, 2023, Battiest entered a Broken Bow residence
armed with a firearm. Battiest confronted the victim, who was a guest at the
house, and shot the victim multiple times.
The crime occurred in McCurtain County, within the boundaries of the Choctaw
Nation Reservation, in the Eastern District of Oklahoma.
The charges arose from an investigation by the Federal Bureau of Investigation,
the Broken Bow Police Department, and the Choctaw Nation Lighthorse Tribal
Police.
The Honorable Gerald Jackson, U.S. Magistrate Judge in the United States
District Court for the Eastern District of Oklahoma, accepted the plea and ordered the completion of a presentence investigation report. The Battiest was remanded to the custody of the United States Marshal Service pending sentencing.

DOMESTIC ASSAULT
An Antlers police officer is facing charges in
tribal court for allegedly assaulting his wife and
threatening his stepson in December.
According to reports, Chester James Marzek,
59, allegedly stopped his wife from leaving an
Antlers home by grabbing her. He also blocked the doorways and laid on top
of her so she couldn’t leave.
During the incident, he also allegedly threatened to shoot his stepson.
An emergency protective order was put into place.
Although his personal firearms were confiscated due to the protective order, Marzek is still serving as a police officer and is allowed to carry his service issued firearm while on duty.
Marzek is being charged with kidnapping and domestic assault and battery. He is scheduled to appear in court on March 13, 2024.

Man arrested for making multiple threats
On February 3, a church member from a
church near 5th and S. Memorial called police
about threats of mass murder made on his congregation.
The church member said he came into contact with Ruben Marquez at a
gas station near 11th and 169th. The church member said Marquez told him
that he was going to use his guns to kill everyone at the church, including
women and children.
The investigation revealed that in January, the church member made a police report after Marquez made similar threats and blamed the church for
breaking up his marriage.
Ruben Marquez was taken into custody at his home, not far from the

A 52-year-old woman was apprehended and
arrested in Durant after she allegedly led police
on a chase and tried to hit an officer with her
vehicle on January 22.
According to court documents, Kimberly Cooper drove her truck toward the officer and endangered other people
while trying to get away from the officer while in the 5200 block of West Main
Street. She also ignored several commands, including officer commands to
open her door.
During the incident, Cooper allegedly hit the officer with her truck.
Cooper is being charged with endangering others while eluding/attempting
to elude, assault, battery, or assault and battery with a dangerous weapon,
and obstructing an officer. Her bond was set at $15,000, and she is scheduled to appear in court on March 6, 2024.

Pilot gets high, tries to bring others down
While fl ying is generally safer than driving, that’s not the case when a man
high on mushrooms tries to shut-off a plane’s engine in mid-fl ight. That’s what
off -duty pilot Joseph Emerson allegedly did during a West Coast fl ight in October where he was a guest travelling in a cockpit jump seat. The 44-year-old
airman told investigators he’d experienced an emotional breakdown and had
not slept.
Colosseum vandal gets an F in history
Some people shouldn’t go anywhere. A 27-year-old tourist confessed to
carving his and his girlfriend’s names into the ancient Colosseum in Rome while
visiting the nearly 2,000-year-old structure. The man identifi ed by his lawyer as
Ivan Danailov Dimitrov apologized, claiming he was unaware of “the antiquity of
the monument.”
Teen “terrorist” shuts down Ford plant
Other people — like Zachariah A. Peterson — are fi ne staying local. The
19-year-old Missouri man is accused swatting Ford’s Kansas City Assembly
Plant in Claycomo, Mo., so his friend wouldn’t have to go to work. Peterson,
who allegedly said he was barricaded in a bathroom on the second fl oor with
an AK-47 and C4 explosives strapped to his chest, is charged with making a
terroristic threat.

Two Choctaw County residents were put behind bars after they allegedly stole copper from a
radio transmitter on January 16.
According to reports, 34-year-old Candice Logan and 37-year-old Matthew Carl Wilson reportedly stole copper pipe from the KITX-FM transmitter site near Hugo. While stealing the copper, the
500-foot antenna fell. The station was knocked
off the air.
The copper-thieving duo then drove across the
Red River and took the copper to Paris Iron and
Metal in Paris, Texas, to sell it. Suspecting foul
play, the staff called authorities.
Wilson is being charged with trespass and
damage to critical infrastructure, burglary in the
second degree, entering with intent to steal copper, possession and transporting stolen copper,
and grand larceny. His bond was set at $200,000,
and he is scheduled to appear in court on February 27, 2024.
Formal charges, bond information, and court date information for Logan was
unavailable.
