14 YEARS FOR MURDER
A Broken Bow man has been sentenced for murdering another person last year.
Devon Leroy Battiest, 43, of Broken Bow, was sentenced to 168 months in prison for one count of Murder in Indian Country – Second Degree.
The charge arose from investigations by the Broken Bow Police Department, the Choctaw Nation
Lighthorse Tribal Police, and the Federal Bureau of
Investigation.
On January 17, 2024, Battiest pleaded guilty to the
charge. According to investigators, on May 6, 2023, Battiest entered a Broken Bow
residence armed with a firearm, then shot and killed a guest at the residence.
The crimes occurred in McCurtain County, within the boundaries of the Choctaw
Nation Reservation, in the Eastern District of Oklahoma.
Battiest will remain in custody of the U.S. Marshal pending transportation to a designated United States Bureau of Prisons facility to serve a non-paroleable sentence
of incarceration.

AROUND THE NATION
What a crappy thing to do!
A teenager was allegedly toppled over a porta potty at a New Hampshire park May 8 — covering the
mother and 4-year-old daughter inside with filth, according to police.
Aiden Studer, 18, is accused of pushing the john
from behind so that it landed on its door, trapping the
pair inside the disgusting box.
“The pair reported being covered in feces and
bodily fluids,” Manchester police said.
Witnesses told police that Studer had been arguing with the mother near the porta-potty at Derryfield Park until she went inside to assist her daughter. That’s when the
vengeful teen allegedly struck. They weren’t inside for long, however — bystanders
rushed to free the mother-daughter pair.
Studer allegedly ended his tirade by throwing an unknown object at officers who
arrived on the scene. It does not appear as though the teenager knew the mother
before striking.
He was arrested and charged with two counts of criminal restraint and criminal
mischief, as well as simple assault on a police officer.

AROUND THE STATE
A Chickasha man who failed to show up for a
court appearance for a misdemeanor charge is
being held in jail on an unusually high bond of
$500,000. Why? He signed a court document
with an expletive. 31-year old Joshua Nathaniel
Ashley was arrested Sunday because he failed
to show up for a hearing in March. The hearing was scheduled after Ashley was arrested in
December for driving without a license. In his court appearance Monday he
signed “f--- you” on the court minute document and Special District Judge
Gina Lowe set his bond at a half-million dollars.

COLD CASE INVESTIGATION
CONTINUES
On the afternoon of Monday November 29, 2021,
while grading a rural Cherokee County dirt road, Cherokee County District 1 employees discovered the body
of a deceased male lying down an embankment below
the roadway and notified the Cherokee County Sheriff’s
Office.
CCSO investigators responded to the area. It appeared the victim had been pushed or thrown off the
roadway down the embankment. The victim came to rest on its right side with its back
against a tree. The victim had been partially concealed in two black trash bags and his
wrists were bound together. The victim was clothed in black ankle socks with white images printed on them, greyish blue sweatpants over black shorts with a nylon drawstring
and a red and black fleece styled zippered jacket. The victim was dark skinned with black
hair and his hair appeared to be cut very close to the skin on the sides and longer than
shoulder length in the back.
An investigator with the Tulsa office of the Oklahoma Chief Medical Examiner responded to the scene. The ME investigator estimated the victim was placed in the scene during
the late evening hours of Saturday November 27, 2021.
No items of identification such as a wallet, driver’s license or Social Security card were
found with the body. The victim had a tattoo on his right forearm that consisted of five
letters, A Y I A J.
With the help of the tattoo on the victim’s right forearm, the victim was identified as MIGUEL JOSUE ORTEGA, a 27-year-old resident of Decatur, Arkansas. ORTEGA’s cause
and manner of death was determined to be homicide by gunshot.
If you have any information on this homicide, please give me a call at 918-456-2583.

HAULIN' TO JAIL
On April 16, Coalgate Police Department,
along with Agent Jason Smith, conducted a
traffic stop on a U-Haul van that was occupied
by two suspects. After speaking to the individuals, the Undersheriff of Johnston County Sheriff’s Office came to the traffic stop and deployed
his K-9. The K-9 alerted to the vehicle giving
probable cause to search the vehicle.
Upon searching the vehicle, approximately 3.9
grams of crystal-like substance was located that field
tested positive for methamphetamine. Also located was
a scale, glass pipes with residue, marijuana vape pen,
baggies, and baggies with leafy green substance.
After the suspects were transported to jail, the transporting officer located approximately 1 gram of what was
believed to be methamphetamine.
DRUG DEALING FOR DUMMIES:
CHAPTER 3
In This Chapter You Will Learn:
• Rule Number One: Don’t Be A Drug Dealer
• Rule Number Two: No Matter What, Don’t Be A Drug Dealer
• Rule Number Three: Don’t Fall Asleep With Your Hypodermic Needle In Your Lap
• Rule Number Four: Don’t Be A Criminal
To truly understand the importance of the four basic rules listed above, let’s follow
along with what happened last month to Megan Kachel, who could have easily avoided
all of this, but instead found herself in jail with everyone else who hasn’t read “Drug Dealing For Dummies”!!
Now this incident unfolds as FTO Darien Fedro was responding to the Kangaroo Gas
Station in Florida regarding a person sleeping in their car. When he located the vehicle,
he saw Megan Kachel asleep in the driver seat with the vehicle running and a loaded
syringe in her lap!! After Kachel was awakened from her slumber, she stepped out of the
vehicle and agreed to talk to a deputy whom she admitted to that the syringe in her lap
contained heroin!!
From there, a search of the vehicle revealed a bag on the front passenger seat which
was partially opened with another syringe sticking out. Inside the bag were multiple bags
that contained a substance that field tested positive for Fentanyl, ultimately weighing 2.9
grams and another bag containing approximately 1.5 grams of a crystal like substance
that field tested positive for meth!! And if that wasn’t enough, within one of the bags of
drugs were 3.5 pills which were identified as Alprazolam!!
Since Kachel didn’t follow Rules 1-3, it ultimately led her to Rule 4, so she was given
a free ride to jail on an $8,000 bond for Possession of Methamphetamine, Possession of
Fentanyl, Possession of Alprazolam and Possession of Drug Paraphernalia.
As a courtesy, in the
future, it’s highly recommended keeping up with
the various chapters of
“Drug Dealing For Dummies” and especially follow Rule One from today’s
chapter, unless you want
to make a reservation for
yourself at the jail!!

Presumed Innocent Until Proven Guilty BRYAN COUNTY 13 | JUNE 2024
COSTLY DECISION
A Federal Jury has convicted a former Durant
Middle School employee of sex crimes.
Ryan John Capps, 25, of Calera, was found
guilty by a federal jury of one count of Coercion
and Enticement, one count of Sexual Exploitation
of a Child/Use of a Child to Produce a Visual Depiction, and one count of Sexual Abuse of a Minor
in Indian Country.
The jury trial began with testimony on Monday, April 29, 2024, and concluded
on Wednesday, May 1, 2024, with the guilty verdicts on all charges.
During the trial, the United States presented evidence that in the autumn of
2022, while employed as a teacher and coach at Durant Middle School, Capps
enticed a minor to produce child sexual abuse material and engage in illegal sexual activity. The crimes occurred in Bryan County, within the boundaries of the
Choctaw Nation Reservation of Oklahoma, in the Eastern District of Oklahoma.
The guilty verdicts were the result of investigations by the Durant Police Department and the Federal Bureau of Investigation.
The Honorable Ronald A. White, Chief Judge in the United States District
Court for the Eastern District of Oklahoma, presided over the trial and ordered
the completion of a presentence report. The sentencing will be scheduled following completion of the report. Capps was remanded to the custody of the
United States Marshal until sentencing.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that
question is NO! OK Jailbirds has never accepted money
or favor to not publish a photo.
We hear many times from people that the arresting officer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.
Thank you and God Bless

A 28-year-old Boswell woman allegedly
stabbed a man and tried to burn down a house
on April 18.
According to reports, Paige Nichole Shults
allegedly stabbed a man several times during
an altercation. She also set a couch on fire - a
dog was in the home when she set the furniture
ablaze.
The man was flown to a hospital in Texas to be treated for his injuries.
Schults was evaluated at a local hospital before deputies took her to the
Choctaw County Jail.
Shults is being charged with assault and battery with a dangerous weapon,
arson in the first degree, resisting an officer, and public intoxication. She is
scheduled to appear in court on June 25, 2024. WAYLEN
