Derek Horney, 30, of Tahlequah, was
sentenced to 63 months imprisonment and
5 years supervised release for possession
with intent to distribute meth, in federal
court.
The charges arose from an investigation
by the Tahlequah Police Department and
the Drug Enforcement Administration.
The Indictment alleged that on or about
November 14, 2014, Horney did knowingly and intentionally possess with intent
to distribute fifty (50) grams or more of
Methamphetamine (actual), a Schedule II
controlled substance.

Steven Dwight McDaniel, age 27, of Muskogee,
was sentenced to 35 months imprisonment and 3
years supervised release for felon in possession
of a firearm, in federal court.
The charge arose from an investigation by the
Muskogee Police Department and the Federal
Bureau of Investigation.
The Indictment alleged that on or about March
18, 2015, McDaniel, having been convicted of a
crime punishable by imprisonment for a term
exceeding one year, did knowingly possess in
and affecting commerce, a HI-Point Firearm,
Model JHP, .45 ACP caliber pistol. The firearm
had been shipped and transported in interstate
commerce.
McDaniel will remain in the custody of the
United States Marshal Service pending transportation to the designated federal
facility at which he will serve his nonparoleable sentence.

On Jan 7, OSBI Internet Crimes Against Children
Unit agents arrested a Locust Grove man after an
undercover investigation revealed he possessed and
distributed child pornography on internet devices at
his home.
OSBI agents, Tulsa police officers, Locust Grove
officers, and an agent with the Attorney General’s
Office served a search warrant at Anthony Duncan,
Sr.’s home at 700 block of S. Bryan and found child
pornography.
Duncan, 53, was arrested at the Pryor Police
Department following an interview. He was then
booked into the Mayes County jail for possession of
child pornography, distribution of child pornography, and violation of the Oklahoma Computer Crimes Act.

A Nowata man hyped up on diet pills hit a man while driving when he reached for his phone on December 20. He told
police that he thought he hit a tree branch, and he felt badly
for hitting “that mother f-----“ because he knew him.
According to the affidavit, a state trooper was dispatched
to Wettack and Sycamore in Nowata due to a motor collision
involving a pedestrian. When he arrived, he saw the victim
lying in a ditch, a woman kneeling next to him, and 26-yearold Jerry Lue Bedell sitting on the ground a few feet away.
The victim was moaning in pain and he seemed to be disoriented.
The trooper asked Bedell what happened. Bedell said his phone fell out of his
lap, and when he reached to get it, he hit what he thought was a tree branch. He
then heard a woman yelling at him to stop. He didn’t run into a tree branch. He
hit a man.
Bedell told the trooper that he felt badly for hitting the victim, whom he referred to as “that mother f-----,” because he knew him. When the trooper asked
him why he could call his friend that, he said he didn’t mean it that way.
While they were talking, Bedell was sweating, breathing rapidly, and he couldn’t
seem to sit still.
The trooper transported him to jail.
Bedell later told the trooper that he had taken some prescription diet pills because he was feeling sluggish, and he needed a pick-me-up. He admitted that the
prescription wasn’t his.
During booking, police found a glass smoking pipe near Bedell in a plastic
bag. Surveillance footage showed the man remove the pipe from his underwear
through the left leg of his shorts and put it in the plastic bag.
Bedell is being charged with unlawful possession of drug paraphernalia. His
bond was set at $75,000.

Murder charges were filed against a Morris man
in connection with the death of a Okmulgee man in
November 2015.
Cory Gene Fish, 26, was charged January 5 with
felony first degree murder- deliberate intent, in Okmulgee County District Court.
Fish is accused of shooting Josh Pascale multiple
times with a semi-automatic pistol sometime between November 21st and November 29, 2015.
According to reports, the OSBI fingerprint lab
identified burnt remains on Fish’s father’s rural Okfuskee County property as Pascale’s.
Bond was set at $100,000 and his preliminary
hearing is scheduled for January 28, 2016, at 9 a.m.

A homeless man has been charged with property destruction after police discovered a 15-footdeep cave they say he dug in a public park.
Yosue Joel Rios, 25, was arrested Dec. 13 after police in Fairfax, Virginia found a man-made
cave in Van Dyck Park. The painstakingly created home about 200 yards behind the headquarters of the City of Fairfax Police Department
headquarters was discovered about 4:10 p.m. by
people walking through the woods. The entrance
was covered with plywood and leaves, police said.
"I haven't seen anything like it," police spokeswoman Sgt. Natalie Hinesley said.
Video shot by police shows steep steps leading
to a split-level home of sorts. On one end of the
cavern was a bedroom; on the other was a sunken living room. Inside, officers
found books and papers that looked like homework assignments.
"He was studying several topics, from what it looked like," Hinesley said, noting officers found English language manuals. "He had an alphabet written out
with the sounds."
He also appeared to be a student of the Bible, police said, and had carved into
the cement-like walls the word " Adullam", the name of a cave where David hid
from the King of Gath.
Staff members at the nearby nonprofit The Lamb Center said they knew Rios
well and that he had just been there on Saturday for Bible study.
Officers also found inside a spade, a trowel and a pick ax, photos show.
Rios wasn't at the home he created when police entered and began to dismantle it. When he returned and said he lived inside, he was arrested and charged
with destruction of property. Police said he also was wanted for failure to appear
in court after a traffic charge in Arlington County. He was ordered held without
bond.
By Monday afternoon, county crews had filled in the cave with dirt. It wasn't
clear how long Rios had lived inside.
At last count, about 1,200 homeless people lived in Fairfax County.
A visitor to Van Dyck Park on Monday, Fareed Naimi, said he admired Rios.
"More power to him. He did something that most people don't do," he said.
"He actually took a step to change his life and made his own little home where
he could study."

Broken Arrow man Newlly B. Ryan, 21, was arrested in
Jay on December 22 after he broke into a home and went
to sleep on the floor.
According to the affidavit, a Rogers County deputy was
dispatched to the residence on 685 Road at approximately
11 a.m. A woman told him she came home around 10 p.m.
and found a man sleeping on the living room floor. She
woke up the man and told him to leave.
She said Ryan couldn’t stand up straight, but he managed to walk outside.
A juvenile male with the woman told her his laptop was
missing.
She went outside and asked Ryan if he had it. He told her his cousin probably took it when she dropped him off. He then started talking about his dad and
wasn’t making much sense.
Ryan told the deputy that his dad brought him there from Maysville for a job.
He said his dad dropped him off at the residence and told him to go inside because he lived there.
Ryan smelled like alcohol, and he admitted he had been drinking whiskey. He
still denied taking the laptop.
The officer placed Ryan under arrest. He put the man in his patrol car and drove
off to see if he could find Ryan’s father. The officer found the dad sleeping in his
truck. He asked what happened.
The man said he thought he found a job for his son, so he brought him back
from Maysville. He said Ryan was supposed to stay with him, but the two started
drinking whiskey and Ryan became upset that he didn’t have any cellphone service. So, his dad said he hit him in the face and took off walking. He told the officer
he didn’t know where his son went.
Ryan is being charged with burglary in the second degree and public intoxication. His bond was set at $3,000.

favor to not publish a photo.
We hear many times from people that the arresting
offi cer of someone at the jail told them all they have to do
is pay us money and we will not publish their photo. This
is NOT true. We feel that taking money in exchange for
not publishing an arrest photo is extortion and, as such,
should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.

A Muldrow woman was placed in jail on December 22 after she attacked an
officer and demanded that he give her his “f------ gun.”
According to the affidavit, a Sequoyah County deputy was dispatched to a residence on 1150 Road around 11 p.m. to deal with a “disorderly individual.” When
he arrived, a man told him his daughter, 54-year-old Karen Chapen, had been
acting unusual. The woman’s sister agreed -- she said Chapen had been up for
days, and she didn’t know what was wrong with her.
The deputy walked into the home. Chapen looked at him and said, “Who the
f--- are you?” He told her who he was. She told him she didn’t want his help.
She then asked her father who he was.
Chapen continued to act strangely. She walked into the kitchen and said she
was “getting on ice.” She then dropped her pants and said, “Look at the scars.”
The officer asked her to get dressed. Instead, she put her hands on his chest
and pushed him toward the door. Chapen then reached for his duty belt and
yelled, “Give me your f------ gun!”
The officer then tried to place the woman in handcuffs, but Chapen wasn’t going down without a fight. She struggled and resisted and fought. Even when she
was in cuffs, she told police she wasn’t walking or going anywhere. Officers had
to physically place her in the patrol car so she could be transported to jail.
Chapen is being charged with assault on a police officer.

Wagoner man Jarrod Dion Riggs, 33, was arrested on
Christmas Eve after he was caught driving without a driver’s
license.
Once he was in jail, he started threatening officers and
damaging his cell.
According to the affidavit, a Wagoner officer stopped Riggs
in the 900 block of S.W. Ninth after he saw that the man’s
vehicle had a faulty brake light. Riggs told the office that he
didn’t have a license or insurance.
Dispatch confirmed that the man’s license was suspended.
He placed Riggs under arrest, transported the man to jail, and that was that.
Or so, the officer thought.
Shortly after 4 a.m., the officer was dispatched back to the jail to deal with “unruly” arrestee Riggs. When the officer entered the jail, he saw Riggs sitting on a
bench surrounded by officers.
Riggs looked at him and called the officer the “worst cop in Wagoner.” Apparently, the two had history and Riggs was still pissed about another time the officer
arrested him.
Riggs told the officer that he would regret arresting him, and he had his coming.
He said, “You’re gonna regret it. If I go to the pen, you are going to regret it.” He
then told the officer that he had armor piercing bullets.
Another officer told Riggs to stop making threats. Riggs informed him he didn’t
make threats. He said it was a God-given promise.
Police put the man back into his cell, but he continued to scream, yell, kick and
threaten jail staff. During his tirade, he damaged the plumbing and flooded his
jail cell.
Riggs is being charged with threaten to perform act of violence, malicious injury to property under $1,000, driving with license revoked, failure to carry insurance/security verification form, failure to pay taxes due to state and failure to
obey traffic control device. He was released on a $2,000 bond and is scheduled to
appear in court on February 3, 2016.

Hartshorne man Kenneth Wayne Newsom, 48, told
police he wanted his tribal council present before he
took a breath test after being arrested for suspicion of
DUI on December 23.
His request didn’t help him much – he was still
locked up. The tribal council probably would have
agreed drinking and driving is not something a tribal
member should have been doing, anyways.
Shortly after midnight, a Big Cabin officer was advised that there was a reckless driver just north of
Adair headed to his town. According to the police report, the officer spotted a speeding vehicle coming in
on Highway 69. His radar revealed the vehicle was traveling 84 mph in a posted
55 mph zone.
The officer stopped the vehicle. As soon as he approached the car, he was greeted with a strong odor of alcohol and a seemingly intoxicated the driver.
The driver, identified as Newsom, had red, watery bloodshot eyes.
When the officer asked the man where he was traveling from, Newsom responded, “Oklahoma.”
The officer asked him if he had been drinking.
Newsom said, “Yes, but it was awhile ago.”
After doing some evaluations on the man, police determined he was intoxicated. The officer asked him if he agreed to take the state’s breath test. He said yes.
During inventory of the man's truck, police found a half empty bottle of whiskey.
When they arrived at the Craig County Jail, Newsom was very unsteady on his
feet and had slurred speech. He became belligerent and started hurling offensive
language toward officers. He then refused to take the breath test by stating, “I
want my tribal council here before I take that test.”
No tribal council was summoned.
Newsom is being charged with driving a motor vehicle while under the influence of alcohol and transporting open bottle or container of liquor. His bond was
set at $5,000, and he is scheduled to appear in court on January 29, 2016.

42, definitely wasn’t in
the Christmas spirit this
past Yuletide. He allegedly broke down a man’s
door and started hitting
him with a hammer on
Christmas Eve.
He could have just given the man a lump of coal
instead!
A Quapaw officer was
dispatched to the 300
block of Virginia at approximately 11:43 a.m.
due to two men fighting.
When he arrived, he saw
a man who was covered
in blood waving him
down.
According to the affidavit, the man yelled, “Mister Alexander just busted
my door down and started punching me and hitting me with a hammer!” The
officer went into the victim’s residence and saw a hammer and some blood on the
ground next to the door.
Shortly after 1 p.m., officers went to the 300 block of Cayugah Drive to speak
with the suspect. They saw him look outside through the blinds, but he refused to
come outside. A woman pulled up to the residence and she told police she would
talk to the man.
Five minutes later, she came back out and said Alexander still refused to come
outside. So, the officers went to him.
A window that was in the room where Alexander had locked himself in was
unlocked. An officer opened it and tried talking to him. Alexander told him, “No,
I didn’t do anything and I’m not coming outside.”
Officers went into the house, and when Alexander tried to run to another room,
he was quickly tased and brought to the ground.
Alexander is being charged with assault and battery with a dangerous weapon
and burglary in the first degree. His bond was set at $100,000.
