SECRET GARDEN
A Dallas-area man was taken into custody for
trafficking drugs, but when officers searched him
at the jail, they found a surprise hiding under his
family jewels.
JeVaughn Deman Erwin, Jr., 21, of Balch
Springs, TX, was charged July 30 with aggravated trafficking in illegal drugs and bringing drugs
into jail, in Garvin County District Court.
According to court records, Erwin was pulled over along I-35 at mile marker
73 in Garvin County on July 29. When his vehicle was searched, officers found
one kilogram of cocaine in his possession.
But that’s not all they found…
Erwin was escorted to the Garvin County jail and searched. During the search,
an officer found marijuana hidden under Erwin’s scrotum. After the marijuana
was removed, he was led to his jail cell.
Bond for Erwin was set at $100,000. At his bond reduction hearing on August
13, it was revealed that not only did he live out of state, but he also had a Nebraska parole hold; the bond reduction was declined.
More charges are expected to be filed pending an OSBI test result for other
substances seized at the time of his arrest.

FIRE DOWN BELOW
For some weird reason, an Overbook man decided it was a good idea to start a fire in the center
median on I-35 last month.
Brian Keith Tarter, 39, of Overbook, was
charged August 21 with felony unlawful burning,
in Love County District Court.
According to Love County Sheriff Andy Cumberledge, on August 21, E-911 dispatch received
a 911 call of a white male intentionally setting fires
in the center median near the 23 mile marker of
I-35. When deputies arrived on scene, they tried to make contact with the male,
who fled on foot.
After a short time of chasing the male around the fire, he then ran through
the fire to evade capture. He was eventually taken into custody without further
incident or injury.
This suspect, identified as Tarter, is also believed to be a suspect in a stolen
vehicle from that morning. No charges have been filed in that incident as of press
time.
Bond for Tarter was set at $15,000 and he was ordered to next appear in
court on September 18.

AROUND THE NATION
A 39-year-old is charged with Aggravated Assault against a Public Servant, following an officer-involved shooting in East Lubbock.
Lubbock Police were called to the 300 block of
East 37th Street at 9:00 a.m. on August 11th for
a report of a domestic disturbance. Initial information conveyed to dispatch indicated Eliseo Padilla
III was armed with a gun and had destroyed property at the residence.
The responding officer arrived on scene at 9:07 a.m. and found Padilla in front
of the house. Padilla, who was verbally combative, ignored multiple instructions
by the officer to place his hands on a nearby vehicle in order for the officer to pat
him down. After giving multiple commands, and with the knowledge Padilla was
armed with a weapon, the officer deployed less lethal force with his department
issued Taser. Despite the deployment of the Taser, Padilla produced a firearm
and began shooting at the responding officer. In response, the officer drew his
duty weapon and returned fire at Padilla at 9:09 a.m.
The responding officer, who suffered no injuries, immediately notified dispatch
shots were fired and requested EMS. Additional officers arrived on scene and
began dispensing life-saving measures in order to treat Padilla. Upon arrival, EMS transported Padilla to University Medical Center via ambulance with
life-threatening injuries.
An investigation is currently underway by the Lubbock Metropolitan Special
Crimes Unit, LPD’s Office of Professional
Standards and LPD’s forensic unit.
The officer who fired at Padilla was
employed by the Lubbock Police Department beginning in January of 2015.
He is currently on routine administrative
leave per department policy.
Padilla, who remains in critical condition at UMC, was served a warrant for
Aggravated Assault against a Public Servant. His bond is $300,000.

Presumed Innocent Until Proven Guilty MCCLAIN COUNTY 15 | SEPTEMBER 2024
PRISON BOUND
Sentencing for a Purcell man is scheduled for
October 9 after a jury convicted him last month of
murdering his wife back in 2022.
A press release from the District Attorney’s Office stated that on Monday, August 19, a McClain
County jury returned a guilty verdict for First Degree Murder- Deliberate Intent.
On February 2, 2022, Steven Moody beat his
wife, Margarita Moody, to death. According to witnesses, there were multiple
injuries to Mrs. Moody’s body caused by the actions of Steven Moody.
“Justice isn’t always easy, but it is always just,” First Assistant Jennifer Austin
said in her closing statement.
“Our office deeply appreciates the swiftness and integrity of the investigation
into this case by the Purcell Police Department, and particularly Detective Cipriano,” says District Attorney Greg Mashburn. “Thank you also to First Assistant
Jennifer Austin and ADAs Merydith Harmon and Jonathan Fried for prosecuting
this case with great passion and dedication to justice. I am proud to have prosecutors who fearlessly defend victims in the courtroom.”
The jury recommended Life Without the Possibility of Parole for Murder in the
First Degree. Formal sentencing will be October 9, 2024.
