Presumed Innocent Until Proven Guilty 3 | MAY 2019 COMANCHE COUNTY
The Lawton Police Department requested the
OSBI investigate an officer-involved shooting that
occurred the evening of April 7 at the 2700 block
of NW 52nd Street in Lawton.
Officers went to that location to conduct a welfare check on 57-year-old Michael Lynn Burton.
Burton came to the door and was speaking with
officers. During the course of the conversation,
Burton brought a gun he was holding behind his
back forward, and was swinging it aggressively at
officers. Officers repeatedly asked him to put the
gun down and when he would not comply with
their request, officers fired their weapons.
Burton was transported to the hospital with
non-life threatening injuries. After being treated and released, he was arrested. The officers involved were placed on paid administrative leave.
The OSBI investigation is ongoing.
Burton was charged April 12 with feloniously pointing firearm in Comanche County District Court. His bond was set at $25,000 and his preliminary
hearing conference is scheduled for May 13.

Two Duncan residents are being charged
with conjoint robbery after they allegedly stole
a man’s vehicle on March 30.
According to the affidavit, a man contacted
the Stephens County Sheriff’s Office after being carjacked by 26-year-old Garrett Matthew
Browning and 34-year-old Rebecca Elizabeth
Farber.
The man told a deputy that he picked up the
suspects at a residence in Duncan at approximately 10 a.m. They had asked him to take
them to a residence in the 200 block of West
Maple.
While the man was driving, Browning started
threatening to kill him because he believed the
man either had or knew where one of Browning’s stolen rings were. Browning told the man
he was going to shoot him in the head no matter what happened.
The man said he drove through a gas station
drive thru and bought a drink, hoping someone
would notice Browning’s gun in the backseat.
When that didn’t work, he decided to drive to
Loco to get some help.
Browning became enraged when he realized
that the man was doing. He hit the man in the
side of the head with the pistol, firing the gun
in the process. The man said he came to a stop in the center median of
Highway 7 and jumped out of the car. He watched as Farber got in the
driver’s seat and took off west down the highway, turning north onto Eastland Drive.
An officer picked up the man, and they drove to the residence on West
Maple. They located Farber and placed her under arrest. When they asked
her where Browning was, she told them that she had been the only one
in the car.
While they were speaking to the woman, officers heard a noise coming
from inside a shed. They found Browning attempting to hide, along with
the pistol he used to hit the victim with.
Both Browning and Farber are being charged with conjoint robbery.
Their bonds were set at $250,000, and they are scheduled to appear in
court on May 22, 2019.

Frederick man Hugh Marshall Akin, 48, allegedly
fired a gun into a golf course on April 6 while under
the influence of marijuana.
A probable cause affidavit in the case stated a Tillman County deputy and Frederick police officer were
dispatched to the golf course around 2 p.m. They
were advised that a man, later identified as Akin, had
fired from across the street into a business on the
golf course, almost hitting a customer. The customer
and another man said they heard a bullet pass by the
customer’s head near hole number 5. Witnesses at
the golf course told the officers that Akin fired several
shots.
When one of them tried to confront the man, Akin ran into the garage and
shut the garage door.
Officers spoke with Akin, who let them into his residence. While they were
there, officers spoke to other people in the home. They learned that Akin, a
convicted felon, had firearms on the property.
The other people inside the home also told police that Akin did indeed fire
the guns. A juvenile at the residence said Akin let him shoot a gun into the
ground.
Akin admitted the guns were his. He said he had inherited them, but he
wouldn’t tell officers where they came from. Akin also admitted to smoking
some marijuana with a woman in the home prior to shooting the gun. He also
admitted that he let the juvenile shoot a weapon.
While speaking to Akin, officers noticed that the man had slurred speech
and pinpoint pupils, and some of what he was saying just didn’t make sense.
Officers confiscated the firearms from the man’s bedroom. They also found
some paraphernalia that was in plain sight – the paraphernalia tested positive
for marijuana.
Akin is being charged with possession of firearm after conviction or during
probation, other weapons offenses, possession of marijuana and possession/
sell paraphernalia. His bond was set at $100,000, and he is scheduled to appear in court on May 16, 2019.

Oklahoma senator proposes bill to allow counties to decide on medical marijuana legalization
OKLAHOMA CITY – Six months after Oklahoma voters approved a measure
legalizing medical marijuana, an Oklahoma lawmaker has filed a bill that would
allow counties to decide whether or not the measure applies to their area.
In June, over 891,000 voters cast their ballots in regards to State Question
788, which legalizes medical marijuana in Oklahoma. Ultimately, the measure
passed by a majority vote.
Under State Question 788, a person 18 years or older would need to apply
for a medical marijuana license with the Oklahoma State Department of Health
after receiving a note from their doctor. If approved, the patient would then
have to pay $100 to obtain that license.
Since applications became available in August, officials say more than 30,000
patient applications have been approved by the Oklahoma Medical Marijuana
Authority.
Now, an Oklahoma lawmaker has proposed a bill that would allow counties
to decide whether they want to follow State Question 788.
Senate Bill 325, which was authored by Sen. Casey Murdock, would add
restrictions to where medical marijuana can be consumed, sold or possessed.
“A county may, by vote of a majority of the registered voters in the county,
restrict or prohibit the possession, consumption, transport, sale, cultivation or
manufacture of marijuana or marijuana products, or any combination thereof,”
the bill states.
Murdock told KJRH that his measure would give counties flexibility.
“The locals, whether it’s the municipalities or whether it is the local law enforcement, they’re the ones that are going to have to deal with this new law,”
Sen. Casey Murdock (R-District 27) said.

A Jackson County Jury has recommended a sentence of
LIFE in prison, plus 208 years, for an Altus man arrested in
May 2018 on multiple felony charges, according to the Altus
Police Department.
A jury deliberated for about five hours on April 18 before
returning with guilty verdicts against 29-year-old Quincy
West. The jury found West guilty on charges of Robbery,
Kidnapping, Human Trafficking, Unauthorized Use of a Motor Vehicle and nine counts of Using a Vehicle to Discharge
a Weapon into an Occupied Dwelling.
One of the victim’s homes, an Altus Police Detective, received damage from approximately 30 rounds of gunfire from an assault rifle. The
detective nor his spouse were injured during the shooting. Police also investigated
shootings at residences on West Frisco and West Commerce. There were no injuries reported in those drive by shootings. West was located in OKC and taken into
custody on May 10, 2018 by the U.S. Marshalls and later transported back to Altus.
“The Altus Police Department is extremely gratified with the final outcome, successful prosecution by the Jackson County Districts attorney’s office against Quincy West and the decision made by this Jackson County Jury. This investigation
showed that Quincy West was the mastermind behind the crimes that he has been
convicted of,” said Chief Tim Murphy.

FBI Seeking Information from Armed
Bank Robbery in Chickasha
Community Bank of Oklahoma
1227 W. Grand Ave.
Chickasha, OK. 73018
The suspect was identified as a white male in his
mid-50’s, approximately 5’8” tall, salt-and-pepper
colored facial stubble, and a thin build. The suspect
was last seen wearing a gray sweatshirt, a grey jean
jacket with logos, tan work boots, blue jeans, and
a black bandana. The suspect was seen carrying a
black bag.
At approximately 9:15 a.m., the suspect entered the location and verbally demanded money
from bank employees and received an undisclosed
amount. The suspect did make known the possession of a weapon. The weapon is described as a silver or chrome handgun. No injuries were reported.
The suspect left the location on foot heading in a
southbound direction.
The Oklahoma Bankers Association is offering a
$2,000 reward for information leading to the arrest
and conviction of this suspect.
