The last few days has been tough for the
Kay County Sheriff's Office. We lost a member of our family. Reserve Sheriff's Deputy
Scott "Scotty" Kulczycki passed away at his
home. Scotty was a retired Ponca City Firefighter that retired a few years back at the
rank of Assistant Fire Chief.
Several years ago while still employed
as a firefighter, Scotty started a new adventure in his life by becoming a volunteer
sheriff's deputy. Shortly after starting as a
reserve deputy, Scotty received his CLEET
certification and proudly served the citizens of Kay County every opportunity he
had.
In 2014 prior to his retirement from the
Ponca City Fire Department, he enrolled
in and attended his second reserve academy to help refresh himself on information that he may had forgotten over the years and prepare himself for possibly a
new career in law enforcement after his retirement. Scotty volunteered countless
hours of his time to serve the citizens of Kay County while working a full time job,
taking care of the family farm and his family.
Scotty enjoyed assisting the sheriff's office by doing what ever needed done and
sometimes just hanging out.
Scotty was always available when needed unless he was spending time with his
family. His family was the most important thing in his life.
Scotty was a valued member of our department, a loving family man and most
of all one of the best friends you could ask for.
Scotty will be greatly missed by all who knew him.

A Newkirk man who reportedly had chest pains
was locked up after he assaulted the people who were
trying to help him.
25-year-old Ricky Lynn Young Jr. wasn’t in any
medical danger, however – a doctor concluded the
combative man was just drunk and high.
On January 30, at approximately 6:53 p.m., a
Blackwell officer and the fire department were dispatched to the 200 block of N. B Street due to a man
having chest pains. When the officer arrived, three
fire department personnel were trying to help Young
onto a gurney, but the man wasn’t cooperating.
According to the affidavit, he was grabbing everyone, and he kept screaming that he needed help.
The officer handcuffed the man to the gurney; he was transported to the hospital.
Young still appeared to be angry when they arrived. He continued to yell,
scream and kick, but he calmed down a little bit and cooperated with nursing
staff. Officers took off one set of handcuffs.
The calmness was short lived, however. Once again, the man started kicking
and grabbing at things.
During a brief struggle, he grabbed an officer’s arm and tried to twist and
squeeze. Police eventually secured the man with a second set of handcuffs.
A doctor ran some tests and relayed to the officers that Young was free to leave
– he was just drunk and high on K2.
When an officer tried to un-cuff the man from the bed, Young became combative again and grabbed an officer’s arm. He refused to listen to commands and was
tased. He continued to fight, and he kicked an officer in the chest.
Police gained control of the man and transported him to the jail, but he still had
a little bit of fight in him. On the way, he kept screaming and hitting his head on
the glass partition.
At the jail, he spit on the walls and floor, and refused to answer questions.
Young is being charged with assault and battery upon police officer, resisting
arrest and obstructing officer. His bond was set at $10,000, and he is scheduled
to appear in court on April 1, 2016.

Raymond Schwab, an honorably discharged veteran, moved to Colorado
last year to get treated for post-traumatic stress and chronic pain with medical
marijuana.
He didn’t expect Kansas would take
his children in return.
“They’re basically using my kids as a
pawn to take away freedoms I fought
for,” he said. “It’s a horrible position to put me in.”
He and his wife, Amelia, say Kansas took the five youngest of their six children
into custody last April, and they’ve only seen them three times since.
“I don’t think what we’re doing is illegal, immoral or wrong,” Amelia said.
The Schwabs’ case highlights how differences in marijuana laws can make a legal user in one state an unfit parent across the border.
They’re not the only Kansas parents at risk of losing their children over cannabis use. In Garden City, medical marijuana advocate Shona Banda was arrested
on child-endangerment and felony drug charges after her 11-year-old son talked
about his mother’s drug use at school.
Kansas has rejected legislative efforts to permit medical marijuana use. Colorado legalized medical marijuana, then passed a referendum that allows recreational
use as well.
Child welfare officials in Kansas did not return phone calls concerning the
Schwabs.
Raymond Schwab is a 40-year-old Gulf War veteran. He served from 1994 to
1996 in the Navy and later qualified for a 50 percent disability rating.
He lived in Colorado when the state legalized medical marijuana and obtained
his own card.
He also tried to treat his symptoms with an assortment of medicines prescribed
by the Department of Veterans Affairs — pain medicines, muscle relaxants, antianxiety drugs — but “they were making me crazy, they made me worse,” he said.
Finally he developed a heroin addiction, but said he overcame that years ago
with cannabis therapy.
The turning point in his family life began with a VA job offer in 2013. He went to
Topeka to work as a benefits agent for fellow veterans.
“I loved it. I loved my job,” he said tearfully.
But two years later, he decided to transfer to a VA job in Denver, where medical cannabis is legal. That’s when a family squabble led to the loss of five children
aged 5 to 16.
Raymond and Amelia say that as they were packing to leave, her mother took the
kids to a police station in another county and reported them abandoned, an action
her mother now regrets.
Nine months later, they say, child-protection workers and a Kansas judge are
demanding that they give up cannabis if they want their kids back.
One condition, they say, is four months of drug-free urinalysis tests, including a
drug legal in Colorado for therapeutic uses.
Raymond remains skeptical and worried. “What if I didn’t make it through four
months?” he asked. He fears his condition might worsen without cannabis.
He and his wife question why Kansas child-protection workers are holding onto
children who should not have entered their system in the first place.
Among the documents Raymond carries in a battered briefcase is the one-page
result of a Kansas child-abuse investigation.
It shows that in April 2015, the state began investigating allegations that Raymond and Amelia emotionally abused all five children. Three months later, those
allegations were dismissed as unsubstantiated.
So, “why do you still have my children?” he asked.

Copan man Alan Joseph McGuire, 22, was locked up on February 3 after police found meth and paraphernalia in his vehicle.
According to the affidavit, a Washington County deputy saw
McGuire and another man sitting in a parked car near a ranch
entrance located at 1900 Road and 4000 Road at approximately
4:43 p.m. When the men saw the deputy, they started to act nervous and get fidgety, so the deputy stopped and asked what they
were doing.
McGuire told him they were waiting on his brother.
While the deputy was talking to the men, he saw about 30 Q-tips scattered all
around the vehicle. Knowing Q-tips are sometimes an indication of drug use, the
deputy asked to see the men’s ID. He asked them if there was anything illegal in
the vehicle. They both said no.
During the stop, McGuire’s buddy was arrested for a felony warrant. McGuire
would soon be joining his pal behind bars.
Another officer arrived to assist, and he saw McGuire pick up a straw. He asked
the man to hand it over. It was a cut straw, which is sometimes indicative of illegal drug use.
The deputy asked McGuire to exit the vehicle. While searching the man’s person, he found a container filled with what appeared to be methamphetamine. He
then searched McGuire’s vehicle. McGuire informed him there was a smoking
device between the seats.
The deputy found the device, along with a tube with a vapor mouthpiece, some
more Q-tips, and a metal dish that contained a crystal-type residue.
McGuire was placed under arrest and transported to jail. He is being charged
with possession of controlled dangerous substance and unlawful possession of
drug paraphernalia. He was released on a $50,000 bond and is scheduled to appear in court on March 4, 2016.

A Jenks man was arrested in Skiatook on February 2 because he couldn’t seem to keep his vehicle
in between the lines. Lucas Robert Harris, 25, also
acted as though he was going to stab an officer with
a knife.
According to the affidavit, a Skiatook officer was
headed west on W. Rogers Blvd. at approximately
12:49 a.m. when he saw Harris’s truck. The driver
didn’t seem fit to be on the road -- the vehicle traveled left of center twice and almost hit the curb on
the right shoulder of the roadway.
The officer stopped the vehicle at W. Rogers Blvd.
and N. Quapaw Avenue and asked to see Harris’s
driver’s license. While he was speaking with the
man, the officer noticed the odor of alcohol inside the vehicle. He asked Harris if
he had been drinking -- Harris said no.
While checking the man’s information, the officer was advised Harris could
possibly be armed and dangerous.
The officer asked Harris to step out of the vehicle. As the man exited his truck, he
put his hand into his pocket. The officer told him to take it out. The man obeyed,
but he pulled a knife out with it. The blade was in the open position as though he
was going to use it against the officer.
The officer told him to drop it -- Harris did.
The officer placed the man in handcuffs and searched his person. He found a
bullet in his front pocket. The officer also noticed the man smelled strongly like
alcohol, and he was unsteady on his feet.
Once the officer searched Harris and put him in the patrol vehicle, he conducted an inventory of the man’s vehicle. He found a loaded revolver, a machete, an
opened bottle of rum, and some bullets.
Harris agreed to take the state’s test -- his breath alcohol level was 0.13, more
than one and a half times the legal limit.
Harris is being charged with assault with a dangerous weapon, driving a motor
vehicle while under the influence of alcohol, carrying firearm while under the influence, transporting opened container of beer, defective vehicle and driving left
of center. His bond was set at $20,000, and he is scheduled to appear in court on
April 29, 2016.

Cleveland man David Allen Randolph Jr., 32, was arrested January
30 after he admitted to breaking into
a woman’s home and stealing several
items.
According to the police report, a
Pawnee County deputy was dispatched
to a burglary in progress shortly after
noon. The victim was pursuing the
suspects on the north service road of
Highway 412 near the Keystone Exit. A
trooper stopped the chase at the 209th
W. Avenue exit in Tulsa County.
The occupants in the car were identified as Randolph and his wife. The victim was also on scene. She told the deputy she filed a report the day
before about some items that had been stolen from her house. She
went to confront the Randolphs about the burglary, but they jumped
in their vehicle and took off down the road. The victim followed them
until they were stopped by the trooper.
Randolph’s wife said she had nothing to do with the burglary. Her
husband asked her to drop him off near the Edgewater mobile home
park. When she picked him up, he was carrying a TV and a bag full
of stuff.
The deputy asked Randolph if he had broken into the house. Randolph said yes. The deputy placed him under arrest and looked inside
the man’s vehicle. He found many items the victim identified as hers,
including an X-Box, some jewelry and two tablets. He later told the
deputy he asked his wife to drop him off at the corner of Edgewater
and Oak Grove.
Randolph said he broke into the house on the corner and took several items. He had already sold the TV.
Randolph is being charged with burglary in the second degree
and larceny from the house. His bond was set at $20,000, and he is
scheduled to appear in court on March 1, 2016.
