You might be intoxicated if police find you running through the woods missing a shoe and wearing clothes that you have apparently, um, soiled.
Apparently, Wilder Adolfo Reyes Leiva, 36, was
so scared running away after an accident that he
peed himself. Or, the Broken Bow man may have
literally been scared sh—, well nevermind.
On Dec. 26, an Oklahoma Highway patrol
trooper responded to a vehicle accident near the
Arkansas state line. According to the police report, witnesses told the
trooper that a truck had struck an SUV, and the driver of the truck
had fled through the woods. Witnesses also said that the suspect appeared to be under the influence of something due to his erratic driving behavior.
While the trooper was on the scene of the accident, the McCurtain
County Sheriff’s Office contacted him and said that a reporting party
told them that a man had just run by her house on foot.
Deputies responded to the call, located the man and brought him
to the scene of the accident.
The suspect was identified as Leiva. Leiva admitted to being the
driver of the vehicle involved in the accident, but denied drinking
any alcohol.
The trooper noticed that Leiva was missing a shoe and appeared to
have soiled his clothes.
Leiva eventually admitted that he had consumed five beers, and
police found an open can of beer in his vehicle.
Leiva was unsteady on his feet and smelled strongly of alcohol. He
was also unable to successfully complete standard field sobriety tests.
Leiva is being charged with leaving the scene of an accident involving injury, driving a motor vehicle while under the influence of alcohol, transporting an opened container of beer and driving without a
driver’s license. He was released on a $5,000 bond and is scheduled
to appear in court on Jan. 23, 2014.

Michael Wilson
The Oklahoma Pardon and Parole Board
rejected clemency on Dec. 16 for death
row inmate Michael Wilson, 38, who is
scheduled to be executed next month for the
beating death of a Tulsa convenience store
manager in 1995.
The board voted 4-1 against commuting
the death sentence of Michael Lee Wilson.
Wilson was convicted of fi rst-degree
murder in the death of Richard Yost,
who was killed during a robbery at the
convenience store where he worked as the
night clerk on Feb. 26, 1995. Prosecutors
alleged that Wilson, who also worked at the
convenience store, planned the robbery.
He was among four people convicted in the
case.
Wilson’s execution is set for Jan. 9, 2014.
The board declined to reduce Wilson’s sentence to life in prison without parole
after Wilson apologized to members of the victim’s family and acknowledged the
harm he had caused them.

Early on Dec. 30, the McCurtain
County Sheriff’s Office requested
OSBI assistance with a reported homicide.
The sheriff’s office received information that Amy Endsley, 38, had
been killed and her body dumped in
the county. Early the next day, OSBI
agents interviewed Eddie Virgin, 52,
in Texarkana, Arkansas, and obtained
information about the location of
Endsley’s body. A McCurtain County
deputy located the body northeast of
Wright City. Endsley died of apparent
gunshot wounds.
A first degree murder warrant was issued for Virgin and was later
extradited back to Oklahoma. Both Virgin and Endsley are from the
McCurtain County area.
According to court documents, bond was denied for Virgin and his
preliminary hearing is set for January 23, 2014.

prohibit the consumption
of alcohol but leaves that
choice up to the individual.
Opponents argue against
drinking by citing the
destructive effects of alcohol
addiction, such as divorce,
job loss, traffic accidents,
breakup of families, and
destruction of the addict’s
health.
One of the most dangerous elements of drinking alcohol is setting
a bad example for other believers or leading them astray. The
Apostle Paul, especially, cautions Christians to act responsibly so as
not to be a bad influence on less mature believers:
Since an overseer is entrusted with God’s work, he must be
blameless-not overbearing, not quick-tempered, not given to
drunkenness, not violent, not pursuing dishonest gain. (Titus 1:7,
NIV)
As with other issues not specifically spelled out in Scripture, the
decision whether to drink alcohol is something each person must
wrestle with on their own, consulting the Bible and taking the matter
to God in prayer.
In 1 Corinithians 10:23-24, Paul sets down the principle we should
use in such cases:
“Everything is permissible”-but not everything is beneficial.
“Everything is permissible”-but not everything is constructive.

An Atoka man was taken into custody after he attacked his girlfriend for
getting mad at him when he blew the
rent money at the casino.
Bradley Fletcher, 39, was charged
Dec. 23 with domestic assault and battery AFCF in Atoka County District
Court.
Atoka Police Officers James Capps
and Justin Kennedy were dispatched
to the 500 block of Cedar Street on
Dec. 20 to a domestic disturbance.
When he arrived, he was met by a
neighbor who directed him to the victim inside the house. When Capps saw the woman, he noticed immediately she had several bruises on her face and arms, according to
the police affidavit.
The woman named Fletcher as her attacker. EMS then transported
her to the hospital, where it was discovered she had two broken ribs.
The officers found Fletcher walking behind a fence near the house.
When they stopped him, he said he was going to a friend’s house and
then asked if he was going to jail. After positively identifying him,
that’s exactly where he went.
At the ER, and after the woman had been cleared to speak, Capps
asked her what had happened. She said she had given Fletcher her
card to get money for rent, but instead he took the money and spent
it at the casino. When she asked him about it, he became angry and
hit her in the face. When she told him to leave the house, he started
hitting her in the face again and began kicking her in her chest. He
then got a broom handle and hit her on the back several times.
Bond for Fletcher was set at $10,000 and he was ordered back to
court Jan. 8 for his preliminary hearing.

HIDDEN CAMERAS IN WOMEN’S RESTROOM
A McAlester man was arrested and faces federal and state
charges after investigators say he put a hidden camera inside
the women’s restroom at the McAlester Army Ammunition
Plant.
Kenneth Elkins, 55, was an employee at the plant.
Elkins is charged with three counts of federal video voyeurism, two counts of recording/transmitting obscenity. The
state is also charging him with two counts of using electronic
equipment in clandestine manner.
Investigators say women were videotaped using the restroom at the plant between July and August. They say Elkins captured very revealing
pictures of least three of the women.
When investigators searched Elkins home they found child pornography on his
computer and evidence he was recording inside a 16-year-old relative’s room.
Elkins is out on bond.

An Allen man is in jail after police found illegal items on his person
while arresting him for an outstanding warrant.
On Dec. 13, a Tupelo officer received information that Adrian Manuel Horton, 32, had an outstanding Coal County felony warrant for
his arrest, the affidavit states.
On Dec. 16, the officer saw Allen walking on Fifth Street and Main
Street in Tupelo. The officer told Horton that he had a warrant for his
arrest and asked him if he had anything illegal on his person. Horton
told him he had a marijuana smoke pipe in his back pocket.
The officer retrieved a black bag from Horton’s pocket and found
a small smoke pipe that had a black residue inside of it. Horton said
he had smoked marijuana from the pipe approximately 45 minutes
before making contact with the officer.
The officer transported Horton to the Coal County Sheriff’s Department for booking. At the
jail, the officer opened up a side compartment on the bag and found two small plastic baggies
that had a white residue inside of them.
After police read him his rights, Horton agreed to speak to the officer. Horton said that he
forgot the baggies were in the bag and that the white residue was meth. The residue fieldtested positive for methamphetamine.
Horton is being charged with possession of a controlled dangerous substance and unlawful
possession of drug paraphernalia. His bond was set at $11,000, and he is scheduled to appear
in court on Jan. 9, 2014.

A drunken Antlers trio was arrested on Jan. 1 after a homeowner
contacted police about a car parked in their driveway that was playing music very loudly.
A Pushmataha deputy went to the residence and made contact with
James Donald Jordan, 41. According to the affidavit, Jordan was outside the vehicle and told the deputy that he was looking for the keys
to the car. He explained that his friend had driven the vehicle to the
location, then left to go to the store. Jordan wouldn’t tell the officer
the name of the friend, but said that he had thrown the keys out of
the window. Jordan told the deputy to leave him along and go away.
Of course, the deputy didn’t leave, and he asked Jordan if he had
been drinking. Jordan admitted that he had, but refused to give him
his license, stating, “F--- you, I don’t have to.”
The officer told Jordan that he was under arrest, but Jordan told the officer that he wasn’t
going to jail. He grabbed the officer and a struggle ensued. The officer was eventually able to
place the man into handcuffs.
Two extremely intoxicated women, identified as Lisa Pfaff, 52, Kristine Renea Keen, 42,
exited the vehicle. Another deputy arrived to assist with the raucous New Year’s revelers.
Pfaff kept trying to walk away and kept yelling that she didn’t want to be there anymore.
While searching Jordan, the deputy found several small blue pills. Jordan told the officer
they were Pfaff’s Xanax pills. This accusation angered Pfaff, who started yelling. The deputy
told her to calm down, but she poked him with her finger and said, “Listen buddy, those ain’t
my pills.”
Pfaff was placed under arrest. Keen obviously hadn’t learned from the behavior of her
friends, because she kept walking up to the deputies and yelling at them, despite being warned
several times not to. She was also placed under arrest.
Police also found rolling papers on Jordan, and he admitted to smoking weed “from time
to time.”
The charges of public intoxication and obstructing an officer for Pfaff and Keen were dismissed, with costs.
Jordan is being charged with unlawful possession of a controlled dangerous substance
without a prescription, unlawful possession of drug paraphernalia, resisting an officer, obstructing an officer and public intoxication. He was released on a personal recognizance bond
and is scheduled to appear in court on Feb. 12, 2014.

A Durant man was arrested after he said he borrowed a
woman’s truck but was carjacked. The man said he escaped,
but the men took the truck.
The Durant police officer that responded to the call believed
that some aspects of the man’s story just didn’t make sense.
On Dec. 28, the officer was dispatched to a Durant residence
in reference to a stolen vehicle. The officer spoke to the victims, who said Shaun Del Wallace, 35, had borrowed the truck
the night before. He had told them that he would be back in
15 to 20 minutes.
Wallace never returned and he ignored text messages from
the victim’s son. He eventually replied when he was told that
they were going to report the truck as stolen. Wallace said that
three men had stolen the truck.
The officer made contact with Wallace. Wallace said that he had borrowed the truck and on
the way back, he stopped at a stop sign at Rodeo Road and Highway 78.
He said three men came out of nowhere and opened both doors of the truck. One of the
men sat in the passenger seat and another hit Wallace in the head with his gun.
He said that they pushed him to the middle of the truck and drove away. Wallace said he
was able to open the passenger side door and jump out.
Wallace did not appear to have any signs of injury that he had been hit or involved in a
fight. In the report, the officer theorized that since the model of the stolen vehicle had automatic locking doors, it would have been impossible for the suspects to open the doors. The
victim verified that the door locks were functional at the time of theft.
The locking function also does not allow the door to be opened from the inside while driving unless it is physically unlocked. It would have been almost impossible with for Wallace
to reach around other men to unlock the door and open it to escape.
On Dec. 29, Wallace agreed to speak to the officer, but never met him at the station or filled
out a written statement of the carjacking.
Wallace is being charged with obtaining property by false pretenses over $1,000 and false
reporting of a crime. His bond was set at $6,000 and he is scheduled to appear in court on
Feb. 19, 2014.

Well, winter is here! With this
most recent ice and snow storm
that gripped Oklahoma, there obviously were some significant
obstacles to safe driving. One that I have noticed, that doesn’t
really get a lot of attention, is the visibility that is obstructed by
iced over windshields and windows on vehicles. I’m going to touch
on some of that, to try to raise some awareness about it, and give
some tips to help us stay safe.
We’ve all seen it...a vehicle coming down the road with just a
small hole scraped in the windshield so the driver could see the
road. Every time I see it, I cringe! The law that governs this is
Oklahoma State Statute 47:12-404.C, which states: “No person
shall drive any motor vehicle with any sign, poster, other nontransparent material, or debris, including but not limited to snow,
ice, or frost upon the front windshield or the side wings, or side
or rear windows......which obstructs, obscures, or impairs the
driver’s clear view of the highway ahead or to either side or of any
intersecting highway.” What this means to the everyday driver is
that the little hole you scraped to drive by, just won’t cut it! While
compliance is the goal, the reason is safety! Obviously the chances
of an accident drastically increase as visibility decreases...so why
limit our vision to just a small hole out the front windshield?
There are several ways to clear those windshields, both
mechanically and chemically. A simple ice scraper has been the
preferred method for as long as most people can remember. They
are inexpensive, and easy to find. Another method is simply to go
out 10 minutes before you leave and simply start your car up, and
get the defroster going! When the windows are clear, you are good
to go! Still another way is to obtain any number of chemical deicing sprays that are available at most stores. Don’t pour hot water
on your windows, as the change in temperatures can cause your
window to crack or break!
While we are talking about it, lets not forget about those side and
rear widows. A significant percentage of accidents happen while
backing, so it stands to reason that we need to be able to see out
our back glass as well as the front. Side windows are no different,
no one wants to be struck by a vehicle they couldn’t see when they
pull into an intersection. After you finish with those side windows,
go ahead and hit those side mirrors as well!
All of these suggestions simply take a little extra time, and
sometimes money, but the time and money pale in comparison to
the impact on time and money that an accident will have on you, or
others. As a safe, courteous driver, you owe it to yourself and your
fellow drivers! Thanks for reading, buckle up and be safe!

An angry, intoxicated Boswell man was taken to jail after
allegedly firing a gun at a man and spitting on a police officer.
Dec. 19 definitely wasn’t 42-year-old David Eugene Russell’s best day. The man that had apparently just gotten out
of jail soon found himself back behind iron bars.
According to the affidavit, a Choctaw County deputy was
dispatched to a Bennington residence to investigate a complaint of malicious injury to property. On the way to the residence, the deputy was told that the suspect, later identified
as Russell, had kicked in the door of a couple’s home and
made threats of violence toward them.
The deputy soon located Russell walking northbound on
Highway 109.
Russell was walking with a large pit bull and seemed to
be under the influence of an intoxicant. As the deputy approached Russell, the suspect told him, “I don’t want no trouble, but if you mess with me, my
dog will get you.”
Russell admitted that he had been drinking and told the deputy that he had gone to the
couple’s home because one of the victims had been messing around with his girlfriend while
he was in jail. He said that the victim pulled a gun on him, so he kicked in the door and left.
“I don’t want to press any charges,” Russell allegedly told the deputy. “Just let me go.”
The victims said that Russell kicked open their locked door, and one of the victims said
he fired a warning shot into the ground and told Russell to leave. Russell eventually left, but
threatened to kill them and burn their house down.
A witness said he heard a gunshot come from the victims’ home and saw Russell running
away yelling, “Kill! Kill! Kill!”
The deputy placed Russell under arrest. The belligerent man released a stream of expletives at the deputy and said, “I ain’t going nowhere and you ain’t taking my dog!”
Russell became violent toward police and it took four officers to restrain him. Russell spit
on police, struck officers with his hands and feet, bit an officer and broke the passenger rearview mirror.
Russell is being charged with attempted burglary in the first degree, assault and battery on
a police officer, prisoner placing body fluid on government employee and public intoxication.
He was released on a $15,000 bond and is scheduled to appear in court on Jan. 28, 2014.
