“Operation Juggernaut”: Six Cherokee County
Individuals Plead Guilty To Drug Or Firearm Charges
Dave Ellis Wilson, aka Jughead, 44, of Tahlequah, pled guilty to Distribution Of Methamphetamine, punishable by not more than potentially 30 years imprisonment, and up to a
$2,000,000 fine or both.
Gary Edward Scott, age 39, of Tahlequah,
pled guilty to Possession With Intent To Distribute Methamphetamine, punishable by not less
than 5, not more than 40 years imprisonment,
not less than 4 years supervised release, and
up to a $5,000,000 fine or both.
Mary Ann Scott, 42, of Tahlequah, pled guilty
to Possession Of Methamphetamine With Intent To Distribute, punishable by not less than 5 years, not more than 40
years imprisonment, not less than 4 years supervised release, and up to a
$5,000,000 fine or both; however, should the court determine she has a
prior qualifying drug conviction, it is punishable by not less than 10 years,
not more than life imprisonment, and up to a $8,000,000 fine or both.
Jason Fred Fortner, 43, of Hulbert, pled guilty to Possession With Intent
To Distribute Methamphetamine, punishable by not less than 5, not more
than 40 years imprisonment, not less than 4 years supervised release, and
up to a $5,000,000 fine or both.
Anthony Lewayne Byfield, 29, of Tahlequah, pled guilty to Felon In Possession Of Firearm, punishable by not more than 10 years imprisonment,
and up to a $250,000 fine or both.
Christopher Andrew Loveall, 25, of Tahlequah, pled guilty to Illegal Receipt Of A Firearm By A Person Under Indictment Or Information, punishable by not more than 60 months imprisonment, and up to a $250,000
fine or both.
The charges arose from a joint investigation entitled “Operation Juggernaut” coordinated as part of the Project Safe Neighborhoods effort in the
Eastern District of Oklahoma to reduce gun and related drug crime. Project Safe Neighborhoods is an initiative led and coordinated by the Office
of the United States Attorney. The agencies involved in the investigation
were, the Tahlequah Police Department, the Cherokee County Sheriff’s
Office, the Cherokee Nation Marshal Service, the District 27 District Attorney’s Office, the Oklahoma Highway Patrol, and the Bureau of Alcohol,
Tobacco, Firearms and Explosives.
The Honorable Steven P. Shreder, U.S. Magistrate Judge in the United
States District Court for the Eastern District of Oklahoma, in Muskogee,
accepted the plea and ordered the completion of presentence investigation reports.

Q&A: I am worried that my loved one is
driving while using drugs. What do I do?
If you share a vehicle, you should demand that your loved one see a physician before using the car again. This can
be very inconvenient for both of you, but
it is imperative that drug users not drive.
Your loved one’s life, yours, and others’ could be at risk.
In many cases, you may not be able to
control your loved one’s ability to drive.
You must tell him or her that the single most responsible thing to do is not
drive while using drugs (including abusing prescription medications). All drugs
can impair skills necessary for the safe operation of a vehicle, including motor skills, balance and coordination, perception, attention, reaction time, and
judgment. Even small amounts of some drugs can have a measurable effect
on driving ability.
Drugs also affect people’s ability to tell if they are impaired—so you might
have to make some difficult choices. If you believe your loved one is driving
and impaired, you should consider calling law enforcement. This can be a
difficult decision, but sometimes court intervention can actually help force a

Is 10 days in the Noble County jail for raping a
14-year-old girl considered justice? According to the
Noble County Court, it is.
On January 11, Michael Harlan Williamson, Jr.,
28, of Covington, appeared before a Noble County
judge and pled no contest to felony lewd molestation
charges. The court accepted the plea and the sentence was handed down: 10 years DOC, serve 10
days in the Noble County jail and balance suspended.
He began his time that day and was out 10 days later.
He is now a free man to continue to do what he pleases- as long as he breaks no
laws and pays his court costs.
The girl, however, faces the rest of her life with what he did to her. According to
the affidavit, Williamson raped the girl after she told him no. He then told her not
to tell anyone or “they both would be in trouble”.
In addition, the girl told her stepmother, Nancy Wells, about explicit Snapchat
messages Williamson was sending her before the rape, but Wells told her to just
ignore them. According to the affidavit, Wells was apparently having an affair with
Williamson.
Wells was charged May 30, 2017, with child endangerment- permitting abuse.
She pled no contest to the charges on December 6 and was given a sentence of
5 years DOC deferred and community service.
As of now, Williamson is still not on the sex offender registration page.
According to online court records, Williamson’s attorney was Ronald Jones of
Enid, the District Attorney is Tom Lane, Sr., and the judge was Nikki Leach.

She’s secretly going to judge any man who she sees getting too close to a child..
even his own. So, NO.. he deserves a life sentence to match the one he gave her.

bond, over less than an 8th of pot… And a 50,000 dollar bond too.
Brady S: Seriously messed up. They will send a guy to prison for years for
drugs or robbery. But let a man rape a kid and basically slap his hand and say no
no?!? This POS needs to pay!
Kathy R: This is sickening! A felony violent crime against a minor should serve
at least half of his sentence day for day. I mean lesser misdemeanor drug offenses
like weed possession get at least 1 year! How is this possible!? WHO BOUGHT
THE JUDGE!?
Michelle K: Just like the guy that raped the girl at the church camp, no justice!
This type of “sentence”only tells the perpetrator they can get away with it and the
victim that they don’t matter!! This is exactly why a lot of victims don’t speak up,
its not worth the heartbreak and anguish you have to relive testifying. That judge
should be pulled from his position!
Wanda Y: I just do not understand these DA’s and judges...does it have to be
their baby girl before they act like real men and care? Are they that damn greedy
for the court money/ fines, court charges..ect..If this coward rapes again..I pray
to God above the family sues all involved in letting him walk..and I pray they sue
for enough that all those so called humans in that so called justice system, you
know the ones that are suppose to be protecting the victims, that they all end up
homeless

he’s married with children what type of souls they have... Whoever this judge is.. I
wouldn’t associate with anyone who associates with him period..

not do time. It amazes me!!! every time someone is charged these days their record shows they should have already been in jail for previous crimes. This practice
of suspended sentences need to be stopped.

days is enough for rape???? Our justice system is corrupt and broken... Remember something election times are coming up and we are going to make a major
change.

to live with for the rest of your life. Waking up in fear, not being able to trust full
heartedly, there will always be that wall between you and everyone else in fear that

Not quite sneaky enough
A 27-year-old man from Hulbert is facing
larceny charges after police say he stole a
pistol from the owner of a store on March 21.
According to the affidavit, officers arrested
Dustin Cody Hernandez on March 21 for multiple warrants.
On March 23, the owner of a Wagoner bait
shop spoke to a deputy about a firearm that
had been stolen from his establishment. Reports state that the man said that the suspect
walked into his store at approximately 6:30
p.m. on March 21 and asked for some minnows. When the man left to get the fish, the
suspect leaned over the counter and grabbed
a 40-caliber Smith & Wesson handgun.
Security cameras from the store captured pictures of the suspect, which
were placed on the Wagoner County Sheriff’s Office Facebook page. Police
say the pictures posted on social media helped officers identify the suspect.
While investigating the larceny, a deputy found the shorts the suspect was
wearing in the video at Hernandez’s residence. He brought in the man for
questioning man the morning of March 24. While speaking to Hernandez regarding the theft of the gun, the man allegedly confessed to the crime.
Hernandez admitted that he had taken the gun from the store when the
owner left to get some minnows that he had asked requested.
Hernandez is being charged with possession of firearm after former felony
conviction and petit larceny. His bond was set at $1,000, and he was scheduled to appear in court on April 12, 2018.

Samuel Jason Nutt, 50, of Sallisaw, pled guilty
to Felon In Possession Of Firearm, punishable
by not more than 10 years imprisonment, up to a
$250,000 fine, or both; however, should the court
determine he is an armed career criminal, he will
be sentenced to not less than 15 years imprisonment, up to a $250,000 fine, or both.
The Indictment alleged that on or about December 29, 2017, Nutt, having been convicted of a
crime punishable by imprisonment for a term exceeding one year, did knowingly possess in and
affecting commerce, a firearm, to-wit: One (1) Chinese, Model 54-1, 7.62 x 25mm caliber pistol, serial number 3700126799, which had been shipped
and transported in interstate commerce.
The charges arose from an investigation by the Sallisaw Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
The Honorable Steven P. Shreder, U.S. Magistrate Judge in the United
States District Court for the Eastern District of Oklahoma, in Muskogee,
accepted the plea and ordered the completion of a presentence investigation report.

Life is a series of struggles and pain. The
way we deal with this pain is what defines
us, not the situation- the way that we react
to it.
I know in my personal walk, my life has
been nothing but a struggle. One of the biggest was when my mom was battling cancer.
It was 2009. We had only been in Oklahoma
for two years. We’d moved here from North
Carolina because of financial problems. We
had family In Cushing, OK, so they offered to help my mom get back
on her feet. She was divorced and a single mother struggling to raise
two kids: my sister Chloe and myself.
We got settled into a rent house my uncle owned. He’s agreed to
provide it rent free until my mom got a job. She soon got a job. She
was also going to nursing school. We never had much money, but we
did have enough to get by.
Right when things were beginning to get better, my mom was diagnosed with cancer. I still remember the night she told me. I was so
afraid of losing my mom. After the tears, I decided I would be by her
side and help her through it. Things began to go gradually downhill at
first, but then quickly everything was falling apart.
We had no money so the hot water and electric was being turned
off regularly. On top of that, the only food we had to eat was donations
from the Salvation Army or the church. At this time, I was about 9 years
old and I was faced with a very big obstacle. I had no guidance, my
parents were divorced, and my dad was never in the picture. This left
me with a choice. I could either give up or press on.
I picked myself up and helped my mother through her treatment of
chemo and radiation. I would cook her meals and care for her when
she was sick in bed. My sister, on the other hand, was not involved and
she was living her teenage years being rebellious and irresponsible. It
was just my mom and I left to fend for ourselves.
Through this experience, one thing I held on to was that God was going to heal my sick mother. Through her losing her hair and becoming
bedridden, I had faith and never quit believing. By the grace of God,
the cancer was gone in 2013. She was, and today is still, a survivor.
This is just an example about an obstacle in life. There are many of
stories, just like mine, in the world, but something people don’t understand is these terrible obstacles in life are good because, from them,
we learn and grow as individuals.
I personally believe that God allows us to go through struggles to
keep us humble and to rely on Him because no matter how strong we
are no one can face the battle of life alone. No matter how difficult your
situation is, don’t give up, because for every obstacle in life, there is a
reward. But to receive it, you need to be strong and have faith.

This month and throughout the year,
Jailbirds encourages all individuals and
organizations to play a role in making
Oklahoma a better place for children
and families. By ensuring that parents
have the knowledge, skills, and resources they need to care for their children, we can help prevent child abuse
and neglect by making meaningful connections with children, youth and families in our communities.
Research shows that protective factors are present in healthy families. Promoting these factors is among the most effective ways to reduce the risk of
child abuse and neglect. They are:
• Nurturing and attachment
• Knowledge of parenting and of child and youth development
• Parental resilience
• Social connections
• Concrete supports for parents
• Social and emotional competence of children
April is a time to celebrate the important role that communities play in protecting children and strengthening families. Everyone’s participation is critical.
Focusing on ways to connect with families is the best thing our community
can do to strengthen families and prevent child abuse and neglect.

Webbers Falls man Timothy Lee Warren, 45, is behind bars for allegedly sexually assaulting some minors in March.
According to the police report, the lewd or indecent acts took place from March 9 through March 12.
The first victim told police that Warren tried to pull her
pants down when they were alone in the living room.
She also said he made her sit on his lap while he unzipped his pants. The victim said Webber then tried to
pull her pants down again, but she was able to stop
him.
The second victim was also at her grandmother’s
home when Warren allegedly assaulted her. The victim said she was sleeping when she was woken up by
Warren “dry humping” her. She alleged this incident happened before she was in
the 6th grade. She also told police the man assaulted her a second time at her
dad’s house.
What the victim described led police to believe that the second victim may
have been raped by the suspect.
Warren is being charged with two counts of lewd or indecent acts to child under 16. His bond was set at $50,000, and he is scheduled to appear in court on
April 19, 2018.

Never trust the macaroni salad. It’ll turn on you when you least expect it. This,
after police in Mt. Morris, New York, apprehended three burglary suspects by
following a trail of macaroni salad they left behind while making their getaway.
In a release, the Livingston County Sheriff’s Office reports thieves broke in and
stole a cash register from Build-A-Burger Restaurant, along with the establishment’s entire surveillance system and a large bowl of macaroni salad. Deputies
were hot on the criminals’ trail, literally, as they attempted to escape via the
nearby Greenway Trail.
“Found along the trail were cash register parts, surveillance system parts,
rubber gloves, loose change and a steady trail of macaroni salad,” the sheriff’s
office said. “It was later discovered that the suspects stole a large bowl of macaroni salad, which they took turns eating, along their escape route.”
Officers arrested Matthew P. Sapetko, 34, James P. Marullo, 35, and Timothy
S. Walker Jr., 23, by afternoon. The three have been charged with third-degree
burglary, third-degree criminal mischief and fourth-degree grand larceny. Walker faces additional charges for criminal possession of a controlled substance,
say police.
Per the Democrat & Chronicle, the three have been booked into the Livingston County Jail. Most of the stolen property has been recovered.
Nobody likes a neighbor who doesn’t pick up after their dog. Case in point:
two Maui residents were so upset at finding dog poop in their yard that they
allegedly menaced a neighbor with golf clubs.
The Maui News reports that Aaron Steen, 38, and Candace Deponte, 32,
blamed their neighbor for planting the dog feces in their yard and approached
her while hurling obscenities and wielding golf clubs. The alleged victim was
reportedly appraising damage to her car’s windshield when Deponte entered
the car and then followed the dog owner into her house, further threatening to
harm her. This earned Deponte a charge of first-degree terroristic threatening,
as well as first-degree burglary and first-degree unauthorized entry to a vehicle
— felonies both. In addition to terroristic threatening, Steen was also charged
with third-degree criminal property damage. The two suspects are now prohibited from contacting the dog owner or going near her house.
You know when you’re in an art gallery and you decide to steal one of the
paintings off the wall and then you can’t find a way to jam it into your sweatshirt because it’s a painting and large rectangular paintings don’t belong inside
sweatshirts? Hate it when that happens! Well, this art thief ran into a similar
problem. Luckily, the piece was recovered by gallery staff before the suspect
could escape with it. However, the would-be thief is still on the lam. Police in
the U.K. have released surveillance video in the hopes that viewers will be able
to help locate him. Probably won’t be difficult, given his general difficulty with
the concept of hiding.
