A Tahlequah man, who had been described as “catatonic”, was arraigned in federal court on May 20 on firearms
charges.
Bryan Berres, 27, was charged May 20 with possessing
an unregistered firearm – specifically, a 1.5-second-delay
flash-bang.
According to reports, on May 9, an employee at AmeriGas Propane Company in Tahlequah saw Berres walk up
to the entrance and remove his backpack. He then asked
to use a phone to call his wife and for employees to call an
ambulance to take him to a veterans hospital in Muskogee.
When paramedics arrived, Berres handed them a knife
and again requested to be taken to the hospital. He then
told them a firearm that contained a flash-bang in his backpack. Tahlequah police, the
ATF and OHP bomb squad were called to the scene to secure the weapons, closed U.S.
Highway 62 and evacuated homes and businesses near AmeriGas.
Berres faces up to 10 years imprisonment, followed by 3 years of supervised release
and/or up to a $250,000 fine.

2013 for some reason seems to
be the year of the drowning. There
seems to have been a large number
of drownings so far on Oklahoma lakes and waterways, the majority
of which could easily have been prevented. I am going to cover
some of the rules on wearing Personal Floatation Devices, as well as
some strong suggestions regarding them, in the hopes that we can
slow down this alarming trend!
First, let me just say that there are 5 types of PFDs. I’m not going
to get into their descriptions, just which types are required for what
situation. All PFDs must be U.S. Coast Guard approved, and used
in accordance with their label. The label will also state the type. All
vessels must carry one wearable (Type I, II, III, or V) USCG approved
PFD for each person on board or being towed. In addition to that,
vessels 16 feet in length or longer must have one Type IV USCG
approved PFD on board and readily accessible. Oklahoma Law
requires that all children under 13 years of age wear an approved
PFD whenever underway in a vessel less than 26 feet in length. Each
person on a personal watercraft or sailboard must wear an approved
PFD. Anyone being towed on water skis or similar devices must
wear an approved PFD. Ski belts are not approved PFDs.
Now, besides being USCG approved, all PFDs must be: In good
serviceable condition. They must also be readily accessible. Readily
accessible means you must be able to put the PFD on in a reasonable
amount of time in an emergency. PFDs should not be stowed in
plastic bags, in locked compartments, or have other gear stowed on
top of them. They must also be of the proper size for the intended
wearer. Sizing for PFDs is based on body weight and chest size. A
good way to test this, especially for children, is to put it on, adjust
the straps, and have the wearer raise their arms up, and try to pull it
up off them. If it can come off, it is not the right size for the wearer.
Those are the requirements, so now lets talk about the suggestions.
If you have children in or around water, make sure they have a PFD
on. Air mattresses, floaties, and other toy floatation objects don’t
count. There have been way too many stories of toddlers near the
water’s edge falling in and drowning, and these could be prevented
by following this suggestion.
Also, keep a watchful eye on those kids...even if they are only out
of your sight for a few seconds, its long enough for them to get in
trouble around the water. Last, wear one on boats even if you don’t
have to. In an emergency, you may not have enough time to put it
on.

A Sallisaw man learned the hard way that stealing from a church
gets you nowhere good.
Around 10:15 p.m. May 15, officer Deshawna Barron went with a
couple of other officers to the Apostolic Faith Church, where they
heard about someone who was illegally inside the church’s van.
When Barron arrived, she saw Edward James, 43, running from
the van toward the back of the church.
Barron chased James, eventually catching up with him and
handcuffing him. At that point, she smelled gas and alcohol all
over his body. A second later, she heard the passenger door of
the van open, and the church pastor came out. A check of James’
pockets turned up a radio book and an electronic Bible, as well as
a calculator belonging to the pastor. The stolen items were from
his office, he said.
Another officer on the scene confirmed the pastor’s office had been broken into and ransacked. An in-depth check of the van revealed two XM radios and a wireless router, some of
which came from the pastor’s office. James was then arrested on suspicion of burglary.
On May 21, James was charged with public intoxication and two counts of second-degree
burglary. He has pleaded not guilty to the charges.
James has court set for 9 a.m. June 26. He remains in custody.

New meaning of dumb-a**
Patrick Stapleton, a 22-year-old Maryland man,
was jailed after his idea of a prank went painfully
wrong.
According to Lothian Police, Stapleton was over at
a friend’s home at about 4 a.m. when he had the illconceived idea of shooting his sleeping friend in the
buttocks with a BB gun.
Investigators say Stapleton grabbed a .40 caliber
handgun, which he believed was a BB gun, and fired
one round into his 21-year-old friend’s buttocks.
The owner of the home was not present during the
shooting and the hand gun belonged to the homeowner’s son, who was not involved in the shooting.
The victim was transported to Prince George’s
Hospital Center where he was treated for his injury.
Stapleton was booked into jail and charged with second-degree assault and reckless endangerment.

A man driving a stolen car that went into a ditch
fl agged down the wrong person for help.
Dean Gangl, 40, of Richmond, Minn., unwittingly asked an off -duty sheriff ’s deputy to help
him pull the vehicle out of a ditch along Benton
County Road 4 west of Foley, Minn., Sheriff Brad
Bennett said.
The deputy, who came upon the stranded motorist at while he was on his way home, noticed that
the vehicle in the ditch matched the description of
one reported stolen hours earlier in St. Cloud. The
deputy radioed to dispatchers, who confi rmed the
man was driving a stolen car, Bennett said.
The deputy arrested Gangl and found that he
was in possession of a white crystal substance.
Gangl tested positive for methamphetamine, Bennett said.
He was taken to the Benton County Jail and
charged with being in possession of controlled substance and possession of a stolen motor vehicle.
A house burglar was arrested at a court when he
showed up for another case, police said. The man
kicked in the back door of a home and entered
but ran off when a teenage girl who was lying on
a couch saw him and started screaming, Nassau
County police said.
The girl identifi ed the 49-year-old man, who
had multiple prior arrests for burglary, in a photo
lineup, they said.
The man, from Bayville, was arrested by an offi cer when he went to First District Court for an
unrelated issue, police said. He was charged with
second-degree burglary.
A Perth man has been charged with drink driving three times in 24 hours, his menacing spree
ending with a bizarre incident at a police station.
The 46-year-old was fi rst stopped by Boddington police in the Perth hills and charged with driving under the infl uence and driving with a suspended license.
He was spotted driving his car again a short time
later and arrested for drink-driving, police said.
The man’s car was impounded in the Boddington police station but early the next morning, the
man allegedly jumped over the fence of the police
station, broke open a padlock on a back gate and
drove away in his car.
He was caught and arrested again three hours
later and charged with three counts of driving under the infl uence; three counts of driving while under suspension and one charge of trespass.
He’s been refused bail.

A former Subway employee in Sallisaw wishes he had his job back
after his arrest May 14.
Around 4:45 p.m. that day, officer Michael Thomas went to a local
Subway after an embezzlement report. When he arrived, he met with a
woman who said she found an employee, Todd Hindman, 29, stealing
money from the cash register.
Video surveillance from the restaurant showed him taking the money out, counting it, walking around the front of the counter and putting
the money in his pocket, Thomas said.
During an evening shift, Hindman was placing tip money on top of
another container just under the register. He pocketed that money as
well, Thomas said. Worse still, the woman produced receipts indicating Hindman was zeroing out sandwiches or giving sandwiches for the price of cookies. The resulting bread shortage prompted her to investigate, which led her to Hindman’s theft, she said.
At 5 p.m., Hindman was fired from his job and Thomas set up an interview at the scene.
Hindman said he didn’t remember the footage on the surveillance camera, denying he took
any money from the register or the tip jar. At that point, he went to jail on an embezzlement
complaint, stealing $170 from the store.
Hindman has since pleaded not guilty to the charge and he posted a $2,000 bond the day
after his arrest. He is due back in court at 9 a.m. June 26.

Tulsa police arrested a man accused of holding his exgirlfriend’s children hostage for $100.
Police said the children’s mother called them and
said she was fighting with her ex-boyfriend, Cody Lee
Panther, and he took both of her children without her
permission.
She told police Panther then started texting her that
he would not bring the kids back if she did not pay him
$100. Police arrested Panther on two counts of child
stealing.

Law-abiding gun owners
should not face felony
charges and jail time for
simply boarding a bus with
a firearm, according to the
author of a bill approved
by the Oklahoma House of
Representatives in May.
Under current law,
anyone found boarding a
bus or other form of public
transportation with a firearm, concealed or otherwise, is guilty of
a felony. House Bill 1558, by state Rep. Paul Wesselhöft and state
Sen. Kyle Loveless, would allow licensed gun owners to board a bus
with their firearm without fear of reprimand. The legislation was
approved by a 79-12 vote and proceeds to the Oklahoma Senate for
a final vote to determine whether it will be sent on to the governor’s
desk.
“In my time in the Legislature, I have run into so many curious
laws on the books,” said Wesselhöft. “Law-abiding gun owners
aren’t familiar with these obscure statutes regarding guns, but they
could face a felony charge. The intent of the Second Amendment
is to give individuals the right to defend themselves. When state
law makes it so complicated and difficult to exercise that right then
reform is needed. I think that’s why we saw bipartisan support of
the bill.”
Wesselhöft said the main concern of opponents is a misguided
fear of law-abiding gun owners.
“The data is very clear on this,” he said. “Criminal and mentally ill
individuals who do not legally have access to guns are the ones that
are using them to hurt people. It is not common for a law-abiding
gun owner, like the ones this bill supports, to commit crimes.”

Board recommends
clemency for Davis
On June 6, the Oklahoma Pardon and Parole
Board recommended clemency for Brian
Darrell Davis, who is facing execution on
June 25. The board voted 4-1 to recommend
that Davis’s death sentence be commuted
to life in prison without parole. The parole
board recommended clemency after
Davis took responsibility for the crime
and apologized to the family of the victim.
“A weight lifted off of all of us,” said his
mother, Yvonne Davis. “Brian does deserve
a second chance.”
Davis was convicted of murdering his girlfriend’s mother. The
recommendation now goes to Governor Mary Fallin, who can approve
or reject the vote. The governor also has the authority to grant a 30-day
stay in order to consider the case further.

A Westville man pled no contest to charges that he broke
man’s jaw and setting a woman’s car on fire in 2012.
Dean Tatum, age 48, was sentenced to a five year sentence
and a 10 year sentence under the custody and control of the
Oklahoma Department of Corrections.
Tatum was charged with Aggravated Assault and Battery
where he allegedly hit and kicked Billy Bearden in the face and
head, breaking Billy Bearden’s jaw.
In another case, Tatum was charged with 3rd degree Arson
after he set fire to a vehicle belonging to Karisha Fuentes on
March 5, 2012.
Pursuant to a plea agreement with the State of Oklahoma,
Tatum entered plea on Thursday May 30th, 2013 to Aggravated Assault and Battery and was sentenced accordingly to a five
year sentence under the custody and control of the Oklahoma
Department of Corrections with the first year in prison and the remaining four years on supervised probation.
Additionally, Tatum’s plea to Arson 3rd Degree resulted in a ten year sentence which was
suspended pursuant to rules and conditions of probation and ordered to run concurrently
with his other case.

The OSBI is off ering up to a $10,000
reward for information leading to the arrest
and conviction of the person or persons
responsible for the homicide of Carina
Saunders. The 19-year-old’s body was found
in the fi eld west of the Homeland Grocery
Store at the intersection of Rockwell and N.E.
23rd Street in Bethany October 13, 2011. The
Bethany Police Department worked the case
until recently when it requested OSBI take
over the investigation.
After a thorough review of the case fi les produced by Bethany
P.D., the OSBI agent assigned this case has determined more
work can be performed – through interviews, forensics, and other
investigative tools. However, the OSBI will need the public’s help
in developing further leads and expanding current ones. Therefore,
if anyone has any information, knows of any evidence in this case,
they are urged to call 1-800-522-8017. The $10,000 reward is the
maximum state law allows OSBI to off er.

Titsworth
A Muskogee man has pled guilty to federal drug and firearm charges.
Aundray Titsworth, a/k/a Aundre Titsworth, a/k/a
“DRE”, 38, pled guilty to Possession with Intent to Distribute Cocaine Base, Possession of a Firearm in Furtherance
of a Drug Trafficking Crime, and Felon in Possession of a
Firearm.
The indictment alleged that on or about December 19,
2012, Titsworth did knowingly and intentionally possess
with intent to distribute 28 grams or more of a mixture or
substance containing a detectable amount of cocaine base,
a Schedule II Controlled Substance.
Further investigation revealed that Titsworth, having
been previously convicted of a crime punishable by imprisonment for a term exceeding one year, did knowingly possess a one Hi-Point “C” 9mm pistol, a Cobra Enterprises
CA-380, .380 Auto caliber pistol, and a DPMS, model A-15,
.223 caliber/5.56 mm rifle, in furtherance of a drug trafficking crime.
Titsworth remains in the custody of the United States Marshal Service pending sentencing.
He faces a punishment of not less than 20 years or more than life imprisonment, and/or up
to a $5,000,000 fine.

God as well.

expressed in harshness, cruelty, bitterness, and a lack of
control.
We must examine our hearts when our kids make us angry.
If it is righteous anger, let it motivate you to take action and
deliver consequences. Sin needs to be addressed, and we
honor God by delivering those consequences with empathy
and love. If it is sinful anger, pray for the courage to confess
it, repent, and resolve it.
Examine your anger to determine the motives behind it.
