THREE SENTENCED
FOR ROLE IN 2021
ROBBERY
Three Tahlequah men have been sentenced to
federal prison after pleading guilty last year to robbery charges.
Kody Fields, 24, Fvs-Chvtv Amos Lawhead, 30,
and Jimmy Dale Brown, 31, all Tahlequah residents, were sentenced for their roles in a 2021
Cherokee County robbery. Lawhead and Fields
were both sentenced to 120 months in prison.
Brown was sentenced to 46 months in prison.
The charges arose from investigations by the
Cherokee County Sheriff’s Office and the Bureau
of Alcohol, Tobacco, Firearms and Explosives.
On July 24, 2021, Fields, Lawhead, and Brown
robbed a victim at gunpoint, firing multiple rounds,
and demanding the victim’s cash, phone, firearm,
and vehicle.
On February 9, 2022, Brown pleaded guilty
to one count of Robbery, and Lawhead pleaded
guilty to one count of Use, Carry, Brandish and
Discharge of a Firearm During and in Relation to a
Crime of Violence.
On February 22, 2022, Fields pleaded guilty to
one count of Use, Carry, Brandish and Discharge
of a Firearm During and in Relation to a Crime of
Violence.
“Using firearms to commit crimes will not be tolerated in the Eastern District of Oklahoma,” said
United States Attorney Christopher J. Wilson.
“Under federal law, using, carrying, brandishing,
and/or discharging a firearm during the commission of a violent crime subjects offenders to mandatory minimum prison sentences, and the U.S.
Attorney’s Office will not hesitate to pursue these charges when the facts warrant.”
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted these cases because the defendants are members of a federally recognized Indian tribe and the crimes occurred in Cherokee County, within the
boundaries of the Cherokee Nation Reservation and the Eastern District of Oklahoma.
The Honorable Ronald A. White, Chief Judge in the United States District
Court for the Eastern District of Oklahoma, presided over the hearings in Muskogee. Fields, Lawhead, and Brown will remain in custody of the U.S. Marshal
pending transportation to a designated United States Bureau of Prisons facility
to serve non-paroleable sentences of incarceration.

AROUND THE STATE
DNA MATCH HELPS SOLVE RAPE
AND KIDNAPPING CASE FROM 2007
On June 2, charges were filed against 40-yearold Isaias Barron in a rape case dating back to
2007.
In 2007, the Tulsa Police Department investigated a reported rape with the following details: The
victim stated that she was walking and was offered a ride by a man in a truck.
She did not know the man, but she felt safe because the truck looked nice and
clean. The victim reported that the man introduced himself as ‘Jose’ and offered
her money in exchange for sex. The victim stated that ‘Jose’ continued to attempt to persuade her to have sex with him for money, and she continued to tell
him no. She said that she became concerned when he was not taking a direct
route to where she wanted to go. She said that she tried to get out of the car
while at a stop light, and that ‘Jose’ reached across her and held her against the
seat, telling her that she wasn’t going anywhere. The victim reported that ‘Jose’
parked the truck and raped her while holding a knife.
The Tulsa Police Department was recently made aware of a CODIS hit in this
case. The DNA recovered from this case in 2007 matched to a known profile of
Isaias Barron. Barron had been previously arrested in July of 2020 for Attempted
Rape, First Degree Burglary, and Sexual Battery. In that case, the 83-year-old
victim reported that she was in her house when she heard the doorbell ring.
When she opened the door, the suspect forced his way into her home and
sexually assaulted her. That suspect was later identified as Barron, and he was
convicted in Tulsa County District Court after a jury trial and sentenced to 16
years in prison.
Barron was interviewed in prison by Special Victims Unit Detectives about the
2007 case. Barron denied ever having met the victim, denied ever picking up a
prostitute, and stated that he did not know how his DNA was on her. Barron is
now charged with 1st Degree Rape and Kidnapping in the 2007 case.
Barron remains in the Davis Correction Facility in Holdenville for his previous
conviction.

A Texas man, who extracted revenge on a resort owner and other campers staying there, will
soon be paying for his actions in federal prison.
Raymond David Phillips, 32, of Lindale, Texas,
entered a guilty plea to a Superseding Indictment
charging him with one count of Arson, punishable by 5 to 20 years in prison, one
count of Animal Crushing in Indian Country, punishable by up to 7 years in prison, and two counts of misdemeanor Assault in Indian Country, each punishable
by up to one year in prison.
The government alleged in the Superseding Indictment that on September
3, 2022, Phillips and his girlfriend were vacationing at a resort area along the
Illinois River when his girlfriend was arrested. Angered by the arrest, Phillips
decapitated the resort owner’s cat, then began burning other guests’ camping
equipment. Law enforcement arrested Phillips at the Cherokee County Detention Center, where he had arrived to bail out his girlfriend. After being taken
into custody, Phillips threatened and assaulted jail and law enforcement officers.
The charges arose from an investigation by the Grand River Dam Authority
and the Federal Bureau of Investigation.
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted the case because the defendant is a member of a federally recognized
Indian tribe and the crimes occurred in Cherokee County, within the boundaries
of the Cherokee Nation Reservation and the Eastern District of Oklahoma.
The Honorable Gerald L. Jackson, U.S. Magistrate Judge in the United States
District Court for the Eastern District of Oklahoma in Muskogee, accepted the
pleas and ordered the completion of a presentence investigation report. Sentencing will be scheduled following completion of the report. Phillips was remanded to the custody of the United States Marshal pending sentencing.

SEARCHING FOR VANDALISM
SUSPECT
On May 9, Wagoner County Deputies were dispatched to East 213th and
South 365th East Avenue in the Porter area in reference to reports of vandalism.
The victim stated they observed a SUV with a trailer trying to load the tractor
at his neighbor’s residence. The SUV was stated to possibly be a newer Dodge
Durango based on the LED lights going across the rear of the vehicle.
A two axle, flatbed trailer was also left on at the victims property. The victim
stated that they believe the vehicle attempted to steal their tractor and became
stuck in their yard. They used the victims tractor to free the vehicle, leaving the
trailer behind.

We often receive calls asking if there is a price to keep
someone out of our publication. The short answer to that

is pay us money and we will not publish their photo. This

The Wagoner County Sheriff’s Office needs your help to
“Stuff the Cruiser”
The Wagoner County Sheriff’s Office is collecting donations
to help the Wagoner County animal shelters and surrounding local shelters that take care of dogs and cats waiting for
adoption.
As the name suggests, the “Stuff the Cruiser” event invites people to stuff a Sheriff’s Office vehicle
full of donated items for the animal shelters in the area. The donation drive will be held from 8 a.m.
to 4 p.m. during the Month of June 2023, in front of the Wagoner County Courthouse at 307 East
Cherokee Street.
There are numerous animal shelters in the Wagoner County area that care for lost, homeless,
injured, sick, neglected, and abandoned animals. There have been many times that these animal
clinics have assisted deputies with a sick or injured animal and nursed them back to health. Let’s
give back to our local animal shelters so they can provide the animals with the care they deserve.
You can drop off your items at the Sheriff’s Office Patrol Unit, located in front of the Wagoner
County Courthouse. We have created an Amazon Wish list if you would like to donate in that way.
All donations purchased through the wish list will be delivered to the Sheriff’s Office. A list of organizations receiving these donations will be posted when completed.

If you live on the West side of Wagoner County, you can drop off any items at the Wagoner County
District # 1 County Barn Office located at 30020 East 71st Street South in the Broken Arrow area.
You can drop off items at district # 1 office on Monday through Thursday from 8 a.m. to 4 p.m. during
the month of June.
Additionally, you can drop items at in Coweta at the Coweta Quick Change located at 13467 State
Highway 51. You can drop off items at the Coweta Quick Change office on Tuesday through Friday
from 9 a.m. to 6 p.m. and 8 to 12 on Saturday during the month of June 2023.

A HIGH PRICE TO PAY
A Sallisaw woman will be spending the next
three years in prison for burning down the trailer
house she was living in after she got an eviction
notice.
Felicia Nicholl Bargar, 35, was sentenced to 36
months in prison and ordered to pay $7,500 in restitution for committing Arson
in Indian Country.
The charges arose from investigations by the Sallisaw Police Department, the
Oklahoma State Fire Marshal, and the Bureau of Alcohol, Tobacco, Firearms and
Explosives.
On May 6, 2022, Bargar pleaded guilty to willfully and maliciously setting fire
to and burning a dwelling. According to investigators, in October 2020, Bargar
intentionally set fire to a trailer house she was renting after receiving an eviction
notice.
“I am thankful for the cooperative investigative work of law enforcement which
resulted in the defendant being brought to justice for her senseless and malicious acts,” said United States Attorney Christopher J. Wilson.
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted this case because the defendant is a member of a federally recognized
Indian tribe and the crimes occurred in Sequoyah County, within the boundaries
of the Cherokee Nation Reservation and within the Eastern District of Oklahoma.
The Honorable Charles B. Goodwin, U.S. District Judge in the United States
District Court for the Western District of Oklahoma, sitting by appointment, presided over the hearing in Oklahoma City. Bargar will remain in custody of the
U.S. Marshal pending transportation to a designated United States Bureau of
Prisons facility to serve a non-paroleable sentence of incarceration.

A Maryland man won’t be going home for a
while after he was convicted and sentenced to
federal prison for trafficking fentanyl through the
state.
Jose Sanchez, of Maryland, was sentenced to
120 months in prison for one count of Possession with Intent to Distribute Fentanyl.
The charges arose from investigations by the Sequoyah County Sheriff’s Department and Homeland Security Investigations.
On May 2, 2022, Sanchez pleaded guilty to Possession with Intent to Distribute Fentanyl.
On November 18, 2019, a Sequoyah County deputy stopped Sanchez for
speeding on Interstate 40. During the traffic stop, the deputy discovered a
vacuum-sealed bag concealed under a rear speaker. The bag contained 9,648
counterfeit oxycodone pills which later tested positive for fentanyl. The fake pills
contained over a kilogram of fentanyl.
“The defendant was transporting thousands of lethal doses of fentanyl,” said
United States Attorney Christopher J. Wilson. “Fentanyl is 50 times more potent than heroin, and a single dose of only two milligrams is potentially lethal. I
commend the work of our law enforcement partners in discovering and seizing
these counterfeit pills. Combatting the trafficking of illegal narcotics, especially
fentanyl, in the Eastern District of Oklahoma continues to be a priority for the
U.S. Attorney’s Office.”

A Stilwell man will spend the next 21-plus years
in federal prison for the 2021 beating death of a
houseguest.
Darrell James Hummingbird, 39, was sentenced
May 31 to 262 months in prison for Second Degree
Murder in Indian Country.
The charges arose from investigations by the Stilwell Police Department, the Oklahoma State Bureau
of Investigation, and the Federal Bureau of Investigation.
On July 18, 2022, Hummingbird pleaded guilty to Second Degree Murder in Indian
Country. According to court documents, on April 26, 2021, the victim was beaten to
death in his Stilwell apartment with a metal baseball bat. Hummingbird attempted to
cover up the crime, but investigators recovered incriminating DNA evidence from the
murder weapon and Hummingbird’s shoes.
The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted
this case because the defendant is a member of a federally recognized Indian tribe
and the crime occurred in Indian County, within the boundaries of the Cherokee Nation Reservation and within the Eastern District of Oklahoma.
The Honorable David C. Joseph, U.S. District Judge in the United States District
Court for the Western District of Louisiana, sitting by designation, presided over the
hearing in Muskogee. Hummingbird will remain in custody of the U.S. Marshal pending transportation to a designated United States Bureau of Prisons facility to serve a
non-paroleable sentence of incarceration.

Two people are facing hundreds of counts involving animal cruelty after authorities found some
dead cattle on their property on June 1.
According to reports, Muskogee County deputies found 103 cow carcasses and a dead dog on
the property southwest of Muskogee.
36-year-old Lindsey Rae Brashear of Haskell
and 31-year-old Kasey Wayne Clay of Council Hill
were leasing the property. They had been told to
vacate the land and remove their cattle.
More animals were found on the property. Authorities had to euthanize a calf.
They took 40 cows and four horses to a nearby ranch. Authorities also took seven dogs to the
animal shelter.
While on the property, authorities also found a
Kubota tractor that had been reported stolen from
Boynton.
Brashear and Clay are both being charged with 155 counts of cruelty to animals, receive/conceal stolen construction/farm equipment, and 104 counts of
unlawful leaving or disposing of carcass. Brashear’s bond was set at $75,000.
Clay’s bond was set at $100,000. They are scheduled to appear in court on
June 20, 2023.

should be a crime.
There are companies who do take money to remove a
person’s arrest information. OK Jailbirds never has and
never will. If an arrest doesn’t make our paper, it is only
because we didn’t receive it or we didn’t have a photo we
could match up.
